    When Judge Milian asked the defendant if the daughter is still living with her, she seemed a little surprised. The judge was probably hinting that she should be in an inpatient facility, because she needs to be. That girl is gonna destroy every property they live in

      There’s really not a lot of long term inpatient type deals for unruly teenagers unless you’re rich and even then, theres not always much they’re equipped to do. I don’t think people really understand how abysmal our mental health care system (or lack thereof) is in the US.
      If her problem is she’s an addict, she can go to a rehab facility. That’s typically 3 months.

      @@Team33Team33 I have insurance, I was talking about the case though, not myself. Also yes, therapists exist, I was responding to a comment about putting the daughter in a long term inpatient facility.

      One of my kids is the same way. Actually worse, I let the state handle her. & there's not much mental inpatient facilities in America. Mental health is a crisis.

      That's what I thought. I've lived I my apt 6 years and my walls do not look like that. The mom is just as much of the problem.

      It does take just a little bit of windex to clean it afterwards but it is possible and easy to dirty.

    The mom doesn’t seem too bright. Her daughter caused all of that damage and didn’t even try to fix it knowing she clearly has a mental problem.

    I think we can all agree the daughter needs help, but I would like to investigate that household and make sure there is nothing else going on that would make her act out like that. There’s always a reason why teens act out like that, there’s some underlying issues.

      something traumatic probably happened to her when she was a little girl so by the time she was a teen the damage was already done so an investigation at the time of this case would have likely turned up nothing because the root cause was something that happened when she was maybe like six or seven years old . its so sad and heartbreaking that small children are at risk in this world .

      As a parent myself, if my child turns out poorly...I am to blame. And if they turn out well...I get the credit. Parents are responsible for their F@#&ed up children. But it hurts to admit you f@#&ed them up. Take responsibility people.

      thats more likely because u had an honest landlord rather than handing it back over as clean as when u got it . too many landlords still wont return deposit money even if they get the place back in great condition .

      Lived in a rental for 3 years, husband and a toddler got all my deposit. Lived 2 years in another rental got all my deposit. Lived in a rental for 7 years got all my deposit. I had friends that owned homes and they wanted us to move into their homes. All of my landlords came to shake my hand because it was the first time after a tenant had moved out and they didn't have to do anything, nit even behind the stove, refrigerator etc. All drawers, cabinets, closets bathrooms, carpets, windows, were left in a better condition than we got it from them.
      The movers also made comments that we were their only customers that they didn't have dirt under any piece of furniture. They moved us twice. 😅

      I lived in my last rental almost 11 years. They returned our whole deposit minus $10 for an administrative fee. 😊

    $470 for all that damage? They let that daughter run amuck and then shrug their shoulders like that's normal teenage behavior. This goes beyond 'normal wear and tear', unless you've rented it to a pack of wolves.

      Well it’s wasn’t just 470 dollars, it was also 1900 security deposit, so plus that she got over 2400 dollars for putting all the damage, and that carpet looked so old it was a disgrace before they moved in.

      @@sandrawestley4193 If it was that bad, why would you move in? Cases like this remind me of why I never pursued owning rental property. People move in, trash the place and you need to spend thousands of dollars repairing or replacing what they tore up.

      The carpet needed replaced before they got there so nothing they did to the carpet is why it needed replaced since it already needed it.

      Correct, but the carpet wasn’t in good condition to begin with. That’s why she couldn’t be reimbursed for the cost of the new floors. It’s unfortunate but a tough reality, the landlord rented it out in the condition she bought it in. If she spent a bit more $ before to fix it up she could’ve walked away with more.

      It cant be cleaned but that doesn’t mean they get brand new laminate floor or even new carpet. They get
      whatever the old carpet was worth when they turned it over and those before pictures looked pretty old and warn.

      have u noticed the homeless problem in america ? its because the mental services SUCK in america so thats why there are so many mentally ill homeless people. so no this family doesnt need to do anything , the government needs to do something for all the taxes and other fees they charge to society !

Using the excuse that the homeless population sucks in ‘America’ is because lack of mental health services is one sided.. there are a host of other contributing factors.. but what people will do is pick apart what fits there narrative… folks have survived years of mental illness w/o ‘support’ so don’t blame ‘homelessness on mental health’
      Homeless suck in American because corps make it unaffordable live, montage rates are ridiculously high, and we would rather push out hardworking families and to make a profit…
      And truth be told most folks that are homeless are not mentally unstable.. but they will have you believe that!

      @@gigimarie1987 um , no u are totally wrong regarding the homeless issue . most homeless on the street ARE mentally ill and its not families out there who simply dont earn enough to afford high rent . there are programs and people who usually assist families with housing but its the mentally ill and drug addicted mentally ill that have trouble getting help with housing because the system makes it too hard for them to fill out all the necessary paperwork and attend all the necessary screening appointments so they just give up or never try and no social workers go out to find them and help them with the process . homelessness today is mostly due to the system failing because there are no longer any govt funded housing projects to house these people like there used to be in the 70s and 80s , thats why there are so many people in certain cities just living on the street .

    As a mother with a child that has several severe mental illnesses, i feel the mother's pain. People judge the parent when some mental illnesses are hard to treat. Don't give up on her. Stay on her side, don't make excuses, but let her know you understand it may be hard for her. My son is 17, and with treatment, he's doing great! Find the treatment that works for her. Don't allow the opinions of others to turn you against your child. It can get better. The older they get the harder it will be but it's still possible. Stay strong.

    I think this judge is starting to lose it... in many cases I've seen her attack the wrong party, meaning treating them bad. The defendants that destroyed this property were walked through this case with their hands held!

      Well it was very clear that they did not intentionally damage it and there were some mental health issues at play. Also they were not unreasonable and let them keep their entire security no question bc they knew they didn’t leave it in great condition. They did their bit.

      They legally can't cuz it's against federal housing laws. And I don't mean section 8. It applies to homeowners and home renters as well. But ppl find a way around it. Trust me... Ive worked in the apartment industry for 10 years and you see a lot of shit like that. Kids , old ppl, black ppl, and middle eastern ppl

    I disagree with JM about the weed smell. If the place smells like weed, you aren't going to be able to rent it out until that smell is gone.
    People wonder why rents are skyrocketing? Because of people like the defendant trashing the place and the landlords are forced to eat the cost of repairs because the deposit doesn't come anywhere near the cost. To recoup this amount, they raise rent on the next renters.

      Some owner/landlords like myself have had to raise rent because of increased property taxes and homeowners insurance (due to inflation, city’s $10’s of millions spent in support of illegal immigrants paid for by taxpayers, etc). My monthly mortgage payment increased by $400. Had to increase rent by $100 to help offset that.

    I rented a 4 bedroom house for 2 years and when I moved out the owner got emotional, cause she couldn’t believe how I kept her place so clean and neat for 2 years. Some folks needs to be in shelter or groups home

    We(me, my husband, and our son) lived in our apartment for 8 years. We moved in when my son was 2 months old. We had to move out because they wanted to renovate the apartment to a more modern look. We painted, cleaned the carpets, scrubbed the walls, everything! I was taught, when you are moving, you clean like your life depends on it lol We definitely got our deposit back and technically they could have kept it or some of it because the plastic curtain things for the back sliding door broke off and was taken away years prior, but they didn’t care about that. One of our blinds were ripped from my son but they didn’t charge for that either. We also took pictures after we were done JUST incase. We didn’t think we would need them but you never know. These People are so lazy

      Yeah (defendant couple) got lucky, as in any other day, Plaintiff and her partner gave a pretty damn convincing case of those out of control/unacceptable damages (which the defendants admit and admit it was over horsesense/them intentionally wrecking the rental/lease smh), and I'm finding it hard to believe all they have to do is blame "the daughter who has problems" and Milian understands and has empathy, but Milian knew deep down she was entitled to something so 500 I guess is better than nothing lol. Wow smh.

    The Judge made an excellent decision. The defendants lost $1900 security as a result of the damage they caused but the Judge drove home the point that they were not responsible for new flooring to replace old worn carpeting.

    "Why didn't you shampoo it again?" The plaintiff should have taken a picture with better lighting so the judge didn't think shadows were stains.
    Regardless, shampoo does not remove black spray paint.
    Also the filth on the walls was not from the daughter. The defendants blamed all the destruction and grossness solely on the kids. I wonder.

I'm this close to believing the daughter doesn't even exist, and it's more like her niece, or her boyfriends/Scarecrow standing next to her, his mistress, or her goddaughter, or some girl from church she was helping out lol. Whatever, it seemed to work, because had they not used the 'daughter that has problems" excuse, Milian would have been harsher on them and favored the flooring damages more lol.

    What is going on in that household? I get that some kids can be especially troubled and hard to manage, whether typical teenage stuff or legitimate mental health issues, but how on earth is that mom just shrugging her shoulders and so detached? She had a responsibility to her daughter to get involved for goodness sake. Why is the daughter allowed to have friends over if she's so poorly behaved?

    The defendant would only pay the replacement value for the carpet in the used condition it was in when they moved in , not for the installation of new vinyl flooring- so JMM has to apply rough justice.

      It literally means remedy, admit that you have no clue and walk away. The renter was not a remedy as your comment reads, therefore NOT REMEDIAL! Furthermore the proper use and mastery of the English Language is important in life, I was TRYING to educate you on the proper definition and use of the word as you did not use it correctly, and further used it erroneously in you attempt at a reply when you intended it as an insult.       I think the overall judgement was correct. The plaintiff already had the security deposit of $1900. JM gave an additional ~$500.
      So $2500 total for the repairs seems right 🤷🏾‍♂️

    Milian and Mathis get too emotional sometimes. This is why none of these judges have nothing of Judge Judy. JJ don't let emotions get in the way for her ruling.
    Milian felt sorry for the defendants because of the daughter and the daughter caused soo much damage. JM was wrong for giving the Plaintiff such a hard time.

    I feel the judge was a bit unreasonable. Yes she has to replace a carpet adter they trashed it. And yes the smell of weed goes away but not out of carpet easily. Speaking from experience. We had professionals come in and it still smelled. Smells permeate unfortunately. And its not always easily fixed with a shampooing. But the tenants were disgusting and dirty and had zero respect for the property.

    The plaintiff shouldn’t be a landlord, as she thinks the defendant should pay for new floors (instead of same as move in. She still has a lot to learn about as landlord & renters. Trashing the place is unacceptable.

      No. Given the Plaintiff's testimony about her own experience in dealing with the out of control daughter, I believe that the daughter caused the damages caused by intentional violence. If police have been involved, chances are, CPS already is too.

    Love how she kept mentioning and using the excused “we’ve lived there for a year and a half” blah blah blah. A year and a half is not long plus those are intentional damages not normal wear and tear or built up damage 🙄 we’ve lived in our home for almost 10 years and our home does not look no where close to that apartment. She didn’t ask for her deposit back because she knows her daughter did those damaged and she didn’t have the place clean and maintained during their one year they live there.
    Plus, that child seems like a spoiled brat who was raise to have everything her way or no way. She don’t need help, she needs serious disciplining. I’m sure she was smoking weed with her parents to.

    People who do not have children like this with medical diagnosis don’t need to judge. There is rarely any help unless it becomes legal issues and if the kid isn’t in trouble and the won’t comply with recommendations from therapy, you can’t do anything. It’s a horrible way to live. I hope the girl accepts the help she needs. I feel for her mom ❤

Did the tenant told the landlord about the psychological issues her daughter suffers before renting the place? If she didn’t, she should pay an extra WITH the safety deposit to cover what damages that person did.
    Those two tenants had absolutely NO EXCUSE to leave that apartment in that state!

    It was nice to see that the plaintiff was hoping the girl was getting help, and you could see that her mother was embarrassed about condition of the house. That is why she didn't ask for her security. I feel for the mother and daughter, hope they are doing better. You don't know what the issues are so you can't say "this is what she should do".

    I DETEST parents who think their kids' mental issues are a pass for the kids to get away with anything...& that other innocent people should stay mum & just "take 1 for the team."       After all:
      They just IGNORED those items they absolutely KNEW were RUINED by them and/or their kids:
      The broken window, both of those ALMOST SHREDDED doors and that nasty black filth on both walls in the son’s room…
      Those things were easy to fix, but instead they CHOSE TO NOT DO ANYTHING ABOUT IT!!
      Especially the son’s room: IT’S JUST CLEANING!!!
      If it is what the defendant claims herself (“it’s caused by him leaning back on his chair”), then it obviously is just dirt and grease (from his hair.)
      The black lines on the bottom of that second wall looked more as if his desk would have been placed there, with the son then sitting in front of that wall and his feet (SHOES) touching the white wall all the time; leaving those kind of black stripes on the wall.
      Both of these dirty spots can be easily cleaned, if you use a good cleaning product (especially for the greasy part of the dirt).
      Just take a bucket and some cloths and do the work!
      It’s just CLEANING!
      BUT NOOOOO…..
      Even thát was too much trouble!
      The defendant giving the “I didn’t have enough time”-excuse…
      “Honey, we’re ALL busy!!!”
      I myself have been short on time too, when I needed to do the ‘final exit walk through’ with my landlord, due to all sorts of factors, ‘working a lot’ being one of them.
      During the day I had to work at my job, that had to be done too of course.
      It came down to me having 2.5 day to fix and clean this house and it was a BIG JOB.
      But I didn’t shrug my shoulders and said “Ow well…” without doing anything….!!!!
      I gathered some friends that could help me in the evening and at night…
      AND WE KEPT ON GOING (!!) UNTIL WELL AFTER MIDNIGHT FOR THOSE TWO DAYS!
      AND AFTER THAT, ON THE VERY LAST NIGHT, WE KEPT ON WORKING UNTIL EVERYTHING WAS FIXED…!
      … AND THÉN WE CLEANED THE WHOLE HOUSE…!
      AT 6AM WE WERE COMPLETELY DONE !!
      At 10AM… the landlord and I did the final walkthrough and everything was perfectly fine and got my whole security deposit back (AS I ALWAYS HAVE!!!)
      I understand that it would be (too?) hard to fix the whole carpet and the spray paint on that piece of carpet, but those other things… that’s just being lazy and/or just not caring…. OR BEING RESPONSIBLE !!!!

    I had a landlord try to do this to me. She was a friend and had an apt that moved me closer to family. I moved right in and spent days deep cleaning the apartment and painting. There was a huge hole in several walls and she said, no worries I’ll get them fixed. After a year I moved out, and she had the place totally done over and tried to get me to cover the cost of everything including fixing those walls… umm no, I took photos of before I moved in and they got nothing in court…

    I feel for the defendants. I have a daughter with anger issues and its no fun trying to fix all the broken things and maintain a HOME let alone maintain my daughters mental health. A required amount to be withheld is obvious, not to CHA-CHING on a COMPLETE RENOVATION

    I’m sorry.. I don’t think her verdict was fair. The landlord WOULD have needed to replace that carpet!! You can’t shampoo out the black paint the violent daughter sprayed on it!!! Come on! The plaintiff made a mistake not getting a carpet estimate.,then the judge should have given the plaintiff the deprecated value of that. She only walked away with what I think was a ridiculous small amount of reimbursement!!! These people were filthy and didn’t care.. besides having a daughter with issues. Just wrong in my opinion….

    I'm sorry but as a long time renter I can wholeheartedly say that living in a place for a year and a half doesn't warrant losing a security deposit. For her to assume that indicates she knows they messed up someone else's property and thought not asking for their deposit would be the end of it. I lived in a place 2.5 years with 4 kids and it looked exactly the same.

    That mother needs to take some accountability instead of blaming her daughter for everything! Maybe its her lack of parenting that is causing her daughter to act out. She seems lazy; cleaning when you move out of a rental is expected and not that difficult if you don't live in squalor while you live there. She gives renters a bad rep, and is exactly why the rest of us normal renters have to pay such high deposits!

    I disagree about the weed smell. It's the same as cigarettes. If the plaintiff could smell it after the defendant vacated the unit, it's the same. The plaintiff should have tried all of the cigarette smell remedies and brought that to court. Definitely not $4k worth of damages but more than what was given. That's on the plaintiff. Hoping things are much better with the defendant's daughter.

    The mother's apathetic attitude about her daughter's behavior tells me everything I need to know about their household. "Medical issue" or not, I can see where things went so terribly wrong.
    As for the landlord, the smell will go away if you air the place and clean the carpet. You don't get to re-floor the place and charge someone else.
