Bike Camera Footage Wins Case For Cyclist
Levenes Solicitors represented Mr RS in a claim against a Sainsbury’s van driver for compensation for the injuries and losses suffered as a result of a road traffic accident.
Mr RS was cycling correctly along the road when he was struck by a van. The van driver had not seen our client and drove in to the path of our client. A claim was made against Sainsbury’s insurers who at first stated that their client was stationary at the time of the accident. Luckily for Mr RS, video recorded by a camera mounted on his helmet showed that the van suddenly swerved to the left and struck Mr RS knocking him to the floor. When the insurers saw the footage they admitted liability.
The video camera proved the van driver’s negligence and without this vital evidence this could have been a case of the word of the cyclist against that of the van driver.
Mr RS has received £3,859.40 in compensation for his injuries, damage to his bike and losses associated with it.

    I'd have held back and not passed the van. We always have to consider whether we've been seen. I'm not so in a hurry that I would have risked it. Maybe that's why, in 10 years, I've never even come close to being hit.

    If you ask me, the designers/engineering firm who design the transport infrastructure should also be legally liable for accidents like these. After all, the fact the road provides poor visibility for drivers and little safety for cyclists contributed towards the accident. If transportation engineers are not responsible for the dangerous environments they create, we will just receive more dangerous environments.

    No way would I cycle at that speed through such narrow spaces, agreed it was the van driver fault but self preservation must play a part.

    Cases like this are why I have a GoPro recording my front view and a Garmin Mini 2 dash cam recording my rear view. I've been hit a few times and most drove off after so now I'm ready and I'll have zero mercy. Especially if they lie like this driver ended up doing. Or try running and I get them on the camera or both. I still need a bilateral hip replacement from the last time I was hit. And it was a bad one. But I was lucky because my helmet did it's job well. I was going down a dark road on my ebike driving it legally and not like a dummy(I am always paranoid of idiots on their phones etc before I ever got hit the first time so I don't play games like a kid on the road), and with lots of extra reflector stickers, even on my helmet, and with lots of bright LED lights front and back and someone going 30-35mph hit me full on from behind and I flipped backwards into the air, my head hit their hood or corner of their roof and I came down on my two feet and my hips got FUCKED and took all that force when coming down. Like jumping from a building or something and my hips took it. They left me. I actually rode side saddle like a horse on the ebike all the way home a few miles. NOT a fun time. Got mostly fixed up and now I'm just waiting for the right time to take months off from work and be in bed for months. UGH. So yea, have your cameras going always.

    nearly all the bicycle crashes with cars would be avoided if cyclists would move to the sidewalk from the street and just drive on proper situational speed. poorly visible and unregistered vehicles with untrained drivers driving among the cars with no speed control is a system designed to cause crashes. and it's only a loophole in the law that these cases are blamed on the car drivers, law demanding everyone else to see the cyclist but not demanding the cyclist to be visible or to drive at situational speed.

      @onehandwashestheother yes, the driver made a mistake. but that is not the point. The point is, that the bicycles should never be addressed to the sides of the lanes anyways - bike lanes as well should always be part of the sidewalk, not the lane. invisible to the other traffic because they're so small, have no standardized lightning or reflection plates and because of no legally set top speed or requirement for appropriate situational speed, unpredictable because of no requirement for training, impossible to prohibit legally because no requirement for registration. cycling on the side of the traffic means you are driving on the dead angles of the cars. all of this combined it is destined to cause accidents, some of which cost lives. cyclists can easily drive with zero risk at sidewalks with proper situational speed, but will always cause increased accident risk when on the lane.

    Agreed it was the van drivers fault, but there is very little risk aversion from the cyclist. I would be very wary of cycling at that speed down that tiny gutter. So many things could have gone wrong from pedestrians stepping out, to what did actually happen. If I was cycling, I would have very slowly and carefully filtered, either on the right side of the cars, or even perhaps gone on the pavement through the narrower parts to be more visible. Remember, being safe on a bike does not equate to following the highway code. Often following it, puts you in more danger.

    As a cyclist I just try and avoid cycling on the inside of vehicles. Just hate getting trapped on the inside and in their blind spot.

    I'm a biker ,and bike lanes are a death trap. Vehicle drivers are looking forward primarily and bicyclist are not plainly visible. Maybe some type of high intensity lights might help,but being that close to so many moving vehicles with no response time is why I get on side streets as much as possible

      The van driver moved over to allow more room for the oncoming car to pass the bus. It's on the video. It's clearly a common courtesy that we can no longer afford. The result could be different today, because the cyclist is clearly close-passing...

    I can understand the cyclist view of course in the video, but not being a cyclist except in the gym, personally I could not go up the inside of waiting traffic as this cyclist did and so many do, just because there is a bike lane does not give you a god given right to zip up the inside or zip up the outside and think that every driver can see you, cyclist are like annoying flies they buzz around you from all directions, and worst of all, give someone a bike, a helmet and a snazzy outfit and suddenly there all the on the Tour de France race on our public roads, they jump red lights, jump pedestrian crossings and anything else which gets in the way of there personal time trials, pain in the arse, if cyclist ever start having to pay road tax, insurance and pass a test I'm sure the motorist would pay them more respect.

    The Roadcraft book, the one police use to train motorcyclists, and the one we use at the IAM, teaches very clearly never ride faster than you can see to stop! The van was at fault, but the cyclist didn’t give himself any hope of avoiding the collision due to his inappropriate speed!

    A bit odd that all of this happened in front of a police van, and still they had no witnesses. Most likely because the police van (as usual) was driving recklessly

    That just goes to show how dangerous it is to ride that quick down a tiny cycle lane passing slow moving cars like this. Great he won his case, great that it wasn't his fault, but he still got hit because he was doing something stupid.

    There should be a cycle speed limit of 10mph when undertaking, this person was way too fast and an accident waiting to happen, undertaking on a pedestrian crossing at speed, riding without due care and attention

    I started cycling with front & rear cameras; I also drive with a dashcam. I needed to have an email exchange with my local law enforcement, to determine what specific evidence i needed to provide to them, and to whom, in order for them to investigate and take further action. I am happy to say that we have it just about right now and I am able to provide other cyclists with guidance of how to deal with these incidents, even when they do not result in a crash. I'll also say that you should be emotionally prepared to abandon your effort, when you do not have the evidence to press the matter; it's not fair to use law enforcement to simply vent about the general conditions. They have to be there and see it, and those resources are stretched in my community.

      I just had a similar conversation with my local police, seems not sufficient to just fill out the report, need to know how to do it, so that it stands out for them. They dont have enough people to follow up on the volume of dashcams they get now.

    I don't like the way the cycle lane disappears when there is a bus stop, or pedestrian crossing - the traffic still needs to know where the lanes are....
