The problems with nintendo patent it just basic mechanic and if you on indie or not 3A studio who having money to uses the patent. I've played Pokemon games since Red and Blue on Gameboy and I Like Pokemon, but their Games Suck on the Switch. I'm 39 and I'm an older fan of Pokemon, their games Sword/Shield and Scarlet/Violet have been very both Sucked, my Nephew hated it...Both Games Were Awful Looking,Very Laggy, Full of Bugs, and They Charged More For Patches That Barely Fixed Anything...

I do hate how much the term IP has gained power over people. Art no longer exists, its all product now As for the designs being obviously plagiarized, if that were the case Nintendo would've sued when the game was announced. The bulk of designs were already there by then. It goes to show how not "obvious" or simple art is. If this was the case Toriyama could've sued Pokemon over Mewtwo looking like Freiza. I suspect The patents are part of a parent patent, theyre most likely just pointing out this specific part of the patent tree for the lawsuit. The pokemon company is just looking to bully smaller companies as usual.
To be completely Fair on the art debate, a lot of the examples are just base concepts that people think Pokemon owns. Like the Wolf, the wolf is just a cartoon wolf, but it looks like lycanroc, because lycanroc is just a generic cartoon wolf with rocks. That being said this entire like lawsuit thing to me it's just awful. I don't understand how you can like patent the concept of riding animals.
The Anubis/Lucario comparison also gets me a lot, as they look nothing alike besides both being inspired by the Egyptian God Anubis, yet the fans treat it as though Pokemon owns the concept of a mythological god.

I'm gonna try to stay as neutral as I can here. One on end, yeah I totally agree that Pocketpair designed a lot of their "Pals" to be very similar to Pokémon's designs, but that can be said to be true about *any* "monster collecting" RPG game with an anime art style. I do think it's pretty scummy on Nintendo's part to update their patent details only *after* Palworld's success as a competitor. Also, if "ball/object capture mechanic in open world game" is the problem then Pocketpair can easily just remove "Pal Spheres" altogether and just have you befriend "Pals" directly. Lastly, the patent over mounting creatures to ride around an open world is really dubious at best in my opinion. Does that patent mean Nintendo can literally sue *any* developer that made a game that features a mounting mechanic or does it only apply in the specific context of the mount having been something you've had to capture/tame?
Minecraft for example has animals that can be used as mounts like horses, including undead variants, donkeys,mules and pigs, those are the animals that players can ride, considering that Minecraft is a game that is popular,it would be funny seeing Nintendo trying to use Mojang for having rideable mounts

For me it opened my eyes that patents exist for virtual mechanics, i.e. for video games and gate keeps game mechanics like yourself said. Plus in worst case scenario this can lead to other companies doing the same.
From what I've heard/read is that copyright law is a nightmare to actually enforce unless you can outright confirm that some things were straight up copy&pasted. So even if Nintendo could win a lawsuit over the copyrights, they may not want to engage in a legal struggle over several years (like seriously some of these lawsuits took over a decade until they were just settled out of court). But I agree, that if Nintendo wins this it may give us a really bad precedent, so I don't want them to just win even though i feel like Palworld did cross some lines with a few of their designs. I hope they can find a compromise out of court, but I think that is just wishful thinking.
Nobody cared when PalWorld was announced 3 years ago in 2021 with the same mechanics even before the original Patent was filed.

There’s suing because of the mechanic of capturing creatures in balls that’s the main reason they’re trying to trademark that mechanic which if you ask me it’s pathetic you can’t trademark a mechanic you can’t do that this whole thing is just a waste of time if you ask me Palworld is probably not going anywhere if they do get shut down I’m just not going to acknowledge Nintendo because they’re just throwing a hissy fit. Honestly, I think if Pocket Pair were to win the lawsuit, it would set a worse precedent that a smaller company could make big money by infringing on copyrights, but making it legally distinct enough to get away with it. Hate Nintendo or Pokemon all you want but don't condemn the creature designers who had their work so obviously stolen, but are powerless to fight it because of the barely legal distinction. The designers are not the ones filing the lawsuit, they are not pushing hard to meet deadlines that result in sub-par games, they are simply artists. Yes I know the lawsuit isn't about the obviously stolen designs, but it would have been if it weren't for the legal distinction, the patent lawsuit, in my opinion, is only happening instead because they can't sue for copyright infringement. Yeah this could set a precedent as well, but I don't think Nintendo or Game Freak will use it on anything else unless it's a company that does the same thing as Pocket Pair. So all your other indie monster catchers that didn't obviously copy designs, are safe.
Honestly I feel like if either side just wins we gamers loose. If Nintendo wins then it may scare off some smaller developers from actually making good games and even if Nintendo doesn't sue everyone they could sue, there could be other big companies who suddenly try to make extra money with these kind of lawsuits. But if Palworld wins then the scenario that you describe will likely happen. Overall I'd say the best outcome would be an out of court compromise where neither side fully wins.
Respectfully i disagree. In no way would palworld winning set that precedent, there is a difference between copying, inspiration, and using the same source material. Heck if anything that "precedent" would have been set when Pokemon almost 1 to 1 copied Dragon Quest or when Digimon, Coromon, Nexomon, Temtem, Etc popped up. This is not for the Artists this is because Sony was partnering up with PocketPair to expand the Palworld IP and Nintendo benefits greatly if they can crush potential competition while its still small AND deal a blow to Sony, i also dont know why you have so much faith that Nintendo would not abuse this if they win considering what Nintendo has gone after people for in the past.

Palworld though is plagiarism that did just enough to be legally distinct, not inspiration. Now as for Nintendo going after people in the past, to my knowledge they only have gone after people making fan games for profit, they rarely bother with non-profit fan games. And if Nintendo wanted to crush competition, they would have gone after every monster catcher, cassette beasts, temtem, farmagia. They have not and will not. Farmagia being a good example of a monster tamer that they are fine with, considering it not only is coming to switch, but it got featured in a direct which means they know of it. Also pointing out that anyone who uses the dragon quest argument is just another person with a hate boner for pokemon and nintendo, those are the only people that ever use that shit when it's fairly obvious that it's a case of inspiration and not plagiarism.

sorry, i have to disagree with you in a small part. around 12:30 you say that palworld fans are mad at nintendo to not making "games they find interesting" and that's not accurate. people is burnt with nintendo because there's been a lot of anti-consumer tactics (such as the WHOLE joycon drift issue (which nintendo denied but at the end they had to admit once court was starting to rule), the whole game being just unfinished (such as sun/moon // ultra sun/moon) AND the insane amount of performance issues (present on scarlet/violet) for a full priced game. but not only that, they took the stake against the fans as they took down SEVERAL hackrooms websites that literally had nothing to do with piracy... and then the "piracy" concerns at taking down emulators (Which btw, are legal) instead of taking down the pirated games which would have been the better answer. (remember that with DMC and copyright rights you can make them vanish quite easily). also the whole switch being underpowered AF, it has been proved that a linux distribution running a switch emulator IN THE SWITCH performs 2-2.5 times better than a regular switch itself which -if you ask me - is just testament of how anti-consumer they are because they had 7 years after the release to optimize it and they just did not. palworld issue is just the last drop... because it is an anti-consumer tactic because they are ilicitly trying to smash the competency, it's a monopoly tactic (don't forget that temtem is made by a spanish company and laws are quite different here in spain, if nintendo tried to sue temtem nintendo would be swept into a trash can, not only because spain laws but also EU laws but on the other hand pocket pair is japanese company). and beyond everything they are just a shame themselves. japan is known by their honor code, but ilicit and unetic tactics are everything but honorable, while they make certain sense in a bussines scheme (and i say "certain" because the consecuences are allways paid by the consumer, so by definition they are an anti-consumer tactic) they don't make ANY sense if you hold the "honorable" title. and to ask if they love pokemon/palworld i don't understand where you asked for, because both in fb palworld and reddit groups there allways are polls (in fb a new one shows up every 4-5 months) and the results are the same, people (me included) love palworld and used to love pokemon before it became a moneygrab and run. for example i can tell you that my absolute favorite games are diamond and Legends:Arceus. and i love the absurdly amount of shenanigans you can do in palworld. X is a weird world because it's not the same kind of engagement that the other two allow. your opinion about palworld being unable to innovate should be applied to the pokemon company too. they spent the last 20 years doing the same, they copied digimon's temporal evolution... they don't even care about what issues people are getting in their games XD whilist poket pair is allways listening to the community and tweaking even the tiniest of the details even if it will take collosal amount of efforts to do so (such as the seamless world update in the craftopia game, which was 100% unnecessary but they rewrote THE ENTIRE game just to give us what we asked for while at the same time keeping up with the regular updates (so technically they developed 2 games at the same time) and they allways have been transpartent about their ideas and they put the consumer first. they could have made palworld a "game as service" to get even more money and they decided they would not because it would have hurt the ones who purchased the game in the first place... it feels like you don't know anything about pocket pair and your opinion is just based on what media has portrayed them. i really really really have certain concerns about who you really asked about their opinion on palworld/pokemon liking... because it feels like it's absurdly biassed.
Hi, I appreciate this comment a lot! If you're concerned about who I've been asking, it was really just people that I knew played the game and I poked around on various social media sites as well. With that being said, since you're a fan of Palworld, I am very curious about why you like the game! ^-^ I see why you dislike Nintendo and those are very reasonable grievances to have! I also see that you're pleased with Pocketpair's handling of updates and feedback. But I want to know what about the game is drawing people to it that doesn't necessarily have to do with them being upset with Nintendo. So far, I have found no one who really could answer that and I found that... odd. But maybe you'll be the first! \o/

*I'm not trying to defend a multi trillion dollar corporation like Microsoft, but hear me out for a second.* First, It takes time to develop video games in the modern era. If Microsoft was to announce a brand new BK game today, most likely, we wouldn't see it until the next console generation. Secondly, Game development also takes a lot of money and resources, Like honest question how big do you want Banjo and Kazooie Thriee to be? Are we talking side project, AA, AAA because then it's gonna cost hundreds of millions to make and God forbid if it false to turn a profit just like Hi-Fi Rush don't get me wrong it was a critical darling game that people universally loved but unfortunately the game didn't make money. God forbid if that happens people will lose their jobs and none of us want that. Lastly, who's going to make it? the lead developers at rare said it them selves that they are currently not interested in making a sequel right now not that they don't want to but because they're busy with Sea of thieves at the moment, so most like Microsoft will have to out source it to brand new developers who probably won't capture the same magic of the original. All I'm trying to say at the end of the day is, it's not that there's a lack of interest in a Banjo and Kazooie franchise it's just the hurdles that it will take to even get a new game that people don't think about.
So, I like both Pokemon and Pocket Pair, but more or less share your sentiment. I want Pokemon as a legal entity to lose, so that Pokemon as a game can win. At the end of the day, companies will act in ways that are most profitable to them, and if they learn they can't bully their way into a monopoly, they'll just have to put more time and money into making the games good. I hope Pocket Pair continues to be healthy competition for Pokemon.
I desperately want Pokemon Company to get their head in the game and stop coasting with their mainline games. I'm a little worried that Palworld won't be enough to do that even still just because Pokemon is such a huge IP with products that span across multiple types. Would Palworld have to compete on all of those fronts in order for TPC to feel like they're enough of a threat to really change things? Dunno. They're already suing Pocketpair so maybe they've already been dubbed a threat. There's been rumors saying that the people over at Gamefreak are sweating because they realize their current method of making games is just not sustainable with the time given. So here's to hoping Scarlet/Violet are the last big disappointments for fans!

Interesting fact, CEO of pocket repair has stated that he previously worked with Nintendo I’m lucky he took away from it is that it’s just better to copy. Another interesting fact is that this whole thing is more than likely due to the fact that pocket repair is working with Sony, Nintendo has some serious bad blood with them after they went behind their back and made the PlayStation, so imagine Nintendo is pure unbridle rage seeing the company that stamped them in the back, help cultivate direct competitive brand to them. Lets not also forget that patents require the "invention" to be sufficiently unique/distinct/original; not obvious, consequential, or derivative. The fact that anyone let them patent "riding a creature you catch" or "catching a creature and adding it to your team" is insane. That's been done before Pokemon, it's been done long before 2021. That's lawyers/magistrates that are either completely ignorant on how video games work, or bought. Capitalists all about that "Free Market" until someone starts competing with them specifically, then suddenly it's, "Um, actually I did this _first_ so you're not allowed to, pay me."
This is a very good point! I've also heard the argument that the patents may not stand because gaming rules may not actually apply as patents but that feels like a ship that already sailed given that WB was able to successfully patent the Nemesis System.

It's very funny to me that there's a mod creator who implemented that feature into Skyrim and they weren't even the least bit shy about acknowledging the replication. The mod is even called "Shadow of Skyrim".

The weirdest thing about this to me is that David Wise has never commented on it over the last 29 years. You'd think he would have seen that name going around and provided a correction. Although maybe it ISN'T that surprising, since there was that one track from Halo that was left off the soundtrack and remains unnamed to this day.

A small note for clarity: When I was researching this, I found that Kannon's Klaim was referred to as the song in the Gameboy game Donkey Kong Land 2's Kannon's Klaim level and also was used as the song name for the level's song in Donkey Kong Country 2's port to the Gameboy Advance. I left out the bit about the GBA port because it felt redundant at the time to bring it up but if I were to do another edit of this vid, I would have brought that up as well (and tweaked some wording lol). I do acknowledge though that there's a chance that the GBA port may have coined the name first then people went back and started attributing the name to the GB game as well. There's an astonishingly small amount of DKL2 material out there so researching that was... difficult, to say the least, as most stuff redirects to the SNES game. Edit: I think Mining Melancholy may have gotten popularized later on because not many people were pushing for really obscure, niche knowledge like this back in the day. Definitely there were people that were doing that but not many. So no one had a name for the song for a long while. An extra trivia tidbit: In the JP version, this level is called Barrel-Barrel Mine!
I am firmly on team "Donkey Kong Land 2 is not a port" since Donkey Kong Country 2 exists as a more "true port" on the GBA (And the original DKC got released on both the Game Boy Color AND Game Boy Advance). I consider Land 2 to be more along the lines of a "Demake" Though I can see the Port argument, especially because Nintendo liked to use "Land" to signify that a game is for the Game Boy back in those days (Mario Land, Wario Land, Kirby's Dream Land, etc), so calling it "Land" might help people understand what they were buying. I think DKC2 was actively in print at the same time. I liked DKL2 a lot because it worked well with its limitations and didn't try to force itself to be a game it didn't have the power to be. Instead, it tried to be something similar, but different. Man I love these niche videos. I hadn't really even thought about early video game music having official names at all.
I never got to play the one on the GBA unfortunately but I've heard that one is def more of a port than the GBC version. I believe in that version, the song is also called Kannon's Klaim but I couldn't find much on it. My theory is that's technically been the song's name since 1996 but Mining Melancholy got popularized at that point and there was less of a push for really niche bits of knowledge back then. (But that's just a theory... a game music theory lol) I remember DKL2 being HARD. It def has a demake feel but I think that makes sense given the hardware it was running on!

Can you imagine a timeline where that petition went through? Nintendo would suddenly release their ENTIRE retro back catalog in a desperate attempt to keep their software out of virtual libraries.
There is a hack out called "Star Fox Adventures: Amethyst Edition" that allows you to play the full game as Krystal and also adds in some additional quality of life improvements. It is definitely worth checking out!
I'm mostly hoping I can still play it handheld and it's backwards compatible with all the games. Then I know most people DON'T want this, but I hope there are achievements added like the ones they have in Steam, PS5 and Xbox.
