Stop Giving Fingerprints and DNA to the police when you're not obligated to. Fingerprints, photo and DNA are only required if you have been arrested and possibly charged with a recordable offence. Summary offences require consent so STOP consenting.

Recently the government gave permission to the police to upload 45 million passport photos and data onto the national facial recognition database, without regard for our rights.
And we did nothing so it will continue.
The long slow creep of the Police State. The cage is slowly being built around you.
PMJ4 Good! This will catch thieves, rapists and drug dealers easier! Everyone was up in arms over CCTV, now its a major source in capturing all manner of scum. One example is wayne cuzzens in the murder of sarah everrard. Caught twice on cctv!
If youve nothing to hide, youve nothing to worry about!
As for the freak panic channels like this one - its BS! They want your DNA? No problem, next time you visit the dentist will do. Or the gp, hospital, drug wipe, breathalyser, any vaccination etc, etc. At least by asking theyre being open, but if they want it they can get it!
@@davejenvey3598 What would you suggest we do in response?
And a recordable offence is............................... exactly. who the hell knows..... THEY certainly won't tell you the truth.....
You are a bloody National Treasure PINACI news .......... I had ALL this s**t done to me many many years ago, and I wasn't arrested or charged with any offence ...... but I DIDN'T know my rights back then like now, so again, Thank you!!!
Write to them and tell them you want your data destroyed under GDPR, they have no right to hold info about you.
Same
Hes wrong. They can take your info if arrested
@DaleSteel you're wrong I'm afraid
@whitehorseflyer maybe I am but I'm going off the government guidelines
Indeed I have personally refused to give prints and photo and I was shocked they didn't argue.
They won't tell you that you're not required though. They class the fact that if you just did as you were told then that's consent. I bet 99.99% of people think they are obliged if they are arrested.
@@PINACI agreed 100% 👍🏻
@@PINACIgovernment website says the complete opposite to what your saying
@@DaleSteel I literally showed you the legislation in my video, go read it for yourself... section 61 PACE. Don't take any notice of a government website typed up by some IT moron, take notice of the actual law instead. Even the first line of the law reads... *"Except as provided by this section no person’s fingerprints may be taken without the appropriate consent"*
I also have a letter from a police inspector confirming it which was shown in one of my arrest saga videos.
@@PINACI well I hope your correct
I am pretty sure.. even if you have been CHARGED..
YOU ARE STILL INNOCENT,
A friend and i were finger printed and had dna sample taken for nothing more than being in the wrong place at the wrong time. It took is 5 months to get these back.
Always a wealth of information thumbs up Naki brilliant guy
Spot on advice as always! 👍👍
recordable offence means basically, capable of being given a criminal record.
The police are the same everywhere they wanted me to volunteer my fingerprints and after the court case they would destroy them. 😂😂😂😂 I told them straight no way are you getting my prints and no you would not destroy them. This is in Canada. I just fojnd your channel #subscribed. Thank you for letting people know their rights.
Worth mentioning that you can apply to have your printa/photo/dna removed from the database if you have been found not guilty. But note that you must apply, it is not automatic.
I wouldn't trust them to remove any data.
Wrong
@@spudhead1161 it is? How?
@@allyup3404Agreed once they have it they have it.
cheers..i wish you would post all the time again..i started following you years ago.....
Totally different in Scotland. Plod here can demand photos, prints and DNA. Stasi Scotland love to flex their fascism.
Good to know that fingerprints & DNA will save me going in for interview.
Might have been worth mentioning section 61(6A) which amogst other things, allows the use of mobile fingerprint scanners, and when they can be used.
The conditions are slightly different than those required when detained at a police station. The retention of the prints is also different.
Interesting to note this. Why are the police not compelled to inform you of this at the point of detention and/or arrest? They should in law!
Wealth of knowledge. 👍👍👍
Not surprised. So if you have had your photo, finger prints and DNA essentially take while intoxicated and then released with no further action taken. Can we have those removed from there database? Thank you PN 👍
Yes you can, but you have to apply
No
@@PINACII honestly do not believe the police get rid of this information. I especially do not trust an institution with the anagram police often lie in court evidence.
@@patriciarowe6685And the anagram is cop lie.
The European Court of Human Rights court held in Gaughran v United Kingdom [2020] ECHR 144 that the police’s indefinite retention of DNA profile, fingerprints and photographs of person convicted of a minor offence without a possibility of review constituted an infringement of Article 8 ECHR (respect for private life). I am not offering legal advice - I just use google
They shouldn't be taken until you have been convicted of a "recordable" offence in court, then and only then are you actually a criminal!
The problem with that is the fact that it could be your fingerprints that's needed to get you convicted, e.g. fingerprints on the murder weapon or on the crime scene.
They can apparently use reasonable force to physically force a sample from you so I will use my own reasonable force to defend my body from being attacked.
I did not consent to have DNA taken for a D&D arrest. It was recorded on the system that I did not consent and I was told I would be made to give my DNA - there was a big copper stood next to me as they took the DNA. Can I request that my DNA is removed from the system? How do I go about that?
It's pathetic that they do these bully boy intimidating tactics.
Some people are getting confused between summery ONLY and summery/recordable. If you were arrested for a summery/recordable offence then you can have your fingerprints taken without consent. For example if you could be sent to prison or fined or both then it would be a summery/recordable offence. If you can only be fined for the offence then its a summery only offence.
I’m not offering legal advice- I just use google: The European Court of Human Rights court held in Gaughran v United Kingdom [2020] ECHR 144 that the police’s indefinite retention of DNA profile, fingerprints and photographs of person convicted of a minor offence without a possibility of review constituted an infringement of Article 8 ECHR (respect for private life).
The police took my fingerprints 43 years ago when I was in the wrong place at the wrong time
When somebody did criminal damage to a motor vehicle
I handed my fingerprints over to them .
Because I knew I was innocent ,
I had nothing to worry about
So " will they still have them fingerprints on file today 🤔 🏴
If you've never been convicted of a crime then apply to have them removed from file
@@PINACI never have done anything wrong in my life , only doing 34 in a 30 mile an hour zone if that counts , lol and working in the back of a pizza shop for cash in hand so the taxman doesn't know 🤣 🇬🇧
Can anything be done in retrospect?
Yes,
The European Court of Human Rights court held in Gaughran v United Kingdom [2020] ECHR 144 that the police’s indefinite retention of DNA profile, fingerprints and photographs of person convicted of a minor offence without a possibility of review constituted an infringement of Article 8 ECHR (respect for private life).
Great idea however impractical in the UK the Police will arrest you then de arrest you just because.. they can and would 99% of the time ger zero punishment
Excellent ... very useful information, thank you.
Here's a follow up question - if you visit someone in a high category prison, are you obligated
to allow your photo to be taken, and finger prints taken ?
I would hope not, especially after watching this video, but many people go along with this
'policy'.
The problem with this if the fact that no, you are not obligated to provide fingerprints and photos but its a condition of entering the prison to visit someone, so if you don't comply then you don't get to visit.
@@PINACI thanks for the clarification.
Always ask.. WHY?
and ask to see reasons.
They threatened me today with a portable finger print
Were you driving a car or motorbike ?
If you physically resisted them trying to force a dna sample from you are they literally allowed to hold you down and rip a sample from your body?
Not for a summary ONLY offence. They can only use force for a recordable/indictable offence or a summary/recordable offence. If the offence is punishable by a fine only and not prison then they can't force you to fingerprint or DNA
@@PINACI Yeah there is no reasonable way to force someone to have a dna sample taken from them against their will, I couldn't care less if the law allows it as getting a group of people to hold someone down so you can rip some hair out of their head Is not a reasonable thing to do to another human being, I would defend myself as is my right.
Whatever happened to Innocent until proven Guilty in a Court of Law? Now it's Innocent until Charged with a Recordable Offence?
Nice one bonnie lad
What does summary & recordable mean?
summery only = can only be fined. Summery/recordable = can be fined or sent to prison. Recordable/Endictable = sent to prison only.
Great information.
💪💪💪
Good advice.
Is there any grounds for a claim after 23 hours in a cell for assult ( that never happened ) and gets an n.f.a ????
Yes, speak to a solicitor.
Thank You For Identiifying Me As A SHEEPLE ....... Noted .
I gotta finger print warrant what does that mean I was charged wit simple assault
Assault is a criminal offence punishable with a prison sentence so you would be required to provide fingerprints and force can be used if you refuse.
I need to present one tiny argumentative point here, Due to the obvious lack of intelligence in most police forces would not injecting just a little intelligence from a clearly more intelligent public serve a positive purpose?
I find the easiest way to avoid giving fingerprints & DNA is to just not get in trouble ;)
Don't be a spoon all of your life
@@thewhinjaninja3610 🤣😂🤣
Now thats interesting ? Thanks for that, duck .
Doesn't bother me whatsoever. Theoretically if I'm found dead somewhere without any id on me, at least the authorities will know who I am and can then inform my next of kin. Chances are it'll never happen. But you never know.
Criminals all of them 😎👍
Taking DNA is standard protocol in Britain?!
They have no rite regardless. Its personal information
I use my right hand.
That tells us everything that we need to know..
YOU'RE NICKED!
The Police use both hands, then put those hand on you.
This information is British or E.U. The title SHOULD HAVE INCLUDED such details.
🫡 .
so this is just for British law not America? Yea you should probably say that in the thumbnail.
In America The Police are allowed to lie to suspects about their rights.
@@gotherecom Agreed, what's your point? Are you saying British law enforcement are NOT allowed to lie? Ever? Is that a law?
Probably waterlive police lol
Require and request are the same legally.
Requests can be denied. 👍
@@cupidstunts.stcmedia.6618 Yes
@@cupidstunts.stcmedia.6618 Exactly!!!
And both are meaningless crap which can be ignored
@@MikeEves So I can throw away all the legal dictionaries then the legal barristers use in court? I no longer have to listen to the police now?
There is no obligation to contract in any way shape or form without consent
Now thats in England but does that apply to Canada 😊
Not relevant in Scotland.
Scotland FOREVER!
@@gotherecom Hail the Union.
A summary offence is a recordable offence, therefore you are required to give DNA and finger prints.
Summery ONLY offence as stated in the video is not recordable. Learn the difference. Summery ONLY = can only be fined. Summery/Recordable = can be fined or imprisoned. Recordable/Endictable = sent to prison.
Urm,
If you have nothing to hide then fine, however my mathematics would suggest there is a good reason they are there, and frankly if someone believed you did commit an offence and you didn't then your name is cleared. simple really, but. You have children, and they grow, especially girls', they develop, and get noticed. The you get someone like Colin Pitchfork, noticing the girls, and before you can say where is Helen, she has been disgustingly abused, had her throat cut and left dead and naked in the undergrowth. Would that be a better option for you?.
There's always one.
I would hope that child is not yours, would you?@@allyup3404
What's your PIN and DOB? Oh, you have something to hide....
Do you have something to hide?
Sadly, on this side of The Pond, police are allowed to lie to anyone other than a judge.
