Bike Camera Footage Wins Case For Cyclist

- Levenes Solicitors represented Mr RS in a claim against a Sainsbury’s van driver for compensation for the injuries and losses suffered as a result of a road traffic accident.
Mr RS was cycling correctly along the road when he was struck by a van. The van driver had not seen our client and drove in to the path of our client. A claim was made against Sainsbury’s insurers who at first stated that their client was stationary at the time of the accident. Luckily for Mr RS, video recorded by a camera mounted on his helmet showed that the van suddenly swerved to the left and struck Mr RS knocking him to the floor. When the insurers saw the footage they admitted liability.
The video camera proved the van driver’s negligence and without this vital evidence this could have been a case of the word of the cyclist against that of the van driver.
Mr RS has received £3,859.40 in compensation for his injuries, damage to his bike and losses associated with it.
The client was represented by paralegal, Dagmara Sztynyk and Partner, Tim Beasley.
When a driver fills in an insurance report and tells a lie such as in this case, the driver should face a criminal prosecution.

I often wonder if penalties should be increased for lying (in this case, the van driver saying he wasn't moving), when clear evidence subsequently comes to light to prove it.
I think they would be in a criminal case of careless or dangerous driving as that would be an aggravating factor.
Some drivers need to back to the first grade where, in coloring, they teach you to stay inside the lines.

It's not that black and white, cyclists need to take more care instead of acting like there are no vehicles there. How stupid can you get.. Immature minded cyclists are taking the piss out of roads that everyone knows is dangerous when you have heavy vehicles and someone on a bike obviously not ready for change in his path. Can't blame the vehicle the road was made for, that's why you don't see motorcycles fly up the inside of the road.. Because it is a stupid thing to do.. I'm wondering what on earth that driver was moving over at that moment in the first place other than to hit the cyclist. There is no parking, drive, or turn in that location.

No it wasn't deliberate . He was turning to park to make a delivery but as usual a lot of these van drivers don't bother to look around and just turn and press on the little pedal .
Except that there was no indication, no brake lights and that turn at the end was also very sudden.....none of which are consistent with someone pulling over to make a delivery.

Head to the bicycle lane and both drivers and pedestrians feel cyclists shouldn't have a designated area because drivers cut in to said lane and pedestrians think its another footpath.

It has been determined through recent personal experience and several media sources that cycling is one of the most ostracized (US spelling, you'll see that a lot here thanks to the keyboard input in my phone) means of transportation in Western metropolitain areas, chiefly in subcultures whose primary means of transportation are motorised vehicles and walking.
These common methods of transportation are popular due to various merits and, as such, have designated sections in developed areas where these transportation methods are safely conducted. Bear in mind, this explanation disregards developed and rural areas where pedestrians and motorists have shared zones.
The two zones do not, however, account for cyclists, whose speed, mobility, agility and fragility exist in a realm between pedestrians and motorists. Cyclists are henceforth ostracized from both of these zones.
With regard to footpaths (or sidewalks), cyclists run the risk of colliding and injuring pedestrians, the latter of which are usually slower and inattentive to their surroundings. Cyclists are at times verbally abused on footpaths by others due to these risks, feeling that their inattentiveness is a luxury found only by walking.
Roads, on the other hand, pose an even greater risk to the cyclist. Motor vehicles are large, heavy, deadly metal machines capable of reaching dangerous speeds. They can be unpredictable, and often a cyclist must be extremely active and highly alert in order to maintain traffic flow.
Furthermore, motorists have been known to purposefully collide with cyclists. Because a cyclist's body is completely exposed such an incident can cause serious injury or death.
Due to various factors including those listed above, governments and town planners have recognized the need to design and develop areas focusing on increased activity with a strong emphasis on outdoor lesiure, and a greater unity between a diverse range of transportation methods. The bike lane was born out of these necessities.
Unfortunately, these were built over the top of, and extended from, existing footpaths. They were also constructed along the side of an existing road, as illustrated in the above video.
Cycle lanes have the added convenience of being a shared zone between cyclists and pedestrians, yet this factor creates various difficulties whereby cyclists still have to contend with slow, inattentive pedestrians. The risk remains.
With regard to the road markers, drivers feel they are permitted to pass over the lines as they would with bus lanes and striped zones. They are not, but the penalty is so low that most traffic authorities ignore it. The risk, as always, remains.
Various critics argue that these bike lanes are granting far too much credence to cyclists and that pedestrians and motorists alike are being limited to smaller zones as s result. Furthermore, cyclists would be respected by the other two if the former kept to the rules and regulations by which everyone else abides. Cyclists are known to cross between the three zones as they presume to exist in a legal grey area as they are neither pedestrians or vehicles.
In any case, the war rages on.
Ban cycleing on public roads, problem solved lol. Get motorized so you can keep up with the flow of traffic like you should, probs be safer for you all that way then you wont have to demand tax $ for your little hobby to have designated road space.

I have just searched and it's not what I found. Also, it's far from the reality where I live.
I live in the U.S. state of Florida. I was in a bike lane and aimed to go through an intersection. Light was green and the truck in front of me turned right without signaling. It forced me to veer to the right which snapped 5 spokes on my rear rim and also marred the threads on the right side of my axle when I had to roll off my bike over a curb. The guy looked at me dumb founded and I asked him why I didn't see his turn signal. He just shrugged and shook his head. He didn't have an answer. I walked away shaken and still to this day extremely angry over how dangerous a single persons 1 second decision (or lack there of) can be. Thankfully I was not injured but that is EXACTLY why it is imperative to check your blindspots!!! Never assume anything on the road!!!
I commute to work which I have 7 km (4,3mile) but I take a D tour to avoid cars so I double the route to 13,5km (8,4mile) .... I got better bike to shorten the time.. Now I feel at much better shape and I ride worry free and my biggest fear is head wind :D I got hit once on the shorter route, That´s why I decided to go further because I simply could ride along the cars for like a year or two without being scared everytime a car passed me..
Always take up primary position through intersections, and this can never happen to you.

My town in California has wonderful bike paths. Can get around almost the whole city without getting on a road and if you are on a road we have wide bikepaths also!

He was making way for the van opposite trying to pass the bus (0.33) . The driver moved likely on reaction after seeing a potential hazard. It is a natural reaction anyone would make and it is very difficult to train yourself out of reacting on impluse. It is unfortunate for both him and the cyclist. People making out the driver to be malicious or negligent only exacerbates driver cyclist contempt. Mistakes happen in life in general, on the roads car vs car, that mistake is often not fatal or even causes injury. However as a cyclist you are prone to much worse injury as the result of a mistake.
Cycling infrastructure is not coming soon if at all. Cycling groups would do be better to advise safer cycling to ensure better outcomes for all. Whilst I do not blame the cyclist, I know this road well. It is a 'route road' and is extremely busy, yet quite narrow for a road of this type. I would personally advise all cyclists to slow to nearly waking pace along this stretch, especially if there is traffic. Of course that will never happen.

Maybe, but after watching the footage again and concentrating on bus and van on the opposite side. I disagree. It looked like there was plenty of room for all parties to fit through without any risky manoeuvres. I do quite a lot of cycling and I get this all the time. People in vehicles can't stand the idea of you getting passed and getting there quicker. People are childish.

The logical explanation is they were going space and didn't do it safely. That does not take away the blame from the driver though.

I started cycling with front & rear cameras; I also drive with a dashcam. I needed to have an email exchange with my local law enforcement, to determine what specific evidence i needed to provide to them, and to whom, in order for them to investigate and take further action.
I am happy to say that we have it just about right now and I am able to provide other cyclists with guidance of how to deal with these incidents, even when they do not result in a crash. I'll also say that you should be emotionally prepared to abandon your effort, when you do not have the evidence to press the matter; it's not fair to use law enforcement to simply vent about the general conditions. They have to be there and see it, and those resources are stretched in my community.
I just had a similar conversation with my local police, seems not sufficient to just fill out the report, need to know how to do it, so that it stands out for them. They dont have enough people to follow up on the volume of dashcams they get now.

Looks like the driver moved over to give the van coming the opposite way room to pass the bus. Doesn't look malicious from the driver, more careless than anything.
The van coming the other way had his own lane , and should have waited until the bus moved on if he had to cross into another lane to overtake , on top of that the van you mention is a Police vehicle . Swerving about in lane in a vehicle as big as that van is just a no .

I always avoid riding in the drops when there's a fair amount of traffic. I want to make sure drivers and pedestrians see me. Plenty of times where I almost been "that" guy who got hit.

It looks to me that he *wrongly* moved over to give the white van driver space to pass the bus that was stopped.
His error was not to check his mirrors before making that manouvre.
I am not a fan of these cycle lanes for this exact reason and prefer overtaking on the right.
Seeing these multidrop drives everyday I would put money on the driver checking his sat nav or checking the next drop and taking his eyes off the road.

The Mirror Guy is correct, the most likely reason was to allow the white van driver to pass the bus. Sadly his courtesy wasn't well thought through and he should have checked his mirrors. Cyclists can minimise the potential danger to themselves by understanding where potential hazards arise and be better prepared for them.
This is not me victim blaming, the driver was at fault. But after watching this I will be especially aware of buses at bus stops on opposite site of the road. Drivers will often pull to the left to allow oncoming traffic through.

I'm really glad I bought a body cam when for when i ride my bike...I've reported a car driver within about a week of buying it...The police are moving ahead with the offense too.....Britains car drivers really do act like they own the road.

Andrew G that's exactly what happened here. The driver was frustrated he had to sit in traffic, got emotional about it and hit the guy on a bike. There was no accident here.
This is multiple factors coming together:
A: That "bike lane" is a complete joke. It's just way to narrow for safe usage.
B: The cyclist is to fast for such a dangerous bike lane.
C: The driver didn't use his turn signals.
D: The driver didn't check his mirrors or failed to check them in advance.
some of these drivers are downright spitefull when it coms to sharing the roads. they cant stand it that a bike can go faster when gridlock happens

Van driver was in the wrong but even so, I wouldn't be passing all those vehicle at that speed and that close if I was cycling. Better to arrive late than not at all.
I encourage everyone I know to get a camera, it's better than your word against theirs!!

Whilst the driver was in the wrong why not ride defensively and this could be avoided. I have been a motorcyclist and cyclist for over 40 years and you may be angered by my view but cycling like this is leaving you wide open to such accidents. Hope you were not too badly injured.

I support this comment. I'm a lifelong cyclist and the points about bad infrastructure and the fault of the driver are both right, but you rode like you had a death wish. Always imagine every vehicle has an idiot at the wheel and a kid crossing the road beyond it.
Cycling in england seems terrifying. Every video I see is someone crammed into a gutter protected only by a bit of paint that most drivers seem to ignore.
It's not too bad . A lot of these videos are the worst case scenario and a collection of videos can span over years .
I think most cyclists have come close like this but the issue was how sudden that van driver swerved and the lack of indication... There was no avoiding that as a cyclists

The best would be a cycle lane that has a separation between it in the form of a pshyical barrier from the main lane, so that drivers can't just drive over some worthless paint on the asphalt and over to a cycle lane. You also prevent drivers parking in cycle lanes with such a design.

If we are to follow your logic, cyclists can never pass other vehicles that are in the main lane when they cycle in a cycle lane in case a driver suddenly out of the blue decide that they illegally want to pull into a cycle lane. This wasn't even in a junction. Do you also do that on a dual carriageway when driving or riding a motorcycle in a city? Never drive faster than those in the right lane, in case one of them suddenly and blindly decide to change lanes without the use of indicators and mirrors?
@@k-rj740 I just commented on that exact scenario, while passing slow traffic on a freeway, I slow to a speed that I can stop if some clown does suddenly dive into my lane, being in the right isn't everything.
Yes the lane is too narrow, but it's a separate lane, just like a bus lane. The purpose of both is to allow either a bike or a bus to continue if the road ahead is clear.
Lean from Holland, there cycle lanes are set back off the roads.

First of all last year it was 613 deaths, not 700, and that's the total amount of deaths in traffic related accidents (car drivers, cyclists, pedestrians, etc). The number of cyclists killed in traffic was 206 of which 2/3 were over the age of 65. (This also includes one sided accidents)
Why do more cyclist die in the whole of the Netherlands than in London?
Simple, we cycle a hell of a lot more.
I think it’s important not to measure the risk of cycling by the number of cyclist casualties alone (i.e. absolute numbers). How much cycling is going on comes into it too: i.e. more cycling casualties could simply reflect the fact that more people are out on their bikes.
2016 statistics
Modal share bicycle: Netherlands 24% of all trips (in some cities even just over 60%), UK 2% of all trips (inner London 3.2%).
Average number of trips made by bike per person per year: Netherlands 250-300, UK 15
Average distance cycled per person per year: Netherlands 551miles, UK 53 miles
Cyclist fatalities per billion miles cycled: Netherlands 22.5, UK 30

DVLA and NHS would loose out big time, you'd have a lot of explaining to do.
Even though the DVLA or/and Highways England would just say that they own the roads making them 'privately owned public roads' and they'd make each cyclist pay £3000 insurance because they're at greater risk of injury. For the UK roads cyclists seem like an afterthought, but they should appreciate it as it can only get worse for them. cyclists have no reg, tax or insurance they're above all, and any accidents are everyone else's fault.

Trouble is the traffic is moving slowly and you do not expect a cyclist to be going fast on the inside! Yes drivers should check mirror but cyclists need to be aware and go slower down the inside

Cases like this are why I have a GoPro recording my front view and a Garmin Mini 2 dash cam recording my rear view. I've been hit a few times and most drove off after so now I'm ready and I'll have zero mercy. Especially if they lie like this driver ended up doing. Or try running and I get them on the camera or both. I still need a bilateral hip replacement from the last time I was hit. And it was a bad one. But I was lucky because my helmet did it's job well. I was going down a dark road on my ebike driving it legally and not like a dummy(I am always paranoid of idiots on their phones etc before I ever got hit the first time so I don't play games like a kid on the road), and with lots of extra reflector stickers, even on my helmet, and with lots of bright LED lights front and back and someone going 30-35mph hit me full on from behind and I flipped backwards into the air, my head hit their hood or corner of their roof and I came down on my two feet and my hips got FUCKED and took all that force when coming down. Like jumping from a building or something and my hips took it. They left me. I actually rode side saddle like a horse on the ebike all the way home a few miles. NOT a fun time. Got mostly fixed up and now I'm just waiting for the right time to take months off from work and be in bed for months. UGH. So yea, have your cameras going always.

Cycling is a great idea in theory. But cyclists themselves are the most self righteous idiots on the road. They want every city to be like Amsterdam but of course they aren’t. The reality is that forcing your right of way means nothing if you’re seriously injured or killed.
I think you are somewhat right when you say it is good in theory, look at the vehicles almost going over the line, its clear the road was never intended to have a cycle lane, the lane itself is appalling drains, poor surface and in some places a heavy camber. Cycle lanes are a good idea but they require more thought than a lick of white paint

Whatever the situation of right or wrong cyclist's (and pedestrian's) are the most vulnerable road users and road users they are. They are just as entitled to use and cross the highway as any other. It's not possible to be definitive as to why the van turned left and collided with the cyclist only clear that he did. It has been my experience however that on single carriageway such as this when a bus stops on the opposite side not all the driver's behind the stationary bus wait for there to be a safe passing space to overtake some push out thus causing others to swerve to avoid a collision. It is a natural reaction to swerve when driving if you think another's action is is going cause a collision and in that split second attention to your nearside (or offside depending upon the situation) would be compromised. IF the van driver had indeed needed to swerve because of an impatient driver behind the stationary bus then the offending vehicle would be partly responsible. It would be a wise consideration for all drivers to put a camera in their windscreen for it may show a mitigation for their action. Another observation is that when bigger vehicles are moving slowly why go so fast you could have gone slower and still got there quicker with a better reaction time to the collision - and that's NOT to be implied that the cyclist was in any way in the wrong but caution has to be the better part of valor - getting there safely has to be the benchmark for all road users

How could they not see a HV bearing down on them? Well if they can't see that, a cyclist definitely won't be seen, especially if at speed. My HV will win any encounter with a car, but being in the right doesn't make it right. If you want to take a stand for your right to travel as fast as you can go in heavy traffic, go for it, your rights won't help you if you're dead.

If you ask me, the designers/engineering firm who design the transport infrastructure should also be legally liable for accidents like these. After all, the fact the road provides poor visibility for drivers and little safety for cyclists contributed towards the accident. If transportation engineers are not responsible for the dangerous environments they create, we will just receive more dangerous environments.

It is obvious that the camera is mounted on the bike's steering bar and not on the riders helmet as stated in the video description.
I rented a bike in London and quickly realized this is not going to work if I had to cycle on the roads. Within 10 minutes I parked it where I picked it up. Some areas of London seems to be death trap like someone else already mentioned.

I'm a biker ,and bike lanes are a death trap. Vehicle drivers are looking forward primarily and bicyclist are not plainly visible. Maybe some type of high intensity lights might help,but being that close to so many moving vehicles with no response time is why I get on side streets as much as possible

I still think we shouldn’t be mixing bikes with 3000-lb hunks of metal with poor side and rear visibility. Back in the day we rode our bikes on the sidewalk and I didn’t once hear a story about someone dying or being seriously injured.

Statistics show that most accidents between a driver and a cyclist happen at junctions (in the UK 75% of all accidents happens near or at junctions) where they cross each other paths.
