Mine is a TDR flat and we do not have a possession letter from the builder. It's been more than 15 years. Now when we visited the builder he said he has given all docs to society and if we want from the builder then we will have to pay him his fees which is about 50k. Is there any way to get the possession letter without any such huddle

To sell it to second party what is the process and what the document I need to have with me and what the document I need to give my new Bayer from builder . Is there any NOC need to be issued by builder before selling this flat to second party? Please explain.
What is transfer of CIDCO's record for the flat. If the previous owner has not given the transfer of CIDCO's record how to get that record.
When a flat is purchased from a builder, is it necessary to make a sale deed or is it sufficient to make a agreement to sell only?

I am about to buy a resale flat. The seller has said that he is currently paying the remaining 2 EMIs of the home loan he had taken on the flat. However, he said he has not transferred the property to his i.e. he hasn't done the registration, nor paid the stamp duty and said that the flat is still under the builder's name. For me to buy the property I will have to buy it from the builder and the builder will give him the money. Does any such process exist? I'm finding it fishy.
There are few other flats in the same society with similar situation where the owner has not transferred the property to his/her name but is willing to sell. The properties are actually unused though and it's been more than 6 years since possession for the sellers.

Yes this can only be mentioned when it is on registry, rest of the cases it is no of car parking

@@sandy00718 is society formed and share certificate is not being issued to you or society is not formed only. If you have lost it, you can always ask for duplicates from society or complaint to registrar of societies of concerned ward for it.

At the time of Token amount:
1) Allotment letter
Date & allotment number
Details of flat-like size, block no. unit no.
Owner (Allotee) Name
2) possession letter
The allotment number should be the same
Owner name same
Flat number same
If not same then reallotment letter and agreement to sell (check for all time if the property being sold b/w allotment to possession time)
In all documents owner name mismatch should not be there
3) Car parking allotment letter (if not then ask to bring it from the builder or society)
4) receipt of payments ( ideally should be there if not then only a possession letter is given)
5) building completion & occupancy certificate
6) conveyance deed (1st registry is known as this)
7) Sale deed (after the conveyance deed all sales will be mentioned in the sales deed)
8) mortgage letter if a home loan is taken (tells what documents are submitted with the bank and home loan statement if not then there is some problem) - if not ask the seller to bring this document and physically verify papers in the bank and on the same day pay remaining 10% and will sign an agreement to sell - usually sellers are ready on this
9) property tax receipts - check for any penalty - mutation - before the registry pays all taxes and submits their receipts
10) share certificate - it is the original certificate of how many times it has been sold then all changes of ownership are written on the back side of it, known as an endorsement
All chain is complete and all documents are original
This document no seller will give you need to collect it:
11) Encumbrance certificate - koi property par laon hai ya nhi 3rd party claim toh nhi hai, basically title ship and owner clean hai ya nhi - available online, or ask a lawyer or better to take bank loan they will check all papers
Papers to be checked before registry:
12) Bank NOC if a loan from the previous owner is cleared or not
13) utility bills such as electricity, and water - all receipts of these things
14)final tax paid receipt and building NOC as no maintenance pending
After registry:
15) mutation certificate in our name (to be in the records of the builder or in Authority)
