The judge listed things his lawyers have done wrong so he can come back and say he didn't have adequate lawyers representing him, they didn't properly do their job or something along those lines.

      @@gern5168 and this is probably why the state made sure the judge asked him a bunch of questions and let him know he is giving up rights. (I can’t remember the word for what the state asked the judge to do 🤣🤦🏻‍♀️). The defense objected to it but the judge did it anyways.

    She reminds me of the judge in the Arbery shooting. He was patient until they tried to take advantage of it. This is how the system should work and we need more justices like them.

    I have been appalled at the defense attorneys in this case, especially the lady in pink. She has had HORRIFIC behavior this entire trial and the judge put up with it so much linger than any other judge would. She needs to be punished for her behavior during this case.

      Seems like a catfight honestly. I heard the judge mention that the defense team has done some things that she didn't like previously, but as someone who hasn't really been paying much attention to this case outside of this and one other video ; it makes it look like the judge is far too emotional and rude to them just from this clip alone.

      @@kita476 No, this whole thing is about seeking the death penalty. The State of Florida decided to seek the death penalty. This phase of the trial was not necessary. Florida could have had him in prison for the rest of his life years ago when he confessed.
      Now, because _all_ death penalty cases get automatic appeals, he'll be in and out of court for years. Every few years you'll see his face again as the appellate lawyers file appeal after appeal after appeal, each winding through the court system to the Florida Supreme Court.
      This all about the prosecutor scoring political points for the next time he has to run for office.

    This judge has been tolerating so much bs from the defense this whole trail. I think she deserves to stand up for herself for once. I don’t understand why people are saying she’s talking down to them. She’s just trying to get a point across that they have been wasting everybody’s time. I would definitely not want to be part of the jury cause just imagine how many times they have to leave their jobs, families, etc. to put up with this nonsense, it’s absolutely uncalled for.

      The judge is impatient and unprofessional. The defense is allowed to pursue the case however it sees fit. The judge cannot tell them they have to call witnesses, the judge cannot tell them they are not allowed to rest their case when they want.
      This is a death penalty case. The lead defense attorney is a specialist capital defense attorney. If you think the defense attorney is unprofessional, you don't understand how a death penalty defense is normally conducted.
      The judge is throwing a fit. She's acting like a child simply because the defense changed its mind earlier. The defense is under _no_ obligation to kowtow to the judge. The judge ought to just accept the defense's decision and call on the prosecution to take up the next phase. The judge is mad that the schedule changed a bit in a _years_ _long_ penalty phase trial. A couple of days, and Judge Karen wants to throw coffee at the help.

      @@AndyCutright The defense has to follow the law & standard court procedures. They were present their case; they had a long list of witnesses they hadn't called yet; both the judge & prosecution were waiting for them to call their witness then the most incompetent lead attorney I've ever seen suddenly announces the defense rests. Even her own team looked shocked. The judge was right to speak the way she did. If there is a successful appeal in this case, it will be based on inadequacy of counsel because of all the F'ups by the defense.

      This is the penalty phase so it's even worse they're just trying to keep an L off their record in a death penalty case its not about helping their client.
      Now if it was about feeling the judge was biased against them in an actual trial and they were trying to get an objective mistrial as a way of judge shopping, I wouldn't like it but I could at least respect it as it's in the interest of their client. But he already pled guilty.

      Unfortunately, Judge Scherer no longer rocks. At least from the bench, that is. She was publicly reprimanded by the Florida Supreme Court for the way she handled this case. The supreme court ruled that she viloated several canons (rules) for how a judge is to behave, and further stated that she displayed obvious bias and partiality to the prosecution, even goin so far as to hug the prosecution team and the victims family members when the trial ended. I understand Judge Scherer's actions. She's a parent who empathized and felt great sympathy for the parents who lost children when the crazy a**hole Cruz entered Parkland and murdered 17 people, mostly children. Anyone who has children would sympathize with the parents whose children were brutally murdered that day. She lost all her credibility as a fair and impartial judge and at the end of June of 2023 she retired from the bench.

    I watch trials on various channels & I have to say I have never seen such disrespectful council, primarily defense, before. They don’t stand to speak to the judge. They talk over her continuing their position when she tells them her rulings.
    I hope this doesn’t become the norm.

      @@Teddymac86 The defense has the right to rest its case. They are under no obligation ethically or legally to continue calling witnesses because the judge says so. If they wanted a mistrial they'd ask for one as they did a couple of months ago.
      They have one job: keep Cruz off death row. Cruz is going to prison without any doubt. Their goal is to keep him from bei g executed. They have one strategy to keep him off death row: preserve the record for subsequent appeals. This is how death penalty defense cases are fought. They are unlikely to win this round so the have to prepare for the next round.
      There's nothing to be gained from a mistrial at this point. He's already in jail and headed for prison. Delaying the penalty phase doesnt help them one bit. It doesnt help Cruz. The defense isnt working to keep Cruz entertained. Thry arent trying to give Cruz a few more days in a courtroom. They just want to keep him off death row.
      Clearly they feeel the record is ready for the upcoming appeals. That's why they rested. There's no tactical benefit to be gained from a mistrial. But please enlighten us how a mistrial is something they want and also how exercising their right to rest their case is at all grounds for a mistrial. Or even how that would work? You think the judge is going to call a mistrial now? For what reason? And please explain the legal foundation for this mistrial they're seeking ...

They're making a joke out of the life of a school shooter and he's loving it. The more entertainment he can see the better, it will feed his ego even more feeling like he's in some kind of movie where he's the villain. If we lived in a perfect world? This case would've been over YEARS AGO and this man would be serving his time without any of this BS and the only entertainment he gets is within his prison cell and the prison itself.

The defense team is led by an experienced death penalty specialist attorney. She has zero interest in a mistrial at this point. If she wanted a mistrial she would have asked for one. But she didn't. She rested.
      The judge isn't going to declare a mistrial because there's zero legal basis for it at this point. The prosecution isn't going to ask for a mistrial because they're going to win. Please stop parroting legal phrases you don't understand. You have no idea what's going on.

    "We're not playing chess!" - that part made me laugh, this lady is clearly sick of their BS! As if there should even be a long drawn out trial for this piece of trash in the first place. What could his defense possibly help with at this point? 100 years + life in prison? or 50+ years in prison + life? Either way the guy is never going to see another day outside prison walls. Give him a public defender and plead for his life, and even that's helping more than he deserves.

      Thus far, I have seen no defense! He needs a defense team...he has none! Kruz is clearly mentally and emotionally deficient! Thus, why doesn't he have an attorney to argue that? I have not seen, nor heard any defense argue that! No, I do not feel that his actions are acceptable; however, his actions are/were not those of an individual who is of sound mind! He has difficulty expressing himself and his behaviour is not that of a mentally healthy and functioning human being. Yes, the are issues that should have been addressed long before this tragic event! The death penalty is NOT the answer for such a mentally deficient individual.
      Furthermore, all I have seen in this trial are friends and relatives of the deceased reading letters from survivors of those who were murdered. I have not seen, nor heard any true prosecution or defense on Kruz' behalf. Quite frankly, I have never seen, nor heard any judicial process quite like this!

      @@AshA-ww8hc wrong for multiple reasons- he has already been found guilty so this would not be a mistrial as a verdict was already given. The Jury was also not in the room for this so this would not be eligible for a mistrial and lastly in death penalty cases if the penalty is given they are automatically given an appeal. That argument would make sense if they were not in the sentencing portion of the trial.

    Judges are required to maintain order and decorum in the court room when proceedings are underway. Having respect for the jury & their time is important as they fulfill a civic duty. I think she handled herself very well and the defense atty is lucky she was not sanctioned or referred to the State for her conduct.

      The major issue is she has now created an appealable issue which means this case isn’t over and there could possibly be a new trial because of the way she acted

      The judge is not a god. The judge doesn't get to dictate how the defense conducts its case. The judge is going off the rails because her schedule has been slightly changed. A day or two out of months and months of a very complicated death penalty case. The judge is the problem here, and has been since the beginning. She lacks the temperament for this sort of case. Death penalty cases are long and generally tedious because the defense must establish a record for appeal. This means the defense is going to object repeatedly about as many issues as possible. The judge should understand how appeals work, but it's not clear she knows what's happening. If the judge can't handle a drawn out and complex defense with a lot of interruptions and twists, the judge isn't suited to be sitting in that chair.

    “Unprofessional” is the most common word used when describing the defence lawyers with the two most notable being the two female lawyers seated in the middle of the defence table. If I were the judge I would have cautioned all the lawyers that grandstanding and unbecoming behaviour in such a high profile and significant case would result in contempt charges. And then I wouldn’t have hesitated to do it, especially to those two defence lawyers. Totally disgraceful behaviour.

    Edit: my apologies for using the wrong ‘council’ instead of ‘counsel’ and thanks to those who corrected me in the replies.
    This judge is absolutely right. I’ve only been an attorney for around 4 years and I haven’t even followed this case super closely which blows my mind to realize how much unprofessionalism and how unprepared these attorneys have been. I understand this is a stressful very long trial with hundreds of people who have been negatively impacted by the incident but good god she is right.
    Every day further this goes on she is adapting and changing to fit each individual council’s mistakes, unpreparedness, and often times tardy schedules. To be honest with you I am amazed how well she has kept together throughout all the bs she has dealt with from both sides of counsel.
    I have seen counsel question and/or disrespect the judge several times throughout this trial be it directly through disagreeing with her rulings or showing up late because of them as she pointed out.
    Good for her for straightening out that courtroom because it is her court. I don’t think I know of any judges that would have allowed or taken everything she has all this time without reaching a breaking point sooner and taking ahold of their courtroom.

      @@jennygater7775 I’m so sorry this is going to be a very long reply.
      To be honest I’m not entirely sure. Everyone has a constitutional right to have an attorney appointed to represent them should they not be able to afford it so that is what I believe you’re referencing when you are asking if the attorney is appointed by the state and I’m also not entirely sure who is paying for Mr. Cruz’s council but I have never heard of council provided by the state having more than 1 attorney appointed for 1 case. I could be wrong because this is a very big case obviously so I guess maybe it is possible more than 1 attorney was appointed by the state to represent him because of the magnitude of the trial.
      This being said, I do remember reading about something back in may of 2019 that the judge had rejected the public defenders request to make Mr. Cruz hire private council so I will be making the assumption the attorneys are in fact appointed by the state.
      Regardless of a private hire or a public appointee, they are still defense so it is their job to do all that is in the best interest of the defendant. This includes challenging the prosecution (who are the attorneys seeking the charges on behalf of the state) and the judge her/himself to maintain the defendants fair treatment.
      This being said, that has not been the case. Challenging a judge’s decision and disrespecting the judge are 2 very different things. These defense attorneys have disrespected the judge several times when the judge has been VERY fair to both sides of council this far.
      But to answer your question, though these defense attorneys aren’t operating on behalf of the state that is the reason even public defenders will sometimes challenge a judge if they feel something is unfair.
      So basically what I’m trying to say is there is no extra significance for challenging a judge simply because council is acting on behalf of the state or via private council. So in conclusion, there is absolutely 0 reason for an attorney to disrespect a judge, regardless of who they represent.
      Judges are an unbiased third party that have the responsibility of ensuring a fair trial for both sides so this further explains disrespecting a judge does no good because the judge isn’t on one side or another they’re the middle ground.
      Sorry this was so long, it is hard to answer that question thoroughly in a short response. Good question!

      @@debbysalmon2498 Well every case is very different in their own individual way but I would say no, this is nothing like what one would consider a 'normal trial'.
      I would say the length of the trial is more rare but certainly possible. But taking the jury to a crime scene is not common practice that I'm aware of. Put simply, no; nearly everything I have seen in this trial would not be considered normal.

    A huge part of legal proceedings is natural human reactions and psychology. It is so unprofessional as defense attorneys to behave this way which could subconsciously tarnish the judge’s view of the defense in general leading to the client receiving a harsher sentence because of how they presented themselves. (even though his outcome has never looked promising)

      @@sA-ny2jl I see, I haven’t been watching all of it, but if your witnesses are helping the prosecution something is wrong. I majored in Criminology so my opinions about the DP and criminal defense are different but there is so much to be discussed about how complex the brain is especially when trauma takes place before and after birth. They could have kept their witnesses only to present scientific and expert testimony and left the personal accounts of his aggression alone to show that he has some biological factors that led to his behavior. With things like this I always believe: Understanding the root cause of a person’s behavior is NOT excusing them.

    The McNeil defense lead (lady in the pink) has been nothing but disrespectful to the judge since day one. I watch a lot of court trials and I’ve never seen a defense attorney be so rude to judge before.

    Defense probably didn’t want the State to question Zach and Richard on their tv show. It’s probably a tactic of the defense to leave the rest of the witnesses to the appeal if it happens.

      You need an extremely good reason to introduce new evidence on appeal. Usually, it needs to be evidence that you couldn't reasonably have introduced at trial. If you just hold back evidence strategically then you are stuck with that decision.

    I hope that if people need defense lawyers they don't choose these. They sure to lose their cases. It is absolutely disgusting behavior from Mrs MacNeil and should have some kind of punishment for it. I have watched this trial right from the start and she was extremely rude on many occasions and that should not be acceptable.
