    **Update on charges at the bottom.
    Reckless driver cuts off another driver. The 2nd driver decides to pay him back by cutting him off, but clips 1st driver's front end. The 1st driver who started it all decides to throw punches and ends up getting shot 3x. If you listen closely, you can hear the guy who got shot yelling "Yo I got a piece" before throwing a punch. So, yes, the shooter had every right to defend himself. Another episode of FAFO!
    **The timestamp is wrong. I normally have it turned off, but just did a reset of all settings before putting it back in and never changed that setting. The real date for this was 11/19/23 at around noon est.
    Side note: the driver of the white vehicle that the shooting victim fell into was also shot by one of the bullets that went through the guy's arm. It grazed his head. THAT's what happens in these kinds of incidents all the time.
    **The Criminal Recklessness with a Deadly Weapon charge against the shooter was dismissed by the judge.

      And "To beat the man, you have to BE the man!" which is what one of our squad leaders in H 2/8 used to say (one of whom was thankfully, not my squad leader) you know the guys who walk around with their shirts off on ship in troop berthing passing-out leadership wisdom that they firmly believed in at high volume--that's how he was in a towel and shower shoes--there were weapons all over the place too, but locked-up and unloaded--and usually clean. I became a squad leader myself later, but if someone gave me hard time, I wouldn't beat the man--I tried once but it went badly for me--which made me: Not the man: I'd write them up or make them clean the ladder-well instead of a good drubbing--but was I still A man through those choices..? Who knows, but it's too late for me to walk around my shirt off now--the last time I had a six-pack was in troop berthing (I still have shower shoes but lost the towel--in fact, I put my clothes back on after a shower, skipping the towel and any motivating moments entirely).

At best 50 dollars and a handshake or offer to repair, at worst, a small claims court if there was expensive cargo inside. If it happened to me I'd be annoyed but not upset since that dude was doing what he should, standing his ground, and his life and his right to do so is more important that a small body-job. Repair places see bullet holes all the time, no biggy.

A new incident was created when they decided to leave their vehicle in the middle of a busy roadway and announce they had a firearm while blocking the van from the front. Then entered the van with the intention of great bodily harm.

    Around 1990 on the Vegas strip, a big black guy stopped his car, got out and was pounding on the roof and driver window of the car behind him. It was a middle-aged white poker player who carried a lot of cash. So he also had a gun. Fed up with the guy, he just shot through the driver's closed window and hit the rager in his heart. He dropped dead on the Strip. The DA felt racial pressure to charge the white driver with murder. Jury said not guilty. He was sort of shunned by the poker community after his acquittal, though.

      Oh and you can only use the same amount of force in Texas, so since they didn’t produce a gun the shooter would still be arrested without the third party being injured. Though it Could be debated by a lawyer if the shooter was a female vs 2 male attackers. Moved from Pennsylvania to Texas. The laws are so similar but also very different at the same time. Gotta stay up to date for each state if u carry.

      @@immachine1565 yeah I’d say in this case self defense is thrown out of the window because they provoked each other, but under the castle doctrine/ stand your ground in Texas and Pennsylvania you don’t have to retreat in your vehicle. Even if you have an escape, but the cops/court will question it. As the first guy said though the shooter was only arrested for the innocent third person. Law is tricky because everything is about how it’s interpreted instead of right vs wrong. Plus you have to include case specific variables. A good defense would probably have a field day beating this case.

      Not true, a state trooper in Colorado watched a guy get out of his truck come back to my truck and throw a coke can at my driver window. I got out and knocked him out and they charged me with the assault. You are only allowed to be a victim. Society will only allow you to be a victim.

      Not completely true. I did have an incident in Summer of 2022. I did have my family in the truck. Instead of allowing my pursuers to get to my truck and potentially harm my family, I got out of my truck unarmed, and stood my ground next to my truck and allowed them to approach me to that point. I am a shooting victim. Shot 6 times in 1994!
      However once I got to court, I explained my actions and why I stepped away from the truck. It was in effort to further protect my family. I was not the instigator in my situation. I was the final word however! I was found not guilty of all charges. I am normally a passive person, but that doesnt mean I will always turn the other cheek!
      It was a scary situation. Each person needs to evaluate their own situation and decide which is the best course of action for themselves. One must consider, is a lifetime in prison worth saving your wife and daughter!

If not, then it depends on how it was being used. In Louisiana, when they guy woke up, the cop would've said something like, "You learn anything?" while cuffing him.

      For example in Hawaii, you can only match force with an aggressor unless it is in the workplace. If in the workplace you do not have a duty to retreat first. Even then you can only match force. If someone has a baseball bat, you can only use a baseball bat also to defend yourself.

    This was in Ft. Wayne, Indiana on 11-19-23 at the intersection of Lake Avenue and Maplecrest Road. The assailant was shot twice (arm and shoulder) while the driver of the uninvolved white vehicle that was used as a backstop was also wounded. Everybody survived with non-lifethreatening injuries. The driver of the red van, 42-year-old Jason Henkle, was charged with criminal recklessness with a deadly weapon while the assailant currently has pending battery charges.
    UPDATE: 12-20-23: 42-year-old Jason Henkle has been cleared of criminal recklessness with a deadly weapon after shooting 19-year-old Alexander Mozee in a road rage confrontation. Henkle’s charges were dropped following the emergence of video evidence confirming his claim of self-defense. Mozee is still waiting for his court date for charges related to the incident.

    Many years ago I worked in a warehouse in Nevada with an Italian guy from New York. He was one crazy dude. He was 6', 4", 300+ pounds and a Vietnam Vet. He came into work one day and shared a story of a road rage incident that happened to him. He was driving on the freeway, and this dude cut him off, so he pulled up along side him and gave him a dose of New York hospitality, complete with swearing and middle finger pointing. He said they both engaged in this behavior for a minute until the other guy faked/feigned swerving into him. This really pissed off my coworker, so he grabbed a bottle of aspirin lying on the front seat, opened his side window (drivers) and hucked the bottle up over his car at the other car. It struck the other guy's windshield and shattered the windshield. The other guy pulled out a 45 and emptied it into his car. He wasn't struck, but he said he was a changed man. He said he would never, ever, ever pick a fight with another driver again. That was 1980.

    Indiana is a "stand your ground" state without duty to retreat. The attacker said he had a "piece" and threw a punch at the driver. Deadly force was a reasonable response. And that is why the judge dismissed the charge.

      There is so much truth to this. I watched something similar happen a few years ago on the way to work but no shots were fired. Some kid in a mustang was driving like a psychopath on the highway passing people going at least 110 because I was going 80 and he passed me like I was holding still. He passed me and about a quarter mile in front of me a guy was simply changing lanes to pass the cars in front of him, signaled just fine, waited for a second and merged and the kid almost plowed into the back of him. Kid passes this dude on the shoulder then slows down to a normal speed. So I'm thinking I know exactly what he's gonna do. He's gonna be a dick to this guy.
      So the mustang kid commences to brake check this dude about 5 times and then the kid stops his car across both lanes and gets out starts coming at the dude gesturing for him to get out and do something I guess. So I pull up behind and wait because I can't get around them. Dude gets out the car and pulls out a whole ass 6 inch magnum and that kid looked like he dropped a load in his pants. Got back in his car still talking shit and drove off.
      I gave the dude a thumbs up and we went about our day.

    Great video showing the entire incident and before, so we have complete perspective. It was pretty clear red van was unhinged from the start. The sideswipe after refusing to let them into his lane was enough warning that they aren't a normal person. Running up to them with your fists flying earned him a brass award

    Scenarios like this are why I stopped reacting to road rage myself. Part of growing up is realizing that just because someone is having a bad day and decides to take it out on you with their driving, isn’t worth your life. Believe me, I still get very upset at times but keeping scenarios like this in the back of my head are a great reminder of why it’s not worth it.

He's watched too many videos online of gangsters cutting up through traffic in a dangerous manner and thought he was 'that guy'. Moral of the story...       I flipped off a guy for tailgating me once and he and his passenger followed me for 10 minutes. They cut me off forcing me to stop and tried to approach my car three times. I finally found a well lit parking lot (This happened at around 2am) and just drove around in circles until they gave up and left. I don't react to road ragers anymore. You never know how far a random asshole might be willing to escalate something.

      Literally part of the ccw course training. You gotta be a verbal punching bag and be absolutely in control of everything you do or it becomes your fault. If he had let it go and dude kept brake checking him or blocking him, and then punched the window it would be different. His little "revenge" move could and more than likely would be considered creating a problem in which deadly force was then used to get him out of.
      Edit: watched it a few more times and it's hard to tell how, but the passenger window of the white suv shattered...either a shot went in or the dudes elbow broke it or maybe both. Gotta know the backdrop cause he coulda just smoked the innocent guy next to him just because he wanted to shoot the guy
      2nd edit: found the story (google: red van road rage shooting) and he did infact hit the white suv with one of the shots. Shooter held on allegations of criminal wrecklessness with a deadly weapon and the car driver could be charged with battery.
