    To be honest, how do you react when brakes fail? Your adrenaline spikes, you become super anxious and scared for your life, and all your senses are gone. All that’s left is the fear of whatever happens next and you try to divert the situation as best as you can once your brain is able to think again. I think this man has a lot more innocence he’s showing than they realize that, while it’s nice that they reduced his sentencing, they should drop all charges and release him. If they had already spoken on the possibility of adrenaline rushes, then I can’t fathom how that idea went past the court’s heads.

      It was a truck malfunction caused by a driver ignoring warnings. I've been a long distance truck driver for over 3 decades. I over heated my brakes very early in my career in California. Seeing the smoke, I braked harder and stopped on the side of the road to cool them. The mountain I was coming down, didn't have any run away ramps. This man had that option, and he ignored it. I think 10 years is a joke. Although, 110 was very excessive.

    • @edwardantrobusjr2253
      @edwardantrobusjr2253 Рік тому +4

      The truck malfunctioned because the driver wasn't driving correctly for the conditions. He was in too high of a gear, allowing the truck to go to fast for the brakes to be of muck value. If there was a mechanical problem with the brakes, the owner of the company would have been arrested.

    A decade remains an excessive period to bear the weight of an accident. It sets a troubling precedent, suggesting that a mechanical failure resulting in an automotive accident could merit imprisonment. If indeed this is the standard, shouldn't those responsible for manufacturing the brake shoes or pads face incarceration? What about the individuals behind the creation of the truck itself? Should the blame extend to those who chose a paint color that compromised visibility for those who tragically lost their lives? And why stop there? Should emergency technicians who, despite their best efforts, were unable to save the victims also face arrest?

      Except that it was entirely avoidable. He failed to do a brake check (this involves doing an inspection of the brakes and ensuring trailer brakes are operating) before a long steep down grade (as trucker drivers are trained to do, and for which there are several pull-outs along I-70 with signs saying "Brake check area") and when his brakes did fail he failed to make use of the runaway truck ramp gravel bed that exists on the last steep down grade for this very reason. There are several signs warning that it is coming up. Having passed up his only chance to stop without brakes, the result was inevitable. He was going 70+mph at impact. Also, no trucker should be reliant on their brakes alone. If the correct gear is used and the posted speed limit for big rigs is followed (35mph for trucks over a a certain weight on those last 2 steep grades) then it's possible to descend safely without using the brakes at all.

      *negligence
      Truckers have an important job in transporting heavy loads. They have to be responsible in maintaining their vehicles and being overly cautious when driving because of the threat they pose to other motorists. Too many truckers toe the line with their old rigs and do the bare minimum to save on expenses. This particular driver had insufficient brakes for the path he was taking, driving speed, and load he was carrying and they gave out (which happens, so municipalities set up runaway ramps). The most negligent thing he did, though, was he panicked and failed to take the runaway ramps available.
      This negligence is the same reason that cop who pulled her gun instead of her taser is going to prison.

      No, they didn’t fail. He made multiple errors leading up to the brakes being useless due to going too fast. He didn’t properly follow his training and it’s sad but ultimately this is a guy who got in over his head trying to make some money not realizing his limited understanding or knowledge, or knowing that he didn’t fully know what he was doing and choosing to do so anyways. It’s either negligence or overestimation, potentially a combination of both. It’s unfortunate but that’s what this seems to be.

Condemning people to Hell isn't in your job description. Assuming God is going to send this guy to Hell just because you feel that's what he deserves is arguably a more vindictive and nasty sin than the terrible accident and loss of life that this man caused.
