You couldn’t be more wrong. How did you come to such a skewed conclusion? That’s not how the law works at all. It’s either private land, or it’s not. A lack of signage doesn’t mean private property automatically becomes a public highway. There’s no requirement for private property to have gates and even if they exist, they don’t need to be installed at the boundary (in fact these days planning permission will not usually be granted unless gates are set back to provide waiting space for vehicles). Find my street is good for general information but it can be inaccurate and is not comprehensive, therefore it should only be used as a guide, which is why it has a disclaimer advising users check with the local highways authority. I just checked with Kent County Council (the local highways authority) and the public highway stops at the roundabout. It’s a private road so it’s not owned or maintained by the local authority, neither is the street lighting. The land registry title plan boundaries also confirm that it’s private land. You can’t just make wild assumptions about land ownership, as that certainly wouldn’t stand up in court (though I’m not sure why you think the courts would be involved in the first place). A landowner or their representative doesn’t have to prove land is private, they can simply ask people to leave and use reasonable force to remove a trespasser if they wish, which is pretty much the only immediate option they have at their disposal to deal with civil trespass. Of course if it turned out they didn’t own the land, or there was a public right of way across it, it would be another matter entirely, as any force used would be unlawful. If reasonable force is legitimately used to remove a trespasser and the trespasser fights back, it wouldn’t be deemed self defence, so it’s vital to understand land ownership before any altercation occurs.

The assumption that 'no gate', 'tarmac roads', 'street lights' etc. means it is public property is often flawed. Holy crap, I have never seen such a disgrace of a security guard. Completely ignorant of the law, absolutely zero de-escalation skills, disregarded his gate-keeping duties to threaten and abuse a member of the public. GXO is a huge logistics company - I have a feeling he won't be working there again after the PR department sees this. Then the plum of a 'contract' manager comes out, talking absolute rubbish - so GXO owns all the land, including the land DPD stands on? Shameful display of security and management.

I watch a lot of them, I've never seen a security guard take hold of someone's property (DJ's bike) or repeatedly get in anyone's face - disregarding their duties to the extent this guy does - especially when the auditor is completely in the right morally and legally. Perhaps you would care to link any of the examples I may have missed?

It was basically because DJ’s gaslighting worked so the guy started to lose confidence and doubt his position. I checked with Kent County Council and the Land Registry which both prove the man was actually correct, it is indeed private land past the roundabout. I suppose this video demonstrates how saying something confidently can convince someone you’re right, even when you’re wrong.

You couldn’t be more wrong. How did you come to such a skewed conclusion? That’s not how the law works at all.
It’s either private land, or it’s not. A lack of signage doesn’t mean private property automatically becomes a public highway.
There’s no requirement for private property to have gates and even if they exist, they don’t need to be installed at the boundary (in fact these days planning permission will not usually be granted unless gates are set back to provide waiting space for vehicles).
Find my street is good for general information but it can be inaccurate and is not comprehensive, therefore it should only be used as a guide, which is why it has a disclaimer advising users check with the local highways authority.
I just checked with Kent County Council (the local highways authority) and the public highway stops at the roundabout. It’s a private road so it’s not owned or maintained by the local authority, neither is the street lighting. The land registry title plan boundaries also confirm that it’s private land.
You can’t just make wild assumptions about land ownership, as that certainly wouldn’t stand up in court (though I’m not sure why you think the courts would be involved in the first place).
A landowner or their representative doesn’t have to prove land is private, they can simply ask people to leave and use reasonable force to remove a trespasser if they wish, which is pretty much the only immediate option they have at their disposal to deal with civil trespass. Of course if it turned out they didn’t own the land, or there was a public right of way across it, it would be another matter entirely, as any force used would be unlawful. If reasonable force is legitimately used to remove a trespasser and the trespasser fights back, it wouldn’t be deemed self defence, so it’s vital to understand land ownership before any altercation occurs.

The assumption that 'no gate', 'tarmac roads', 'street lights' etc. means it is public property is often flawed. Companies are in part to blame as they should put up suitable signs, at the limits of the public land, if they don't want people approaching what are internal gates.
@@drp9542 there's a difference between land being publicly owned and land being open to the public. If there is no sign or barrier restricting entry, then there is a presumption of access. This is the same as anyone can walk up to your front door to knock on it.
