The plaintiff apparently was never taught (psychologically) that "you can't control how someone else acts, you can only control how you react." She couldn't control herself in court.

The defendant needed to keep it as a professional venture. Not enlist the plaintiff’s help or unload her personal problems. “You pay, you teach” should have been the only thing happening here. And, the plaintiff should never have agreed to anything more.
This is not a good ruling 😢 the woman said she was learning as a therapy. Meaning she had some trauma she was trying to work through. Now forcing her to stay in a very uncomfortable relationship is more trauma. She could have made the woman pay back what wasn’t used. I love this judge but she missed the mark on this one. I think she rushed through the reason the woman needed a hobby which she clearly said in the beginning was therapy
This case Judge Milian was INCORRECT. The plaintiff did not prepay for classes but invested. How I know this?? because what customer gets a copy of the key to the business? If she gave the money to prepay, she would of never had a key. That is an investment into the business. Unfortunately, the plaintiff wined too much for too long that defendant was not allowed to present evidence of the investment.
I don’t agree. If it had been an investment, then there would have been some mention of a return or profit for the plaintiff but nothing to that effect was stated.

I kinda agree. Nothing was going to be clean here, but this is exactly why courts usually don’t force specific performance in contracts cases, unless there real estate. The court would then likely have to also police a good faith attempt for both sides to complete the contract, knowing at least one party doesn’t want to be there.
