When you go in without your facts, names, times places and you stumble through questions it gives them the chance to put you off. You need to write down the names of the people and times you spoke to.

It was so clear that they couldn't just ignore it and decide against pressing anything. Instead, the police and the district attorneys devised a way to minimize the charges and then prevent James from participating so they could basically dismiss them.

James, the reason they charged him with an ordinance violation for battery is because he wont get fingerprinted or mug shot . An ordinance violation even if he pleads guilty does NOT go on your record. Him being a state employee, if he was to be charged with a misdemeanor battery and found guilty, potentially he can lose his job. Even if found not guilty he'd still have the arrest on his record. Keep fighting for a misdemeanor battery charge against him. you have 3 years for the statue of limitations.

Im sorry if this is a long comment T.T. but i think its important and this situation i think relates well to what ive been saying the last couple years. I have probably commented about this maybe 20 times on different auditors videos and have never gotten a response from anyone. I knew a little about it but i did my own research this week and what is happening with virtually every law enforcement division in the country goes against the constitution in my opinion. Ill try to make it short. So the constitutiongave us the three branches. Executive, judicial and legislative. What the constitution also set forth is that each branch shall have a set of checks and balances basically to make sure each branch is doing the right thing and these sets of checks and balances ensures that each branch will not oversee and monitor itself but that other agencies will oversee and check on them to make sure they are doing the right thing. And it ensures that each branch is not monitoring , investigating or policing itself. Police are part of the executive branch. Yet they monitor, investigate and police themselves. Which in my opinion is a direct violation of the constitution. How iare they able to get away with this? And how have they gotten away with it forever? But they have and continue to. Smaller departments dont have a fancy title for their set of checks and balances. They just investigate themselves...ie: when theres a complaint on an officer just another. Officer investigates the claims against that officer. The larger departments have that fancy title of "internal affairs" who investigate any officers who have recieved a complaint be that criminal or not. Mso the smaller departments investigating themselves.......100% a direct violation of the constitution. That is not how the constitution states a government branch shall be monitored. Then the larger departments with the internal affairs is a little different but mostly the same. Essentially they are still monitoring and investigating themselves which is against the conatitution. Internal Affairs aounds good on paper. But in reality their offices are usually in the same building as the police department they are tasked with monitoring and investigating. Alot of times I.A. is in the same exact office as the police department. Also alot of I.A. detectives retired from the very department they are now monitoring. So maybe they went from the street to working in the same office they worked out of when they were on the street except just behind a desk now. Then alot of times they are of course friends with the officers they investigate and monitor. Doeant sound like a conflict of interest to me......lol. so with that whole set up with the location of Internal Affairs offices and the fact they are friends and ex coworkers of the officers they are tasked with investigating that goes against the constitution because they are still monitoring and investigating themselves. There absolutely needs to be a n entity assigned to monitoring and investigating the police but in my opinion they should be a completely separate entity. The investigators should not know the officers they investigate. In other words they shouldxbe a completely outside third party organization. How in the world have they been permitted to have it the way it is for so long without anyone saying anything or trying to get that changed? I have no clue. I have watched auditing videos for the last 2 or 3 years now and i have seen so many officers violate someones rights or not do their job properly. Not vonduct a proper investigation. Assault a member of the public, along with many other innapropriate actions and illegal actions and in so many of those cases internal affairs or their fellow officers find that there is no wrong doing that was done on the officers part. And i have seen those decisions made when there is 10p% video proof that the officer did do something wrong or illegal and yet still.......no wrong doing found. Or the usual........"we have found that officer so and so violated the persons rights and we have handled his discipline internally. The case has now been closed". Omfg. Really? But yes, i have seen that written on the reports so many times its not even funny. I guarantee if internal affairs was truly a separate entity with outside investigatored that were hired for those positions that have no allegiance to that department or to the officers in that department and that I.A. department was also overseen there would not be these problems of a cop doing something illegal and getting away with it because their best friend or ex coworker was the one that investigated them and found no wrong doing. Its out of control. And they can get away with it because of the way it is set up. Again, how has this been left untouched and unchallenged for many many years and just allowed to happen and continue to happen? In my eyes its a direct fonstitutional violation. You are not supposed to be able to monitor yourself. The system of checks and balances works excellent if set up and utilized properly like our forefathers planned it out to be . But its not. Its misused imo and therefore so wrong. So many people have their rights violated or are assaulted by police or their money stolen or whatever it is and nothing happens. Its very sad. Can anyone answer any of this? Or am i completely wrong about it? Sorry about the novel i just wrote. Lol.

File your formal complaint against all parties involved. Then File your lawsuit regardless if the taxpayers have to payout a lawsuit. They don't care,so you should not care either if the taxpayers are on the hook.

@@alexlewis5526 It's a conspiracy to avoid applying the law to a government employee. The government employee battered James. He went to press charges. It was so clear that they couldn't just ignore it and decide against pressing anything. Instead, the police and the district attorneys devised a way to minimize the charges and then prevent James from participating so they could basically dismiss them.

James, the reason they charged him with an ordinance violation for battery is because he wont get fingerprinted or mug shot . An ordinance violation even if he pleads guilty does NOT go on your record. Him being a state employee, if he was to be charged with a misdemeanor battery and found guilty, potentially he can lose his job. Even if found not guilty he'd still have the arrest on his record. Keep fighting for a misdemeanor battery charge against him. you have 3 years for the statue of limitations.

Im sorry if this is a long comment T.T. but i think its important and this situation i think relates well to what ive been saying the last couple years. I have probably commented about this maybe 20 times on different auditors videos and have never gotten a response from anyone. I knew a little about it but i did my own research this week and what is happening with virtually every law enforcement division in the country goes against the constitution in my opinion. Ill try to make it short. So the constitutiongave us the three branches. Executive, judicial and legislative. What the constitution also set forth is that each branch shall have a set of checks and balances basically to make sure each branch is doing the right thing and these sets of checks and balances ensures that each branch will not oversee and monitor itself but that other agencies will oversee and check on them to make sure they are doing the right thing. And it ensures that each branch is not monitoring , investigating or policing itself. Police are part of the executive branch. Yet they monitor, investigate and police themselves. Which in my opinion is a direct violation of the constitution. How iare they able to get away with this? And how have they gotten away with it forever? But they have and continue to. Smaller departments dont have a fancy title for their set of checks and balances. They just investigate themselves...ie: when theres a complaint on an officer just another. Officer investigates the claims against that officer. The larger departments have that fancy title of "internal affairs" who investigate any officers who have recieved a complaint be that criminal or not. Mso the smaller departments investigating themselves.......100% a direct violation of the constitution. That is not how the constitution states a government branch shall be monitored. Then the larger departments with the internal affairs is a little different but mostly the same. Essentially they are still monitoring and investigating themselves which is against the conatitution. Internal Affairs aounds good on paper. But in reality their offices are usually in the same building as the police department they are tasked with monitoring and investigating. Alot of times I.A. is in the same exact office as the police department. Also alot of I.A. detectives retired from the very department they are now monitoring. So maybe they went from the street to working in the same office they worked out of when they were on the street except just behind a desk now. Then alot of times they are of course friends with the officers they investigate and monitor. Doeant sound like a conflict of interest to me......lol. so with that whole set up with the location of Internal Affairs offices and the fact they are friends and ex coworkers of the officers they are tasked with investigating that goes against the constitution because they are still monitoring and investigating themselves. There absolutely needs to be a n entity assigned to monitoring and investigating the police but in my opinion they should be a completely separate entity. The investigators should not know the officers they investigate. In other words they shouldxbe a completely outside third party organization. How in the world have they been permitted to have it the way it is for so long without anyone saying anything or trying to get that changed? I have no clue. I have watched auditing videos for the last 2 or 3 years now and i have seen so many officers violate someones rights or not do their job properly. Not vonduct a proper investigation. Assault a member of the public, along with many other innapropriate actions and illegal actions and in so many of those cases internal affairs or their fellow officers find that there is no wrong doing that was done on the officers part. And i have seen those decisions made when there is 10p% video proof that the officer did do something wrong or illegal and yet still.......no wrong doing found. Or the usual........"we have found that officer so and so violated the persons rights and we have handled his discipline internally. The case has now been closed". Omfg. Really? But yes, i have seen that written on the reports so many times its not even funny. I guarantee if internal affairs was truly a separate entity with outside investigatored that were hired for those positions that have no allegiance to that department or to the officers in that department and that I.A. department was also overseen there would not be these problems of a cop doing something illegal and getting away with it because their best friend or ex coworker was the one that investigated them and found no wrong doing. Its out of control. And they can get away with it because of the way it is set up. Again, how has this been left untouched and unchallenged for many many years and just allowed to happen and continue to happen? In my eyes its a direct fonstitutional violation. You are not supposed to be able to monitor yourself. The system of checks and balances works excellent if set up and utilized properly like our forefathers planned it out to be . But its not. Its misused imo and therefore so wrong. So many people have their rights violated or are assaulted by police or their money stolen or whatever it is and nothing happens. Its very sad. Can anyone answer any of this? Or am i completely wrong about it? Sorry about the novel i just wrote. Lol.
