California has introduced a new law in public schools called 'Workplace Readiness Week,' aimed at educating high school students about their labor rights. This is FINALLY a HUGE win for workers everywhere. This is incredibly relevant considering the 283% spike in labor rights violations for those under 18 since 2015. I delve into the differences between employees and contractors, wage and hour protections, and worker safety. I also talk about the legality of discussing wages at work, which is often misconstrued by employers.     I'd like to add "vague working hours". I showed up to the office at 8am and left at 5pm (or 9am and left at 6pm). Either way, I always put in my 8 hours. I always got all my work done on time or even early. But When I leave at 5pm or 6pm, people still were hanging around in the office doing work. It's strange.
    And during my performance review, my boss accused me of, "Im not sure you even want to be here. All of us put in hours to get the job done. That's our company culture." Even though I had finished all my assigned work. I got written up.
    Honestly I could have left earlier most days since I finished my work earlier, but I didn't want to get accused of "not putting in my 8 hours".

      That's because your co workers still think hard work pays off and they're sheep. Alot of them probably doing it because they feel pressured and scared.

      And if you work (and even track) your time to be exactly 8 hours a day, no more no less, then you're penalized for putting in the "minimum amount of effort," even though you've worked your agreed-upon 40 hours (and haha if you think they're interested in paying you any form of OT because you're a salary wage slave). Happens all the time.

      I’ve had workplaces such as that, but I told the supervisor “You don’t sign my paycheck, you don’t have the power to hire/fire, so f* right off!”. I never stayed late. When I’m done, I’m _done_ ! I never stay more than a few years at any workplace, anyway.

      Some people really thrive in this environment. They like to put in extra hours to mask their poor performance. It’s pretty effective because managers have no real idea on how to measure someone’s quality of work.

      "work".... they talk smalltalk, smack shit, drink coffee... was your company like google where they offer company "lunch" at 6pm? either way, you are one of those top talents and keeping that motivation and drive "safe" is very important, however you manage to do it.

    I worked as a closer at Subway about 9 years ago. Before I started working there management had the other closers believing that they had to clock out by 10:10PM, even if they still weren't done closing the store (counting down the drawers, cleaning, putting all the food away, etc), and if you clocked out past 10:10PM you would be written up. I told my co-workers that it's illegal for them to make you work off the clock, so DO NOT clock out and if management says anything to you about it then tell them to come talk to me about it. They stopped clocking out early and management never wrote them up like they claimed they would.

      This exact thing happened to me. I started working at Subway almost 20 years ago and as a teenager and another teenagers didn’t know the law. The manager insisted that even though the store closed at 10 that we needed to have everything wrapped done and be out of the store at 10:10 and then we wouldn’t be paid any longer. Nine nights out of 10 someone would pop in the door asking for food at 9:59. We would be required to still serve them and half the time they would sit in the lobby and eat after they ordered the mostly they would leave after about 10 minutes. a few nights someone called in and I would occasionally work with the manager. She would take shortcuts and leave things undone for the morning shift, making excuses for herself, and then claiming that she could always be done at 10:10 things that all the workers were not allowed to do the night shift, eventually someone who knew the law ended up working there they brought it to the labor bureau and they ended up having to backpay all these teenagers for all this extra time that they worked that they didn’t get paid for needless to say that 1010 rules stop applying

    This should be in the national curriculum.
    Also, just putting this out there, but, now that I live and work in the UK, the labour laws here as opposed to those in the US have floored me. I'm still, after working here for 4 years (I was doing a second master's in my first year), wrapping my head around the MANDATORY, GOVERNMENT-REGULATED 28 days paid holiday per year. This is for every full-time employee anywhere in the UK. EVERY. SINGLE. ONE. I was lucky if I got 5 in the US! Hell, my current uni job gives me, I shit you not, 40 DAYS A YEAR. Over a month of PAID holiday, plus PAID sick days! Those don't exist in the US! Being American, I still stay in this panic if I get sick. I've had to have managers send me home and remind me that it's OK and not to worry.
    Going back to the holiday, though, I keep thinking I only have one or two here and there, but look at my balance and am like, "Welp, I can take a few there and a few there... I don't even know if there are enough free weeks for me to TAKE all this holiday!" Then again, I also still struggle to take days off when I'm sick and to go to the doctor, even though there's national healthcare here and the most I pay for ANYTHING is £9.85 for my prescriptions. That's it.
    The sad truth is that even when I worked in other countries, the paid holiday was better than the US (I taught English by trade). People wonder why the US is so miserable and full of angry people. This. This is why. People don't get to actually enjoy and live their very short lives- they're slaves to the system, and it's cruel and wrong. They work people to death there, literally. They don't have the sick days or paid holiday to get better. My mental health is so much better knowing that I can just take a few "me" days off, if I need to. I actually have the holiday to have a real vacation without losing out on pay, especially because I've still not broken the American habit of working off-the-clock.
    I personally think a lot of mental health concerns in the US would reduce if there were federally-mandated, company-required, set amounts of days of holiday and sicks days (a logical amount that lines up with other developed countries), along with abolishing hire-at-will/fire-at-will laws- those don't exist here or in most other developed countries.
    Unfortunately, the longer I'm abroad, the more I realise that the US is basically a third world country when it comes to labour protections for the common human than any other, even in places like the Middle East. Land of the Free? Ha. Land of the Shackled, maybe. People need to rise up and demand better. They deserve better.

      Add to that the fact that there's a ton of meaningless work added because employers have their employees for so much more time than is necessary, You have people who are staying at work when there's no meaningful money-making work to be done. When the time is crunched at work, then all the important things get done. It's incredible how many meetings are canceled when there's a backlog of customers who have work they want done.

      This is why that massive petition was going around for companies to tryout 4 day work weeks..........I'm ALL in favor of that perk! Europe is said to have the happiest people on earth because of that perk, long lunch breaks, national health coverage, etc.
      I work for a defense company and I have every other Friday off for RDO (regular day off) based on a 9/80 schedule I opted into. It's amazing having a 3 day weekend every other week.........I work slightly longer hours to makeup for it. I gotta say I am shocked you guys get 28 paid holidays!! I never knew about that, I thought you would have around 8 - 12 at the most so that is amazing. I think I get 10 paid holidays in my company (we have 2 paid days off for Thanksgiving, Christmas, and New Year's holiday weekends respectively). I also heard some regions give their people 2 hour lunch breaks and nap time!
      Those are the best PTO aspects of my job, the worst are the vacation and sick days. We get 3 sick days for the year and it's lame.........you could get sick multiple times and need at least a week or more for yourself. The vacation time we have to accumulate and it sucks balls......takes forever to build so it's hard to plan actual vacations here. All in all WLB is not bad here between RDO Fridays and paid holidays to be fair, but it's still lacking in the areas of vacation days and sick days (we don't have personal days, which sucks we have to take from our vacation days). I heard in Europe you get at least 3 - 4 weeks of vacation time by default......that's exactly what people in the US should qualify for at least.
      I think everyone should get at least a week of sick days, a week of personal days, two weeks of vacation time, and the paid holidays that the company participates in would deliver a solid WLB compared to the scattered PTO benefits to be currently experienced across US employers. I also think people should have the option for 4 or 5 day work weeks depending on the business and what an employee prefers, would be game changers for sure! Employees will be so much happier and supercharged when they have more time for themselves and things they care for.

      Yep.......I've seen this in one form or another in every company I ever worked at lol. Why do we need to do basic and unnecessary crap just to punch an exact time on the clock when we should be heading home a few hours early if there is no critical work to be done (I'm a salary remote worker myself now)! That's why in my previous fintech role I would skip lunch and just head out a hour early, much prefer to beat some traffic and see the sun on my way out.@@Roescoe

      @@Roescoe It's liberating......I know you feel every ounce of that! Pretty much what my tech lead and PM told me in the beginning, as long as they are happy with the work quality and output no one even really cares how I do my schedule (we do need to be on between 9 AM - 3 PM since those are core hours in case a team member or client needs us, but in truth it's not really monitored or enforced). If we have anything to do during the day, we can just deduct some time and work later evening.
      It was a loooong road getting to where I am now, absolute best work/life balance so far. In the previous fintech role some days were rough with screaming clients and being stuck at the office until 7 or 8 PM........then it takes like 45 minutes to get home after rush hour. If I can control it I will always opt to leave ahead of time and not stay late to impress people I don't care about.
      Working remote is amazing.....just focus on delivering solid quality work and gain great experience in the mix. No bullshit 1 hour traffic routes, loss of sleep, risk of accidents and insurance premium spikes, less miles on the car, less gas since no real driving, and no losing time dressing for the office.......1,000% time >>>>>>> money and office distractions/politics.

    I always just had the " You get what you pay for " attitude with places that paid minimum wage . I always looked for better jobs when I had 1.

      While I agree that some people are destined for minimum wage jobs and nothing but, it's no excuse to leave them open to violations of their rights. This is one of the extremely rare examples where I think CA is doing the right thing. I'm more than willing to give people credit where it's due. The more people learn about their rights, practical skills, and law in general, the better they'll be even if they decide to work menial jobs for their entire life. Even menial jobs are necessary cogs in the machine.

    So today at thanksgiving lunch, we were taking about the differences between my parents when they worked and now. My dad said something that literally made me gasp. In this area, textile mills were a huge thing back in his day. He said that they literally had a cute little area behind the building where people would get married. Yes at work…..the sad thing is that people just didn’t “have enough time off” to get married or do things like that. He said he remembers 6 of the weddings in that little scenic area. 🤦🏼‍♀️ it blew my mind. I do remember my dad working 24 and 36 hour shifts when I was young. It sucked cause he was always working just so we could have food on the table. All that to say, way to go California!! I wish my son’s school did something like this. If we let (some) employers they’d be fine with us having weddings in the break area just so we worked. It’s a dang shame really.

      modern corpos seem very efficient at keeping workers at workplace but doing lot of effort to prevent them doing useful valuable things (disruptions, reports, feedbacks, monitoring, ...)
      I heard this year they actually said more people should go to office coz it looks better for customer(most of staff is in india though, small minority are onsite in this country).

      @@stevenjohnson891 I’m in Alabama, they were here up til around the 90s or so. That used to be about all that we had here. It was like everyone worked there. Thankfully now it’s a lot different. Long hours and they got away with barely paying folks.

      As a cynic, I feel obliged to point out that if school teachers knew how to be financially savvy and understood debt and investing, they wouldn't remain teachers. Not under the current working conditions, anyway. Smart college students (like a relative of mine) always drop education as a major and steer into a field that pays well. Only the naive remain, and the cycle perpetuates itself.

    I worked in California for a few years, its strange working in a state where the employers are all terrified of the state labor department. Its much harder to get fired, but also makes ir harder to get hired too in my experience.

    After working in the corporate world for 10 years, i realize that company benefits, bonuses, allowances could easily be removed at any time by the company but labour laws and workers rights companies have to follow

    I wish there was a "workers rights" class or a "how to do your taxes", "how to finance a house" classes in high school.
    I know how to find the area of a triangle and what a "hypotenuse" is. All those wild triangles out here, sure am glad I spent years preparing myself!

    I think it is a good idea to teach early and often about worker’s rights in this nation. Companies love to take advantage of employees who are not aware of their rights. Knowledge is power, power should belong to the workers.

      Sadly, our nation does not want its people to feel empowered. An empowered populous is a populous that will take action and resistance. Gov-corporate relationships tend to work against that ideal as it's mutually beneficial. It doesn't require any grand planning behind the scenes when it's beneficial for both parties involved.

    Job offers and job descriptions should be treated as legally binding contracts and should be fulfilled as such. If an employer breaks that contract, they should be sued.

    As someone who lives in California and has worked here for about 20 years, and has had to have hearings from the California labor commission three times in the last 10 years, this is really good. Maybe now businesses in California being so blatantly, egregious, and how they violate their workers rights.

      Facts! California companies (especially all those Orange County businesses, in my experience) are the WORST when it comes to labor violations. I didn't know what a good work environment was until I was employed by a company headquartered in a different state. Garbage pay, expectations of working off the clock, it takes a month to build just 3 hours of vacation time, and they deny you vacation even when you have it. Shameful, glad California is putting these greedy a-holes in their place.

    EVERYONE should study this on their off time throughout the month. And do mean everyone. It is crazy what employers have gotten away with and it also goes beyond just work but also so-called rights of being a 14th Amendment citizen which is the same thing as saying you have none when you understand what is going on out here. It's definitely a start and I'll take it.

    Fun fact a lot of what you’re saying Joshua applies under Ontario Employment Law as well. I caught my employer reprising against me after I called OHSA on them for harassment and bullying and their response is essentially them twisting the same story I told them. Best part is this was in a call center and now I have PTSD with delusions from it. Now I’m taking them to court to explain why they thought that was a good idea and I’m going to therapy but hold these shitty companies to account. In the US you have the NLRA, OSHA and the EEOC use it. In Ontario we have the Pay Transparency Act, Employment Standards Act and the Occupational Health and Safety Act also use it

    My greatest concern is how to recover from all these economic and global troubles and stay afloat especially with the political power tussle going on in US. The government has really called things more difficult for its citizens,and we can't sit back and bear all the consequences of the bad governance.

      The wisest thought that is in everyone's minds today is to invest in different income flows that do not depend on the government, especially with the current economic crisis around the world. This is still a good time to invest in gold, silver and digital currencies (BTC, ETH.... stock,silver and gold)

    Super timely for me. I happen to be doing my annual mandatory training today. In my jammies. Its one of the few things I can do as work from home. I will get paid in full for all of my training time. Good companies exist but they are getting more rare.

    My first and last job in retail was 8 years ago. Stayed there 1.5 years even though the gaslighting sh** from the bosses there was huge a red flag to leave immediately. Would not make that mistake today..

    Since I work at a college, I am a member of the union. My rights are protected by them, and I am grateful for that. I talk with my daughter a lot about workers' rights, but I'm not an expert. This course should also be available in Illinois.

      Well, the union is protected by your paying dues. You're not as protected by the union as they'd have you think. You'll likely also find your job priced out more quickly than non-union labor.
      There's a reason unions aren't all that common outside of niche areas these days.

      It's largely because unions have become as bloated as the corpos. Imo, unions fail when they are no longer represented by actual employees of said company. Once someone's job is to solely work for the union, it will inevitably become corrupt, lose focus, and become a wasted source of revenue. Workers need to be more concerned with the value of their labor than paying union dues the same way consumers should be more concerned about where their dollars are spent then what the product they're buying can achieve. It's an idealistic want, but it's absolutely what would empower the people and create a better economy.

    I swear to God, this channel is a godsend, if I wasn't subscribed to this channel I wouldn't know everytime my employers tried to pull a fast 1 on me or someone else. 1 of my friends at work (I only have 2, bc co workers r not your friends like that) took leave after getting approved then they put him on the schedule, got upset because he didn't show up & then tried to fire him. He showed them the paperwork signed by the shuft coordinator. Never seen nobody flip it in Reverse back peddle so fast. 😂

    Worked for a company. They ran outta money and - since I was their only developer - they asked me to keep working. Said they'd back pay me if their funding came through. When I separated from them, I noticed they had never done that. Sued them. Judge said I wasn't employed during that time period and - thus - they weren't obligated to pay my salary.
    Just because a worker understands that a company "can't" do something doesn't mean they'll prevail in court. Most courts are just going to crap all over you.

    Notice that Walmart specifically put in their note to the employees, that discussing pay, WHILE ON THE CLOCK, is not allowed. That could potentially be a loophole. They might be able to tell you you're not supposed to talk about it while they are paying you. They also know that you aren't going to get together with your fellow employees after work.

    I remembered working for a company as a “marketing specialist”. Turns out it was a sales position where you had to sell fiber optics and direct tv to people in Walmarts. Also had to do everything by commission and the pay rate was fixed at $200 a week and you get $400 per person you sign up. Man I was so stupid for not quitting sooner, plus I couldn’t even find the company’s real name registered in the records!

    My company just laid me off before the off the season after making me salaried last year at a rate below minimum wage. They also never paid overtime despite being a manual labor job and paid every two weeks, never got a break.... Just saw an ig ad for suing your employer, pretty sure it was a sign. I signed up real quick. They should have at least offered me more than 2 weeks separation pay.

      @@user-hm9is5ke9i So that was during last year's off season so i technically wasn't really doing any work, we were just reading a book and doing meetings once a week. With the agreement that it would double when the season started, only to get laid off on this off season.
      Hopefully that clarifies, i know it sounds a little weird, but it was a weird employment. That's usually how they get you though, when i took the job it was supposed to be $35/hr, full time with benefits. That's the job i accepted.

    Somewhat Unrelated, but I wished Health Ed actually taught my generation about body nutrition (Like what is a calorie or protein?). All I got taught was how to put on a cond0m on a banana and stuff like that. I learned nothing about how to maintain a healthy body.
    I hope this new job education course actually teaches kids about job laws. And doesn't get hijacked by something else.

    My biggest nugget of wisdom to young people just starting to work - have the self-awareness to learn on your own. It's not in a company's best interest to give you a comprehensive breakdown of fair labour practices. I learnt this in the last few months. If you don't take it upon yourself to get clued up on fair work, pay and rights, then you'll pay for it in one form or another.

    The whole unlimited PTO thing is why US needs to implement similar laws to what we have in place here in Australia. Over here, employers are legally required to give you 4 weeks annual leave (PTO) per year at a full time job, and that builds up too. So if you don't use any of it for three years say for example, you'll have 12 weeks accrued. And if you leave the job, they have to pay you out for any unused leave that you have accrued.

    Walmart did two of these things right out of the gate. Stock equities were vested over a 4-year period, so whenever you leave the company, you are always losing at least 3 to 4 years of your options. They shifted to "unlimited PTO" which they call Discretionary Time Off of DTO last year, as well. It just meant that it's up to your supervisor's discretion whether you get the time off or not. I asked for one day about 4 months after that policy came into effect, and my supervisor gave me the 3rd degree about it. "Is that really necessary?" "Do you absolutely need to take that day off?" etc. I just gave my notice, instead.

    I worked for Rivian for 2 years. I was told it was contract to hire but I never once saw any developers get hired the whole time I was there. Every dev was a contractor and my contract just kept getting extended until oops btw a new policy as of yesterday just came in that contractors here over 10 months have to be let go. bye.I was told that all developes that get placed get hired and love it there during my initial phone call with a recruiter. It was cool React projects I worked on and owned/lead one of them for a year but now im unemployed for almost 6 months. ugh.

    I think the law and company policy are viewed the same. Speaks to the fact that corporations have too much power and always misuse it. Corporations operate very similar to a government. We work under mini tyrannical governments. This is why corporations generally get away with anything.

      There was a recorded meeting with someone who talked to a high-level member of a large corporation (really wish I could remember the name). The high-level corpo was happily bragging about how much power his company wielded. One of the things he bragged about, it cost about $10,000 to buy a member of congress.
      After that, lobbying gifts, favors (such as guaranteed high-paying positions once the congressperson left government) and 'campaign donations' ensured that the corporation would have their very own agent within the government who would take any actions that benefitted the corporation over any other interest.
      Every major corporate entity engages in this. Major pharmaceuticals, oil companies, defense contractors such as Raytheon, etc.
      Effectively, the corporations aren't just mini tyrannical governments. Corporations ARE the government. The corporations bought this government. They run the show. Outside of a few tiny wins for the peasants, corporations get what they want. Always.

      The state has a monopoly power to regulate and control market forces like competition, bankruptcy, etc. which enables them to grant special legal priveledges and protections to whomever they please. Naturally, Corporations start lobbying for this power, and buying political connections becomes a top priority over providing valuable products and services to your customers.
      government creates corporations by granting certain businesses special privileges and preventing other businesses from competing in a free market.
      the state also creates elaborate regulations that only large "corporations" can meet thereby pushing out small business and destroying market competition.

    I'd love hearing your thoughts on employers mandating employees work a second shift in a row when coworkers call out, and how in the medical field employees could be held criminally liable for medical neglect if the employee doesn't work the second mandated shift that management only tells them about 5-10 minutes before the first shift ends.
    Do note the above thing is not illegal for an employer to do if you don't have an employment contract. That happened to me all the time when I worked as an overnight DSP (Direct Support Professional).

    It is currently less expensive to pay a settlement as the result of being sued, than it is to allow employees to talk about their wages. This can be applied to nearly anything in the workplace. A court settlement is nearly always less expensive, regardless of the cause.

    ya my boss after first 2 weeks of me working there. One of his employee's ask me what I was getting here. I told him because I don't care at all. He raged out and called the boss. He came over to me to try and discuss it with me like I did something wrong. I was like look dude. I not going to lie to people for you. Sorry if you got a problem with it fire me and we will have some fun times with that choice.
    He looked at me and went ok. I am going to tell that other employee to eat a bag of D's and he walked over there and continue to tell him to eat a bag of D. Now he comes in everyday crying about his wage...... I just ignore him and tell him everyday if he is upset then quit and go somewhere they will pay him whatever it is he thinks he deserves.

    Let's not forget the 1099 contracted positions. The ones where you will be put on a shift or set hours, monitored and tracked in all your work, and will get some sort of "review" if you don't adhere to said schedule/monitoring, but you're not an employee.
