Armed Suspect Shoots at LAPD Officers Responding To Restraining Order Violation Call

Pacoima, California - On February 16, 2024, at around 7:50 a.m., Foothill Division officers responded to a radio call of a Restraining Order Violation at a residence in the 13200 block of Paxton Street. The comments of the call indicated the Person Reporting (PR) had a restraining order against her husband, and he was at the location. Once officers arrived, they met with a witness in the front yard who directed the officers to a back house on the property.
There, officers met with the PR who confirmed the suspect, later identified as 52-year-old Pete Garcia, was inside. The officers approached the front door of the rear property and asked Garcia to step out of the location, Garcia refused. The officers verbalized with Garcia for several minutes before making entry. While the officers were attempting to detain him, a physical struggle ensued. During the struggle, Garcia produced a pistol from his front waistband area and pointed it in the officers’ direction. Simultaneously, one of the officers TASED Garcia.
Garcia then fired one round from his pistol at the officers, resulting in an Officer-Involved Shooting. Garcia was not struck by gunfire. He was brought down to a bed, where he was taken into custody without further incident. Garcia was later transported by Fire Department ambulance to a local hospital where he was treated for unrelated medical issues. Garcia was subsequently booked and charged for 187(A)PC - Attempt Murder on a Police Officer and is being held on $2,080,000 bail. Garcia’s gun was determined to be a Polymer pistol.
It was recovered at scene and booked as evidence. The 27-year-old officer involved in the shooting was transported to a nearby hospital where was treated for an injury to his left hand that he sustained during the incident and was later released. It was later determined that the officer’s injury was likely caused by a round fired by Garcia that impacted a metal bed frame and the ricocheted fragments struck and impaled the officer’s hand. No other community members were injured as a result of this incident.

It wouldn't have been a quick conversation though. That is the setup. He had violated a restraining order, he will be arrested and he knows it. The part he doesn't realize is that doing anything else is just going to be worse in the end.
If the cop was being completely honest he would straight up tell him that he has to arrest him because he violated the restraining order and either he comes peacefully or things will be way worse for him.

If he needed his clothes then he coulda called the woman and asked her to drop them off at his crib or outside the residence so he didn't have to come in. In my past experiences, I just tell the police I don't agree with the stop but I still complied and answered the questions and they just leave me alone after like 45 seconds. It saves you from trouble and makes your/the officers lives way easier.

He violated the RO, failed to comply, then pulled out a gun and fired at officers. Those were all his choices. She's not the one responsible to keep him from violating his restraining order. He is.

When in the heat of the moment and a round went off, if you suddenly have a hole in your hand i'm sure you'd think you were shot too. But, technically you're right, he wasn't *shot*, but rather had fragmentation in his hand.
Damn seeing that cop put his gun away while his partner only had tazer out made me nervous.

When the cop allowed the second woman to lead them to the house and be involved, the taser not being deployed sooner, the officer shooting one round while his partner was going hands on, not calling shots fired sooner, dropping the radio, dropping the taser, having issues communicating on the radio, dropping his gun, etc. it surprised me it went as well as it did.

I'm still trying to figure out what that 2nd officer (with the taser) was doing by running away from his partner and the suspect when the shot was fired, and then running around in the back of the room. The female P-3 who arrived showed exactly what to do: jump in there right with the partner and suspect and then check that side door for any other threat.

The place smelled like a combination of cigarette ashtray & rotting food...Like put spoiled milk, rotted meat & 30 full ashtrays dumped into a bucket & stir it around...Even going inside for 60 seconds & not touching anything. When you come out, your clothes had that rotten food/cigarette ashtray odor embedded into them. So you had change clothes asap & wash them. I have no clue how they lived 24/7 in that nasty stench 🤮

Our noses are made to detect a smell change. That’s why they could stay in that house; they didn’t even smell it after a while. That’s why stinky people don’t know they stink. They may have caught the smell of their body odor but didn’t shower before their nose got used to it

Those were the worst for me when I was still LE. Those with children involved were when I was called. Children always suffered the worst. Some of the worst of the worst domestic situations involving drugs and abuse combined with neglect of children were why I quit and will never go back to LE. I've got those memories burned into my memory forever. Drinking them away only ended my first marriage.

Even as retired LEO, we called DV calls kill boxes. More officers are killed on DV calls then any other. And sadly, it's a common ambush tactic used to lure police in. Why in many states, and down to the city level all DV calls are handled with 2 or more units.
My most intense situations were on 38s, our code for domestics. Got in every type of use of force during those calls. Not a situation to play with.

@@SouthernGIGI No, the officer made it very clear he wasn't going to arrest him. And from what it seemed like, he wasn't even going to ask for identification. I think the "smart" suspect knew he had a warrant or smt that when ran, he would have to be arrested. Or he was a paranoid "smart" person with too much time watching FOX4. But either way, the officer can't just be like "I'm not gonna arrest you" to lure them out and then arrest them (unless something else comes up for them to arrest)

It was indeed, but the cop was also behaving in an unreasonable manner. "I will stand here and talk to you for five minutes but I will only warn you about the restraining order if you're standing precisely where I tell you to. If you don't stand where I tell you, then I will handcuff you." It seemed like a power-trip to me. Sometimes the wisest thing is to recognize a suspect's stupidity and work with it instead of being so macho. edit: If the cop was trying to arrest or detain him all along, then that changes things, obviously.

"I want to tell you a special message but only if you're not standing near the special door.", might work with a child. If he wanted to arrest or detain the guy, then that's a fair approach, but if he wanted to give him a formal warning, then it shouldn't matter whether the suspect is standing near a door when it happens. Do you agree? What threat do you see coming from issuing a warning like that when someone is standing near a door?

You’re correct. They had issues with the person behind the door and the suspect trying to get back behind the door. Back up should have tased instead of the primary going into that cluttered corner. Definitely better communication between the two was necessary, once the taser was deployed the officer in the back struggled with positioning himself to assist in subduing the male. An ultimatum of showing his hands or getting tased would’ve been best: it signals the other officer that taser will be deployed and once it is move in, plus you define a reasonable use of force in the report by establishing an officer safety issue.
2nd guy shouldnt even be a cop fumbling with radio while partner wrestles a guy with a gun. Help your partner dude worry about the radio later. Then he drops his gun, drops something else and proceeds to stand there and watch his partner do all the work. I'd be asking for a new partner.

Then he finally got a call from the city I lived in and they were willing to pay for the police academy that's when he learned all the stuff that could happen to him and he bounced.
