Does the postman get arrested for harassment? Nope. You’re allowed to contact someone to ask them where your money. Telling you that you’ve taken matters into your own hands is ridiculous - you were asking him when he intended to deliver on his last communications to your wife. However, the police turned up so quickly because there was a marker on his house which shows that there had previously been some serious aggression and possibly violence by someone - which doesn’t surprise me if he owes them a sizeable sum of money. So it’s best to issue a claim immediately and get it logged - don’t waste time writing letters, just issue.
Just to add - I like to give a balanced view and be fair. I ordered a kitchen off this company about 4 years ago and the service was terrible, they took a large deposit off us and took 3-4 months time wasting on the design. We took the view to cancel and go elsewhere. On that occasion, we received a refund within 5 days of cancelling. We were lucky in that respect but I didn’t get the impression they would take it. The shop has been there a while too so I can only let assume that problems have occurred over the last 6-12 months which have messed up their finances. I hope you get the money back and I’m sure if he can, he will pay you back. But you need to issue a claim asap and you’ll see quicker results.
@@The-Reesyou are correct. He must take quick action to recover his money through the civil courts (escalating to the high court if necessary) before others do likewise. Otherwise, there may be nothing left in the pot by the time others have claimed.
Looks like your kitchen guy is living beyond his means. Is enjoying a luxury lifestyle that is being funded by ripped off customers. I used to live next to a guy like this. He did a midnight removal from his flat. The girl that bought his flat had to put up with numerous phone calls from angry clients. The guy that also had anger management issues liked his cars which no doubt was being paid for by his customers.
This is the type of situation where an association with a couple of scary guys is useful. This conman is obviously a coward and would crumble at the sight of a couple of guys who feel they’ve got nothing to fear standing at his door. That being said, why would you give a stranger £34,000 upfront? With any luck he will try this on with someone who isn’t as polite as you.
Yeah, of course you can. And you’ll be told the law and if you continue in these circumstances action will be taken against you. Quite reasonable and proportionate. Just like in Wilmslow. Well done to the cops.
If you look at the pictures on his Google page (with the video of his shop and him standing beside a small plane?) there are pictures of reviews. One from a previous employee (designer) says he is an alcoholic who drives home drunk, is poorly organised, pays poorly, and has multiple court cases you can look up... The review appears to be from the 9th of September 2023.
Small claims I don’t see £34.000 as small claims . so to understand what has happened he defrauded you of all that money and the police don’t do anything.but when you calmly call to his house to ask for your kitchen or refund you get threatened with arrest…..wow what a country we live in good luck hope it works out for you
I'm not saying you are wrong, far from it, but prove that he was defrauded? There certainly seems to be a breach of contract - but that is a civil matter that should be brought before a civil court. Once the creditor has instructed a solicitor, that solicitor will decide if there is enough to justify a criminal charge, and then (in theory) further representation to the police could be made, or indeed a private criminal prosecution pursued. In practice, that is fantasy - the costs involved would probably escalate exponentially with no guarantee of a return. If the debtor is bankrupt he's probably a lost cause.
The threat of arrest for returning at any point is completely unwarranted and unlawful. If you have not had a restraining order issued by a court, this means nothing. This is why you don’t give details, don’t let them see you drive off (registration number will be used to identify you) and don’t talk to the police at all, end of. They have clearly shown why they deserve no respect, enforcing feelings over law.
Tip for anyone parting with large amounts for a product or service, always pay a percentage of the fee with a credit card, you’re then covered by ‘section 75’ of the Consumer Credit Act.
Hate to say it but he ain't going to be paying a penny back, hes a conman and knows how to avoid paying. If it was me I certainly wouldn't be looking at lawful means of getting my money back.
Why she asking your date of birth ? I definitely would not of given her that or my address! A contact number or email should of being sufficient. Your the victim. They treating you like a criminal.
I certainly wouldn't be giving the police any of my details. If they're so interested, they can do there own investigations on finding who I am. I ain't going to do there job for them
Because in this instance he has been accused of harassment - that is the "crime" they are investigating. The creditor could have been arrested, and it would have been a lawful arrest, and processed down at the station. That was not deemed necessary because the creditor was compliant and explained his actions in a reasonable manner. The officers responded by accepting his explanation as to why he was there, then gave advice as to why he was wrong to be there (personally IMO I think he was more than justified to be there). Remember, the complaint was made by the debtor HE was the one who claimed harassment. Is knocking on someone's door harassment? It is if the law says it is. Should it be? That's for our elected representatives to decide. Suitable advice was given.
@@reb0118 There could be one exception to the tradesman complaining about the chap here "harassing" him at his house and that is, if the bloke has registered his business or company to that address, then it is the registered address for the service of writs, summonses etc, etc, so he is entitled to attend on the respondent at his registered business / company address to seek fulfillment of their contract.
Presumably, he'll be hiding behind a limited company. Issue a writ against the Ltd company and name him as a second defendant (or whatever the current lingo is). I hope the Blackbelt guy can help.
Police are completely wrong here. It’s not illegal to knock on someone’s door. It’s not harassment if it’s done in the course of his legal conduct. He doesn’t need a lawyer, he’s allowed to represent himself in such matters.
No he was suggesting not to compound the loss by being charged with a criminal offence. He did not imply that the creditor should forgo his money but rather that he pursue it though the proper channels - via a solicitor & the civil courts. The breach of contract and the debt are not police matters, the alleged harassment is (whether you or I think it's harassment is immaterial).
@@matthewcole4923that said it still might be a viable option for partial redress (i think the remaining debt could still be claimed through other means). The small claims solution is much quicker that regular court action and may allow this claimant a head start over other creditors.
You go to court & sue & if you don't get any money back you get the court bailiff's in ....like the ones on the TV a while ago !...to cease goods up to the amount lost plus costs !
Can you tell me what goods are as defined in law, and please don't tell me they are items that one owns, because they are not. Please note: I used the word LAW.
"Yes we know he has stolen £34,000 pounds from you and that he is a low life scummy thief but we will arrest you if you harass the thief". "We have to be fair after all."
Define fraud. Then even if this can be defined as such can you prove it to beyond a reasonable doubt. Can the criminal intent to defraud be proved and do beat police officers have the necessary training & expertise to do so. Or is this a simple breach of contract that can be adequately pursued through the civil courts?
@@reb0118 'Wrongful or criminal deception intended to result in financial or personal gain'. From what I understand it's not just one customer he has ripped off so in my layman's view I would say that shows intent to defraud.
I think that anyone who lives in a £250,000 house and has a £200,000 car in the driveway probably needs to stop and have a re-think about their life I think that the police in this instance have failed (once again unfortunately) to display intelligence, empathy, compassion, understanding or ... and most importantly .... any sense of right and wrong
It’s not harassment! Bad advice there from the old bill. If the kitchen fitter feels harassed by the contact he needs to pay the money he owes. It’s a civil matter not for police to get involved in. If anything the police should have told the kitchen fitter to pay up if he wants the contact to stop. Not criminal!
So you can effectively steal money off someone or steal something and then use the police to stop the person who you've stolen from from contacting you to find out where your stolen items / money is. That's bizarre. The police are protecting the criminals.
Small Claims court '' those police officer are a joke'' they should be arresting the con artist who has stolen all that money. Footnote, that registration on that car does not exist so the police alt to do their job in investigating, I did zero's and oh's and nothing works for OOO5 SNW
Seriously, though, when will decent people realise that the police are their enemy and the criminals' friend? That's not hyperbole or exaggeration, it's fact. It pains me every time someone says, "Oh, this happened and we called the police and they did nothing," or "They tried to arrest us instead!" Yes, that's their mandate. They will do their damndest to protect the criminals and prosecute the law abiding. The only time you should ever call the police is for very serious crimes, when specialist teams would be involved. The day to day police - never, ever call them or interact with them under any circumstances.
Rule 1 never pay a supplier more than £10k in advance as this is the max value you can get from small claims in England (£3k in Scotland). At best, you will only get the £10k even if you go through a full civil case as the guy (his company) is obviously insolvent) You could get the receiver in, but the likelihood is, you could still only get a % amount as asset recovery will be based on those of the company (which he will have milked dry)
Ok folks here’s your answer, the Car is a Honda E , & the dash is just a wallpaper, nothing is actually functioning, David hasslehoff or Kitt would not be impressed , fraudster is now the victim 😂fantastic police values
Having a Limited company only limits your responsibilities, you can try and find out if the owner of the company had used your money to pay other debts to try and keep the company afloat, but if not and the owner had taken your money knowing the company is closing and personally drawn the money for themselves, then there maybe a small chance, but certainly worth looking at.
Technically he hasn't done anything illegal yet, he has 30 days to give a refund from when you asked. I know it's stressful, but wait the 30 days, then do a letter of intent of legal action (search online for a template) fill in your details and demands and send it recorded delivery. He will then be under court rules, can't remember what they are but I'm sure one Is, that he has to try sort things out in the time frame you give. If you don't hear anything back, then proceed to court. Go to the court, get the form and fill it in and hand it back with the fee, I don't think it's much but if money is an issue then let them know as there is a fund and it may cover other stuff as well, but I'm not sure. When you win, if he still doesn't pay then look into getting a court order to send the bailiffs in. I had a similar situation but for somthing that was only £400, I hand delivered the letter of intent to him at his shop and recorded it as proof of delivery. I told him that he is under court rules and that they are listed in the letter so he can look them up, he then told me that he will get back to me in a few days after he has shown it to his solicitor, just over 24 hours later he is on the phone saying that he will refund it straight away. He wanted to refund the full amount to my account, but to get a bit of revenge I pointed out that he has to refund me in the same way that I payed unless I agree to another way. he then had to take a trip to a cash machine to get me the deposit I payed in cash lol
Another victim of WKI here - I provided him 30 days back in August, letter of intent was been served recoded delivery, time frames provided heard nothing back. Projected court and legal fees are 15-20k (quoted by my solicitors). Unfortunately we are dealing with a scumbag who owes (that we know of) almost 250,000£ to just customers alone. Not sure he will be refunding this anytime soon (including those who have active court orders in their favour against him)
What I noticed from watching this, is the second policewoman seems to be throwing in rules based on her own opinion. Like she's already judged you before she's aware of your situation, or the set up. That is a very dangerous game she's playing and absolutely nobody needed her input as the other two officers had the situation under control and knew the score.
truth be told the first police officer was very fair and nice, the other two went inside and obviously heard his stories and they both came out and turned on me I showed evidence and they ignored, you can hear at one point the first officer defending my knocking and that I had footage from home and they just carried on...

I am so very sorry for you. I have to say, you have conducted yourself perfectly, in my eyes. Oh how I hate to see a man & his wife, who has worked all of his life, provided for his family, you then decide to purchase yourselves a new kitchen. You never kept him waiting for his money. How is it, you have done everything legally. Then you get this guy who has promised you, what you are rightly entitled too, then this guy has decided to take your money and run!! And now you are having to fight to get your money back, or the kitchen. Absolutely disgusting how come the law, is on the side of the Scamming fraudulent person. I am so sorry you’re having to go through this. It’s not fair. I do hope you and your wife manage to get your kitchen that you really deserve or, all your money back. Well done you for keeping yourself calm. Please let us know how all of this is resolved. I do hope you do not incur any more charges. Kind regards, Sarah.
£34,000 is a ridiculous price for a kitchen. However, anyone affluent enough to pay that much _(for a status symbol)_ should *never* pay any more than a small, returnable deposit. Maybe this was a salutary lesson on the downside of consumerism and what is really important for a good family life.
This is not a police matter its civil. Crime is out of control and our alleged police force is wasting time and our money on matters that don't concern them. Mr kitchen man should be paying his bills.
If you stole his car to recoup your losses, would the police be saying he needs to go through small claims court to get his car back?? What a coward he is!!!
But it's ok for the police to make repeated visits to someone's address in order to speak to someone. It is also ok for the tv licence people to keep coming back, and also ok for a bailiff to make repeated visits, and with the appropriate paperwork gain forced entry to the premises. None of the previously mentioned have any legal complaint against the accused but someone who does have a legal complaint like this man who is out of pocket by £35k will be arrested for asking for his money back. Really?
Its illegal to pass a bad cheque, so why isn't it illegal to take money off someone with no intention to provide the goods they've paid for. Simple case here of crooks backing up crooks. Always there for the corporation never the public.

Can I ring the police, every time the tv licence goons knock on my door ?

If you look at the pictures on his Google page (with the video of his shop and him standing beside a small plane?) there are pictures of reviews. One from a previous employee (designer) says he is an alcoholic who drives home drunk, is poorly organised, pays poorly, and has multiple court cases you can look up...
The review appears to be from the 9th of September 2023.
Criminals get support from the police.
Yes victim blaming makes less work for them . GMP are notorious for it.
He does not need to tell the police anything He was not committing a crime The police are getting worse in the UK at abusing their powers in public
I bet if one of those was owed the money it would get done ?
Police are completely wrong here. It’s not illegal to knock on someone’s door. It’s not harassment if it’s done in the course of his legal conduct. He doesn’t need a lawyer, he’s allowed to represent himself in such matters.
There is no way I would walk away from 34,000.

It’s not harassment! Bad advice there from the old bill. If the kitchen fitter feels harassed by the contact he needs to pay the money he owes. It’s a civil matter not for police to get involved in. If anything the police should have told the kitchen fitter to pay up if he wants the contact to stop. Not criminal!

absolutely rubbish cops, there is no justice here
What did you expect the cops to do?
Seriously, though, when will decent people realise that the police are their enemy and the criminals' friend? That's not hyperbole or exaggeration, it's fact. It pains me every time someone says, "Oh, this happened and we called the police and they did nothing," or "They tried to arrest us instead!" Yes, that's their mandate. They will do their damndest to protect the criminals and prosecute the law abiding. The only time you should ever call the police is for very serious crimes, when specialist teams would be involved. The day to day police - never, ever call them or interact with them under any circumstances.
Come on now, this is the UK where the victim is always the criminal, you should know that by now.
DISGRACEFUL Law but stupid in giving £34 k upfront 😮
Rule 1 never pay a supplier more than £10k in advance as this is the max value you can get from small claims in England (£3k in Scotland).
At best, you will only get the £10k even if you go through a full civil case as the guy (his company) is obviously insolvent)
You could get the receiver in, but the likelihood is, you could still only get a % amount as asset recovery will be based on those of the company (which he will have milked dry)

£34,000 is a ridiculous price for a kitchen. However, anyone affluent enough to pay that much _(for a status symbol)_ should *never* pay any more than a small, returnable deposit.
Maybe this was a salutary lesson on the downside of consumerism and what is really important for a good family life.
