I have one question, my h4 visa has expired but i94 is still valid.. am i eligible to continue my stay in the US or do I have to go back to india for re-stamping? Moreover, my H1B visa has been picked this year and is under process currently.. so, what should I do? Stay till i get i797? Will there be an issue for my h1b visa since I am overstaying on H4? Also, since that my h4 visa is expired, can I apply for i539 now? Kindly guide TIA 6:23

Hi Pragnya, I came to USA on H4 Visa in 2022. In 2023 second lottery my H1B got picked up but it got RFE. Meanwhile I had personal family emergency and travelled to India and returned back to USA. After I return to USA RFE got approval and H1B got approved in April 2024 but my change of status from H4 to H1B is not approved. My employer told me as I travelled to India in between of approval I need to go to home country and get stamped in order to get H1B. Should I go for In person interview or Dropbox. Will the Dropbox application be approved? If any rejection my H4 is also expiring in September to travel back in September.

H1B Petition Validity: Hi, I have an approved H1b petition from my employer since October 2022. Due to some unfortunate reasons, I couldn't travel. Note that I already got my stamped visa during this duration. All I have is a petition and stamped Visa validity which says its valid until September 2025. Based on my knowledge and research, I found that H1b is valid for 3 years and can be extended upto 3 more years. Now my question is, if I apply for the visa and get it stamped and relocate to US, will my visa's 3 years start from that date? Or the visa will expire in September 2025, which is the petition validity date/current visa expiry date? I am not sure where, but I read somewhere that petition expiry date is the last day of entry for the petitioner. Assuming that 3 years of H1b will start after the issuance of the visa? Also Can I renew my petition and visa being in India? Please enlighten me.
