We have no assets but he doesn't want to sign. So what should I do?
Grest video, straight to the point, thanks
quick question, on the written agreement where we say I'm going to keep my things and she is going to keep her things, should these things be written by name? e.g. cars models and years, furniture descriptions, saving accounts numbers etc. or can it be just a broad statement? Thank you
The broader the language the more likely it can be misinterpreted. Specificity is usually always better.
Dude, really?
Really what?
@@IllinoisDivorceTV
Not knowing that one must specify items by name, not broadly.
Thank You, Do Not Need To Mess; The Evil Divorce Process Up; Criminals, Former Attorney , The Exspouse are furtherance their interests. I did not know
Hi. Do you have a link available so I can start the divorce process without a lawyer.
Google "Illinois Legal Aid online divorce process."
My wife sold r home and kept all the money from the house and did not give me anything I didn't put my name on the house because they said I didn't pay my student loan but I did my info burned up in a house
Been married for 28yrs this man didnot want to get married according to what he said said that he was forced to marry to me so if you were forced to marry to me why didn't you divorce me he got married again after me and him got married and is now living in Tobago married again and not divorced it is hard for me to come up with the amount of money to pay a lawyer
After getting married on the 12th of August 1995 by January 1996 he left the matrimonial home married again so I shouldn't have any problems going through with the divorce
my spouce has a serious civil action lawsuit against him. I want a divorce to protect myself and my assets . Get back my name so I can go forward without fear of losing everything. Any advice?
This is a complex area of the law. My only advice is to have a consultation with a lawyer.

Nothing cud go wrong w "My Agreement!" NO kdz! NO property2split- A Car, A Pet-NOTHING! Worst part-Have had ZERO contact in Over A DECADE! NO IDEA where they work, NO IDEA where they live, NO IDEA how2contact them!!! How do u getta divorce under these circumstances PLZ!??!
1. Wife filed for divorce and demands sole possession of the unencumbered home. She does not want to sell the home.
2. Husband does not agree to the demands. He, too, does not want to sell the home.
3. What happens?
In my opinion, the judge has to throw out the divorce petition, or never let it be approved. i.e. how dare the state order a home to be sold when neither party wants to sell it.
In short, divorced/divorcing couples can live in the same home... forever if they wish.
Correct?
I'll answer in regard to Illinois Law.
You're incorrect. It's well established law and unequivocally constitutional for the court to order the sale. Or to even order that the husband sign over his rights. The total marital estate must divided equitably however.
This is also similar to what happens if you buy a house with somebody else. If you're both on the title to a house and one of you wants to sell but the other doesn't you can file a petition for partition. In the court can order that the house be sold.
When you get married you're agreeing to the laws of divorce. If you don't want those laws to apply to you then don't get married.
@@IllinoisDivorceTV
"order the sale..." to whom?
Neither party wishes to sell.
Another way to look at it:
Suppose the wife doesn't know the law and/or her lawyer isn't telling her.
Then she finds out the law as you interpret it: a judge will force the sale. So, she panics.
Please point to an article that answers the question: what if neither party wishes to sell?
ALL of the articles I've found are about one party wishing to sell the home, but the other party wishes to remain in it. In those cases, yes, a judge would force the sale.
That's obvious.
But what isn't obvious is my case:
A judge cannot order the sale of a home if both parties want it. A judge CAN order that both parties can live in the home, i.e. one spouse cannot legally order the other spouse out of the home, since they both own it.
@@IllinoisDivorceTV
But again, in your example, one party wishes to move out.
In my example, neither party wishes to move out.
Divorced/divorcing couples can live together, and hence, a judge cannot order the sale even if one spouse wants sole possession in her divorce demands.
So, the judge cannot grant the divorce.

Please let me know what you think about my question, and point to an article if possible, Thanks!
