The law should be made clear-if you enter a home that is not yours, you are a criminal and get arrested and removed. Too much of this squatting going on.
what comes into my mind is how come anyone in the house that has no legal right to be in is not charged with burglary? in nyc if it is a home it is a felony if it is a commercial establishment it is a misdemeanor. how come squatters are not charged accordingly ?

In New York City they have 631 of THE REAL PROPERTY ACTION LAWS that makes it easier to EJECT SQUATTERS.
But the owner cannot go to HOUSING COURT. They have to go to The New York State Supreme Court Special Term Part for an Ejection Action against the Squatters.
I use to file the action for my clients and immediately file A Petition for AN ORDER TO SHOW CAUSE AS TO WHY THEY SHOULD NOT BE EJECTED AS A MATTER OF LAW.

After going through a long, painful, and expensive eviction process, the judge had me pay the squatters b/c I had failed to perform the necessary repairs. Housing courts are SO tenant friendly that they consider squatters “legal tenants” in NYC if they can show they lived on the premises for more than two weeks. I am not kidding. They don’t have to pay anything or have any documents/leases to be considered tenants; they just need to show they have lived there for two weeks, and squatters are entitled to the same perks legal/paying tenants would be. Makes NO sense to me.

Your house does not get foreclosed for a single missed payment. You mortgage has to be 120 delinquent before the process can even start.

This is absolutely crazy. Why is there not a simply law against anyone living in a house that they do not own or are not renting? One phone call to any police department in any city in the world ...and it is the police's responsibility to show up at the door and remove ALL squatters. It doesn't matter what time of day or what the weather is like. But it would be good for the neighbours to make the call to the police before a ton of furniture is moved in.

That's usually the best measure because cops show up and say "It's a civil matter". Then throw all their stuff out and let the squatters take you to court. If they don't have the money for rent, they don't have money for a lawyer.

Vacation rentals and corporations buying all the residential properties is putting a strain on rental and biying markets.. If you want to see housing become cheaper, then what needs to happen is the red tape for affordable housing needs to be trimmed down *a lot*. It's a situation made by government, and people are demanding that government make more legislation that will inevitably make things worse.
Inb4 the "So you want buildings to be unsafe?" replies: The rules and regs that make buildings safe can stay. The rules and regs that make buildings accessible for the handicapped can stay. The rules and regs that make it impossible to build a structure because some random ordinance from 200yrs ago is still in place? Those need to go. Examples include the ordinances that 'preserve' the skyline of a city, or the ordinances that restrict where an apartment can be built (except those for safety and health reasons), or the ordinances that specify who can actually build and who can't (these protect certain investors while forbidding outside investors). Heck, there's even ordinances that specify the kind of apartments that can be made available, and some that even set minimum sqft requirements (these prevent studio apartments from being built, which hurts lower-wage earners).
@@Tank50us Bullshit. I have 3 degrees, work in healthcare and cannot afford a home in my area. My rent went up 15% if I want to renew my lease. No one got a 15% raise. The market has been artificially inflated by places like Zillow and investors. Saying people choose to be homeless is a sign of your privilege. While yes, there are some who chose to remain that way (most with health/mental health issues), very few do it by choice.

The point about having degrees, is that according to people like you, I shouldn't have any issue paying for housing. Except that's not true. The state I live in has a very high cost of living. The company I work for is based out of a state with a much lower cost of living. Which state do they based their wages on? Their home state. This is the model many companies use.
Furthermore, the housing crisis is, in large part, caused by the investors who have been driving up housing costs for the last several years. Buying up all available housing to jack up the selling price when the house itself isn't worth that much not only effects home buying, but it also effects renting simply because people need a place to live. If there is no inventory in your price range to buy, you have to rent. So rental companies can charge whatever they like and call it "market" value. Hence my huge increase this year.
Thanks to companies like Zillow, who is now dropping like lead balloon thanks to the practices noted above, the housing market is not running parallel to wages by any stretch of the imagination. Add to that the high cost of even APPLYING to a rental and too many people can't afford to get sucked into it. A nurse I work with moved from DC. She said the cost of living here is as expensive as there. And that she and her husband spent more than $1800 on application fees to find a place to move to here. How many of the people you're claiming choose to be homeless have an extra $1800 sitting around to waste on application fees? Hell, I don't have that much I can afford to throw away on applying for a place I may or may not get, which is exactly what happened to them. There is so much competition for these places that you have to apply to be considered, but your money is not refunded if you don't get the place.
That you are so clueless as to the actual housing crisis baffles me.

It’s crazy to me the ethereal thinking of just walking into a random house and saying “ yup, this is mine now”.
This happened to me and husband - it was hell- they were big time drug dealers - they’re out because he went to jail.. it’s a long story but it was horrible.
We need to change the law so that the minute you know someone is squatting on your property you can have them arrested and kicked out immediately. The way they have it now is that they are allowed to stay and you have to go through an eviction notice, all this takes time and since these squatters know they are going to be moving they leave you with a house of horrors with damage to walls, carpets and steal whatever they can in the time they have left.
Laws are written for lawyers. Court cases mean more money for lawyers. It's a racket.

It's not a race thing. Squatters come in all races. There's another case that recently happened in Riverside, CA that involved white people. This story took place in a neighborhood with a higher black demographic, which increases the likelihood it would involve black people.

Lol yet in Pasco, Polk, Pinellas counties there have been more than a few squatters in the news. The home owners had to go to court to evict them. Cops said thier hands were tied. Not sure how it works in other Florida countys.

Agreed. I think it’s original intention was good, to protect the poor from quick evictions or destruction of “shanty” towns, but it is outdated and abused to the point it defies common sense.
1 major problem is cops cant get involved if squatter pretends to be a renter by writing a fake contract and a few letters they mailed to themselves in the mail. It now becomes a civil issue and cops will now need court ordered documentation to remove them! Costing the legal home owner more money on top of the damage they created while squatting. Trash out cost for all the junk they leave behind could be 500 to 5000 dollars. I've done quite a few. The easiest way is to keep cameras on your empty property. As soon as they come in you have to get them out. Good thing for wifi hotspots from your own cell service provider. Sad to say I've done that aswell on empty units. 1 camera outside and 2 cameras inside. Owners don't know of the problem usually until it's too late! Once they have the issue they quickly opt. For the cameras while vacant. Remember to post signs you are recording live so possible renters dont get upset while viewing, but if you see them now you have to second guess the surrounding area you are planning to rent in. And the circle continues spinning?

In my state, a person has to continually occupy a home for 15 years before they can claim "squatters rights".
Most people who own a second property to rent out are not rich people. They worked very hard and invested their money into property. Many are still paying a mortgage on that property themselves. Squatters or a bad tenant could ruin them. The government should stream line laws to help get these thieves out.
Another shinning example of black parenting and black culture
A family in my neighborhood sent on vacation. A week later, they got home and learned that a family had moved in. 6 months later and they're still trying to get their home back.
I was on a rehab job of a big old ship captians house squatters got in there 5 of us went in there with baseballbats, no more squatter trouble.

The squatters laws need to be done with. This happened to my grandfather. He was in the hospital for 2 months after getting surgery on when he returned to his house the locks had been changed. The cops told us there was nothing we could do because my grandpa didn't have keys to the house and all the ownership papers were inside of the house with the squatters. It took us almost 5 months to finally get into the home when the squatters were not there. When we finally got in most of his personal belongings were gone probably sold or sent to a pawn shop. Homeowners definitely need absolutely more protection from these criminals. This can literally happen to anyone you don't even have to be gone for weeks at a time this could happen to you while you're at work.
