      He may have boxed himself into *having* to testify because the many conflicting statements he made.
      It feels like a catch 22... he may have to but it likely will be a disaster.
      The Stephanopoulos interview has obvious edits. I wonder if they can subpoena the uncut footage for court.
      Baldwin is the poster child for stfu.

      Yeah, considering he went on that insane George Stephanopoulos interview , it seems either he ignores his counsel's advice, they're incompetent or they're simply yes men.
      Anybody else got the hunch he hired yes men for his counsel?
      This kind of reeks of an Amber H personality that just has gotten away with it for a few decades longer.

      This filing makes his lawyers sound like bozos, not high priced wizards... but floating that Ford/Mirren/Ackles type bs makes it sound like Alec is calling the plays here.
      It's audacious to do a "documentary" about what happened, with interviews by witnesses... and feels like they're trying to trade Hollywood goodies, like how her widower ended up a producer on the movie....
      Should have taken the misdemeanor and run. This defense has to be costing a fortune, as no doubt the civil cases.
      Here's an idea: don't cheap out and be lazy when making a movie, certainly when it involves dangerous props and when you have a significant net worth to protect.
      Would taking the misdemeanor have actually made a difference in the civil cases? Pretty hard to see it would.
      Morrisey is constantly trolling throughout this filing, and you can bet she's goading Alec to testify. And that would be spectacular. Maybe they can arrange a violinist behind him like on George P's show.

    The other thing that really got me besides the church scene that you're talking about and him pointing a gun at two other people, is after the shooting he told his wife come on down, everything's been paid for we'll have some fun and relax. No he didn't know that she had died yet but he knew that two people had been shot on the scene of his movie and he's calling his family down not to be consoled by them but to have some fun because the place is already paid for. What an asshat

    This prosecutor grated on every single nerve I've got, and I'd hire her in a heartbeat based off this filing alone. I mean seriously, not only is she a snarky ball of hate but she brought enough receipts to make a walmart greeter run for the hills.
    I'm so hoping for two things in particular - the Judge fires off a damning order to show cause over Baldwin's lawyers' conduct, and Baldwin gets any bail/release agreement revoked.

    Started watching this on my phone and then had to switch to the tv because footage of Baldwin being a reckless asshat and treating a deadly weapon like a child's toy needed a bigger screen. And wow, this is such damning proof that he had no respect for the seriousness and responsibility of handling guns.

      @@MissteryDiva The Procecution witness that Said Hannah Gutierrez Reed should have removed the Cylinder from the gun to check for an Obstruction. The Colt 1873 peace Maker required tools to remove the Cylinder, and it wasn't necessary, you can see though the firing pin hole at the Back of the chamber with the hammer at Half Cock. I see many mistakes in that trial.
      It wasn't until 1896 that you could remove the Cylinder on a Colt without tools. That's when Remington's patent on the push pin Cylinder release expired.

    Remember the old Dragnet series? "Just the facts mam" Fact 1. Baldwin was holding the gun that fired the bullet that killed Mrs Hutchins and wounded the her co-worker. No one is refuting this. Fact 2. Baldwin pointed a "real gun" at Mrs. Hutchins. No one is refuting this. Fact 3. " I didn't know the gun was loaded" or the "gun just went off" has never gotten any one off. Pointing the gun at someone after being instructed by the Armourer never to point a gun at anyone during his safety training is negligent! Guilty!

    IMO. AB should have taken the generous plea offer (misdemeanor, 6 mth non-reporting probation, 1 day weapon safety class).
    He could have spun taking the deal as taking responsibility for ending a life. (Not disputed weapon was in his hand).
    Plea deal sentence would have has zero practical impact on his life.

      Wait? That was the deal? People with weed get harsher plea deals than that! Someone with a security clearance could probably keep their job from that deal, much less a famous actor.
      Plus, you're right. It would have been an easy PR win to spin it as a tragedy and feed his anti-firearm rhetoric.

      That was the plea deal?? And he didn't take it?? He was insane not to. Or his lawyers failed him big time. Does he realize just how easy it is to find him guilty on the charges they brought?
      New Mexico law doesn't care what SAG thinks. Yes the actor should be able to trust others to keep him safe and in check, but Baldwin was the producer and so any failures in hiring effective crew members could arguably be at his feet as well, not to mention the effects of his own behavior on set.

    A fourth degree felony conviction will make Baldwin a prohibited person in regards to firearms. Not only will he not be able to legally buy one, he can not even possess or handle them. That would really mess up his career.

    He needs jail time, regardless of the armorers experience, safe handling 101 is you check to see if its loaded EVERY TIME its handed to you. NEVER take anyone elses word for it. So for this level of carelessness, he is guilty.

    If anyone, like Alec Baldwin, violates the rules of safe gun handling, it is his ass if anything goes wrong. It might be needed to violate the rules, but it definitely requires knowledge and sufficient caution.

      I found it a little difficult to follow because she felt a need to list every blow by blow. It may be because baldwin 300 some odd page motion was kitchen sink defense… but I’m glad runkle could navigate me through the weeds on this one. Ty and I look forward to continued commentary about the firearm and projectile components of this case.

    I suspect at some point Hutchins, at one point, told Baldwin to point it at the *height* of her armpit (not at her) and he then tried to wrangle that into an excuse (since we already know he isn't very smart)

      If she did direct him, she was looking at the camera screen and focusing on the picture, not watching him directly.
      Since they were only rehearsing, it was unnecessary to have ANYTHING in the cylinder but air.

But since it's Baldwin, he wanted his toy for everything and it makes me mad. There was no need to have it. (and a gun should not be a toy anyways but we all have seen how he handles weapons)

    I haven't liked Baldwin's manner in addressing things related to this awful shooting to the news, but it is worse than I recalled. Mr. Nikas is pretty terrible. He and Baldwin seem to share a predilection for lying.

    That attorney is a BOSS! Here’s how I picture her with Alec Baldwin: she is the Roadrunner who always wins and he is the hapless Wile E Coyote who is always getting his head smashed with the anvil.
    Baldwin is arrogant enough that he will insist on taking the stand in a jury trial, thinking he will be able to charm the jurors into believing his story, whatever his story is that day. That guy is a piece of work.

      Well, actually I was listening to many things when this first happened and Alex tried to spread lies right away. He was talking to someone and mentioned that last weekend they had some fun because they had a bunch of target practice and even used some real bullets. Now that was intended to make Hannah Gutierrez-Reed look even more guilty and remove him from any hint of guilt. He was never in control of the scene, or so he says but he was guilty of reckless behavior from the start.

    I've got to give my congratulations to the voters of New Mexico for electing a damn fine prosecutor & judge. They are not going to recoil in intimidation at Baldwin's cacophony of power lawyers. I can't wait to see them mop the floor with this jerk.

    He pointed the gun at least once at the cell phone video people which it absolutely against the rules. This is not the first time he has ever done a film with firearms so he can't claim inexperience. The SAG policies literally to always act if the firearm is loaded with live rounds and do not point or fire at what or who you don't want destroyed. That's literally the only thing he had to remember as an actor. And repeatedly he broke that rule and he eventually killed someone. In NM, it is illegal to not use proper firearm safety regardless if someone says the gun is cold. SAG also says to know the laws in the state where you are filming.

      Correct! There is still a need for basic firearms safety performed by everyone. Assuming that there was no live ammunition was criminally negligent and got someone killed.

      Without a live bullet, none of this would have happened. NO live bullets are ever supposed to be on a movie set. SOMEBODY brought that live bullet onto the set, and put it in that gun. Why aren't they more concerned with finding out who did that? Was it deliberately put into what was supposed to be a prop gun that Baldwin was to handle? Were they trying to scare him when a real bullet was fired? I look at this more as a deliberate action to "get" Baldwin. And it went way farther than the "prank" was supposed to go. Or, was the target the armorer? She was being discussed as a nepotism hire and not qualified for the job. A person who wanted that job or knew somebody who "should have" gotten the job would be a good suspect.

    I always found it weird that if they were only blocking why the gun: A. Needed blanks or dummies at all. They weren't filming only setting up the shot. Seeing or not seeing bullets in the gun shouldn't have been required.
    B. Why did he needed to cock the gun at all to see what angle to film.
    C. Why was your finger be ANYWHERE NEAR A TRIGGER. Basic fire arm safety says if you're not prepared to shoot, your finger is off the trigger. Any first time gun handling class emphasizes even if you are 100 percent certain its not loaded, you still treat it like its loaded
    Also 300+ page rebuttal, damn someone was pissed.

    When I saw the description of Baldwin filming himself shooting the gun during his training I imagined someone filming him from behind as Baldwin shoots and aims downrange. Something where he's in a training situation. Pretty normal stuff. NEVER would I have guessed these videos would show him playing recklessly with the guns, not aiming at anything in particular, and probably sweeping across everyone there(!). Absolutely insane.
    The armorer shouldn't have allowed that, but also, he should know better.

    I’ve lived in New Mexico since the early 1970s, so I’m still a newcomer here. However, I get the impression that the New York and Texas lawyers assumed New Mexico was some kind of hick state and they could just steamroll the prosecutors.

      I mean seriously! Every actor should be aware of what can go wrong on set with guns - it’s Hollywood infamy with Brandon Lee. Different circumstances I know and the armorer sent home for the night before they decided to FAAFO, but still. Dangerous weapons, not toys.

    Most accidents have a chain of events, where the outcome of any particular event can continue or end the sequence. In aviation, it's called the _Swiss Cheese Model._ At every slice, there is the opportunity to have the path of destruction blocked. But if the holes line up ...
    Baldwin is the last slice of cheese, as the pilot in a plane would typically be. He would be as responsible as those before.
    Fun fact: Baldwin listed _gunslinger_ on his CV. Kinda guessing it's not there now.

      She’s definitely a pitbull and a hard working attorney. I do worry about her style in the courtroom as she is most comfortable with cross even though she is prosecuting and that getting the best of her with these seasoned attorneys. We shall see. I would like to see justice done here for the victim(s).

      She may have learned a few more things from the HG trial and how to carry prosecuting forward, though. Hopefully, that will be the case.
      Her closing arguments were devastating, I gotta give her that.

    OMG, those videos are crazy!!!! Why would Baldwin be doing such stupid stuff??? What an idiot! Is Hannah there? Good Lord. That is ridiculous. NO gun safety at all, and probably miraculous that more people weren’t killed.
    Super great and accurate prosecution response.
    And this is a man who has six or more young children at home. Those poor kids may be lacking their dad for some time. I can’t believe his call to his wife. Thank God she had enough sense to tell him no.

      Defense attorneys rarely defend the innocent. Their job is preserve people’s rights and make sure prosecution proves their case. And then onto the next one. I don’t think it hurts their career at all.
