    The funny part is, anyone with "papers" is most likely the faker. So the sign is doing the opposite of what it's meant to try and do

    • @ambersmithpxt
      @ambersmithpxt 2 роки тому +4

      I agree, everyone that has told me I have to have paperwork don't know any of the ADA laws, and moreover are usually ESA owners not SD/SDiT owners. My mom unfortunately falls into this category as she keeps trying to tell me I need to go get certified and take a ton of *expensive* classes before my dog can be a "legit" service dog. Btw she got a small dog who was highly traumatized in several homes before landing in her lap and is trying to turn that dog into a SD. She has to have "paperwork" for her landlord because it's an ESA and constantly barks and growls. My dog probably behaves ~87-97% of the time in public. She's been doing alot better as I train her (so closer to the high 90's now) but still it's a work in progress. My mom literally tried telling me about 4 days ago that my dog needs paperwork and my reaction was *facepalm* "not this bs again"

      Even legal service dogs. If handlers are showing papers to avoid the hassle of explaining the law, it just passes on the problem to the next handler.

    One of my cousins has a service dog for seizures and he once told me, people without service dogs don't get a lot of things. But, there is always the moment when you pass someone with another service dog and making eye contact and just kind of silently connecting.

    Honestly, I can't hate managers who are suspicious. They need to regulate service animals more somehow. I feel like other people ruin it for those who actually have service animals. You've got idiots bringing their pets from home and faking disabilities, you've got people bringing "emotional support animals" which is becoming more and more common, etc.
    I've got a friend with a psychiatric service dog. Her dog can actually recognize when she's about to have a panic attack and he'll even help her get through it. What's frustrating is that some disabilities are not obvious (e.g. mental illnesses).

    I understand that this is wrong, but I feel like she comes off as very aggressive. I've also noticed that's her personality (no hate). I feel like if they were educated in an understand way and a better tone and approach then any of these situations wouldn't cause a scene. A lot of people don't understand service dog laws. Lilyann Renee Jesus Christ this girl said that her mom has told them to take the sign down multiple times. So she is not aggressive, just more frustrated. Watch other videos on UA-cam where the handlers are screaming. This was not screaming or aggressive but more frustrated. Lilyann Fagg - yes she can have a tude but she's correct in this case. I've made charitable posts to her about the way she deals with things.. but at least she's doing something - also DISABLED PEOPLE ARE HELD TO A DIFFERENT STANDARD- we are not supposed to be confrontational or assertive. Other people are supposed to do things for us, etc. I would have been worse.... I would have been like "OKAY wait until 100 people with legal service dogs come in here at the same time and the local news team is here to cover it."

      Lilyann Fagg, I agree with your points. She first approached the woman (whom I understand is the manager) asking where to find a product. Then, she started speaking aggressively to her about service dog laws. If she was going into educate them, it would have been better to go in and ask to speak to the manager about the sign, rather than speaking to her aggressively in the aisle (after asking a totally different question in the first place).

      Basically you're all just determined to silence someone with a medical disability demanding fair treatment, regardless of how she goes about it.
      When you witness someone breaking the law, the normal response is to berate the person who's breaking the law. Instead, you complain about the criminal being called out by someone who is affected by the crime. This makes it very clear what your real intentions are. The only person who should be chastised is the criminal, period end.

    • @peepslostsheep
      @peepslostsheep 6 років тому +92

      They can ask two questions;
      "Is that a service dog?"
      "What tasks does it perform?"
      They cannot ask for documentation. They cannot ask for identification. They cannot ask to see proof of certification. They cannot ask what your disability is. They cannot require a vest.
      "otherwise they're would be no point in service training to begin with"
      The point of the training is to help the handler. That has absolutely nothing to do with requiring papers.
      The only way for them to verify that it is a service dog, is by asking if it is one and what tasks it performs. That is all. If the dog misbehaves or acts inappropriately, it can be kicked out of the location.

I've had 3 retail/customer service jobs before, and unfortunately I have only been given very minimal information on ADA and service dog federal laws. I do agree that there should be more awareness and better training put in place, but I wish you had waited until speaking with the manager to really get into the issue. Don’t say “because it’s against the law”, I’m not arguing the letter of the law here, I’m asking why as a person with a service animal in tow would it be so difficult to carry his papers in your wallet/purse? They ask to see them, you show them, they say have a nice day. Simple, innocent courtesy to a business owner.

    • @littleberryslime5159

      Joshua Tanner because service animals don't have federal paperwork. That's why it's illegal to ask for papers. Keeping a service dog out of a public place with their handler because the handler doesn't have papers that don't even exist is illegal. Most service dogs are trained through their owners. They can go through programs, but again, there is no federal paperwork to qualify service dogs.

As a retired police officer i can say (at least in my state) that calling police about this kinda thing serves no purpose. I don't know who enforces these rules but it ain't the "police." THANK YOU! And thank you for your service! When she threatens to call the police it's so ridiculous! Like REALLY??? You don't think that the police have MUCH more important issues to deal with than a sign!?! And I agree, it seems like she just wants to stir up trouble because no one said anything to her about the dog, SHE instigated the confrontation over the sign. And with an employee while they're just trying to do their job. They aren't the owner or manager of this establishment, they didn't make the rules, and they aren't going to risk losing their job and income because she comes in throwing a temper tantrum. It's sad because service dogs are very important, as well as respect for people with disabilities that need the service dogs. But you can't expect respect if you aren't willing to give it. And she's on here claiming to educate others, when she constantly goes about these issues in the wrong way. It actually has the opposite effect of educating and showing a good example to the public who don't understand how service dogs work. She's giving all people with service dogs and disabilities a bad name. It would have been one thing if they had come to her and refused to let her in. But they didn't, she went in looking to give them a piece of her mind. Not educate. There's a difference. If she can't be mature and have a conversation without making ridiculous threats she really shouldn't be on here "educating" others. But it doesn't appear she cares, since this has been said over and over in the comments on her videos and yet she continues the same confrontational behavior time and time again.

      Yes, because there is not certification papers given for service dogs unless you go through a school or something, and the US allows owners to train their own dogs. They have to be trained for like 2 years or something to be considered service dogs. Service dogs will be well trained, and perform certain tasks depending on the disability of the owner. Anyone can go and buy a vest yes. But that doesn’t mean their dog is trained. It will be fairly easy to tell a service dog from someone’s pet, even if the pet is fairly well behaved. Any dog who misbehaves or is aggressive toward other dogs or people can be legally removed from the store.

    UPDATE TWO: As of 3 days later (11/06/17) the sign is STILL up. I called the DOJ (Department of Justice) and somehow got connected to an FBI agent. Not sure how that happened. Turns out that FBI Agent has a Service Dog of his own. He told me to make a Police Report with the PD of the town it happened it since it's happened multiple times, get in touch with my attorney, and call the local news.
    I've already called my attorney. He said it was a specialties case so I'm calling him back tomorrow to see if the guy he knows will take the case. I also contacted our local news station. I make the police report tomorrow as well.
    UPDATE: That lady WAS the manager. She was also the lady that my mom had spoke to the FIRST time along with other cashiers. Hey, just wanted to thank you (and Max, of course!) for teaching me more about how to deal with service animals not only in my retail job, but in general public situations as well. I always knew about the don't talk/don't touch rules, but it never occurred to me that something as simple as making eye contact could distract them long enough where they might miss a warning sign from the person they're trying to take care of.
    I also now will be looking into the laws in Canada toward service animals more, as I'm sure I see signs like this one (or similar) on a regular basis. It makes me sad to see you have to defend yourself and constantly tell people to act appropriately/follow the laws. Thank you for putting yourself out there to educate us!

    Years ago I worked for fast food. We had a group of teens come in with a dog who was no where near a temperament of a service dog. No vest, not even trained as it seemed out of control. We had strict sanitation and my manager asked them to leave. We did have service dogs come in and were always welcome. Sadly people take advantage of this using their pets to fake their way in. Even going as far as going to buy fake vests. So there is no way to win in these situations.

    This all seems kind of ridiculous, even it *is* is illegal for them to have signs like that. It isn't hard to have a piece of paper carried around in the dogs vest or in a wallet or what not. The most likely reason those signs are going up in places is to try and protect the company from idiots that try to get away with bringing in untrained dogs for their own convenience. That isn't the fault of the actual service dog owners, sure, but it isn't the fault of the company, either, and some day some "service dog" is going to bite someone because "paperwork/proof isn't needed". Then laws will change. It seems it would be a whole lot easier to just follow what the sign says and not throw a fit. You'd even save yourself some time in not having to explain how illegal it is five different people if you just whipped out the papers and were done with it.

    • @peepslostsheep
      @peepslostsheep 6 років тому +6

      " It isn't hard to have a piece of paper carried around in the dogs vest or in a wallet or what not'
      It's hard to carry something that doesn't exist. There is no certification. Some organizations that train service dogs provide their animals with a paper 'certifying' them as being FROM that organization, but the ADA and DOJ do not recognize any certification or registration as legally providing rights to a service dog or handler. Nor are vests required.
      TL;DR version
      Legal certification doesn't EXIST, that's why it's illegal to require it.

    • @user-vg2tz5xr5e
      @user-vg2tz5xr5e 6 років тому +1

      Then a note from the doctor (I honestly don't know much about the process but I imagine there is some form of 'this person requires/can use a service dog' or can be) or something might be helpful. Or perhaps it would be helpful to insist that companies *do* provide their dogs with certification. I realize it might be annoying for those who have every right to have a dog, but I feel like it would also put a big end to this mess. It would, at the very least, be a hole in the plan of anyone trying to cheat the system, which seems like it would be worth it to me, as they're the people to blame. Not the dog owner, and not the company.

It says the exact same thing, in one case, it's just in writing and could (hopefully) remove or help with the entire issue between people who really need a service dog for reason X and people who want to cheat the system and have poorly trained animals.

    To be honest what they did there wasn't necessary illegal in this case. Yes you dont need vest and papers, but the workers didn't ask her to show them that or didn't allow her service dog to come in without vest, did they? According to the Alabama law (which she said she was in at the end), they are only allowed to ASK if it is a service dog. The letter stating that papers and vest is necessary is not correct. STATING that is misinformaltive, but not illegal. NOT ALLOWING the dog to come in without paper and vest is. There is a difference there.

There are so many laws regarding many other things and these people work on the till they don’t need to know all of this stuff. It even says on the sign “MANAGEMENT” so go straight to management and don’t bother an employee who has no power over whether or not the signs are put up. I understand you want people to recognise a service dog but if you don’t put the vest on don’t get annoyed at people asking if he’s a service dog. Coming from a retail employee you seriously need to adjust your attitude and condescending tone because you have no right to talk to people the way you do, telling them to listen as if you’re above them. The uniform doesn’t give you a right to talk to people like shit.
    Also, if you don’t like the rules of the shop then just don’t go there. It’s embarrassing that you go out of your way to harass these shop workers.

    PLEASE, approach in "less aggressive" tone. Quite confrontational & your educational message should have been directed at Manager. I VERY much know "personally" how OVERLY FRUSTRATING it is. I'm guilty too of directing inappropriate tone & at wrong people. We MUST ALL be more "patient" as too many internet sites sell vests & tags, etc & then bring "untrained" dogs into public areas creating a NIGHTMARE! I'm questioned EVERYDAY - petite blonde looking age 30 w Vizsla/German Shepherd mix, getting asked immediately "is that a service dog?". You can't see my illnesses - Heterozygous Gitelman Syndrome, Renal Insufficiency Stage 3B w tubular necrosis, CPTSD w Fugue, MAYO CLINIC, MN patient, on & on. People simply don't know & thus, they ask. I'm working to have short, quick answers. For myself, STRESS literally could kill me. Tetany full body spasm cramp & I also fall sometimes, Orthostatic Hypotension. I've decided to "teach" rather then "bark". Jane Doe The whole point of her having a service dog is so she can have a life that is as close to normal as possible. Why have a service dog if she should just stay indoors and avoid the world? Yes, being in crowded areas triggers her anxiety, but in order for her to go shopping, go out for dinner, go to events like birthdays, go on holiday, etc she has to be able to function in a crowd which is what her service dog helps her to do. It's unhealthy for anyone to just lock themselves in their home all the time, just because it is an inconvenience to you doesn't mean people with a disability should stay at home 24/7. The Black Friday video is one of those situations that is a good opportunity to see how Max does in such a crowded space, he did very well which would make her feel more comfortable going out in that situation again because he can handle it.
      Oh and in regards to "You expect everyone to know all disability laws regarding service dogs!" by not using it you're only exacerbating the situation and perhaps intentionally trying to cause a confrontation put the vest on it'll be better for you better for the dog and the people around you even though maybe they don't care to have an animal inside someplace they understand the reason but you need to understand that a lot of people out there who take their dogs any place and they're not service dogs that's why you're giving that vest to show that your dog is special

      S a b yeah it's easier do a whole lot of stuff but none of that has a damn thing to do with this dog situation no you don't have to put the vest on a dog but if you don't then don't whine and belly ache when people ask if it's a service dog you are intentionally creating confrontation at times and then you turn around and you film it you put it on UA-cam when it could have been avoided and don't talk to me about a hundred degree weather
      Im from Texas and 100 degree temp.and those vest are not as hot as you think they are there vented the point is when you equate all this other stuff with putting a vest on a dog it's comparing apples and oranges it's not the same thing

      As a handler I can tell you there are instances where wearing a vest does more harm than good for the dog. It can interfere with the dog tasking, Temps can be too hot or humid putting the dogs health at risk and endangering the handler, there are many reasons a dog may not be vested there is a reason ada states a vest is not required

There have been many cases where fully trained service dogs had to be washed out because they were attacked, and it made them too nervous.

    I have a service dog myself who is in training. And things like that is why I bring her into my work on my days off to Educate my coworkers as well as train my pup while learning her signals for my blood sugar. They know if I bring her in don't interact with her unless I bring her up and say "Hey, want to see if she will let you pet her?" Since she was previously abused and is a rescue I am teaching her regular customers are not to be interacted with but if one is in a uniform they can be trusted. So if me or my sister are alone shopping and we get lightheaded or pass out she knows okay this is a worker I can go get their help. But also teaching her if I say it's okay she can interact with the workers if not then walk on by or ignore them.
    Another thing is I have been having problems with a worker at an Aldis near my apt and we have told him twice now not to interact with my pup and talking to her is illegal especially if we tell them not to. So it's a common problem I have noticed in general

    Um, there are no papers to prove. If they educated themselves enough, they’d learn this. I actually had to ask my ASDI trainer to give me a specific certificate of training since we live abroad now. What’s extra annoying, certain other countries do not see Service Dogs as anything EXCEPT blind or hearing. If you traveled abroad (do not know if you have or not), you may run into issues with certain countries feeling your medical issues aren’t “service” related. I hate flying the domestic from where I am. My anxiety and stress levels go crazy high, and my chronic issues are worse. When I’m reunited with my dog, I feel so much better and he is crazy snuggly as he feels like I punished him. I love LOVE your videos. It’s informative, educational, and true. And, I agree with your statement about them being employees, so they need to know at least that much. Your dog is very well trained and I love his alerts to you. Good luck to you and thank you for continuing to educate where you go. People might get offended, but if they were the ones with the issues, they’d get peeved if laws were broken or ‘bent’.

I am able to control my reactions with medication but I don't always have it with me. If stores let anyone walk in with a dog, no vest or certification, tons of people will bring their dogs in, and people like me will have to deal with their reactions. I also know your dog can be certified in special tasks such as a diabetic alert dog. No there is no online registry. But you don't just walk up to any dog and declare it a service dog.

      Louise Austin they also have to pass their public access test. I've literally worked at the auburn center for service dog training.

      Louise Austin public access test is literally required for any service dog or horse to be allowed in public. If they do not pass they cannot help their handler in public per distractions which is endangerment of both the owner and the dog. If they fail their public access they also are allowed to be removed from the premise for acting up or if the owner or establisment manager feels the dog is misbehaving

      Actually, the other person is right. There is _no_ laws stating a service dog has to pass the Public Access Test or Good Canine Citizen test. Look it up on the ADA website -- the official, government one. I can link it, if you'd like. There are no certifications or tests or anything to stop someone from just saying their dog is a service animal (which is stressful for those of us with actual service dogs, but at the same time, we've kinda got our hands tied...) :/

    How often do people take family or untrained dogs into public places? I've never seen people exposing themselves and children and employees to the danger of their animal.

      getting an instagram before you turn 13 isnt the same as denying people access rights. this store was breaking the federal law. it is against ADA for any public place to refuse service to someone bc they have a service dog. it is also illegal to ask for them to wear a vest. asking for paperwork is also illegal bc it doesn't exist. you dont get a certificate to show you have a SD

    As someone that lives in Alabama with a service dog, I can say that there are many people who do not know the rights of service animals and owners. I have have before been threatened that if I hadn't told what my specific condition was and showed papers I would be denied service at a restaurant. I don't blame you for being upset, especially at the manager who stood there like she didn't put the sign up.

  • @starstriker2242
    @starstriker2242 6 років тому +2

    Ok, so they have been told multiple times to take the sign down because it goes against federal law and they could get sued for it, yet they were stupid enough to not take the signs down but to not check if their rules were against the law as well? That seems like a common thing you should do before making a rule in a store that there are laws made for this sort of thing. 😑. Really people? Why? What happened to common sense? ... Bravo manger you just got sued.

    U should just put the damn vest on🙄 omg 😒 if that's the case I could just bring my well behaved dog anywhere I want & people have to just trust whatever comes out of my mouth (people actually do that) 😂 doesn't make any sense. People will bother u and/or ask u to leave if it looks like a regular dog. That's common sense.

    What is considered a service animal? And why is it illegal to ask for paperwork?

    • @brittanyraulerson5112
      @brittanyraulerson5112 6 років тому +3

      The only service animal that will have any kind of papers is an emotional support animal. A emotional support animal can be any type from a cat to a bunny to a dog. I working service dog (trained to a specific service) does not have papers. It is illegal due to working dogs not having any papers.

      Madi McCabe Some service dogs do not have paperwork because they didn't go through an organization that requires THEIR dogs to have it. It is legal for Service dogs to be owner-trained or trained by a professional dog trainer, and often they don't bother with conjuring up paperwork that isn't necessary. Some organizations give paperwork to show that the dog was trained by them, it's a kind of pride and recognition thing. That's why some have paperwork and some don't. As for why it isn't legal to ask for paperwork, that's because it isn't required by law.
      A service dog is a dog that is trained to migrate a handlers disability. Legally, all the training that is required of a service dog is housetraining, and they must be under control (meaning if the dog pees, lunges/acts aggressively, damages/eats products, is excessively noisy, etc the facility can kick the dog out), and preform a trained task to migrate a handlers disability. Often service dogs with this minimal amount of training are in-home service dogs, meaning owners choose not to bring them into stores, but legally can.
      Personally, I think SD laws should be altered to make a distinction between in-home SDs and public access trained SDs, but that's just me and really unrelated to your comment.

    I understand that you guys think she is being aggressive but I would be too if I were her! She says her mom has come in multiple times and tells them every time and nothing has happened. It is illegal and “paperwork” doesn’t exist. The woman wasn’t really listening and just kept saying she doesn’t know the laws. She was trying to educate them. I’ve watched some of her videos (and others with a service dogs) and this seems to happen all the time whether it’s written or people ask for it. IT IS ILLEGAL and I’m sure she is just frustrated by the amount she has to tell people that.
