So the developer knew that the zoning had changed, but expected that the city was sleepy and would give him a permit?

So existing residents got together and changed zoning laws without compensating other owners who intended to rebuild to larger homes? If I bought a lot as these developers did with the intent to rebuild the home then socialist neighbors made a new rule preventing me from doing so, I'd sue the crap out of them for my loss. They have a case if they owned the land before the change.
He needs to be called out in court for that.

@@J4k7193R He stated he knew the permit application he submitted was AGAINST zoning laws. HE KNEW THAT. He tried to pull a fast one, and he got busted. GOOD ON HIM. Shame on the city yes. they are 50% responsible for the approval. But HE bears the financial burden to his clients, and his financiers should be suing him into oblivion for the fraud..
The developer knew what he was doing. He was there when they decided it! He should take the ding as well as the city.
Yes! He said he *knew.* But did it anyway. Saying the city is supposed to enforce it. Well... Let's hope that they do at his court hearing. This is how they push people out of their communities.
It depends when he bought the land. All existing owners should be grandfathered in because if someone bought the land before the zoning change with the intent of rebuilding a larger home then they would have suffered a loss. Sue the socialist residents and make them buy your land and compensate for all losses.
@@bubbajones4522the developer said he was present during the zoning ruling so he knew the building heights were not suppose to be that big. He is trying to act oblivious because he was given the permits.
City Zones change all the time, usually right before development starts, as well as residential voting for those zones.
He knew in general but that doesn't necessarily mean he knew exactly which properties would fall under the changes and it wasn't his responsibility to make sure that the city properly updated their planning maps after the new restrictions went into effect. Yes, he is partially responsible but so is the city. If they had properly updated their maps his application would more than likely have been denied and he would have had to revise his plans. Additionally, the construction apparently passed several inspections before an inspector noticed the problem. His lawyer can point out that without the approvals by various city employees, the developer wouldn't have invested as much money into the development as he did.
We used to have developers who would build an entire subdivision with multiple lots that didn't meet setbacks. Then they would come in and request variances on multiple lots. The reasoning was always, we've already built the house and it would be a huge expense to tear it down. We're not talking like a couple of feet. Some of these that I remember were a 40-ft setback that was built with only 7 ft of setback. Things like that.
Then we had one gentleman ran for the commission who made it to his mission to not do that. His exact words were, the first time I see somebody bring one of these before the board. That's this egregious. I will drive the bulldozer and knock it down myself.
That nonsense stopped immediately.

Playing devil's advocate here. If the city had updated their zoning map as they were supposed to his permit would more than likely have been denied and this wouldn't even be an issue. Now unless you want to claim that he knew that the city hadn't updated the map... Just because he knew about the changes doesn't necessarily mean he knew exactly which properties would be affected. It doesn't help the city's case that the construction had apparently already passed several city inspections before a city inspector finally realized their mistake.
They issued the permit. The resolution that I see is for the city to buy out the properties affected and then remove the structures that violate the zoning at their own expense. And they are pretty much going to have to cover the builders expenses to date, and a modest profit for the lost opportunity. After that, they can resell the lots to be developed with use that fits the zoning. Forcing a developer to remove permitted buildings is just going to build huge lawsuits for the city. That even if they don't lose, will cost major amounts to pursue.
Lawsuit central, the city should have to pay back for this. Someone made a big mistake and it will cost the taxpayers money unfortunately. Just the same with police departments being sued…
Just thought of this resolution! What if they assessed the amount they’d owe, divided that by the number of households that were affected and offered them the money instead and let the construction continue? Might be a win win for some of the people. They could sell and move if they didn’t want their place anymore. I dunno? Instead of just tearing the whole building down?

Taxpayers would reject that. He doesn’t even claim ignorance, he needs to bring his lots into compliance or start getting daily fines …and eventually surrender them.
@@AbNomal621 But, when did he know? I'd suggest that English is not his first language and he may not have known exactly what he was being asked. If he found out later in the process that he should not have been granted the permit, he's clean. In any case, he applied and was granted the permit. No mention of variances being needed. No mention of money changing hands. He "may" have some liability, but the city definitely screwed up!

This is all on the city. Either let them finish building or pay them for all the damages you caused by issuing permits that you didn’t honor.

Even if the developers knew, it's on the city for not knowing the law. Now. He shouldn't be allowed to go forward, but i think he needs to seek legal action...let the courts sort it out

It is morally wrong to try to preserve the exclusionary policies ushered in half a century ago during redlining. And it's equally morally wrong to create new exclusionary rules which this neighborhood did not too long ago. Let them build more housing in this neighborhood. We don't want more state-sanctioned residential class segregation.

@@w.miller7282 The reason a builder needs a permit and inspections are done during the build is to make sure the structure is complying with codes. This is why a builder PAYS the building code office.

The developer wasn’t getting permits in good faith. If he had said I didn’t know I would agree but to say he knew then it’s all on him. You just can’t do what you want to and hope you don’t get caught or think nothing can be done after you’ve put a bunch of money into something that’s wrong then ask the taxpayers to pay for his blatant mistake.

The developer KNEW there were restrictions before he started building, and still went beyond those restrictions hoping to get a permit. Now when code enforcement shows up, is when it becomes a problem because he got caught.
The permits shouldn't have been issued. They were anyway. Since they were, it's the city's responsibility to make it right, not the obviously shady developer. That permit removes culpability from developer. He's shady but not stupid.
Too bad the taxpayers will be paying for it, and not those who approved the permits. They're the ones at fault.

Sounds like a huge version of a small development near my home that a County official green lighted just before he retired, even though it was against County policy and planning, and prevented the realignment of a dangerous intersection that was already planned by the County.

not true!! Removing the second story and lowering the existing roof is not a difficult task.
It's also lot coverage. You would have to reduce the building footprint, and the foundation is built. Plus "removing the second story" is easier said than done. It means a total redesign as the bedrooms were probably up there. See earlier comments about foundations (and plumbing as well).
@@Bigrignohio , I can put together a daily labor crew in your area and have that reduced to a single story in about three days. very simple rigging. And it's not difficult all the days work. If you need to reduce the footprint, run one foundation wall and add 18 inches of dirt to your yard. If you're only familiar with new construction, then yes you're not qualified to remedy this.
@@user-ny3ke1iu1s No you can't. First you need new plans. Then you need to resubmit those plans to the city. Then you have to deal with the plumbing that is already roughed in. I am VERY familiar with construction and unless you are another of the "no license, no permit, no insurance" trunk slammer contractors this will NOT be cheap and will NOT be easy.

Jennifer Staubach comes to mind, Chad West and his greed is at the top! These monsters want Dallas to have no single family zoning so the entire city could looking like Oaklawn. Whether the developer knew or not the bottom line is the city did not do their job. I mean they gave him a permit which means the city officials should have looked over the building specs before giving the permit to build. I mean as i said the developer most likely already have a buyer for this place at the start of the build so obviously he would want to continue. If he has to tear this down then the city should be paying the price for his loss which to those people crying the blues about this that means tax payers money.

I don't feel bad at all. They are doing this nationwide. The houses a large and gaudy. The way they build them are cheap and shoddy. They want to build and off load it to someone else for the problem to be off of their name.
