Unfortunately the officer is wrong in this situation. Yes, they are allowed to refuse service to any PERSON. What that means is that she could've come out and said "you guys are not allowed to come in here," and if she had left it at that then it would not be breaking the law. However, because she came out and said, "you cannot come in here because of your dogs," she passed over into violating the ADA. It would be the same as if she walked up to someone in a wheelchair and said, "you cannot come in here because you are in a wheelchair." You have grounds to file an ADA complaint and win because you have her on video refusing service specifically because of the dogs.

They SHOULD know the laws considering that is their job but 🤷‍♀️ I know there is a lot of grey area but this isn't grey area at all. He should've watched the video before passing judgment.

Restaurants have open food, it does NOT matter if it’s privately owned or a flippin Franchise. If they are open to the public they CANNOT discriminate based upon your dogs. You absolutely could file a grievance with the ADA

People get this false idea that because a business is privately owned that the ADA doesn’t apply. But most of the businesses in the USA are privately owned, but they are open to the public, such as a restaurant, a clothing store , etc. so the ADA applies to any business that is open to the public. Even if you have to pay admission such as buying a ticket, like amusement parks, etc.

    • @wildrebel-love5771

Susan Ronan No the police officer is correct. Unfortunately ADA can’t deal with “trespassing” orders. Private properties can trespass anyone for any reason and do not have to give any reason... the Police have to carry through. Like he “It does apply but it doesn’t” that’s the best it can be. The police handled the situation is in a very good way. Attitude is everything.

@@karenmcmillan7496 yes I agree. All businesses must comply with ADA. And yes the officer was incorrect with his answer. That access issue made me heart race. You’re protected under the ADA privately owned or not. They are open to the public, anyone can walk in, you cannot exclude you for having a piece of medical equipment. It’s like telling someone with a wheelchair they aren’t welcome. It’s ridiculous and scary for people with service animals. I’m so sorry you had to go through that Lexie.

Basically it’s a loophole... “yes we have to let service dogs have public access, but we have the right not to serve anyone for any reason, so you have to leave.” I’m super worried about something like this happening when I get an apartment with my ESA. Under ADA law they have to allow ESAs housing rights, but I’m worried they will deny me for some other made up reason, etc. Or try to say because of his size or something ...

Based upon what has been posted on THIS channel, it appears that most people do not stand in opposition to SD Dakota. He conducts himself like - at the very least - a well-behaved pet that could easily pass for a genuine service dog. It is Lexie, her teen posse, their sophomoric behavior, foul language and caustic attitude that they bring into public which many adults find so offensive. Any business owner or store manager who spends enough time on this channel to discern her modus operandi, would be more than justified in refusing Lexi access to their properties. ADA or no ADA, in a court of law, she would not have a foot to stand on. Willfully creating a public nuisance for the purpose of generating social media views (ie, for profit), is not a disability.

We've had that, we just kept the grouch Inna different room since she was old anyway and we had some FUN times when she started forgetting who I was....
I perfected how to pin a dog without being injured on that dog.
      Senile fatty that she was.
She only remembered me the night she passed last year.
Was my mom's dog, but she was at the hospital with my sister who was having her baby....
So I got to climb in and over the dog to give pain meds cuz she was in her kennel facing the back and couldn't move.
      Just whined.
Wound up ignoring my phone cuz I was told not to do it..
She was our first large dog as kids, I couldn't let her hurt like that.
But she sat up and turned around after a while and it was the first time in over a year she hadn't acted aggressive at me.
ER anyway I just meant it's not easy, but we managed to keep her separate from my SD pretty good.
      Have a nice night!

"Under federal anti-discrimination laws, businesses can refuse service to any person for any reason, unless the business is discriminating against a protected class. At the national level, protected classes include: Race or color. National origin or citizenship status."
"The right of public accommodation is also guaranteed to disabled citizens under the Americans with Disabilities Act, which prohibits discrimination by private businesses based on disability."

It does not matter what her attitude is like. When the first thing someone says is "your service dog is not allowed here" that's breaking the law and she can say whatever she wants after that... it's illegal to deny access to someone with a service dog and I understand why she gets upset because I have a service dog and that crap gets old real quick... not only are we dealing with disabilities, we have dogs that help us with it and make it easier for us to be safe, but you have people like this woman that makes you feel lesser than because of the dog when you have a legitimate reason to have the dogn and she is complaining about the dog she just said "no big dogs qllowed" in the video LOL so they can be used for that because she has proof and if I was her I would... that's all I'm saying.

Hey guys! So glad you’re enjoying the video! The gas station incident took a toll on my mental health for a bit. We ultimately decided it wasn’t worth it and left. As for the responding officer, yes he was wrong, many police officers don’t know or aren’t familiar with Ada laws and our rights. That’s why it’s important to stand up to people and fight for your given rights. There’s hundreds of laws officers need to remember, service animal ones aren’t always a priority. Officers can’t know every single thing in the book. This is clear discrimination. I will update soon in a new video. Thanks so much for the support and feedback!

When in reality, it makes it hard for other people who actually know you dont need an id nor that an id exists for service dogs. Just like there is not certification or paperwork for service animals.

So I haven’t finished the video, but the “right to refuse service” does not apply if they are refusing you service BECAUSE OF THE DOGS. If it’s because you’re ugly or annoying or she doesn’t like your hair, fine. But NOT because of the dogs. Ughhhhhhhh.
Edit: also don’t ask the cops questions when you know the answers. Know your rights and INFORM the cops. Most of them have no clue about the law. Politely TELL them your rights and they can verify it themselves.

Regarding the dogs inside goodwill. I understand it could be frustrating ,but it is your service dogs job to work through it. Its part of his training to be able to ignore other dogs. It shouldnt interfere with him if he is properly trained. This is not me throwing hate this is just me expressing my own opinion. If my service dog reacted to other dogs then she clearly would need to go back to training. People love thir dogs and are gonna take them places. Thats why it's so important your service dog is properly trained for your dogs safety and others.

Where I work we don't question people about their animals unless they are causing a problem. People have comfort animals that make it possible for them to be in public. Anxiety is real just like the 100's of other issues people face. You don't know why they have the animal with them. Live and let live. Your Service Animal will still alert if trained properly no matter how many other dogs are around. The example I saw at the Goodwill was a well behaved dog not bothering your dog. It's all going to be ok. Keep posting! Have a blessed day! 😀

Trained animals should be the only ones allowed in stores anyway but service animals are working to keep their handlers safe. It's not a joke or anything to poke and make fun of. That should be a lesson for the people that don't know. Even go in schools and teach kids not to pet, distract, etc. Educate everyone on this. I'd love to help spread the word. I'm disabled an I want to train my new pup. I lost my 11 yr old dog almost a yr ago. Keep up the good work spreading awareness on the service animals and what they do.

It did bother me how you used to get into peoples faces over service dog issues, but I can understand where you are coming from with having PTSD. I have multiple disabilities and I am trying to training my dog (German Shepherd/Husky Mix) to be my service dog. Right now we go to pet friendly places for training. Today we were at Lowes with a trainer and people kept trying to pet and distract my dog and the trainer kind of got into their faces. It bothered me when this happened. I think these people should be confronted, but I think it can be done in a kind way. I really believe that many people just don't understand and they should be educated, but in a nice way. That is why your channel (this channel) is so important. I love your videos! Yes, many of the titles are dramatic, but clearly it is working! I don't see anything wrong with it.

The city I live in is exploding with pet owners abusing the rights of service dog teams.
I personally have talked to law enforcement many times and even taken people to court over this issue. The problem seems to be coming from how the ADA is regulated. That being said I have been asked to start looking for SD & SDiT handlers to voice together the issues we are facing in regards to poorly trained animals in public spaces & possible solutions. Like you stated this is an ongoing problem and it's exhausting, so I think it's time handlers support each other in this fight. When you feel rested please PM me.

I used to work with kids with disabilities and one of the things we used to do was "community based training" (CBT) we would do things like go to a restaurant to teach the kids how to behave in that setting, how to order, etc. or we would go to the mall, again to teach them what to expect and expose them to ... society. One of the things we occasionally got to do was take the kids for a couple of hours to work and Goodwill stores was one of the places we would go. The kids would sort or stuff envelopes, or put price tags, whatever needed doing.

Anywhere that allows general public access HAS to allow your service animal, UNLESS the animal is either misbehaving, or not housebroken (usually only when it wasnt professionally trained) OR if its presence could become dangerous (for example, if at a zoo, the animals on display are either pray or predator of a dog, and it causes those animals to act out, the workers are legally allowed to ask that the service dog be removed, as stated by the ADA. Or, a service animal may be allowed in a building, but not permitted into areas dedicated specifically for people with dog allergies.) A privately owned building that does NOT allow general public access, may refuse entry with a service animal. Thats about it. A store cant refuse entry if your dog was being well behaved.

That white dog definitely acted better than Max. She's being so judgmental and critical of every freaking person with their dog in public and it's annoying. Like, I'd believe that white dog was a service dog 100%.

    • @Shelbsalexis
      @Shelbsalexis 4 роки тому

Emmalese K yup. I agree. And then for her to go and call goodwill about the white dog? All because her dog is “in training and the other dogs are disrupting him” even though that pup didn’t do a damn thing!? I don’t get it. She acts like she should be the only person with a damn dog. Ugh makes me so mad.

Its so true if its open to the public then yes service animals are welcome but then again, it was suck for a person with a wheelechaire to be turned down,

Refusing service and/or being rude to a service Dog and handler is not only unprofessional behavior, but it is illegal at both state and federal levels.

Circle K has done something similar to my mom and her dog. He's trained , he was wearing a vest, and they told her that he couldn't go in, he's a small dog.

How do you know if the other dogs in the Thrift store weren't service dogs? Did you ask them? If you didn't (which I think is rude to do so) you were just making a complaint based on your feelings not fact.

Can somebody please tell me who is Zeus and who is max. I'm so confused. I think that Zeus is the littler one with the brown vest and max is the bigger one with the black vest. Am I right?

The Ada actually makes it nearly impossible to weed out the fakes, but if it were any stricter you would be harassed everytime you went anywhere. So the idea is to remove barriers for disabled people, the Ada laws do that but to block fakes disabled people would loose rights.

    • @HyliaFell
      @HyliaFell 4 роки тому

Wrong.... The ADA works as it's intended. It's business owners not following the law or learning it that are the problem.

      They can help a ton.
Mine is random nuerological issues, but Ford has to help me balance, catch me if my nerve damaged leg doesn't lift and I fall(helps me fall safely), and then holds me down during seizures(mostly at night).
Without him I'd be in a wheelchair for my own safety.
But picking the right sized dog and harness type is a biggy.
Along with waiting as long as possible to spay/neuter because of the joint stress a mobility dog has to handle...
      And of course joint vitamins.
I think anythingpawsable .com has info specifically on mobility dogs...
I haven't browsed thru there in a while tho.
      Good luck in your research!
Feel free to @ me if you have questions for me ^-^~

Depending on how long you're willing to wait you can check out different organizations, but that also generally takes alot of cash.
      If possible many owner train
But anythingpawsable .com goes over basics and options...
Been a while since I looked, sorry heading to bed but I'll check in the morning if u have any questions ❤️

Goodwill sucks. I had a panic attack ( rare) there and begged them to call my husband. He was at the other end of the small strip mall, buying milk. They said it as against thier policy. Finally a customer helped me. Bless her for helping a handicapped senior. I call corporate to let them know they should change the policy. They acted anoyed. So much for goodwill having a heart for the handicapped.

  • @JayofallTrades

Lexi:"there's another freaking dog in here...this is Goodwill OMG."
Me: refers back to another video of Lexi in Goodwill asking an employee if they allow pets and the response being Yes, then her going back outside to read the service dog only sign proving that they were breaking thier own policy
For future reference find the store number and contact the goodwill corporate office with the name of the person you spoke to ect also Twitter is a way to get the word across.
Goodwill could care less about disabled people like they say, they are more retail now and rarely hire a disabled person nowadays. I tried getting a job there and I had 2 years retail experience even and was turned away.

Hi Lexi you might be proud but I just educated my mom and a restaurant server about service dogs well kind of not aggressively but just said like ya service handlers don’t legally have to provide paperwork on there service dog. No I don’t have a service dog but I have watched your videos for a long time so everything I know I learned from your videos. Ilysm Lexi💛💛💛💛
