      @@davidborboa77 Doesn't matter. Property management is not allowed to enter any occupied rental without notice. I worked at a property where someone committed suicide. Gunshot was heard by neighbors and I had to follow the law, contact police with the tenant's employer who stated he did not show for work just to do a wellness check and enter the unit. If it were not for the police check, I would have had to post a 3-day notice to enter and wait.

      The contract has to do with who the apartment complex has to deal with to resolve their mistake.
      The property manager said it correctly. Since he isn't the legal tenant of the apartment they can't work with him. They can discuss a resolution with the legal tenant but not some guy that's not a tenant of the complex.

If it goes through court then anyone else wronged by their landlords will have legal justification and reference to fight back with.... not that this man wouldn't win anyways.

    To those who think he has no case because he's not on the lease...wrong. That violates the regulated eviction process. Even without a lease, by cashing his checks consistently, they effectively moved him into a month by month lease. He became their tenant when they took his money. It's why some folks are getting out of hosting through AirBnB. Many states have 30 day laws. Once a tenant stays for 30 days and you take the payment for their stay, you would have to go through the formal eviction process to remove them. They no longer had to serve his ex. They had to serve him, and leave a 24 hour notice. They did neither. They f*cked this up royally.

      By sending the checks on the behalf of the actual tenant doesn't really give him fill legal grounds since it could be her (ex) mom sending checks in her name legally the occupant is the one who is contracted with the building. Mama have no day so. I'm this case neither do he.

      @@MsMookalate​​⁠​⁠​⁠Nothing in this case mentions anyone’s mom providing those rent checks that the property owner gladly accepted and cashed so I’m not sure where you got that information from. Making assumptions on where the rent money came from won’t excuse the fact that this man was still a tenant and has been since the day he’d been living in the apartment for 30 days hit and the rental company accepted a check with his name and bank account on it as rent payment. Every rent check also came directly from this man and has his name on them. He can easily provide proof that the rent money came out of his own bank account with his bank statements, fyi. So yes, he absolutely does have a case and somebody’s about to lose their job because their boss is about to have to pay up for their mistake lol.

      @MsMookalate I worked in mortgage law in Texas. Again, this is why AirBnB is illegal in many cities. Any state that has a 30 day residency law can leave themselves open to squatters. If they pay for a month, then decide not to leave, you have to evict them, even without a lease.
      He gave them money. They were cashing his money orders and checks. Their acceptance of his money and the length of time he was in there would mean they were operating (in a legal sense) on a month to month shadow lease. The longer he stayed in that apartment without them ever questioning it makes it harder and harder for them to try to pull what they did. They messed up. They weren't paying attention to their property, and they didn't serve proper notice. Their attempt to justify throwing out his stuff by saying he wasn't on the lease means nothing. They didn't get him out like they were supposed to, and now they are legally exposed. This excuse of "he wasn't on the lease" isn't gonna fly with a judge. If they've stayed over 30 days, you have to go through the full eviction process, which includes a 24hr notice on the door before entering and removing his things. They're gonna have to come out of pocket on this one.

      Everyone is like that, that's why i just stay away from people, all everyone wants to do in life is f*** you! And even on the rare chance its a mistake, all everyone does is make it worser, but not owning up to their mistake!
      Instead they will shift the blame to you and make you look bad instead of them. Like what was done in the video the tenant recorded, of the conversation with the Landlord.

      It began as an honest mistake of apartments and a sincere apology...and then the executives got involved and didn't want to take accountability once they found out they had a possible "out" from accountability.
      ...but they had no problem accepting this man's money for several months because he was a quiet, rule-abiding resident who paid his rent on time and didn't cause problems.
      Executive management is often ruthlessly greed-driven...or so narcissistic that they sweep every problem they create at work...and in their personal life...under the rug.

    I was late on rent many years ago so the apartment manager assumed my apartment was “abandoned” and did the exact same thing to me. Gave away my belongings and sold them in her garage sale. I sued & won. Apartment manger lost her position of 20 years. Best of luck to this man.

    Calling him a counterfeiter on that document after finding clearly labeled play money should be grounds for a libel case. This management company is just awful. Who on earth thought it was a good idea to file eviction on a man who consistently pays rent on time and has no violations other than being an unlisted tenant AFTER accidentally destroying his family's entire belongings, their livelihood and even their dignity. What an amazing PR department they must have. Slimy scum will always look for any crack to ooze out and away from responsibility.

      Not quite. They took "HER" money because they assumed she was still living there with him. She wasn't. It was rented to his ex-girlfriend, who in turn rented it out to him while still under her name. Yea....can't do that. I'm sure he knew and just figured they wouldn't find out. Well, now they did.

The news story says "Johnny was subletting without permission" - meaning he was added to her lease or replaced her on the lease (unofficially). It also showed receipts from The Hamilton and said "Johnny paid the near $3000 rent each month...". I thought they were saying that he was literally the one paying the rent. Like, the check came from him.

They had legal standing to evict him upon learning, and then they would have the ability to throw out his stuff after serving him with the appropriate paperwork. Since he wasn't legally served those eviction papers, they can't throw his stuff out.

    It's sad how the apartment complex wasn't complaining when he was paying all that money for rent on time every month, then when THEY make a mistake and throw him and his daughter's belongings out all of a sudden they try and throw all those "stipulations" on him and threaten him.       He was subletting without a lease. Most places dont allow you to sublet, its a violation of the lease. They are trying to cover their mistake by pointing at his mistake, which was a lack of a lease.

In the mean time it's likely that with the destruction of property, especially with their confession that they did it, would mean whoever they had do it could face SERIOUS legal issues if not themselves as well. I'm talking criminal there. Destruction of property, tresspass, illegal entry, breaking and entering (since it was done without a 24 hour notice, mistake or not). There's a multitude of things that are likely going to force the Hamilton to pay up without even taking it to court day one. IANAL but as someone who's caught their landlord trying to illegally evict them before by tossing my stuff without the right to do so, it was a nice payout and we never saw the inside of a court room. The 7500 dollar fine he had to pay too was nice.

    The lawyer is right. It doesn't matter if the lease owner is there or not. The only thing the complex got right is that he was supposed to have his name on the lease to be there full time. But it doesn't excuse the first infraction of throwing his stuff out. Since much of his stuff was either damaged or pretty much free for the taking, they don't need to "retrieve" his items back. They need to sign him a fat check to replace everything. I hope this lawyer tore the complex a new one.

    I was a property manager at some large complexes and no one in my company ever evicted the wrong unit. Never. Even the maintenance staff were on top of this along with the Sheriffs who accompanied our evictions. The entire staff who did this should be fired. And there are laws about entering apartments without advanced notice. I hope he takes this company to the cleaners. Everyone in Dallas should boycott this place. Overpriced and breaking the law.

      It really depends on the minutae of state housing/ contract law. Texas is not known for it's strong tenant protection laws.
      If this happened in California, home of the gay communist agenda, when a landlord knowingly accepts payment from a named tenant (like seeing your name on the cheque every month), that establishes certain basic rights for the tenant. Is obviously not the same as signing a rental agreement, but (as another comment here thoughtfully corrected me on) accepting the check in CA would generally be considered a type of contract, and the tenant would fall into a verbal agreement for month-to-month, until the landlord has a tenant sign a new rental agreement. The specifics of that month-to-month/no signed rental agreement are going to be different depending on county and city. This is based on a principle in contract law that if someone is getting a benefit, then they have obligations that go with it. Ie, if the landlord is getting the benefit of the rent money, courts would say that, even without a rental agreement, the landlord knew what they're doing, and thus they have certain obligations for how they treat this guy.
      But in Texas, this will be a hard fight in court. This guy needs to win in the court of public opinion, hopefully shame them into settling, because the property manager has a good case. Courts are not exactly tenant friendly.

They had no issue taking payments from his account, so they knew he was paying the bill, yet tried to weasel out of any responsibility immediately by trying to evict him in a short period, thereby not giving him any time to respond and trying to overwhelm him with other issues. If he has a decent lawyer he will win. It's just sad that there is zero morality in the way they are treating him regardless of his financial situation, most corporations and businesses, especially in that market, are awful to deal with.

      Apartment neighbors are really obnoxious in this regard. I was moving into an apartment once and had a stack of objects on a landing inside the locked door. The parking lot was far from the door so i moved a full carload of stuff into the landing. I went and parked my car then came inside. I think i went up to my apartment for some reason like to unlock the door and put some stuff down. Maximum 1-2 minutes had gone by and i come back to find 2 women picking through my stuff. Obviously i was like "WTF are you doing?" They are startled like kids in the cookie jar. They just start smiling at me like "ohh we thought this was free to take because someone was throwing it out." In my case it was neatly stacked boxes. This guy just had his stuff dumped so i can imagine how much care people had to respect the stuff.

      My property manager, who lived and managed here for over 25 years, was suddenly fired/evicted during the pandemic, for no good reason. A “management company” was hired, and things got real sketchy. Finally a tenant, who happened to have a real estate license, and wisdom, found the owners & got them to sit down with the tenants. I guess the owners snapped a whip, cuz now things get fixed, tho not at easily as when we had a live-in manager. “Management Companies” are a RACKET! - I pray this family gets recompense thru a common sense and common good minded judge.

    I hope this man and his daughter are recovering their losses and are able to move to a better place. He deserves to be well reimbursed for all their items that were haphazardly tossed in the trash and looted by other tenants.
    I refuse to live in an apartment complex ever again. The last complex I lived in was nice but the owner and management staff were so shady about rental payments and added late fees that I didn't actually have because I'm dutiful about paying rent on time. I moved out as soon as I could. Then out of the blue they tried to sue me for apartment damage a year later after I had already moved out. The suit was dropped because I took pictures of the inside of the apartment I rented before I moved in and pics right before I turned in the keys as I moved out. I proved my point that the management was trying to harass and sue me for damage that wasn't there. My pics saved me from a lawsuit and also showed how greedy and petty the Apt management and owner truly were.
    **DEFINITELY Take pics of your rental before you move in and after you move out and keep your monthly rent receipts that proves you've paid on time every month**

      Why we stop using this video rental years back is because they wanted to charge mom for never rewinding the movies she always checked behind us to make sure they were rewound this was when we were young and I didn't know how to touch any buttons till I was about 7 I didn't trust myself till then we always triple checked but everytime we took them back that evil movie rental place said we didn't and it was like a $20 charge for each movie not rewound and they said all of our movies weren't think like 3-5 movies that rental place went out of business a few years after we stopped going

      This is kind of a fundamental human flaw and the removal of this flaw starts in childhood. Not every human has this flaw but the majority have it to some degree or another. It basically boils down to not wanting to deal with the mess we sometimes cause when we're wrong about stuff. We're not perfect and make mistakes. Sometimes those mistakes have serious consequences for others and in those cases we have to do our best to make them even or at least work towards it in cases where that isn't possible.

      They definitely can. When people are evicted from houses their stuff gets put out at the street for trash pickup. Once your residence is terminated, the property owner is not obligated to protect your possessions.

      It's funny how they didn't care that it was his name on the checks every month... Until there's a problem. All they've done is add his legal fees to whatever they owe for his property. Because regardless of his status as a tenent, he was not a squatter. And they had not served him an eviction notice at the time his property was illegally destroyed. I'm unsure about Texas law, but where I live, the apartment must give 24 hours notice for entry in non emergency situations. If Texas has a similar law, the apartment complex also broke that law in addition to destruction of property.

      @@jdmichalto add: I don’t know about Texas law, but the landlord waives the right to remedy if they take a payment while knowing that there’s a lease violation in Florida. 8+ months of checks coming from somebody not on the lease is going to make any judge think really hard about whether this is a non-issue and twist the knife into the management company.

Most people today don't even know what personal checks look like or how to fill them out.     I’ve worked in property management for 5 years and what the management is saying is true in the sense that we cannot discuss lease material with non-residents. However, it is also illegal to enter someone’s homes without a proper eviction through the court. They were 100% wrong and tried to use that sliver of truth to protect themselves.

      Yet they were taking his money and never asked for or required the lease holder to be the one who brings the payment.. The ex girlfriend wasn't the one who went to the leasing office to pay the rent each month he did.
      The leasing agent on the video is absolutely abhorrent. She's trying to ignore what they did and use this as an excuse but notice the level of apology doesn't match the level of nastiness that she's exhibiting on the video.
      They had no warrant and no legal right to enter the unit. Even when a marshal shows up to complete an eviction the leasing manager should always pull the lease agreement to make sure it matches what's on the warrant from the court so as to prevent these types things from happening. I realize that when they are dealing with minorities and low income residents they are given carteblanc to operate in such dispecable manner.
      I would not have accepted anything from the trash. I'm only glad he was able to get pictures that he can use as evidence in his case. How do we know some of those same workers didn't steal what they want first from his things before putting the remaining items outside?
      Prayerfully he's able to purchase his own house cash when this case settles and begin to build wealth for himself and his daughter and so that they won't ever be put through this traumatic, disrespectful and humiliating experience ever again

      It is not illegal to enter someone's home with or without a court order. That doesn't matter for entry. I have the full right to enter whenever I want if I place it there like that. If I want to give you 24 hour notice. I can and will, if I choose.
      What I don't have the right to do. Is remove all your stuff, without any notice at all and a court order with cops present.

    This is absolutely outrageous. This man paid every month and when they made a mistake all he got was an "Oops we're sorry". Then they wanted to call child's play money counterfeit. They need to own up and take responsibility for what they did and pay this man for his belongings they destroyed. The management team is heartless. I hope others people living there see this and move out causing them to lose money.

      If they want to claim he illegally Sublette all that time, then they illegally took his rent payments with his name, establishing tenancy.
      I was told that if a person is late on the rent, for example, I have the option to evict, but not if I accept the payment late. By accepting it outside of the lease contract, I have established a new relationship with them as a tenant on a month by month basis. As long as I keep accepting payments, I keep agreeing to that relationship.
      They saw the checks were in his name, not hers and they should have brought up the issue the first time the payment source changed.

      @@Metqa the "unauthorized Sublet" thing is Obviously thinly-veiled retaliation against the man for Pursuing recompense over what was a clearly Illegal eviction. The Judge ought to be able to provide a restraining order to the owner against proceeding with the new eviction until the original case is settled. Although it Does mean they may have a legal claim against the Ex-girlfriend for unauthorized subletting and be able to evict him eventually, They Should not be allowed to do so in a short timeframe as retaliation for a legal claim made against them - Or it just further exacerbates the damages from the first Illegal Eviction On top of all the property damages.

I know what is going on, The attorney said to do this knowing that the individual is going to litigation now the attorney can make money from the property manager company and end up making a settlement with Johnny.... If I was the property management I would work something out with Johnny without litigation.... The property management attorney knows how to make money its billable hours for the attorney and believe me the attorney is going to take this time.... I seen this so many times working for law firms.... Sometimes attorneys would joke about it....

    Good tenant appears, rasies his kid, never causes you any issues for years, pays his 2500 for his undersized 2-bedroom every month and on time, so you trash the guy metaophrically and his possesions literally with a mistake and then a technicality.

      That loophole won't hold up. He has been paying rent under his own name since the girlfriend moved out, and they have been cashing those checks. That means they knew he was staying there, subletting or no. If he has a lawyer even half awake he can clean up.

As the rent was paid in full to them and the sublettor didn't gain anything there was no harm. They could have evicted him but that's about it. Going in and removing all his stuff? without notice? That's just straight up theft and property damage. This will be settled the moment a judge actually sees it.

      It was an honest mistake at first. Then it became criminal (and they're quickly trying to get him to sign a contract...because there is some wording in that contract that protects THEM and not him...like some clause about requiring renter's insurance in case something like this happens.
      You wait and see...there is something in that contract that legally protects them from having to pay, and this is why people need to stay as far away from these corporate apartment owners because they are ruthlessly greed-driven. They will do whatever it takes to protect themselves...they would smear this guy's reputation publicly if they could find any dirt on him, just to avoid taking accountability.

      I'm currently living in my first apartment and honestly, never again. My lease is up at the end of this month and I'm going to live with my mom until I'm able to buy a house because they've entered my apartment 6 times without any 24 hour notice and then had the audacity to try to evict me TWICE. Once for having an "unauthorized guest" (mind you, they lied and said there were 2 men in my apartment) and once for having a pet that wasn't on the lease
