    LMAO, she was probably ready to dismiss from the beginning. That’s why she didn’t care to hear Alan’s rant on fat people.

    In honesty, this judge was awesome. The sadder truth is that the defense would have won if they simply filed "wrongful termination," instead of "discrimination." The Harvard study would have pulled some legal weight but that is all up to the judge if they want to take on Harvard Law.

      I'm not a lawyer, but I think you are wrong. The law was on their side. She could have said: "you don't need to give your speech, I've already decided to dismiss the suit." Was it Harvard Law, or Harvard Medical?

      @@fstbr4 You are wrong. The law was on Denny's side. The grounds for a wrongful termination finding could be racial discrimination. But obesity is not a protected class. People may be fired for being fat.

      It's the law. If you don't like it, you can try to get it changed. The obese are not a class protected by anti-discrimination law.

      Likely dismissed as a matter of law. She would have read the arguments from the initial lawsuit and had a chance to hear the deposition in evidence. Since she was going to rule for Alan’s side, she only needed to hear the plaintiff as a matter of procedure.
