    ST. ANTHONY - During a hearing at the Fremont County Courthouse on Tuesday morning, prosecutors in the Chad and Lori Daybell murder case made their arguments about bringing in a jury from Ada County rather than moving the entire trial across the state.
    The Daybells are charged with multiple crimes, including first-degree murder and conspiracy to commit murder. The charges concern the deaths of 7-year-old Joshua “JJ” Vallow, 16-year-old Tylee Ryan - two of Lori’s kids - and Chad’s first wife, Tammy Daybell.
    The trial is set to begin in January at the Ada County Courthouse in Boise and is expected to last up to 10 weeks. The number of people listed as potential witnesses in the case is 104.
    Officers, media representatives and several spectators watched as the hearing got underway. Seated next to his attorney, Chad was dressed in a white shirt and blue tie. He said nothing and showed no emotion.
    District Judge Steven Boyce ordered months ago that the trial will be moved to Ada County so a fair, unbiased jury can be selected. But earlier this month, Madison County Prosecutor Rob Wood and Fremont County Prosecutor Lindsey Blake filed a motion urging the court to follow Idaho code 19-1816 by transporting a jury to Fremont County. The statute outlines several reasons jurors can be brought in from another county, one of which is for economic purposes. That was the entire focus of Tuesday’s hearing.
    Blake was in attendance, along with special prosecutor Rachel Smith.
    “The defendant picked the venue when the bodies were buried on his property and he killed Tammy Daybell,” Smith said in her opening statement.
    Daybell’s attorney, John Prior, noted Boyce has already made his decision about where the trial will take place. He says his client has a right to a “fair and impartial trial,” and the cost of a legal proceeding “is not the overriding factor.” He asked the court to dismiss the hearing, which was denied.
    Fremont County Clerk Abbie Mace was called as the first witness and appeared via Zoom. One of her responsibilities includes overseeing court clerks and managing the budget. She addressed the costs involved in lodging, feeding and transporting a jury and other personnel during the trial and the method used in determining those numbers.
    She said it will cost significantly less to sequester a jury in Fremont County versus Ada County.

      Personally, I'd rather hear her say hmmm a lot than listen to Prior's disdainful or disrespectful remarks, which he utters with poorly disguised anger and affront. But I think I understand your comment: her hmm might project a weakness of sorts; or, worse yet, a lack of self-confidence. Are my assumptions anywhere in the neighborhood of accurate or possible?

      @@melstiller8561 Hi Mel, I agree 100% with you. I can't stand listening for Prior, he's a bully. I was only making an observation that while she is 100% professional and she has a very strong reputation, but, she did come across a little weak. I will say I did notice her getting stronger as she asked more questions to the witnesses. Maybe is was just a case of nerves starting out.

      It actually does. That area is heavy LDS. Most are members of the LDS church and these are small counties . Moving to Boise ensures a good jury pool and courts able to handle a huge death penalty case. Hotel, food, media. It will be very busy with 1000s of people

    It is not cost-effective to move the trial plain and simple. The trial should be held where the crimes were committed.

      I understand they don’t feel like they’ll get an unbiased jury in Fremont County which could potentially raise reasons for an unfair trial. I honestly don’t think it would matter if this was held in Alaska, I’m from the UK and have followed this case since Lori was in Hawaii. I imagine everyone in the US is interested in this case

    I thought in a death penalty case, the defendant is supposed to have two lawyers. I wish they would also get rid of Prior I can’t stand the thought of listening to him for the whole trial. 😖

    Is it just me or is Prior the most obnoxious and annoying lawyer there? I don't think he's doing any favors for anybody. The jury is going to get really sick of him. I guess that's a good thing since the Daybells are so disgusting.

    Chads Lawyer has to be the biggest prick I have ever seen. He is going to be a train wreck at the actual trial. The police Chief was absolutely amazing dealing with his tirades. I give him so much credit.

    How I wish the court would make Prior set his mic to the correct direction…pointed at the ceiling is why it is so hard to hear him when he isn’t in the exact right spot but everyone else has the mic pointed at their face and low and behold we can hear them so well!!! He does this every dang time almost, if not every time. It must be part of his annoyance strategy.

    Mr Prior can argue their figures all he wants but it would cost a shit ton of money to have it tried in Aida county. Plus Freemont county citizens deserve to hear the case in person.

      If the court does decides to sequester the jury why not have it in Freemont County!!!! It would definitely save a lot of money, court records would all be in in the Freemont Court system (not also in Aida Court system where Pryor can come back and say the court records weren't kept up and are missing documents,etc..), citizens of Freemont are able to attend, cost savings to the Sheriff's department, surrounding police departments and staff,
      the cost of hotel, food is much more reasonable, plus if the jury wants to see where the killers buried those precious children they don't have to travel one way 357 miles from Aida to see the site. I say select the jurors from Aida and bring them to Freemont and sequester them for the entire time of the trial. Just my thought.

    The chief assignment was to figure out the costs based on the information given by the prosecution. you can't have officers on call without paying them. Who can travel 350 miles to testify on a moments notice.

      I love how Prior was like "can't you just have them come in to testify as needed?" Uhm.. that would mean somehow making sure they had an open schedule and ability to travel at a whim (esp. to his new desired venue). The best way to do that is to expect to schedule and pay for days they need to be free. Prior is embarassingly ignorant to the routine procedures required to run law enforcement. His "do you mean to tell me"s and "quite frankly"s are not effective.

      @@kry023 And his, "can't they testify on the phone, "CORRECT?" The "correct " at the end of every sentence is supposed to get the witness to agree with him, and his usual nonsense. You'd think he would learn that his bullying backfires, especially when he tells the judge what to do, but he just keeps on. And Chad literally a wax statue with zero emotion, which demonstrates his psychopathology. Those two deserve each other.

    Ms.Smith is a well-spoken, exceptional lawyer. Put Pryor in his place a few times. For ex: Pryor arguing non-sequestration. Ms.Smith & the clerk knew this was a Capital Crime, therefore sequestration was compulsory. Loved it!

      Admittedly, I listened to the hearing at 1.75x speed - but wasn’t it Ms. Smith’s actual position that jury sequestration is required, by law in a capital case, *only* during the period between _submission_ [of the case to the jury for deliberations] and _sentencing?_

    Unbelievable...the cost that the state has to eat up ... if a person loses the case they should have to pay back at least 50% or more ..
    IMO , they should of tried to make a plea deal , save $$ and they get life without parole and ship them to hard labor prison.
    I don't know who looks more miserable 😕 Daybell or Pryor.. lol

    I am really confused on prior‘s argument about why he thinks it would be a good idea for detectives, witnesses, and investigators who are involved in his clients CAPITAL MURDER TRIAL to not be there to review and testify on evidence in this case? That should never be acceptable to a defense attorney for his client.

      It is puzzling - his resistance to the state’s proposal (besides calculated orneriness). After all, if witness testimony is delayed by the wait when recalling a witness, and the time cannot be used to move on to another’s testimony (for reasons of case progression, or otherwise), the trial days will be shortened and the total duration of the trial will be extended. Greater cost and greater inconvenience for all, with ripple effects on scheduling.

      @@u.synlig if Prior is even capable of realizing these potential consequences, I'd say he wants this. Every move has been to delay and draw out while crying about things not going fast enough. None of this actually helps his client, especially while the prosecution and judge are so tolerant of his BS. He looks like an ignorant and cornered bully. In the end, he will have spent more time whining that the prosecution didn't come up with his client's defense arguments/witnesses themselves while eliminating some arguments he could save for appeal.

      And I truly don't understand his cross examination questioning of the police chief with regards to attendance of his detectives in person at the trial - surely their attendance is the court's decision? How could the trial be conducted properly if witnesses are not available to be called, or re-called when necessary to the proceedings! And how is the police chief supposed to know how long each witness will be required to give evidence for? Surely that depends on the prosecution and then by the amount of cross examination by the defense - which judging by this hearing, the cross examination will go on and on and on and on........

    Pryor forgets that they are being tried together.One trial.I am waiting for Lori's hearings to catch up,and then the judge will finally combine their cases and all lawyers will work for both Chad and Lori.It happened in the Crunbley case.That way one can't turn against the other.

      I heard the trial will be Jan of 2023 when I listened to the Arraignment.

      They haven’t decided on the trial date and whether they will have to separate because Lori is asking for a speedy trial, which has to be within six months. Both defendants lawyers will meet with judge this week.

    Why is he going off on this chief when he is giving numbers based on what the prosecution has asked for? He's asking this police chief questions that have nothing at all to do with this Chief's position. I am shocked that the prosecution hasn't jumped in, or the judge, and told this defense attorney what you are asking him is in no way part of his job. It is outrageous that this police chief is being badgered this way when he's only giving information based on what the prosecutor has asked for. The police chief doesn't decide how long Witnesses need to be in the court hearings

      It maybe due to the fact that all this court wrangling is pretrial but seriously, he doesn't seem to have control over the rambling defense constantly repeating, repeating and bordering disrespect for the witnesses/ people testifying and allowing the change of venue is an undue burden on the prosecutor/people of Idaho.
      This is not the Timothy McVeigh case!!! This is/was simply two mormon believing criminals thinking they had the right to murdered their children/ spouses for money, sex and power the oldest game on earth... And quite frankly, should be treated that way!
      This defense is sensationalizing and making this case bigger than it is... And this judge is allowing it.

    Crazy this change of venue (COV) is about to come to fruition for Daybell! I hope they do the tickets again for a seat in the courtroom, and the overflow room. I’m going to try attending a couple days this time. Ms. Blake is amazing and I wish her and her team the best! Just keep your head up; you know your stuff Ms. Blake! It’s too bad Rachel Smith left or had to leave, so I hope the State’s request for a special AG is granted. But I have faith in Ms. Blake even without one. On a different note, I’m not looking forward to having this COV debate in the Kohberger case, but it sounds like it might not be so focused on the cost, just to find an impartial jury.
