    I also want to note, the law firms that Lockyer worked on before seem to be entirely blameless in this: They are victims, not offenders.
    Also, appears I was wrong on the law clerk thing--cultural distinction I missed.

      There is that client "consent/permission" for stating they are clients of a firm (or a specific attorney of that firm). I was in a job interview 100 years ago (non-lawyer), where the attorney wanted me to disclose who my firm's clients were and I stated I didn't have permission to disclose that. She was annoyed. I went on my way.

      This is out of topic but I must ask: Have you made an episode on Quebec’s non-restricted firearms registry? If not I think that would be an interesting topic to understand what is going on in Quebec. How Quebec gouvernement was able to add a layer of control by sticking their nose into federal’s laws. How the Sureté du Québec have obtained even more power to conduct firearm seizures on non restricted and legally obtained firearms.

      Is it possible the "respresented" so and so was actually representing their estate for IP violations? I'm not a lawyer and don't know how that works but if someone was using their music, likeness, lyrics etc couldn't their estate sue for IP/copyright infringements? Lockyer is a terrible lawyer and absolutely shouldn't be disclosing his clients but maybe he should have said "Mac Miller's estate" or "Nipsy Hussle's estate". If so, he could have worked on cases for "them".

      @@madsfiedler3884 the bar association doesn't allow it. I assume because lawyers are held to a higher ethical standard, and since there is no standard for saying you're an expert, it's moot and not allowed.

      Well, no. You get rid of the lice first and then the nits. The lice is easier to get rid of, so it's done before the tedium of combing through the hair with a nit comb and picking out the tiny eggs (nits).

    I'm an Australian lawyer and looked him up when his name was first revealed as Janet's attorney. I was horrified but assumed the professional standards/Rules in Illinois were completely different and didn't have time to look further into it. I appreciate this video. You'd be in big strife for this in Australia too :)

    Former Chicago paralegal here. This is horrifying! Whether you're a paralegal or attorney, you have to take a substantial amount of classes and / or course work in the ethical rules for IL. I took a 16 week course and still signed a (although non-binding) oath with my school to maintain legal ethical standards; especially confidentiality. What is this kid doing? While he did work as an attorneys general for about 4 years, that is not nearly enough time to build a book of clients to open your own shop. Also, how would companies like Crayola and Von Dutch *be* clients, if he was an attorneys general? The client is the State of Illinois!

    How did this guy work with Nipsey Hussle, who died in 2019, or Mac Miller, who died in 2018??? Working with an estate is NOT the same as working WITH said person. That is improper in and of itself...

    18:32 just a quick point of clarification: some firms/government agencies in the US use “law clerk” for law students or JDs working essentially in quasi-lawyer roles, like summer associate positions and intern-type positions. the summer after my 2nd year, I had a summer associate job with a law firm that called us “law clerks.” my current firm also has a “law clerk” who is a law school grad waiting on bar results. it is definitely not super common though.

      Same. My cousin had a disfiguring injury from the violence that killed him, and his body was in really bad shape when he was found deceased. I'm ok talking about it now, but if I ever saw someone talking about his body the way LTM speaks about the people she's worked on, I'd be really upset.

    Robert S. Freund's "Representative Experience" is not only more ethical, but as a layperson it sounds a hell of a lot more PROFESSIONAL! These lawyers, Lockyer & Braun, sure are birds of a feather. It sounds like Lockyer's pro-bono taking of this case is going to cost him a lot more than just travel, time, & what he seems to call "effort".

    It reminds me of the interview I read that Janet did with the Chicago Bar Association, talking about how she'd been an expert in whatever field for 25 years... when she was in her 30s. She hung out at her mom's work after school and decided that meant she was working there? Idk. She also talked about how she started her own law firm because she couldn't get hired after law school. She also dropped a lot of names in terms like "and I shard a cubicle with this fancy guy"

    Just a heads up, a lot of US firms use the “Clerk” title to refer to law students who have completed sufficient credits to do work under a lawyer’s signature. Same title, but very different position to the clerks in US courtrooms.

    In the US law firms have law clerks and it is typically a law student (slightly lower than a summer associate position). What you are thinking of is a judicial clerk here.

    It is possible that Ben encountered files in an IP firm in relation to the IP rights of dead rappers. Those are held by the estate, so you’d expect to the “estate of” to appear before the name. If he was working at a lower level he may not have thought through “who is the client/who can give us instructions”. Eg dead people can’t give instructions but their estate representatives or beneficiaries can give instructions. I was reading a case today where 2 of the people died during the course of the case and there was a lot of confusion amongst the lawyers about who were parties under particular obligations.

    I work for a law firm in IT, it is absolutely drilled into us that we are never to reveal anything about our clients including who they are to anyone outside the firm, even family. I've been told that I can't discuss our clients that have been discussed in public press releases or are covered in national press as being represented by us in litigation. At most I might be able to refer someone to our website as that information has been vetted by council.

    16:49 it’s possible he was practicing under Illinois Rule 711 that allows students to practice law while under the supervision of a barred attorney. Here in RI it’s Rule 9 but I was taught to list it as “Legal Intern/ RI Supreme Court Rule 9 Certified.” So it’s possible they had him doing something similar and sent him to a hearing that wasn’t a big deal.

      @@AfterTheRains yea there’s an application process and paperwork your supervising attorney fills out. In at least MA & RI you have to have taken Evidence and passed and be out of your first year. For me the earliest I could have qualified would have been the spring semester of my 2L if I was able to get into Evidence in the fall.

    I am so impressed and curious how Runkle does this, are the laws similar where he practices and that is how he knows to look for these rules in Illinois, or did he look up Lockyer's info then go back and find the laws he was violating? No matter how Runkle does it I am very much in awe.

      It's a similar situation for most lawyers around the world (and other professionals, in fact). There's what the law says, and then there'll be a professional body that licenses and regulates its members, and publishes codes of ethics and professional conduct, among other things. Dentists, doctors, engineers, lawyers, &c. Some societies will even publish price guidelines for the services of their members. In this case the code actually comes from the Illinois Supreme Court, their "Rules of Professional Conduct", though that resource is directly linked to from the Illinois State Bar Association webpage.
      Client confidentiality and privilege is pretty much a universal thing. So if you ever see names, dates, dollar amounts, criminal charges, &c. sort of thing in the open, that should immediately trigger a "huh hold up". Medical professionals have a similar duty to their patients, though I think it varies whether a breach is criminal, how the professional body reacts, and so on. So yeah, a variety of folks definitely would have raised their eyebrows, but Runkle (being a lawyer) definitely has more ability to investigate and make sense of what he finds, more so than, say, an engineer wondering if they're allowed to name their clients.

      Basically, I saw that and knew immediately that it'd be a major breach where I practice. So I thought "Maybe it's not where Ben practices", so I looked that up. And nope, breach there too.

    The confidentiality section and ABA guidance was exactly the same as applies to me as an auditor. I have to use the same general and vague descriptors when talking about past work I've done. If I can do it, Ben can.

    Oh I so needed another installation of the Janet Jam after how this week has been going! My flabber is absolutely ghasted. In Present Job I work with one of the large corporations listed. I'm surprised he hadn't been contacted by their giant school of shark lawyers with a message to cut it out already. In Past Job I would have had security at my desk to immediately escort me out if I had done such a thing. (As an extra measure, we often had to sign NDAs for the Rich and Famous clients on top of the usual code of ethics.)

    FWIW - in Texas, we have law clerks in private practices. They are law students/unlicensed attorneys who do primarily legal research and some motion drafting.

    This is also just a great lesson in how to read (and write) resumes and marketing materials. Not just for a lawyer.
    Extensive experience (2 years) vs, 18 years of experience. (Or 60 years of combined experience = 12 people × 5 years.)
    Specializing in white-collar criminal defense, IP, and family law. (That is the opposite of specializing.)
    List of clients that tells nothing more. (Like, did you even provide legal services to them? Or were you just delivering pizza while you were in college?)
    Puffery often guides being big words with little meanings. There is more meaning in the things they are avoiding telling you that what they *are* telling you.

    Just want to say in America, a law clerk is also used to describe a law student that works at a law firm during law school. Confusing but not just used for judicial clerkships here

    Ian, I have lots of great stuff to say about this video-it’s awesome. But I have to differ on the “law clerk” designation. In the US, in my day, law students working part time for law firms were called “law clerks.” It was not exclusively a judicial clerkship. “Summer Associate” and “Law Clerk” were interchangeable.

      In England & Wales a trainee solicitor is known as an "articled clerk" so I would assume "law clerk" is the US equivalent.

      Runkle said elsewhere that in this case, it would still be a breach of confidentiality if they were clients of the firm he worked at, which they probably were.
      If we're talking in general, where there would be no relationship, I think it couldn't be. It would still be a misrepresentation (lie).
