You need to request his video footage. It will show him adding the speeding to the ticket after you asked him to explain the ticket. They have to release the footage to you, or your lawyer. Hold jackass accountable and make a huge video of it.

The loud exhaust code (27150a) only applies to vehicles subject to registration. Your vehicle is not subject to registration because it is already registered in Canada and is owned/driven by a Canadian citizen visiting California as a tourist. He knows it will not stick in court, which is why he added the speeding citation.
I was trying to figure out the difference between somebody visiting California from out of country vs out of state. It’s funny that the phrasing basically makes it so out of country cars can’t be ticketed but out of state cars can be.

Wow is all I can say .. First off let me say that I’m a recently retired Deputy Sheriff from a large Northern California county . The way you handled yourself by being calm , respectful and polite during the entire traffic stop was really commendable and I’m glad to see we still have respectful citizens as yourself in this chaotic times that we currently live in. The Officer’s actions to me were definitely retaliatory in nature In my opinion because of the evidence you submitted ( prior video 2019). You also verbally articulated the entire situation to the on duty Sergeant at the police station as well. The actions of this Officer were questionable no doubt but the part that really got me a little upset was when he stated to his partner that you were starting to obstruct or that you were obstructing. Basically what he was about to do was arrest you for PC 148 ( delaying/ obstructing a Peace Officer in the performance of his duties) because you were not signing the citation fast enough for him . Police are not owed respect just because they are police. Like everyone, they else have to earn respect by being professional, calm, and respectful. Officer's seem to have the grandiose idea that because they wear a uniform of authority, they can approach citizens as if they are criminals. It is becoming rare that an officer is polite and respectful to their target. What we are seeing on video and from personal experience with a simple traffic violation is the officers are brusk, demanding, suspicious, rude, and disrespectful on their first encounter. Then they fail to identify themselves and refuse to answer questions. They act like HOW DARE you ask me anything. LEOs feel entitled to poor behavior and it shows. Immediate escalation of the most minor events is the next step. LEOs have to learn to be respectful if they want to be treated respectfully. Then comes the COPsplaining. End Qualified Immunity.

Here’s the problem. The officer was correct, he wasn’t bullying. If you refuse to sign acknowledging that the ticket was received, you are holding up their duties. It wasn’t bullying. Police officers are not lawyers or involved with the court systems. They can’t argue the merits or validity of a penal code on the side of the road. That’s what the court system is there for. Damon handled it properly in the end, but should have just signed acknowledging the receipt of the ticket from the beginning. Then you fight the validity of it through the court system/file a complaint, which he ultimately ended up doing.
He was looking for the other officer to agree on obstruction or refusal to sign so he could yank him out of the car and arrest him. He needs to be fired.

I grew up in Costa Mesa and Newport Beach. Cops there are the worst, law means nothing to them, they make it up on the spot. When I was 17 years old I walked out of my house and a cop stopped and accused me of being a run away, I was standing in my front yard. No amount of explaining to him that I lived there was enough for him, he was sure that I was a run away, and actually arrested me and took me to jail. I won't even enter either of the cities any longer. I spend my money elsewhere.

But if people actually filed complaints every time a cop did something wrong they wouldn't have time to laugh and at some point they'd start to take their work more seriously as they would become tired and bored of all these complaints. I'm not going to say he shouldn't be able to do the job but this obviously comes down to supervision and training and if the officer can't be trained or can't follow policy or supervision then that would suggest maybe he's not cut out for that department but they did just pass the law this year about having to explain tickets before requiring signature and having to explain the reason for the stop before requesting the driver's license let's see how many cops follow that law

As a police officer, the way Dave and Damon handled this and the previous encounter was great. The officer went from one extreme to the other between both stops and neither is appropriate.
The officer giving the silent treatment just shows he knows he’s in the wrong. I’m not sure legally but more than likely department policy wise there is something describing that the officer needs to be clear about what citations were written. Legally how can someone be expected to sign something without an explanation. What if they had some sort of handicap preventing them from being able to read it or whatever the case. Then when the officer vocalized to the other cop about “where do you want to draw the line” Damon signed under duress. Not cool and probably against policy.

Assuming stop occured in 2024, there are some new laws in California regarding what a cop must explain reason for pull over. Doesn't look like that cop complied too well with that when refusing to explain in detail when Damon was asking
You shold do a FOIA request for the body cam footage from Torres. The Freedom of Inbformation Act gives any person the right to request access to records of the Executive Branch of the United States Government. They have to give you the footage from that day. It also has to come with the original audio so you can hear what he says even when he was behind the car.

California has a new law that says cops have to explain why they pulled you over as soon as they contact you. This feels like he is in some sort of violation of that law.
I came here to say this. As of Jan 1 they can no longer ask you “do you know why I pulled you over?” Because it can be seen as entrapment. They now have to verbally say why exactly they initiated the stop.

Out of state/country would be exempted. Ie: in your scenario your Lamborghini would be exempt from California laws because you are Canadian. Just as long as the vehicle in question meets the laws within the laws of your Provence. It is the OFFICERS job to conduct the necessary investigation into your laws and to base his findings on the appropriate CANADIAN law.

It's hard to wrap your head around what makes them want to try to be the biggest a holes they can possibly be. There was a cop just like him where I once lived and he was terrible. Once ticketed a 9 months pregnant lady who "illegally " parked in a business parking lot because her water broke. His fellow officers disliked him and would cruelly prank him (and he probably took it out on the public). However, they protected him and they kept him on for years, because he diverted the attention away from the rest of them. It'll be the same for this Torres guy.
Of course it will get swept under the rug. His only way is to fight it in court. That's what every officer he speaks to will tell him. Other than that no one is going to do anything about it.

FYI - starting on Jan 1 they are required to start the stop with what the stop is about. After seeing the beginning of the video again he did not do that. May get off due to that but feel free to file another complaint on him for that as they need to start doing that as of a week ago.

The loud exhaust code (27150a) only applies to vehicles subject to registration. Your vehicle is not subject to registration because it is already registered in Canada and is owned/driven by a Canadian citizen visiting California as a tourist. He knows it will not stick in court, which is why he added the speeding citation.
I was trying to figure out the difference between somebody visiting California from out of country vs out of state. It’s funny that the phrasing basically makes it so out of country cars can’t be ticketed but out of state cars can be.

The way you handled yourself by being calm , respectful and polite during the entire traffic stop was really commendable and I’m glad to see we still have respectful citizens as yourself in this chaotic times that we currently live in. The Officer’s actions to me were definitely retaliatory in nature In my opinion because of the evidence you submitted ( prior video 2019).

Officer's seem to have the grandiose idea that because they wear a uniform of authority, they can approach citizens as if they are criminals. It is becoming rare that an officer is polite and respectful to their target. What we are seeing on video and from personal experience with a simple traffic violation is the officers are brusk, demanding, suspicious, rude, and disrespectful on their first encounter. Then they fail to identify themselves and refuse to answer questions. They act like HOW DARE you ask me anything. LEOs feel entitled to poor behavior and it shows. Immediate escalation of the most minor events is the next step. LEOs have to learn to be respectful if they want to be treated respectfully. Then comes the COPsplaining. End Qualified Immunity.

Here’s the problem. The officer was correct, he wasn’t bullying. If you refuse to sign acknowledging that the ticket was received, you are holding up their duties. It wasn’t bullying.
Police officers are not lawyers or involved with the court systems. They can’t argue the merits or validity of a penal code on the side of the road. That’s what the court system is there for.
Damon handled it properly in the end, but should have just signed acknowledging the receipt of the ticket from the beginning. Then you fight the validity of it through the court system/file a complaint, which he ultimately ended up doing.

I grew up in Costa Mesa and Newport Beach. Cops there are the worst, law means nothing to them, they make it up on the spot. When I was 17 years old I walked out of my house and a cop stopped and accused me of being a run away, I was standing in my front yard. No amount of explaining to him that I lived there was enough for him, he was sure that I was a run away, and actually arrested me and took me to jail. I won't even enter either of the cities any longer. I spend my money elsewhere.

The officer giving the silent treatment just shows he knows he’s in the wrong. I’m not sure legally but more than likely department policy wise there is something describing that the officer needs to be clear about what citations were written. Legally how can someone be expected to sign something without an explanation. What if they had some sort of handicap preventing them from being able to read it or whatever the case. Then when the officer vocalized to the other cop about “where do you want to draw the line” Damon signed under duress. Not cool and probably against policy.

The Freedom of Inbformation Act gives any person the right to request access to records of the Executive Branch of the United States Government. They have to give you the footage from that day. It also has to come with the original audio so you can hear what he says even when he was behind the car.

Once ticketed a 9 months pregnant lady who "illegally " parked in a business parking lot because her water broke. His fellow officers disliked him and would cruelly prank him (and he probably took it out on the public). However, they protected him and they kept him on for years, because he diverted the attention away from the rest of them. It'll be the same for this Torres guy.
