Joe B is a cool humble guy. I briefly met him at one of the Southern California vintage guitar events a couple years back. It’s not surprising that he handled this with class. I also used to own one of those copper JB fuzz faces. It was a little dark for me so I contacted Dunlop and they offered to have me come in to their Benicia factory and they’d adjust the pots with me tone testing on their guitar. I was blown away at how cool they were. Another piece of gear I shouldn’t have sold.

The vid was very supportive of Joe, so he should have been happy, but AI is in need of thought. My take is it is soooooo BORING. AI images are everywhere,,,they're instantly recognisable, because they on one level look similar. To me I see it and think what a lazy post. It is rare anyone uses it in an interesting way. It is largely used as a quick cheap convenient way out of doing something interesting...in that regard Joe's comment on IG was awesome, and on the money :)

Joe deserves his roses, and all the success he’s garnered. Someone really needs to set some ground rules and guidelines on the use of AI. It is definitely going to be a problem in the future. That's a great conversation to have. As an animator, our community is having lot of talks about the impact of AI in the creative industry in general. One example, not too far back it became a trend for social media influencers to change their avatars into a more fantastic paint like version of their own faces, and the same quastion you made here applies, who owns it right? What AI does is not create something from nothing, when you run a prompt to have let's say your photo, but in "Disney's style", the tool searches the internet for artwork on that style, and combine multiple pieces into a database that will then, assimilate that style into your photo. That artwork used to feed this database is the work of countless artists, who are not being credited, or paid for the use of their work. I guess there's not a simple solution for it yet, but it's definitely a conversation worth having it, and it will probably take a while to figure out.

This is a very interesting topic/question without a really good answer. I definitely agree with the need for the artist to protect their brand - they put in all the work for it. On the other hand, what is the difference between someone taking a photograph of an artist, drawing/painting a picture of the artist and an AI generated picture? As a photographer, I think they own the rights to their pictures unless they were specifically hired by the artist. I believe a painter owns their painting as well. Definitely something to think about though.

Legally there are two separate aspects to this.
    1. Nobody can copyright AI art, that simple. If you create an "original" image for whatever use, you cannot copyright it if it is entirely AI generated (things are more complex if you use bits of AI elements and then combine them, as an artist/creator, into a creation of your own).
    2. The legal issues appear when either the source material, aka the material used to train the particular AI engine, is copyrighted, and/or when the work generated is in the semblance of a person, brand, design, etc who is then entitled to protect their image and trademarks. In that sense, in this particular case for example, it's a little bit as if you had used a photo of Joe without his consent or without paying usage rights.
Legal definition of AI use and potential copyright infringement is an ongoing and constantly evolving process ATM. Some providers (like some prominent stock shot providers) are hoping to neutralize infringement potential by training their AI engine using only legally safe or self owned material, etc.
Joe's reaction was indeed gracious, and honestly appropriate, as he no doubt understood there was no ill intention on your part, especially as the content of the video was positive. As a conclusion, draw authentic, we are watching you, you have been warned hahahah (sorry couldn't help it).

I heard a lawyer talk about it the other day. AI-generated art work, music or copy can not be copyrighted. But something like this would probably have to be decided by a jury.
ChatGPT says that a legal precedent has not been set for this specific problem yet - but it's coming. It also said there is something called "Transformative change" that is similar to "Fair Use" - that if you change a character so much that it becomes somethign different - it may give you some protection from lawsuits in certain jurisdictions. It's all up in the air.

  • @ThunderingCreation

AFAIK, AI art (visual atleast) isn't owned by anyone and cannot be copyrighted (Its been tried in a court of Law in the US from what i remember) because its not original artwork. It works on an algorithm of "Stitched together" works of art from a database of many images created by other people and uses that data to make (not create) a visual representation of a prompt. Granted it does it in very clever ways but its neither creative, inspired nor original.

I am a musician and a visual arts teacher. My question is, if a student was to draw that same drawing in pencil would that being infringement? There is a whole history of editorial drawings in newspapers. Does the fact that the AI generated art looks like a photograph change our perspective? Is a photograph, more truthful, than a pencil drawing, which is more truthful than AI generated art? Does each one of those infringe on an artist than the other? These are the things that are being struggled with in visual art classes in schools.

Oh no! AI tricked me- I thought it was a picture. I think we are in trouble. We are going to go post truth and the arts are going to also suffer quite a bit. I think that human beings are going to do less and less hard and more and more producing. They’re going to be more and more art producers who use AI to generate their art. Notice I am not calling these people artists. They will not be artists. They will just come up with ideas and prompts. Then the machine, with a database as big as human history, will get to work and - hey presto- some inhuman thing will be created based on human experience from human history. These artistic things that were created by AI will themselves be subjects of a database, and they will be reused by AI as well. I’m glad I’m getting older. I’m not sure I want to live in the world that these computer people are over seeing.
