I think the pumpkin bomb would be considered self defense. The bomb would have exploded and killed him if he hadn't cast it away away, And he had every reason to believe that harry was going to throw more bombs and was therefore stopping him from doing that by throwing the Bomb back at him.

In Peter’s defense:
Peter is shot at prior to anything he does against the criminal. It could be argued that he was acting in self defense. Upon learning the identity of the criminal, Peter backs down but then has a gun raised to his face. He breaks the criminals wrist, again in self defense, and the criminal trips to his death. I argue that Peter would not be brought up on murder charges but manslaughter at most, if even that. There’s also the factor of the emotional distress Peter was in since this incident directly followed Uncle Ben’s death, a loss that most people would be devastated by. Factoring his emotional state, the fact that his life was in danger prior to any further action he took, and the fact that the criminal’s death was purely accidental, I think Peter would walk.
You can't claim self defense, If you attacked first. You Can't claim self-defense if you start beating someone within an inch of their life and they pull a gun. They would be the ones acting in selfDefense, not you.
The fact that they are a criminal or even killed someone in the past is irrelevant. Peter would be charged either on second or third degree murder charges or first agree manslaughter.

but the criminal would not have shot at him had he not intentionally went and hunted him down, with the intent of doing bodily harm

I think a good defense for the death of uncle Ben’s murderer is Voluntary Manslaughter. That was definitely heat of passion.
Heat of passion goes out the window when you hunt the man night after night. That's when it's premeditated
@@sincity313 Maybe, considering he has spider powers to get around town really fast I think an argument can be made there was not a sufficient cooldown period and he was still acting under heat of passion. I think I could get it down to voluntary. You have a very low value victim here.
Between videos like these and Legal Eagle, I love our media, especially superhero media, being put under the microscope of the legal system (to see what holds up...and what doesn't!).

What about intentionally killing Electro in TASM2 (which I always felt very out of character)? Was it murder or self-defense?
Now hold on, driving a vehicle can result in negligence because it is inherently is dangerous to others and carries obligations. Surely, in established law, being a vigilante doesn't carry an obligation to prevent third parties who involve themselves in a fight from being harmed? This would be more like a "stranger saving someone who's drowning" situation, wouldn't it? In which case Peter would have no obligation?

Batman also has done many crimes. Didn't Uncle Ben's killer kind of kill himself? Did the Green Goblin actually intend on stabbing himself along with Spider-Man? If I was the Green Goblin I wouldn't have the glider fly right at me. Spider-Man barely had time to react to the glider.
Didn't Spider-Man try to stop Gwen from putting herself in danger?

superman usually stops accidents and saves people. many times when first responders or law enforcement fail. when called upon he will pummel a bad guy. to my mind hes not a crime fighter like most nyc based superheroes. same with FF. one mans opinion!@@justsomeguywithamustach
What degree of murder will it be for causing the death of the guy who killed uncle ben. I'm sure it wouldn't be first degree murder since it's not clear at all That it was premeditated.
