it's not.. The independence and wisdom of the U.S. Supreme Court has been irreversibly destroyed by 3, possibly 4 justices who have placed their ultra right wing biases over the very Constitution they swore to uphold. For decades to come, legal scholars will look at certain members of this court and say, " My God, look what you've done.. ".
It's like foreshadowing eh? As if the show had a vision into the future.
An incredibly human reaction from Joe here, I remember my family being shocked that he would lie even for a moment about the Justice’s condition. But in that moment he’s not only frustrated with the prevailing political winds, but heartbroken that Toby was right.
I agree. I think I would have lied at that moment too.

you should take the time to watch it. i rewatch the entire thing starting around thanksgiving and finishing before christmas.
Yes, everyone's thinking of the past month's news, but another point of relevance is the bit at the end about how Republicans appoint neo-conservative judges so young they're still "in swaddling clothing" and "hope that they don't grow a conscience." Because since "The West Wing" came out, Republicans got smarter and began to bribe the justice (like Clarence Thomas and Samuel Alito) to keep them in the right-wing fold.
It's a show that means more today than it ever has. It holds up well. It depicts Democrats and Republicans that can be admired.
Whoever is uploading for the channel is on point today!
Thinking back to Matthew’s time on WEST WING I think of this storyline. Joe loves the Chief Justice so much, and his heart aches.
And all these Democrats in charge have tunnel vision, only interested in what they need. Toby, especially, can forget to even think of the other person’s feelings.
I’m glad to finally have the season and episode listed so I can follow all of Joe’s time in the Bartlett White House.

It took about a day before the Republicans resorted to new conspiracy theories, backed up by misogyny, sexism, and racism.
From July 21st, 2024, the choice is now between a young accomplished well-spoken prosecutor and an almost octogenarian convicted criminal who goes on incoherent rants about toilets, windmills, sharks, and Hannibal Lecter. Which will the American people pick to lead them.

1. In an "absolute mathematical value" sense, Toby was right that the Chief Justice may have been physically and/or mentally incapable of fulfilling his judicial duties further.
2. BUT Toby was 100% WRONG is his GROSSLY MISPLACED belief that he, the President, any of the President's staff, or ANYBODY else OTHER THAN the Chief Justice himself somehow had the AUTHORITY to MAKE THAT DETERMINATION -- they DID NOT !!!!!!!!!!!!!!!!!!!
I shudder to think what's going to become of this Country as our "rule of law" and respect for the law continues to unravel and evaporate. TOO MANY Americans simply have NO CLUE and NO IDEA what the Constitution says and provides ... and/or how to change it. This is largely (but not exclusively) due to the FACT that MOST students are no longer taught the Constitution or Civics in school -- certainly not with any vitally necesary detail. As a result, they erroneously believe that court decisions ought merely to be a matter of "popular opinion" or "majority rule" -- the hell with what the Constitution mandates or what the law (statutory and/or case law precedent) provides and demands as a resulting outcome. And if one court fails to render a decision or outcome that they "want" in a particular case/dispute, then it's up to an appellate court to reverse the decision to give them the result "they want" ... all the way up to and including the Supreme Court. Further, if the Supreme Court failsto give them the result"they want," then it must be time to force "non-cooperating" justices out/off the bench and/or time to "pack" the Court with enough judges who will see things their warto achieve the result "they want" once again. THAT'S NOT HOW COURT DECISIONS ARE decided (NOR SHOULD THEY BE DECIDED THAT WAY ACCORDING TO "POPULAR OPINION/WANT) !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
I am NOT OPPOSED to "term limits" per se -- but I DO DEMAND that they be attained legitimately and properly. This means that ONLY an Amendment to the U.S. Constitution can accomplish that objective -- NOT merely some piece of Congressional legislation signed into law by the President. Currently, with respect to age, the Constitution REQUIRES (among other things) that Representatives in the House be at least 25 years old, that Senators be at least 30 years of age, and that Presidents be at least 35 years old. But the Constitution affirmatively omitted any reference to an "upper age limit" at which any of those individualy could serve in their political offices, or any "maximum" number of terms/years in office an individual could serve.
As for Article III Federal Judges, the Constitution specifically awards them LIFETIME APPOINTMENTS. The Founding Fathers specifically included that provision to SAFEGUARD JUDICIAL INDEPENDENCE and to ensure that judges would never be intimidated by mob rule into deciding a case according to "how the mob wanted." I agree with that protection -- and the judge has to be responsible and selfless enough to step down/aside if/when he/she is no longer capable of doing the job ... but it's the JUDGE'S DECISION and ONLY the Judge's decision. ONLY a CONSTITUTIONAL AMENDMENT can force this "term limits" issue.
The pain of being Toby is that he is always right.
Finished watching all 7 seasons, episode a night, a couple months ago. I think I'll start again, something comforting about watching a political system working with dignity and class, given what's going on in real life.

TWW was and will remain my favorite show of Aaron Sorkin’s. One thing he wrote very well is the level of loyalty law clerks have regardless if they are SCOTUS Clerks or if they are local Superior Court Clerks. It is a special bond and undying loyalty that often times can complicate judgement and/or ethics. Every former law clerk of any judge that has been under my wing when they enter private practice have strong pride in their clerkship years and are loyal to a fault. It’s incredible.

There are two types of commenters in this video: those using it as as a parallel for Joe Biden’s age running for re-election (and these people should also lump Trump into this category), and those identifying Toby’s concerns of keeping/managing /stacking Supreme Court justices along party ideals is what the Republican Party has been doing since 2015

This scene isn't really just a parallel for Joe Biden. It was also a parallel for Ruth Bader Ginsburg and for Diane Feinstein. Joe's (Matthew Perry) lie at the end of the scene is the same lie that Ginsburg's and Feinstein's aides delivered in the months and years when they were obviously no longer fit to serve. Add on Mitch McConnell.
Fair to lump Trump’s faults, with Biden’s disabilities. Unfair to cite Republican court stacking without including Democrats less successful attempts.

"Lifetime appointment", "He's still alive". No public office should be run like this. Lifetime appointments are ridiculous in every instance. Things change more than people.
We need term limits for EVERY public office; when you can no longer serve the office you need to leave it. It is more honorable to give up a position you can no longer do than to go on unable to function.
If RBG would have resigned her position when Obama was in office we might not have lost Roe or had a SCOTUS decision turning our president into a king.
There are a bunch of people running now that shouldn't be, including Biden and Trump. Moscow Mitch should have been voted out a decade ago, same with Feinstein and Pelocy.

Ed Lazarus developed a plan to switch from lifetime appointments to SCOTUS to staggered 18-year terms, so one Justice would come up for replacement every two years (absent death, early retirement, resignation, or impeachment). Lazarus's plan addressed how to deal with the current Justices, who of course have life terms that cannot be altered. Of course, we would need to amend the Constitution to do any of that, but it would be worth it.
Amen. I say 20 year term for Supreme Court justices, and then retire with a splendid government benefits (including clerks). That seems fair to me!

What the hell are you talking about, she would’ve had to resign in 2008-2010 by that logic. The Republican didn’t allow a replacement for 2015 and they held congress from 2010-2018, Trump was president from 2016-2020.
She held on as long as she could so a democratic president could replace her with a liberal judge.
@@cgallegos2106 Well, I think what the OP is saying is that RBG should have retired during the Obama administration. She was 75 when Obama first took office, she could have retired then and there and would have been replaced by a justice with similar views by the Obama admin. People learning from this past mistake is why there was so much pressure on Breyer from the court of public opinion to retire while Biden's in office and make way for someone younger.

Not necessarily age limits, but cognitive and ethical tests. I am not sure which candidate would fare worse.
Capability, cognitive, and ethical tests are all subjective. You can't argue against a birth certificate. Many state and local level judges have age limits already. There's absolutely no reason not to change the supreme court justice appointments to "up to age XX." I suggest age 72, maybe age 75.
If most of the general public retires by age 70 or 72 (if not before), then that's good enough for politicians and judges too.

Again, there should be term limits. We have seen in recent years, people occupying positions of authority and power who were well past the time of retirement. Having a lifetime hold over a role is something I strongly disagree with.
I do sympathize with Joe perspective, but ultimately, I agree with Toby's standpoint.
I'm more of a fan of age limits instead of term limits. There's nothing inherently wrong with someone staying in politics for a long time, and the issue of people amassing wealth or power over their time there can be dealt with by other laws and regulations. There definitely is something wrong with letting someone remain in politics after their physical, or particularly mental, faculties have started to fail or wear out from old age. Just like how we make aging folks retire from the workplace in their 60s, so to should politicians be forced out at the same age. The average age of the US Congress is currently 58, so just age limits alone would help clean the legislature up and allow more opportunities for fresh faces to get in.

Whilst I'm sure that there are exceptions to this rule, most people over the age of 70 don't have the mental and physical stamina and capabilities to hold down a full-time job - especially one where you hold significant power, authority and influence. Which is what public office is all about.

@@_Hoagie Age limits are an interesting idea. Term limits, on the other hand, are a terrible one. People are against ‘insiders’ nowadays, but these political and government positions are like any other job. People develop salient skills and knowledge as they gain experience. They also can develop trust with one another; that can help them get things done and weather tough times together. Term limits are a way to ensure that amateurs are in charge. A remedy that is worse than the disease it aims to cure.
@@_Hoagie We do not make aging folks retire from the work place - they choose to retire or they are let go often because they cost their employers too much in benefits and salary over a long tenure. The GOP wants to increase the year you can claim social security to 70 instead of 65. Recently I watched Dr Fauci be interviewed by Lawrence O'Donnell and he's the same age as President Biden but he comes across much younger. The presidency ages everyone. Individuals age differently. I think an upper age limit is fine for the year you would begin your administration - 70 is about right as a max. But in my opinion, age is not the big problem but how long they have to be lobbied and have millions of dollars funneled into their campaigns to buy a vote and stay in power. Citizens United (2010) was a huge turning point, not the beginning of all the pay to play but it opened the door to much bigger influence and dollars pumping into the campaigns.
You hear so often from family of the frail, dying and very elderley: 'He always bounces back' and 'he's a fighter' or 'He's in really good health'.
Imho this was a classic example of why Supreme Court and federal court justices should have age limits. In Australia about 40+ years ago we made 75 the mandatory retirement age and our legal system hasn’t fallen apart! Also ALL our High Court (the equivalent of the US Supreme Court) justices are expected to recuse themselves from any possible political decisions!

And just so you know, when tabulating their rulings, Trump's nominees make up 3 of the 4 members most moderate members of the court. The Democrat-nominated members comprise the 5th, 6th, and 9th most moderate. So, there's really no cause for your statement. Trump's judges are actually very serious people.

Oh. What an incredibly great show this was. This was the dying era of appointment television. Great cast, great writing, great stories: The West Wing and The Sopranos were probably the last few good things on TV to end the 90's with.

This was such a damn good show, the best show that has ever been made about American politics. I have been interested in national politics since I was 15 during the Vietnam War. This issue never occurred to me until I saw this episode - who discusses resignation with a SCOTUS judge? is it appropriate for the Executive branch to put pressure on elderly judges?
The way Perry's face shuts down at 4:32 "He's fine, Toby...". Beautifully acted.
Perry is gone but that scene is one that every dem should watch and think about. They’re those who will side with loyalty, those with opportunity, and those who think they are doing the right thing but unwittingly serve the enemies to democracy. Run Harris dems. Don’t run the lion that was run a lioness that is.

That episode was AWESOME.
It's weird because everybody talks about the supreme court being independent and yet every president who can appoints his own people, to sway it one way or another. Terms should be fixed and the chief justice should be independent of any party.
No such thing as true independence. Everyone leans one way or the other. And ultimately, all courts are fundamentally conservative, because it's their job to read and protect the law, not change it.
If you look careful, you'll notice that until very recently, presidents have been unsuccessful at swaying the philosophy. Franklin Roosevelt got frustrated by the Supreme Court interfering in his efforts to get America out of the Great Depression: he kept appointing justices during his fourteen-year administration who'd say things during Senate confirmation hearings and do very different things once they got appointed. It's one of the drawbacks of lifetime appointments.
Eventually, presidents started gauging by judge's bodies of opinions, so prospective justices started avoiding saying or writing anything that might be considered controversial later.
This aged badly in light of the corruption of Clarance Thomas.
This seems entirely unrelated.

People loved Joe, but this moment of hypocrisy from him was one of the biggest testaments to who he really is. Sees Toby is right, but lies to save face and keep his party on the bench instead of doing what's right. And the exchange of:
Joe: "You think it's all a game, treating the court like it's Tammany Hall gone national!"
Toby: *Raises good points about Republicans doing the same thing.*
Joe: "Y-y-y-yeah well we could all do it better y'know."
Can't stick to a single gun this entire scene.
It's not about his party. I mean I haven't watched this episode in years but I remember it being clear that it was his love for his former mentor that made him irrational. He was in denial and couldn't bear to take the position from the man he loved and respected.

Man, I've been away from GB for a long time. I only recognize one person here.
A timely posting. TERM LIMITS! The original idea for lifetime appointments was so they wouldn't be influenced by outside sources, knowing they had a job for life. We can see how that's working out with the greedy bastards on the Court now. No amount of money is ever enough for some people. I'd even give them a limit as long as 20 years but then they have to leave and live under the same laws they helped reinforce as the rest of us.

You are wrong. We can't find any real conservatives anymore to have this discussion with. The Trump lead MAGA thinking crowd has stepped past the American ideals of honesty, equality and fairness. No lie is too grand, no deviance too horrible for them to recheck the path their leader is taking them on. One political party is opposing a near religious cult. One group up holds the Constitution, the other's leader calls for it abolishment. There is no middle ground when these are the poles of the debate.
