- The plaintiff rented a room in the defendant’s house. She says the house was disgusting because there were bugs and the septic tank overflowed. She moved out and is suing for her security deposit back. The defendant argues the plaintiff was the one who caused the septic tank to overflow, and she was a nightmare tenant

I agree, she just had a baby and started flushing a paper towel already. Every adult knows not to chuck those or other non dissolvable things down a toilet. She was stoned and couldn't care less. Luckily for her, nobody had any evidence. But I am in no doubt she did this.

Hard agree! I love her, but often times she is very out of touch with the reality of many people. And often times, she gets so bogged down in details that have nothing of importance to do with the case.
From a legal standpoint, removing emotion, it is a valid question. The judge wont understand what is going on without clarifying questions. It may seem insensitive but its her job. Just the way i see it anyway.
I love how she says she didn’t flush wipes. However she hesitates to answer each time, and then watch her body language each time she answers. She definitely caused the damage.

Because the Plaintiff did not give the LL a chance to make repairs, she just moved out when there was a problem. She could called the Housing Code Inspectors or the health department. The LL would have been put on notice and a threat of fines if not properly fixed in a timely fashion. Like within 10 days.
It comes from a place of privilege. Just like when I hear lawyers say "Just take the ticket. You'll have your day in court" rubs me the wrong way. Someone who lives paycheck to paycheck who gets a bogus ticket cause a cop was in a bad mood or something can't afford to take time off to go fight the bogus ticket or afford help to fight said ticket. Capitalism is just a way to keep the poor even poorer and the rich, richer. Cause it's the rich that dictate how the rest of us live by buying off politicians.
If I had a child and was living in sewage, I would move to my car if I had to.

My last landlord almost tried to play that game. I lived in that apartment for 17years, as soon as her & her husband walked into my house without permission, the day they bought it from my old landlord I gave 10 days notice and wanted my deposit immediately within 30 days. There was nothing in the apartment that was damaged but even if there were she would have no proof after 17 years that anything wrong wasnt there when I got the place. My old landlord didn't even remember what it looked like 17 years ago.
Pro tip; Tell the judge their question is irrelevant, that way they’ll know how well versed you are in litigation. 😂

This was a tough case to watch. The judge was uptight and both parties were an absolute mess not knowing basic court decorum and incredibly unorganized

How is toilet paper worse than baby wipes. I'm so thoroughly confused.
Some baby wipes say they are flushable because they are made to be treatable/soluble in water. The problem is they take a very long time to break down. Meanwhile paper towels are made to NOT tear at all- they are strongly knit fibers that will not tear, they just bunch up on water.
Paper towels are another thing completely! I definitely know the difference between paper towels and toilet paper, but the plaintiff said she doesn't use toilet paper, not paper towels!
Can someone who works for People Court tell the judge not every person can easily move for many different reasons. Judge we get your a multimillionaire but stop with the why did you not move in your condescending way and just say "was it possible for you to move"?

You know what I learned. As long as your a tenant paying your rent every month, the landlord is cool. But when its time to get that security back, here come all the complaints from the landlord 😂
Defendant did herself in when she mentioned needing the money; an indication she may have spent and no longer has the deposit.
There is a rent crisis in the world ESPECIALLY FLORIDA! Us natives are being forced out with the rent prices ! We can’t just “MOVE OUT” when u are now required to make 3-4 times the rent , they wanna see bank statements etc. We were born here , we shouldn’t have to and can’t “JUST MOVE” get a grip judge. It’s better to be dirt poor or rich, middle class is the absolute worst class to be in today’s world! We don’t qualify for any government assistance and taxed the heaviest!

My hubby works at a sewerage treatment plant. Flushable wipes cause massive blockages. Alongside feminine hygiene products and paper towels. I costs so much to find and fix the affected pipes and clear the filters at the treatment plants. They're so detrimental to the environment.

Why would you take a picture of standing water, but not have any pictures of the baby wipes? I think the septic hadn't been pumped in a while and there was a few paper products and tried blaming the plaintiff. The LL said that she needed the money and that's why she didn't kick her out, so of course she is going to come up with any excuse to keep or milk more money out of her.

I thought they said she was on a city system for water and sewer?? Those old pipes will have tree roots growing into them, cause blockages. Those wipes may have been from a previous tenant and just hadn't quite blocked the system yet.
