Gurl it's a billboard for a local zoo, not a billboard for like, Lollapalooza, of course the pay isn't gonna be super high! I would appear in a zoo billboard FOR FREE if they let me pet one of the animals lol
Especially considering the fact pics like this aren't exactly labor intensive for the models. You stand next to a couple other random people, smile blandly, and people take pictures of you in a few similar stances and arrangements, then you go home. They didn't even have makeup people or wardrobe department because it's a really basic, generic picture for a small local zoo, not a TV ad for Disney world or sea world.

The real issue is her agent didn’t do the due diligence to read and know what the contract is. Then the next issue is her not reading and questioning the contract. She was lazy.

@@IIDEADBIRDII normally in contract business an agent usually does due diligence to ensure the pricing is favorable to them and employees because agent usually takes a cut % so if the rates are higher then they can collect more. Is the same with hiring lawyers, they are normally looking out for your best interest and in courts you can file a motion that it was ineffective counsel if you feel they didn’t do the due diligence to represent your case.

Also, "social media" isn't a use category for talent. There are "internet only" or "influencer" contracts, but if she started 10 years ago, she should know her industry terms. If you work under "all media", every talent should know that means anything, anywhere. Read your contracts! Real contracts also have an expiration for use (13 weeks, one year, in perpetuity). Wonder if she knows how long they have the rights to that photo.
That's a good point, she never mentioned the length of use. Did she really sign her use for all media in perpetuity thinking it was gonna be some little social media thing cause I sure hope not.

Bit of an explination. As a marketing student, 'All Media' is used for when you will be using a single piece (Like a photo, video etc) in multiple media sources or channels, through traditional marketing outlets like billboards or busses, or E- Marketing, like social media and influencer marketing. Essentially, its so you can have a clean message going through (using one image so people can see it and be reminded of it multiple times) They might use that billboard image on their pamphlets, signs outside the zoo or on their online media.

I would see her point if there was some precedent where "media" typically only referred to social media, but... there isn't. The term "all media" has been around way longer than social media, and it's always meant the same thing - all media.
Especially stupid since social media ads are relatively recent ans she claims to have 10+ years experience in the industry meaning she would have started right at the dawn of social media advertising, so she should have realized that most media isn't social media or even digital media

So, looking it up, apparently billboard models can make from $1500 to upwards of $10,000. My guess is, though, that it's normally for a national ad campaign or a regional campaign. She even said here that it was going to be six billboards and they had 15 models there, so that's likely why it was low and there's nothing saying they won't still use it for other advertising as well.

Yeah, it’s pretty nonsense. You could absolutely make the argument that the company is trying to manipulate things by saying “all media” so they don’t have to charge higher rates for specific types, but it’s not like they’re forcing anyone to do anything or being deceitful about it. This woman’s over here acting like she’s being taken advantage of, and I’m just like “How? Because you’re so greedy that you can’t just turn down a shoot that doesn’t sit well with you? @@Croach193 Also, there's little that is more clear than "all media". They can put you in any media they want. In their brochures, on tickets, in the monkey exhibit for comparison. An adult should know that media is more than social (hence a specific type of) media.

There are plenty of people who would be happy with a few hundred bucks for a days work, and a billboard costs money, it doesn't make money. It brings awareness, which can lead to making money, but her face isnt on the packaging for a product being sold.

In the Corps there's a wonderful usage of the acronym USMC, "U Signed the M*F* Contract". You read it, you signed it and now you are bound by the terms therein, good or bad. No one forced her to sign it

If the contract says "all media, " you must assume it means ALL media. I work far and away from the modeling industry but if I saw that in a contract, I'd presume it meant billboards, posters, bus ads, etc. It's like getting upset if you write a book and the publisher sold it as both an ebook and a physical book.
She's just upset that she agreed to a lower rate than she feels that she's worth after failing to perform any due diligence whatsoever. If she felt like there was any hint of ambiguity, she should have run them by her agent or contacted the ad agency asking for details before signing the contract.

As a media student one of the first things you learn is that before signing any contracts you read through them fully and in sure your lawyer dose as well and if you don’t understand a part research it with your local regions regulation on the topic.

The rate was apparently low for the job, but was clearly advertised with all the associated conditions.
And now she's making the company out to be misleading or deceptive?
I can understand being annoyed with yourself. I can understanding being wary that the company pays below the expected rate for billboard work.
But I can't understand anything past that. It's ultimately her mistake and her choice. She was not misled, she just misunderstood the terms and is now annoyed about it.
It's like being mad at a waiter for you accidentally ordering the wrong dish at a restaurant, or mis-reading the ingredients of the dish you ordered.
It's ultimately her 'fault'. It sucks that she was lowballed on pay, but she still accepted it and should just move on with her life, learn for the next time she reads 'ALL MEDIA' on a contract.
Honestly, she probably isn't even annoyed at herself. You can tell she's one of those ignorant people who always think they're in the right and you just can't win an argument with. She's essentially mad at a company for an assumption/misconception she made on her own, which she shouldn't have even HAD if she was truly working in this industry for a decade.

As an autistic person who is very literal, her reading “all media”, yet thinking it meant something else is the perfect representation of how it is when I say something to someone. They “interpret” what I said, when in reality….I meant literally what I said. 🤦🏾

Besides all media meaning all media, most people really overestimate how much people in certain industries make (such as acting, modeling, music etc.) as they typically focus on the exceptions, you know, the "stars".
(Local) billboards do not have nearly the reach of a national ad campaign, especially on radio, television, or a major national or multinational print publication (even though print does not have the power it once did) and radio/television also have to do more than look attractive, they have to be able to speak and emote. Also, fashion models typically make more than other models.
A quick internet search reveal that the financial compensation for billboard models can range from $500 to $10,000 (or more) depending on whether local or national, location of billboards, number of billboards, duration of campaign etc. And who signs a contract without asking questions and sorting out specifics, and maybe even negotiating first. Maybe someone just entering a field for the first time but surely not a veteran.
You should definitely buy Jacks cookbook and make a weekly video where you do a new recipe everytime and give a review.
My mate is a model/actor and he did a shoot 6 years ago, about 2 years back he found out his image was used in an advert without his permission, on his contract he was signed up for one company to use his likeness for an advert. The company that took his photo, had put it into their reel of images available to buy, this WAS a violation as it was a set job for a set shoot to be used by a set company.
He sued and got $100k+.*
Now I'm not sure if this woman is in the right or wrong, he makes sure to look at his contracts and makes sure he knows how it can be used, now while the company who took his picture thought they could use them in their stock reel, they made a mistake, sure, but they messed up, got sued and had to pay out.
*Edit: sorry was $10k, there were several people who the company messed up their contract, it was a class suit and so it was $100k settlement but he got roughly $10k.
I asked my mate about it to clarify details and ask his opinion on the video, he feels personally she made a mistake as August said, but he also wasn't 100% sure on the details, he feels she left some key info out of her video, either way, he still said, read your contract and make sure you understand it before you sign.
Also if you think this story is made up, I don't care, have a good life and again, make sure you know what your signing before you sign it.
She read the contract and if she was confused she should have asked for claification or walk away. She literally went through with it and then is whining about it.

Dude i was once on a billboard as a kid. My friends dad was a photographer and he did a free photoshoot for my yearly pics and stuck em on a billboard. We never got paid and didnt give af. It was fun and smth to brag about in school. Its not that deep...
I think you're comparing two very different situations, though. Not that I agree with her stance, but she does this as a job: a form of income. Many people do. This is as important as any other form of work and should be considered as such by all parties.
My face was in the newspaper for our state a few times as a kid. That doesn't mean it's anything even close to what this kind of work is. In addition, even children that do this professionally need advocates that can CORRECTLY interpret contracts and legal documentation.
It'd be one thing if she just allowed one picture for fun. The scope of reasoning there is that she won't be compensated and that singular instance would be used for its intended purpose, which would be conveyed to her. However, even in your case, that doesn't mean it's allowed for anyone to "borrow" your likeness without your permission at any point. You had awareness of your picture being used at that time, for that purpose, but if that same entity uses your picture without your knowledge for other things, that's when these things turn sour, and is the kind of angle she's trying to pull here.
There are different levels to all these things. She's wrong simply because she didn't properly advocate for herself like she's claiming. She didn't correctly read her contract and ask the right questions about it. Knowing what you're doing is half the job with these things. She isn't doing her job well.
So if a friend's dad invited you to be in his movie and didn't pay you, that wouldn't mean that actors shouldn't get paid. I don't know what the billboard was for, but if it was advertising that made him money, he might have been ripping you off. You were cool with it because you were a kid who didn't know better.

I hate the whole free trade argument because the agents and content producers capitalize on it and use it to their advantage. These are the same people who would appeal to the idea that there are "standard pricing" for certain gigs whenever the standard pricing benefits them. Worse yet is when you refuse to do a gig for the price you set, because free trade, and they start blacklisting you.
2) Yea, ad and modeling agencies are shady af, especially in Florida. I was reading an adult actress explain how she entered the industry since she was still actively in college. Turns out, she was a regular model before hand but wasn't getting any gigs except for adult content which she regularly denied.
To which I wondered, which professional modeling agency also dealt with adult sites and what would ever be the incentive for them to get her regular modeling gigs which pay less and has way more competition, meaning less gigs. Ofc, she ended up entering the industry when she was in debt and was about to be evicted and needed cash fast.
Some agents have trafficked women as well for mainstream sites which isn't talked about for some reason.
Show biz is shady biz. And there should be unions involved.
I can kinda see both sides here. On one hand, obviously, all media means all media. But the client isn't exactly in the clear here either, it does seem like shady practice to keep your client in the dark about what they're doing so you can pay them less.
This is what we call buyers remorse she thought she was getting a good rate then later found out that it was worth more and she's salty about it oh well won't hold up in court at all
She can't afford a court battle... she is out there selling her ugly mug for a couple hundred here or there.
