This is probably the single most significant factor as to why a pro se will lose their case and it's one of the most overlooked. The odds of a pro se litigant winning their case against an experienced attorney is next to impossible. One of the biggest mistakes a pro se makes is assuming that if they follow the rules and file the proper paper work and do everything there supposed to do, that they don't need a lawyer to win. The truth is it doesn't matter if you do what your supposed to, hell it doesn't matter if the other side has no defense to what your alleging, you will not win your case for the simple fact you do not know how to present yourself to the judge. I sat in a hearing where the Petitioner had been granted a default judgement against the Respondent and the Respondent had filed a motion to set aside the default, the Petitioner was pro se and the Respondent had an attorney. The Respondent's attorney approached the podium and spoke for about 4 minutes, the first 2 minutes were spent talking to the judge about the judge's to Alaska and how if the judge hadn't sent him the picture of how big the halibut was that he caught he'd never of believed it, the other 2 minutes were spent speeding through his argument on why the default should be set aside. When the Petitioner got up to present his side, you immediately saw the judge become annoyed. After only a few seconds of telling the court what rules and case law agreed with why the Respondent's motion should be denied, the judge just cut him off and granted the Respondent's motion. After reviewing the court logs the Petitioner was given 20 seconds to try and present his case before the judge cut him off. The bottom line is this; if you're a pro se going up against an attorney, it doesn't matter if you're 100% right in your case, you're 98% likely to still lose your case. The biggest mistake a pro se makes is assuming that the justice system is fair.

I have representation but I would feel less anxious if I "test drive the judge" in our case. We live in Laurens county Georgia. Which is most likely the problem lol. Anywho... I am having trouble finding a schedule. Is this perhaps info my lawyer could give me?
