Judge says prosecutor will stay on Daybell case

- Wood and Evans filed new documents Friday morning asking that Shiflet be allowed to testify and an affidavit be submitted Mindy Gee. The woman is a staff member in Wood’s office who took a call from Shiflet.
Means and Prior objected to both requests. Boyce agreed to allow part of Gee’s affidavit into the hearing but denied testimony from Shiflet.
In his closing remarks, Prior questioned Wood’s ability to prosecute the case and said that because he made “disparaging comments” to Shiflet, Wood should be removed. Prior said such comments were an attempt to influence and manipulate Shiflet’s testimony if she is called as a witness in her sister’s case.
“Mr. Wood is cheating,” Prior said. “Mr Wood is lying, and Mr. Wood is doing nothing but trying to influence, coach, intimidate a witness, before that witness has had a chance to get in front of a trial.”
Means said Wood and Shiflet’s conversation raised “red flags” and eyebrows” and argued that experts in the case testified that the prosecutor was attempting to coerce and manipulate Shiflet. Means said now other witnesses need to be investigated because of Wood’s alleged actions.
“If this type of behavior goes unwarranted, unchecked, unsanctioned, you are telling myself, Mr. Prior, the prosecutor and anyone else who wants to cite this case in the future that you can engage in these tactics without repercussions,” Means said. “That is a dangerous precedent that I don’t think any court or any witness or defendant would want to have.”
Evans disagreed with the accusations and argued that Wood never told Shiflet what to say during the conversation and affirmed that Smith, Shiflet’s attorney, never objected or opposed to anything discussed during the meeting.
“The defendants again have shown no damage to their client in any way if Mr. Wood stays on the case,” Evans said.
Wood did not speak during the hearing. However, EastIdahoNews.com received the following statement from him afterward through a spokeswoman:
“We appreciate the judge’s ruling. We remain resolute and focused on our search for justice for JJ and Tylee.”
The next Daybell hearing is scheduled for a pre-trial conference on June 2. However, the issues of moving the case out from Fremont County and dismissing the case still need to be taken up before Boyce. Those hearings were postponed because of this week’s hearing.

Well really if you listened to the tape, Mr. Wood in fact started the disparaging name calling. Inappropriate from a prosecuting attorney, I expect that of slimy defense attorneys but not someone who takes an oath to do and be better. Really now calls into question all of his interactions with every witness, NOT something you want at a trial as important as this. Just gives grounds for prosecutorial misconduct when an appeal is filed. Now the bar will have no choice but to sanction him, or disbar just like Juan martinez.

Bcuz Mr Woods wasn’t in either location that they’re speaking of…. The detective was trying to find out where JJ was bcuz Kay Woodcock had not heard from him…. Which he FaceTimed them everyday…. I think we’re going off the real reason for this foolishness!!!!
It wasn’t a warrant, Lori had I believe 5 day’s too bring JJ proof of life… At the time they weren’t aware of Tylee missing also…. And then Lori and Chad were trying to get out of Hawaii…. And they pulled them over on a traffic stop…. And the vehicle was full of thing’s of JJ thing’s… And they had a bag full of money…. When the reporter asked Lori where the children were and he made the remark I know where my kids are daily her response was that’s great….

He doesn't have to prove his clients innocent; in the American legal system, the burden of proof is on the prosecution. The defense's only job is to poke holes in the credibility of the prosecution and the prosecution's witnesses, with the goal of establishing enough doubt that a jury and/or judge would have to acquit his clients no matter how strong the case might be. So he's basically doing his job, but in the most transparent and incompetent way possible. This was a waste of everyone's time.

"There is a Supreme Court case, I don't have it on hand . . . " This is not an argument. It's a waste of time.
It seems he is using the tactic of trying to use the legal system to do anything he can to get the trial thrown out down the road since he cannot argue their innocence, and he cannot create reasonable doubt. One can’t blame him for trying. That’s his job. But it does make the legal system seem more like a game.
When murder charges are filed it won’t even be possible to create reasonable doubt ...”if” they can present to the jury the Robert Durst Texas case, in which attorneys go to extreme measures to do so. If they can’t bring that example up they may be taking a chance since a persuasive attorney could hypnotize a jury easily enough. The prosecutor will need to really know how to override that before pressing those charges.
Mark Means never passes up an opportunity to remind everyone how supremely out of his league he is and how fantastically he fails to understand how to behave in a criminal matter, having ZERO criminal law experience.
