@@LadyInTheTree my husband asked the same thing. As of now, the go fund me doesn’t specify if they will be returning the donations if they are awarded lawyer fees in the judgment of the lawsuit. I’m assuming that’s because they just recently filed their response requesting to have their legal fees paid along with striking the suit. I’m sure once this is all over- they will let everyone that donated know what is happening. 🥰

It seems to depend on how the anti-slapp is worded, but given it's considered the most robust, I would suspect it's possible. I'm sure the Girlies all have their lawyers communicating with each other too.
I believe Jessi Smiles also lives in Georgia, so the anti-slapp stuff would apply to her as well.

I think it gets a bit different for Lily and Jessi since they DO make sense to be tied together because of the podcast. I’m not sure how the laws work in that regard. Since they were all sued together and they don’t have any competing interests I believe they all have the same lawyers so I’m sure their filings will be just as well researched.
The sad thing is that "being in a gay relationship" doesn't mean you can't also be transphobic. As someone who is trans, I can tell you that there are lesbians who do not like and do not support trans people. Thank goodness this isn't an attitude shared by a majority of lesbians. I've always received positive and supportive comments from gay women when I've hung out at establishments that cater to lesbians. But I've seen cases where this isn't the case.
Absolutely. I have heard people argue that the t shouldn't be included in the lgbt. Because they don't want to be associated with trans people. There can absolutely be a transfobic problem in the queer community too, even if I think it grows less and less common.
I’m a trans man and I’ve also faced a lot of transphobia from gay men, too. Hell, I’ve faced transphobia from other trans people, like transmedicalists or people who think I’m “not trans enough” or whatever.
Absolutely, I am always amazed at the lesbian TERF's that are happy to align with the conservative right regarding trans rights and don't get it that these people don't want you to exist either and want to limit women's rights in general. They don't seem to care as long as the transgenders can't go into the bathroom or play sports.

He felt they were people putting their toes in the pool, so to speak, but not committing. Should have called him out on it, but I was still figuring out things on my end back then. 'runkle at my puppy' is not defamation unless you're intentionally doing it with a malicious intent to harm Runkle and he has suffered a documentable financial loss.
@@aickavon small disagree. Financial loss does not have to be proven for "defamation per se" (or however you spell it). "Runkle at my puppy" if used in a serious context, would probably fall under that, due to the appaling and criminal nature of the allegation (theft of the puppy, animal abuse due to the death of said puppy, etc). And personal knowledge/disregard for the truth can be presumed in such a personal statement, in which case intent is also a given if the statement is false.
Hence the only thing that has to be shown is that the statement was shared in a serious context with people other than Runkle, and that people believed the allegation to some extent.
Only if said lack of financial damages is matched with a clear and obvious emotional duress caused by other parties harrassing the defamed. I would call that reputational damage, but I'm sure there's a legal term for it.
If there is no third party harrassment or financial damage that is documentable, then the case would have very little merit in court.
@@aickavon Yes and no, emotional damages and reputational harm are two very different things. It actually depends more on how serious a crime eating a puppy would be and how believable the statement gets to be than emotional duress applied. If people from this comment go viral accusing Ian of being the Canadian equivalent of a felon cuz eating a puppy would amount to felony animal abuse, especially given that he's a licensed attorney, it could do untold damage on his career. He wouldn't necessarily have to prove damages, I don't think, cuz being a felon is something that puts your license on the line automatically, and the reputational damage could be so grievous it'd let him skip the proving damages part. At this stage, the point of suing would be to get the person making false statements stop, though, not to get money out of them, so I wouldn't think that the defamation per se claims would be that high. If this went on for years or they completely ruined his career, then it becomes more about money and loss of income due in part to the intentional infliction of emotional distress.
Idk if you've heard of the TikTok psychic who went viral accusing the one professor of being the brains behind the quadruple homicide in Idaho cuz she was supposedly tryna hide a lesbian relationship with one of the victims, but she sued the psychic for defamation per se, if you need a relevant example of defamation per se. I don't think the emotional damage really came up at all in the pleadings, but lmk if I was wrong there.

I am an attorney in Washington State. This lawsuit was bizarre to begin with. The claims made about Janet are opinions, and that doesn't rise to a tortious act. Beyond being opinions, the truth is always a defense to a slander/defamation accusations. And from what I have read from Janet's filings and C&D letters, I think bad lawyer is probably accurate. Being a bad lawyer is also so incredibly subjective it would be hard to prove that opinion harmed her. You know, the little things a halfway decent lawyer might consider before filing a case.
My favorite response to someone telling someone else, "You suck," was George Takei's. His answer was, "Quite well, I'm told."

Being a lawyer is a lot like being a high end D&D player. You argue about the rules of the game and argue about how the rules of the game apply to the situation. Here, we're using Federal law for procedure, Illinois law for a claim, and Georgia law a counter claim. This is next level D&D.

The difference in professionalism is astounding, this document was no question written by a knowledgeable lawyer. My middle schooler could have written better than Janette’s side. I want this to end in a way where KC and the girlies get big payouts from the other side, they deserve it especially Kitty. I keep reminding myself that getting attorney fees and dismissed is a good outcome but Janette and Lauren deserve a punishment for this behavior beyond just paying for attorneys IMO.
Unfortunately that not in the cards unless they were to counter sue.

Do I think the court will throw it out? Yes. Am I disappointed? With apologies to the defendants, yes. This is a very entertaining debacle and I shall be sad when it trails off with a whimper. Happy for the defendants, but sad for the loss of entertaining law drama.

I think that’s where it gets tricky with being a public figure and malicious intent. On its face it feels like it would be easy. But it’s not that clear cut. And hella expensive to do.

I had no idea who any of these people were other than Suarez. When I saw the video about the cease and desist letters, I was hooked. It wasn't because of anything anyone else said, but because of the letters they themselves sent. Just reading them was enough. They are so bananas.

Janet and Lauren's lawyer, per his own website, worked at one point as an assistant attorney general for Illinois, so he really should have known better than to hitch his name to this trainwreck of a case.
Better to be silent when called a fool than to open your mouth and prove them right. I cannot believe that after the horrific crap they levelled at Grayson for... *checks notes* ... doing his job, and everything else that they did, that at no point did anyone on their team say "Hey, maybe this isn't such a good idea..... Public service announcement for folks who hate the term "transphobic" -
Letting trans people live as the gender that they have always been internally since birth stands in your way and harms you in no manner whatsoever.
Supporting equality, respect, and medical autonomy for trans people in a passive, effortless manner is all that's required to disqualify oneself from being transphobic. For the most part, trans men & women maintain the qualifier when identifying themselves. They say, "I'm a trans man," or, "I'm a trans woman." Nothing scientifically inaccurate about that.
Kindness is free. It costs you zero dollars to be nice/respectful. Using he/him for trans men, she/her for trans women, and they/them for people who don't feel comfortable using male/female pronouns is super easy & costs you nothing.
They say you can be happy, or you can be right. You can't be both. "Is that the hill you want to die on" comes to mind. There's something to be said for weighing the costs & benefits of being stubborn about something, and pronouns seems like a really lame hill to die on. You may not "get" trans people, but they exist anyway - transgenderism is a real thing, regardless. Non-binary is a real thing, too, even if you can't relate.
I have a saying "I don't completely get string theory... doesn't mean string theory isn't an actual scientific theory". Same goes for trans/non binary people. You don't have to "get" it (and honestly, given the internal struggles some trans/nb folk go through to realize their identity, lucky you for fitting in that cisgender box). That doesn't mean trans/nb don't exist and aren't worth basic human decency/respect. And really, anyone who's *that* pressed over what's going on with a(n often) complete stranger's gender/genitalia structure is hella weird.

As a fan/follower of Kitti (and Lauren previously) their brands being confused stemmed from Lauren taking up a Beetlejuice schtick that Kitti did first, in addition to copying her vocal pattern, but it was the beetlejuice thing mostly

It was complete bs and my lawyer agreed that it was complete bs, but it was still stressful until it was over. I know the girlies will breathe a sigh of relief when it's over.

I just wanted to say that you're really good at making the law both fun to learn about, and easy to understand - you do a great job at explaining complex concepts in an easily graspable way for laymen like me. This is 10,000% Streisand Effect. I have never even used TikTok because I prefer very long form content. Before this started, I had no idea who anyone was, never saw any of their videos. Not Lauren, not Jaime, Kitti, Bekah, none of 'em. I watched a video from a drama youtube channel with a title like "Tiktok Lawyer sends unhinged cease and desist letter" because of course that's going to be hilarious. Was wondering... How can they sue in Illinois? I mean say something is illegal in Illinois, but legal in Georgia. How can a citizen of Georgia, acting in Georgia, be held to a law in Illinois? Wouldn't that give one state control over another states laws?

reading this requires more Tylenol... In my humble opinion, this case is a waste of court time and resources. I feel sorry for any judge or paralegal court staff that touch this. However, I can appreciate Runkle of the Bailey's coverage of this.

Every case I've randomly checked is real and relevant too. If ChatGPT was used here, it was rigorously prompted, double-checked, used in appropriate ways (for filler prose etc., though there's not much of it here), and most importantly, never trusted when it couldn't be confirmed by the lawyer's clearly extensive knowledge/research.
Besides the comprehensive citations, it's those deft touches - citing a case that lets them put "deeply greedy people" into the filing and thus into the judge's mind - that makes me think Witkow | Baskin is a top-drawer law firm.

OMG… I was involved (as a paralegal) in that Solaia Tech case that was cited!
The problem with them suing for copyright is that, in the US, you have to have a Copyright Office registration for your copyrighted works BEFORE the alleged infringement, and BEFORE you file suit. I'd bet a dollar the Propson and Braun have NOT applied for a Copyright for their videos. They may not be able to, depending on how the T&C on TikTok read on the issue.
One of Braun’s claims against DWKT she did include the copyright registration or whatever. Whether she did that before or after the claim…. No idea. Probably after. But also. Who registers copyright for a TikTok they made?!??!!

I understand that the confusion between Lauren the Mortician and Caffeinated Kitty comes from the fact that both of them use a call-out tag of "Beetlejuice". That is, their followers "summon" them to respond to on-line content by tagging them and saying Beetlejuice (referring to the Beetlejuice movie where calling his name makes him appear). I follow Kitty and I've heard her make the Beetlejuice reference numerous times. I can see that this could cause confusion for some.

Wisconsin and Illinois are right next to each other. Depending where he is in IL, he could drive it pretty easily. Our capitol is 2hrs from Chicago - not a great commute, but not prohibitively long either. I know people who do it for work (ewwwww), but I can see why he wouldn’t want to. 🤷♀️

Travel time, especially if you're driving, is not productive. If I'm forced to lose time I'd otherwise be paid for, I'm charging for it!
I've driven across the country multiple times (from AL to CA and back and AL to ID and back). Compared to that, driving one state over is kinda nbd to me.

I am glad you are covering this so in depth. For KC’s sake though, I hope it’s dismissed with prejudice and that she’s awarded attorney fees. I don’t want her to have to deal with this issue for longer than necessary. As entertaining as Janet’s antics are, this case being drawn out isn’t worth KC’s stress both financially and emotionally.
I’m thinking about that TikTok psychic who accused the history professor at the University of Idaho of being the one who killed the 4 students and the professor has sued said Tiktoker for defamation as we all know Brian Kohberger was arrested for the crime. The judge keeps giving the Tiktoker chance after chance (she’s pro se) and it’s frustrating because in my opinion she’s used up all of her chances. The judge has been too lenient to the tiktoker. Don’t be a month late (habitually) responding. Meanwhile the professor has to keep paying attorneys fees. We all know that the professor will NEVER see a dime of her money back.
That’s why I think the this judge needs to nip this in the bud. KC doesn’t need to pay out of her pocket for the continuation of a case that’s likely going nowhere.
