    I don't see anyone mentioning how brave and smart Keri Ann was. At 13 to have the presence of mind to go into the slide tube and hide was the best thing she could have done and it saved her life.

She did say she was buying for both kids that day at the store (if I remember correctly) and he wasn’t the father of the other child? Please correct me if I’m wrong, I didn’t think she was. But I agree, it was just an awful, horrific story..

      @@TUDGAF it’s not just America. Just heard about a case in England, where a mother was literally trying to sell a baby and she only got probation. She also had a history of child abuse, where one kid was found in a makeshift cage at two years old, and another one escaped out of his house through a 6 inch gap in the window and fell a couple stories, and the kid was only four years old and ran and was found wandering the streets. They put the kids back in their mothers custody. After seeing a baby in a cage.

      There’s a case in the UK right now and the Mother has left her little girl with several men freely after knowing them just days and weeks, the little girl calls them Daddy after weeks even though she has a real Dad fighting for her in court but the court keep siding with a corrupt and broken social services as they have a vendetta against him. This little girl was admitted to hospital with bruises all over her and a fractured collar bone and the social services are attempting to give the little girl back into the Mothers care. The Mother has a social worker as a Mother. You see the problem

    As an Aussie I have watched a lot of videos of this horrific case! However you Annie have delivered a more in-depth coverage than any other video I’ve seen! Thank you! I can’t help but think that Rain is cognitively challenged with an inability to comprehend the danger she placed herself and her kids in. Not that this excuse’s the neglect of her children! She had already abandoned her first child, never to speak of her again! This is a woman who should never have had children at all.

I will never ever understand why she would have a series of kids yet neglect them severely, abandon them (her first child), and then put them in an incredibly insanely dangerous situation like this - the mother knew she shouldn’t be trusting some random man with a van buying ROPE and taking a little girl alone repeatedly into a dressing room ffs. She also sounds very odd on that phone call - I wonder what else was happening. So tragic for this little girl.

    This is one of the cases that has stayed with me for years. Especially the medical examiner testimony. I don't know how anyone could defend the mother for one second. Not only did she not protect her from a man who was giving her plenty of reasons not to, she let Cherish feel comfortable with him by her own actions towards him. She let Cherish feel comfortable enough that she could be alone with him and leave the store. If the mother was concerned, Cherish would of felt it. Also, when calling 911, she said she hoped he didn't kill her bc she didn't want to be one of those parents..that goes to prison. I think this video is unnecessarily understanding to her when this never should have happened.

So she had a somewhat functioning inner alert system. But she then did put it on ignore, and I presume that he did so openly approach her, showing his id even. That was likely making her doubt her initial instinct of something was wrong. If she had a bipolar diagnosis she had probably heard more than once that she was ridiculous, rude etc for having done things out of an emotional reaction.

      Failed her in many ways. The mother was clearly mentally ill and unable to properly care for the girl who should've been in the care of her father. He had a stable life to offer her but was denied custody.
      Most importantly, this evil criminal should've been locked up for life. Instead, the system allowed him to be free to re-offend again and again.

    My mother is bipolar. When I was 8 she left me in the park and didn't come back. Luckily my father eventually found me at dusk. I had been too afraid to leave the park because we were in a strange city so I had no idea how to walk back to the house we were staying at.

      Are you really just blaming the mother? The guy was on parole for numerous offenses including some being child related. He’s a bigger threat than Rain. Yeah she would never have won Mother of the Year but I don’t think she wanted any of that to happen.
      I also think that her sister and Rain’s oldest daughter were a little out of line. It’s one thing to blame her but to blame and trash talk?
      My biological mother wasn’t fit to raise my half sisters and me - and she actually did have a learning disability. And a pathological liar. So heh you think I have reached out to her? No. I’m in contact with my younger half sister since we lived close to each other for 5 years. Now we get together every Christmas (if weather permits). But seriously, I don’t see Rain as someone worse than my own biological mother. She’s naive. I don’t think we will ever know exactly why she didn’t trust her first instinct about the guy.
      I just think she doesn’t deserve all this hate towards her. Don Smith deserves all that hate. He did the crime. Could she have been better at trusting her instincts? Yes. Sometimes it’s hard to be vigilant when you’re dealing with a lot.

    The mother should face charges as well. It’s difficult for me to even call her a mother as I don’t think she deserves to be called that. She abandoned her first child & allowed her (basically replacement) child to be taken by a stranger, a man at that, in a van (of all cars), all for money- incredibly selfish & negligent. She is not a mother. She is to blame as well. She shouldn’t have had children, especially after abandoned her first child at only five years old.

    The system, I believe, is to blame above all else. It's insane that someone with Smith's record would be repeatedly released is murder by negligence. That perpetrator should long ago have been sentenced to life, never to be a threat to society again. We have to remember we have a privatized prison system, profit over people.

    Absolutely Horrific.
    The jurisdictional system fails so many times. Child predators are another level of crime, one of the worst. Why aren’t they dealt with harsher sentences in the first instance. This problem with the jurisdictional system is NOT just in America, it’s in other Western countries as well.

    Donald J. Smith should not have been a free man walking around when Cherish was abducted and murdered.
    Cherish also should have not been living with the mother.

    I'll never forget the Medical Examiner breaking down on the stand when trying to describe the horror of that poor child's injuries. This is one of the most Infuriating cases I had ever seen. The mom came across as sympathetic, but I agree that she completely failed her child.

    Did the coroner really need a break from describing what she discovered during her autopsy of Cherish?!? How many cadavers has this woman seen in her career? Id imagine hundreds….so for someone who is so desensitized to seeing dead bodies, to hear her get choked up/need a break…I just lost it!! I just hugged my child harder than I think I’ve ever hugged him!!

    I think parents/adults need to understand that kids see us talking to "strangers" everyday. Learning the difference between polite chit-chat and trusting a stranger enough to get in a car with them is an important lesson. That sweet girl just assumed that if her mom trusted that man enough to get in the van with him and go to Walmart with him - he's not a stranger anymore; he's a friend. And why wouldn't she go out to the van with him to get his wallet? It's a very sad story. :(

    He found the conversation in jail funny, trying to hide his smile. She was incredibly naive! She was going with her father, if she didn’t have any clothes, he could have bought them. Especially having young daughters, children in general, you can’t put your guard down for even a second! Trust your gut!     This happened at the Walmart down the street from me. I didn't go in there for a long time after this. Extremely disturbing. Since then, 2 women were found dead in the parking lot of that same Walmart. Something's not right there.
    Also, there are thrift stores here where she could have gotten what she needed. The Salvation Army even offered 50% off clothes on Wednesdays. And there are MANY churches & charities that distribute food & clothing FREE of charge here. Some will even deliver to your house. I hate to judge people, but what this lady did makes absolutely no sense. My daughter is nearly 25 & I'm still weary about where she goes & who she hangs out with.
