I vividly remember my first time in Welland District Court on a cocaine importation case in the mid-80s. The defense showed up from Toronto, wearing an Armani suit, and was a walking cliche of ‘stand back you small-town hicks, big city lawyer here’. The judge was not an imposing figure - a tiny woman who could hardly see over the bench. He started with: “Your Honour, you may not be familiar with this section of the charter, so let me fill you in…”
The judge raised her hand to stop the flow of verbiage and said: “Sir, I helped draft this section of the Charter. I think I can get by without your help.” The court went dead silent, the lawyer blushed purple, and we tried not to howl with laughter. Ah, it was glorious to behold.

My civil procedure professor in law school said you need to have a rule 11 buddy in your law career. A rule 11 buddy is another, trusted, lawyer who can review any even slightly controversial filling for you to keep you from doing something stupid. This guy doesn't have a rule 11 buddy.
And, I recommend having an amazing paralegal as backup along with that (if I do say so myself, as a criminal defense paralegal 😊)

I am a retired attorney. The State Bar of California did a study over twenty years ago that found the vast majority of attorney misconduct was a result of substance abuse. They have mandated since then that California attorneys complete training on substance abuse among their mandatory continuing legal education every three years.
I think most attorneys in my state would probably be thinking that alcohol was likely to be involved here. The judge pointed out that this was late at night on a Friday and that there were several errors. I suspect he was thinking much the same thing.

John Prior has been seeking the help of a death-penalty certified attorney for quite a time because Prior is not death-penalty certified. Prior is acting alone in an 8-10 week trial against four attorneys for the State. He needed help.
However, if Ratliff decided to join the case and help Prior, maybe he should not make that decision just before midnight on Friday of Easter weekend before jury selection begins on Monday morning.
The Intervenor sounds like a WWE wrestler who gets on the ring in the middle of a match not to fight, but to delay and annoy the referee.

Technically he filed good Friday at midnight. And seriously expected by Easter Monday he gets a hearing. Despite not having any part in the case. I can only assume all the precedents were for victims families or other victims of a purp or the public wanting cameras in the courtroom. Not a random lawyer who demands to delay the case

I don't know if that would even be possible. Daybell hired Prior. He wasn't court appointed. Daybell is out of funds including his mortgaged house. So Prior was trying to get off the case since there's no more money coming in, but the judge said no. Maybe Ratliff was trying an end around to get himself in as a public defender and Prior off the hook?

No, Ratliff’s lawyer was trying to argue to the judge that under the Idaho laws for contempt of court, the lawyer in contempt has a right to a lawyer to represent him in court. So the judge tells Bartlet or whatever his name is “I’m not under contempt” meaning, he isn’t conducting this hearing under the laws of contempt of court, he’s conducting the hearing according to the laws under Rule 11.
That lawyer must have drunk Chad's kool-aid. Nothing else makes sense, as he just torpedoed his law career.

My guess is that it will remain sealed *at least* until the trial is over.
I don't think they'll unseal it. It seems clear to me that the judge thinks it will muddy the waters and isn't in the mood for any more delays. So I think we'll have to wait until after sentencing to see it.
This makes no sense at all. He is a well regarded defense lawyer for the area and was death penalty certified for Idaho. He received Idaho Trial Lawyer of the year in 2023. He was sanctioned a few years ago for a conflict of interest issue. I can't find anything to indicate that he's Mormon. My best guess is that this is alcohol related.

Or - and hear me out here - he is nobly taking the fall for his highly intelligent cat, who aspires to be a lawyer but has always been hampered by its fuzziness and lack of opposable thumbs. Said cat has heard a lot of discussion of the case in the household, and wants to contribute, so one night when Ratliffe accidentally left his computer on, the cat seized its opportunity and trotted across the keyboard in a semi-efficient (and really commendably accurate, under the circumstances) fashion. Having figured out the situation the next morning, Ratliffe decided that telling the truth in this instance would not only hamper Mr. Fluffybutt in his career aspirations, but would quite possibly get him, Ratliffe, committed to Bellevue. So he took the only feasible course of action and decided to try and brazen it out.
Seriously, I think it covers everything here. The weird timing, the many typos, the impropriety of filing the petition at all…!
If you set aside religion or alcohol as possible motivations my wayyyy off the cuff theory was that maybe he's turned into an anti death penalty advocate and this was some attempt at a grander gesture against capital punishment but that doesn't make sense either.

That's not suspicious, it's astute. Look at the history of this case. Prior has tried every trick in the book to stall and delay it. Daybell's co-defendant had her trial last year and was found guilty in May. Chad was originally supposed to go to trial straight after her, but his lawyer has been stalling ever since, and the judge is *done* with it...

Prior did try to find Death Penalty certified co-counsel but had advised the court back in I think January that he couldn’t find someone able to come in as co-counsel. So their talk might have been regarding that issue.

If I had to hazard a guess, it would be that this is related to Chad's attorney, Mr. Pryor's filing in Jan to be removed from the case, as it is a capital case and he is not capital certified. East Idaho news has coverage of it from Jan 12.
I love the idea that there were a couple of older lawyers getting drunk together plotting out this filing and being so drunk and giggly that they can’t even spell motion. I could imagine the text messages the next day being something like “did we really send that email”? Absolutely cracks me up!
