Officer Pulls Over Couple Minutes before Fatal Crash

  • Around 1:49 AM on August 4, 2021, Officer Jon Nunez with the North Bergen Police Department stopped a 2022 Kia Stinger at 61st Street and Kennedy Boulevard for excessive speeding and reckless driving. He made contact with driver and his passenger, who were identified as 24-year-old Luis Fernando Cevallos and 27-year-old Alexis Rodriguez. Alexis told the officer that they were on their first date, and she blamed herself for his reckless driving because she was in a rush to get home. Officer Nunez reassured Alexis that it was not her fault and issued Luis 3 citations for reckless driving, failure to observe a flashing traffic signal, and violation of restrictions on a provisional license. Before letting him drive away, Officer Nunez reminded Luis to drive responsibly to avoid a fatal accident. The traffic stop was cleared around 2:02 AM.
    Around 2:13 AM, Officer Jessica Toro transmitted over the police radio a motor vehicle accident involving a tractor trailer on Route 1-9 and 36th Street, and Officer Nunez (the same officer) responded. As he approached the scene of the accident, he observed the same vehicle that he had just stopped a few minutes earlier. The occupants of the Kia Stinger appeared lifeless and he immediately called for a crash team to investigate a fatal accident. While it was apparent that the driver was Luis Fernando Cevallos, Officer Kevin Rodriguez looked through Alexis Rodriguez’s purse to determine her identity because Officer Nunez had not asked Alexis for her identification during the traffic stop.
    Sergeant Schubert, Sergeant Yousef, Officer Rodriguez, Officer Perez, Officer Vitali, and Officer Sloan arrived on scene shortly afterwards. ALS Unit 476 and North Bergen EMS South also arrived on scene. Both the driver and occupant of the vehicle were pronounced deceased on scene by a doctor at 2:26 AM. After they were pronounced deceased, Sergeant Tattoli contacted both the North Arlington Police and the Bergenfield Police to make Next of Kin notifications.
    As Officer Nunez proceeded to collect documentation from the truck driver and get his account of what happened, he told Officer Nunez that he was backing into 36th Street to make a delivery at the loading dock of Pat LaFrieda Meat Purveyors. As he was backing in, the Kia Stinger which was traveling southbound struck his tractor trailer at an excessive rate of speed. Officer Vitali eventually transported the truck driver to police headquarters so he could provide them with a voluntary statement.
    Sergeant Tattoli informed the Hudson County Medical Examiner’s Office about the fatal accident. Around 2:45 AM, Detective Mena arrived along with Officer Suarez to conduct their investigation. Sergeant Ragland from the Hudson County Prosecutors Collision Unit arrived on scene at 3:37 AM. An investigator from the Medical Examiner’s Office arrived at 5:35 AM and they removed both the remains at 6:10 AM. The Kia Stinger was towed from the scene at 6:30 AM and the roadway was back in service by 6:45 AM.
    At 1:00 PM, Detective Mena returned to Tumino’s Towing with Secaucus Police Lieutenant Martin Moreda, a member of the Hudson County Regional Crash Team. They removed the EDR (event data recorder) from the Kia Stinger and Lieutenant Moreda had the information downloaded. By 7:00 PM, Lieutenant Moreda determined that 5 seconds prior to impact, the Kia Stinger was traveling at 124 MPH (181.784 feet per second). At the moment of impact, the Kia Stinger was traveling at 68 MPH (99.688 feet per second). On August 24, 2021, Detective Mena concluded his investigation and determined that if the driver had been driving at the posted speed limit instead of 124 MPH, this fatal accident would not have happened.

    The fact that he can get 3 different tickets related to reckless driving so late at night, get lucky with being able to drive away, and be hitting over 100 mph a few minutes later is just absolutely insane to me. This guy really didn't take a thing the officer said seriously

      @@lyngi2024 It was not the officer's fault. Officers are allowed to use their discretion in multiple situations including this. There are no guarantees when giving someone an easier time like he did to this young man. Sometimes the person learns from their mistake, and sometimes they just completely ignore the point.
      Countless drivers have been given a chance by officers in the past. Have they all gone on to wreck soon after? At the end of the day it's just a judgement call, and there is a small chance that things can go very bad.

    Hearing her say “it’s our first date” immediately gave me chills…I’ve been a Trauma and Burn ICU RN for 20 years and one Friday night we admitted 2 young people, 19 and 20 years old and they were on their first date…he was nervous and got lost so he pulled over on the side of the road to look up directions to the restaurant and out of nowhere a drunk driver swerved then slammed into the back of his car and the gas tank exploded on impact…..not only were they all broken but burned too. Those sweet young precious angels held on for about a month before they finally passed away. She had a 8 month old baby and he had just opened his own barber shop. They were so special to so many people and in the blink of an eye were taken away from everyone and everything they loved.
    The drunk driver had a broken wrist, got 8 years in prison and that’s it. We wanted so bad to make him come everyday and watch us take care of the burns and broken bones and let that be something he has to think about for the rest of his life.
    It’s been 15 years since this happened but I still remember big Kevin/big 60 and his momma telling me the key to getting him to wake up was offer him lasagna…..😢 you smile and laugh then go cry because you know he’s never waking up again.
    I can’t tell y’all the horrors I’ve seen done to people on motorcycles and bad car accidents and 99% of these accidents are avoidable ….just be safe out there if not for you, then for your family and the family that you could possibly hurt

      I am so sorry you had to experience this. I'm from the Santa Clarita Valley, and for a majority of my childhood, this place was a never-ending construction zone due to rapid growth. There is this one street, Decoro, that used to just be stop signs until a really bad accident. Our babysitter's daughter, Gail, was a very amazing career woman in her late 20s/early 30s, and she took Decoro every day to and from work. One night, a speeding car completely obliterated a Stop sign and T-boned Gail's car, instantly killing the driver and his passenger. As it turned out, the driver was a teenage boy trying to impress his girlfriend, the passenger, and he already had three tickets for reckless driving before he turned 18. Gail did absolutely nothing wrong, there was nothing she could have done to prevent what happened, the families of the driver and passenger were extremely kind to her to make sure she knew not even they blamed her for what happened, but she was never fully able to get over it. She never had children and moved away from the Santa Clarita Valley and finally got married in her 40s to a firefighter who could relate to her experience because of his job. People never think of just how many people are victimized by the actions of one driver. Much love and many prayers sent everyone's way 🙏 ❤️

      Amen! It reminds me of the Simmons family who lost 2 daughters and a son to a drunk driver 3 yrs. ago.So sad.MADD has been here so long a people are still driving drunk when there are many options to get home safely. Take away their license and keys and make the volunteer in hospitals and see the results of drunk driving. So many family members affected by this huge problem ! It's so avoidable .

      I worked at a ski area a few years ago. I bumped the chair and spoke to two girls at the bottom of a certain lift. We had 72” of snowfall in like 4 days. Great powder, can be dangerous. Her friend came down and she didn’t and next thing I know ski patrol was out looking for her. Unfortunately she passed and I was one of the last people to see or speak to her other than her friend. It’s a humbling feeling.

    That sergeant was so caring towards his officers. Even though they were not involved in the accident the mental trauma was horrific. His sergeant kept making sure he was okay

      It was heartbreaking when the cop jumped out the emergency van after getting blood pressure checked and spoke to the truck driver right away and the truck driver just trying to contain himself 😔

    The ripple effect of thoughtless behavior. The driver not only killed himself and his passenger, but has traumatized officers, ems, and that poor truck driver. Their families will also be traumatized forever over the loss of two young lives, because one of them had a lead foot and a cocky attitude. That officer will never forget this. God bless him and help him to heal.

    I felt HORRIBLE for this officer. He was trying to be nice and let them go with a warning and then he turns around to see they have killed themselves. This is hitting him hard in the video. I don't believe he'll ever forget this. This video needs to be shown to all the new cocky drivers who think speeding is fun. You are not invincible.

First date and the guy was probably speeding to try to impress her. But kids don't realize how dangerous this actually is until it's too late. Which is why I think young drivers should be shown these videos as cautionary tales.

    As a former forensic scientist, and aviation mishap investigator, the clearly visible crash scene evidence reveals the horrific details of the immediate death of these two young people, Luis Cevallos (driver), and his passenger, Alexis Rodriguez.
    Given the car's recovered EDR computer info (Event Data Recorder), Cevallos was driving at 68mph when his car struck the tail end portion of this 58 foot semi trailer, at its left side, just behind the wheel wells.
    Just five seconds prior to impact, the car was speeding at 124 mph towards this intersection of 36th Street, along US highway 9.
    At this very high rate of speed, driver reaction time is minimal and greatly reduced. So as the driver suddenly saw the stationary trailer, he veered right slightly, but could not clear the trailer prior to impacting it.
    Although the car driver likely suddenly braked rapidly, and decreased his speed from 124mph to 68mph on impact, the car struck the rear underside of the trailer, and continued to travel completely underneath the trailer for about another 40 feet, before striking the highway overpass concrete structure directly to the front.
    This high car speed at immediate impact thus resulted in the entire car roof to be sheared completely off, essentially removing all parts and items from the car door upwards.
    Both car occupants were killed instantly, and suffered severe blunt force trauma, and/or amputation, to their entire upper torso.
    Given the overall impact and street scene, even if the driver had swerved to successfully miss the trailer, he would have driven right into the massive stationary overpass structure at well over 70mph, killing both occupants, regardless.
    So given the involved excessive speed, the posture of both involved vehicles (semi truck trailer, and car), and the street layout, the death of both car occupants was all but assured, and completely unavoidable.

    That's a serious psychological burden to deal with. I hope that this officer gets the support and help he needs and that this doesn't change who he is, because you can tell he is a good person.

      Kind of how it should be honestly. Someone going 100mph in what looks like no more than a 40 mph zone could have easily killed someone else. If that were your family you'd be yelling hysterically why they were still on the road.

    The fact he literally told her "if you get into an accident it's his fault" is just depressing. Even if he'd arrested the guy and had the car towed, the driver would have done this again and possibly killed more than just himself and the passenger. There was no saving the driver. It's just a damn shame that someone else got dragged down with him.

      Actually lots of us young people respect safety. I would never be a passenger in a car driving at those speeds. They could have killed someone innocent but they didn’t care. Both of them, the ah driving and the ah in the passenger seat, she made no effort to demand to be let out of the car unless he stopped speeding, she was completely fine to remain in the car with him when stopped by police.

      In some first responders - other high stress/dangerous gigs - grief doesn't always manifest this quickly and/or honestly.
      I'm not negating the humanity of those who react differently. Extreme stress creates different reactions. I hope these folks not only have access to mental health pros, but utilize it. Walking wounded with PTSD puts lives at risk - their own and the public.

They said it was DOA (dead on arrival) and they just had to wait for the coroner to arrive and give the official time of death (which is always how that works, even if it’s clear someone is definitely no longer alive). The TOD is always after the coroner arrives and declares their deceased.

      Thnk God, because ive seen so many idiot boyfriends who never knew how to drive and ended up killing the other partner for his idiotic actions, ive seen it first hand with my younger classmates, he was driving back from prom night with his gf and he decided to race with his friends in the highway ending up colliding with a truck, he died , his gf died weeks later in the hospital, their parents fought in the police station.
      If i have a daughter someday im never letting a pre pubescent jackass loser driving her anywhere, id rather he died alone for his stupidity.

      There was a group of teens who lost their lives in a similar accident near where I live. The girl that owned the car had let a boy drive. Who drove way too fast. They were videoing and you can see her in the backseat screaming to be let out. She knew before they hit the overpass pillar that her life was in danger. So sad. It ejected most of them, it was a horrific scene for first responders.

Just like there are bad cops but not all cops are bad. It boils down to who the individual cops are as a person.     This is crazy. My heart goes out to the last guy that last talked to them. Heartbreaking. You can tell he is majorly affected by this. A flashback to when I was younger driving sports car up north.. It was dark out. I was pulled over by State Patrol for speeding, who back then gave me a warning and told me there were deer constantly crossing the road and just go the speed limit. I heeded his warning and so glad I did, because about a mile up the road there was about 10 deer crossing the road. I had a low riding vehicle so that probably would have not ended up well. Again I got a warning, not a ticket and those were the days where advice was given for safety not a profit. I will always be grateful to that man.

    Apparently, this newly licensed driver already got another ticket in a different town besides the ticket he received 15 minutes before this fatal crash. His guardian angel probably tried to signal him by these various traffic warnings to slow down, but he carelessly didn’t listen. Big lesson to be learned for all… for the love of your life and the lives of your passengers and all the drivers on the road, please slow down and drive with caution. A moment of recklessness can instantaneously change lives.

    It's comforting to see how many of his colleagues asked if he was alright. And I believe the EMS woman who told him he did all he could and that it wasnt his fault and to "talk to somebody" meaning a therapist or mental health professional, deserves a thank you..I'm sure it helped a bit to hear that from her. My heart goes out to everyone involved victims families and officers who witness stuff like this daily for our protection so we members of the community dont. God bless yall.

The driver in question was accompanied by a person by the age of 25, which is the legal requirement. He had all his papers. There were no signs of drunkenness in their interaction. Most cops will let you get away with a warning at a certain time, so long as everything else checks out.

      ​@@sherrykirk6207 if hes addicted then the addiction is controlling his behavior. Its extremely hard to self discipline yourself when your brain is hooked on a particular routine or substance. I have addiction issues and in moments of deep depression i have tried countless times to convince people around me that I need external factors to help stop. I need them to find ways to force me to stop because it feels more like a compulsion than a mere choice. They dont really get it and still treat the situation like its something I have control over.

      About ten years ago I totaled my friends new Mercedes on our way back from Mohegan sun. We had both been drinking, her more than me tho, which is why we had the ‘great’ idea that I would drive us home. I had taken a Xanax bar however, and nodded off at the wheel. Thank god I didn’t hit anyone and we weren’t hurt. It was like 4 am. A passerby called the cops for us, and I remember we chucked a bottle of booze we had into the high grass. When the police showed up they never asked us about drinking or being intoxicated in any way….He wrote me a little ticket for like failure to stay in the lane , called us a tow truck and that was that !

      thank you for recognizing that, it's easy to see he was raised to be polite to people at all times and he is even in all the pandemonium, not shouting or rather barking at everyone like a rabid dog that typically cops behave when people clamor to a crash scene. my prayer and wish for him is that today he's as polite as then not letting the trauma and stress in the time between embitter him.

    I appreciate that he closed the scene, as soon as people started showing up. He cleared it immediately. I’m glad he closed it before the cell phones came out.
    We all need to learn that when we come upon a scene, we should treat one another as human beings. Not video footage for Twitter 👍’s and views. Seriously, people’s families see this stuff.
    I’ll never forget the person that posted the 4 year old child that’s brain got blown onto the sidewalk at the Texas outlet mall shooting. His parents were killed too that day, thank God they never had to see it but the rest of the family did.
    We need a reality check. 💔

    Had a friend from school who became a cop. He lasted two years. He said he saw so many violent and horrible things that he could not sleep at night. A violent rape and murder was the last incident he attended. It takes a lot of work to divorce yourself from the stuff you are exposed to as a cop.

      That's something a lot of people don't think about. Police and firefighters/ems see it all, and it can change people forever. My dear buddy, who passed at 25, was a lighthearted happy guy who became a firefighter, and after a few years, his happy demeanor changed, and he'd tell me the awful things he'd seen. He wasn't mentally prepared for it, just like I wouldn't have been.

      Right. At my high school there was a mock accident done at our high school parking lot. They use actors and makeup. It was pretty creepy. We also had a tragedy at our school a girl accidentally hit another girl walking in front of the school. It was pure accident she wasn't speeding She hydroplaned in accidentally hit the girl. That traumatized a lot of people. So a lot of people didn't try for a while.

    I don't understand how people are saying that the officer is at fault for the accident because he gave him a break and let him drive home. I most certainly don't think this was the officer's fault for giving them a break. Where I live, that would not have happened. The kid got a break but ended up having a fatal accident. That's just tragic.

    When I was in high school around 2000, they had us watch a presentation that showed uncensored videos and photos from fatal accidents like this, and to this day it still stays with me. Life is so very fragile, and kids often don't realize how quickly it can be taken away. Teen drivers tend to be much more reckless, and they definitely should be shown the reality of what can so easily happen as a result of that. Definitely heartbreaking and tragic.... Hopefully they're still actively showing kids the real life consequences of drinking and driving, or reckless driving and speeding like this incident, because this sorta thing IS preventable. Damn.....

    This officer's voice when he realizes who was involved...I felt that all the way to my core. Imagine the guilt and all of the "what ifs" he is feeling for letting him off with a warning. Prayers to the family and the officer. 😢

      He ticketed him on the lesser charges to give him a break financially. He was ticketed I think for 3 violations.

    The terror in his voice when he realizes it’s the young kid he just gave a huge break to is heartbreaking. Hopefully he gets support through this and knows he did nothing wrong. It brought me right back to when I lost 7 people in one day. 3 adult friends and 4 of their children. My friend decided to drive 104 on the highway, passing a car in the breakdown lane and when she moved back over she clipped the front of the car she was passing. Sent the van she was driving rolling and out into the woods. Some of the first responders to arrive we’re so traumatized by the scene that they were out of work for well over a year, some never returned to work. The children were ages 2-9, not one of them was in a child seat or seatbelt. I wish people would just slow down!!! Thinking of all first responders who have to go through moments like this, reach out for support. ❤❤

      Absolutely. I feel extremely lucky. I did however always have a huge fear of speeding and would scream if someone was speeding as a joke to scare me when I was younger. Had a D.A.R.E officer scare the hell out of me in 5th grade about it. Wish it worked with the drug part!

      You definitely feel like you have so much time in the world and that you're going to be just fine when you're young I also enlisted in the army when I was young and served in combat I used to walk around like I was some kind of bulletproof badass but throughout life I've learned that anybody can be taken from this Earth at any time. Last year just after my 40th birthday I had a heart attack and a seizure and then I was in a coma for a month. I was technically dead for about 10 minutes and thank God I survived so I can still be here with my family. Young people and fast cars are definitely a bad combination. I used to drive stupid enough in my old school Volkswagens and BMWs and those only had maybe the fastest I had just about 280 horsepower. They have cars out of the lot over four or five hundred horsepower

    This may sound harsh, but at least they are no longer a danger to society. And they thankfully took themselves out in a way that didn't snuff the life out of the driver of the other vehicle ... which is rare. Posthumously, the car driver's insurance will cover the damage to the truck.

      Something about knowing the victim, even if only from a short interaction a few minutes earlier, makes it 1000 times harder to disconnect and do your job in the moment. I'm not a first responder but I live basically on top of a dangerous stretch of highway, knowing what that cop is seeing in the moment, I'm impressed with his ability to think and act quickly. He's built for the job.

    My husband’s mom was hit and killed, while walking to a store by a speeding, drunk driver, she declined a ride because it was a “beautiful day” she said. This happened back in the 80’s. My husband was only 16. The devastation of the loss and what his tiny 4’11’’ and only 110lb Mom went through still haunts him. She didn’t pass right away but did later that night.
    My thoughts are with all that were affected by this horrific but avoidable tragedy.

    This is a very real example of how fast a fatal event can happen. One moment you are completely confident we have our whole life ahead of us , for years and years. Sadly we would have never predicted death just 15 mins from that exact time. Life is precious because the reality is , we only get one shot to live the best we can. This is sad but also a real eye opener , seeing with our own eyes what can really happen just like that.

      tends to happen when you let someone whos clearly piss drunk continue on their way, and even if he wasnt the level of reckless driving on city streets was an instant take me to jail card. Shoulda let him sober up overnight in a jail cell whether that it was alcohol or just a guy on an adrenaline rush, clearly needed to be sobered up in a jail cell. can't believe he ran a red, almost killed a ped, and officer didnt do any field sobriety tests and let him drive away.... WILD.

    To be perfectly honest I think they shouldn’t blur the deceased occupants of the vehicle when reviewing the bodycam footage. Like it would be one hell of an image to remember and show others just how gruesome and dangerous a car accident traveling at a high rate of speed can be. Might just show others especially young kids who think thier invincible just how deadly their reckless actions can have on themselves..smh.

      Hi, I work in a court house where we review Axon body cams all day long. They blur this out to protect the victims (in this case, the deceased). The original copy is confidential and left with the prosecutors, police, judges, attorneys etc. but the one released to the public is always redacted. It’s also why the officers dob was blurred.
