I have to agree with the defendant and Judge Milian. Considering this was a World War II-era building to begin with, fixing what was there could quickly become an exercise in futility, as subsequent leaks due to age would probably follow. The new pipe that runs outside of the building where it can be monitored and maintained without disruption of the business is the proper solution. Patching what could be 80 year old pipe isn't a long-term answer to the problem.

The plumber (plaintiff) should go to Amazon (or wherever) and buy a laproscopic snaking camera to use to find problems in pipes. They work great and connect to your smartphone allowing you to see what you're doing. We have a couple and one is under $100.

Even admits the demo only took a few hours, not days. The 2nd guy replaced the pipe and I would imagine make sure the drainage is correct and reseal it if need. If he charged 2-3k for labor and parts and did fix try problem while working the 40 hours( and judge said his paperwork didn't match a weeks worth of work) I'd agree that he should be compensated. Based on the the video and lack of evidence that anything beyond demo occured and resulted in what was showed he's lucky the defendant didn't try to countersuit for the expense of hiring another contractor to do the job, Something you can try to do in the U.S.

I agree. I had to pay around £400 for a mechanic who took apart my car without my knowledge telling me he was looking for the problem. I took it to small claims and lost. I was never told that diagnosing the problem would cost hundreds and other mechanics confirmed they would never take apart a customers car without prior permission and explaining the costs. The judge ordered me to pay because they did work! Whether it was work authorised or not it was still work. I got my car back with all the gearbox components in the back seat.

You should’ve taken that judge’s judgement and had another court review the case using testimony from the mechanics that you stated have said the work was unjustly done without your permission. Judges look at professional testimony and affidavits signed by professionals to make a ruling. If you didn’t have those in court with you beforehand then I understand why you lost the case, but if you presented that evidence to the judge then that judge is at fault and you should have had your case transferred to another court to be looked over for errors in judgement. I usually agree with all of the judges rulings but this one was kind of tough, I think the plumber should have gotten something for tearing down the wall to find the leak. The new plumber isn’t even doing the same work the first one did, he’s totally bypassing the wall and just going straight down which is a hell of a lot easier. The first plumber already did all the troubleshooting and made it easy for him.
I will respectfully disagree with you. The ruling was fairly clear as stated in the video. 1) There was no written contract as to what should be paid for whatever work was to be done. Even if the work wasn’t completed. There wasn’t even a verbal agreement as to what would be paid for whatever work was done. 2) Be honest, would you hire a plumber to fix a leak at your house/place of work only to find that after 5 days of work they only made the issue worse? Would you still pay them money for making your tiny leak worse? That’s what happened here. The first video showed a small leak before work was done. They just opened up the wall and recorded what the leak looked like. The second video showed a much bigger leak after the plumber had done his work. Now, the plumber says that he tried to keep costs to a minimum by doing just a few hours of breaking down the hole in the wall, but the judge interjects, and more or less says that $50/hour is not keeping costs to a minimum. Because he charged the defendant $2,000 for unfinished work. That was literally for just unfinished work. And the judge even calculated that price to come out to 40 hours of work. So if a few hours was taken to knock down a wall, let’s calculate a few hours to be 3 hours, so that would be $150 of work. The plumber is essentially asking for roughly $1,850 for taking five days of work to do unfinished work on an old pipe that was installed in the 1940’s. Let’s not forget that the judge called out the plaintiff on his claim that he stated he worked 7 days on the pipe but it was revealed in court that he only worked on it 5 days. This gives us, and the judge, insight that says the plumber is adding those extra 2 days to jack up the price of the unfinished work. In short, the plaintiff was lying about his costs of work and because of that the judge cannot file any money to be paid to someone who lies about how much they should be paid for work that is based off of no proof. All of this is why I say that the ruling was fair and clearly stated in the video.

Maybe this plumber made D's and F's in school. Who knows, don't they have current ways to find leaks? My bldg is not as old as this one but the plumber who came here, ran lots of different tests back n forth on an on to narrow down section with the leak. Till I finally asked what they were doing, he explained the tedious process they had to do, which was time consuming to narrow down the section.it took them a long azz time, to find it. He called me down to see and told me why it was leaking, what he was replacing and also noticed something else and went ahead and just replaced that too.

My house was built in 1973 and ALL the plumbing is in the concrete slab under the house (no basement). Further, the walls of my house are concrete block and we just had a leak in the kitchen plumbing which was inside the concrete block wall. $15,000 later…
Listen my husband runs a plumbing and gas firm, in old buildings it may take you days to actually locate where the leak is coming from, he located the leak the next plumber comes in looking like a hero smh
Wrong judgement again! It's an old building. Leaking from where has to be found. Cold enough to be iced. Pipe is in concrete. So, he did all the work & inspection of the entire hidden pipe. When, it was time to fix it. He isn't allowed to & doesn't get paid. Think of a car mechanic. Especially electrical. Because, they've no contract defendant shouldn't be allowed to not pay anything when he sent to plumber away who did all the work opening up the wall & getting to the leak.
Turned out it was cheaper to replace the drain than to repair it. The plaintiff didn’t realize that until after putting all that work into it. Plumbers go by getting paid by time, regardless of whether the problem is solved or not; but lost in this case because the judge ruled he did not complete the repair. Lesson learned for the future; consider replacing instead of repairing.
So if a lawyer looses a case why does he get paid, the lawyer also hasn't fulfilled the clients mandate, as a judge you shouldn't apply different principals to blue collar worker!
Wow the judge sure screwed that one up. You could tell she had her mind made up before she entered the court room. Sure another guy comes along after this guy has done all the hard work to find the problems...and no small feat to chip all that ice from inside, and outside, the pipe....and this new guy can come, see all the problems uncovered by the plaintiff, so naturally he comes up with the solution of just putting in a whole new pipe...so easy to do after all the problems are uncovered for you. Judge Milian is often way off in her judgements. And she's often sexist. Based on Judge Milian and Judge Judy, it looks like women judges are unable to keep personal viewsn prejudices separate from their rulings. Men are usually pretty good at being fair and keeping personal views/prejudices out of their judgements.

Maybe this plumber made D's and F's in school. Who knows, don't they have current ways to find leaks? My bldg is not as old as this one but the plumber who came here, ran lots of different tests back n forth on an on to narrow down section with the leak. Till I finally asked what they were doing, he explained the tedious process they had to do, which was time consuming to narrow down the section.it took them a long azz time, to find it. He called me down to see and told me why it was leaking, what he was replacing and also noticed something else and went ahead and just replaced that too.
If the plumbing were not in the walls, it would be exposed on the Finish walls. Then she would be saying this is current time shouldn't Plumbing be hidden. That's plumbers can never catch a break.
My house was built in 1943. I have them same problem. I had to get fixed

This is all due to bad communication. If the plumber would have informed the owner as he progressed this could have been avoided.
This ruling was completely unfair. He did a lot of work and was not allowed to finish. JM is not very consistent. This man did a bunch of the hard labor and diagnostic work for NOTHING.

Judge does not understand that with a lot of hands on jobs like this, 75%(ish) of the work is GETTING to and finding the issue. Of course the new contractor only had to do $500 to finish.
The second guy didn’t “finish” a thing. He had a completely different workable solution that didn’t use any work of the plaintiff.

Listen my husband runs a plumbing and gas firm, in old buildings it may take you days to actually locate where the leak is coming from, he located the leak the next plumber comes in looking like a hero smh

It's an old building. Leaking from where has to be found. Cold enough to be iced. Pipe is in concrete. So, he did all the work & inspection of the entire hidden pipe. When, it was time to fix it. He isn't allowed to & doesn't get paid. Think of a car mechanic. Especially electrical.
Because, they've no contract defendant shouldn't be allowed to not pay anything when he sent to plumber away who did all the work opening up the wall & getting to the leak.

Plumber was dealing with a lot of real obstacles also. He did not explain it well, but still sounds like he was milking the job.

Turned out it was cheaper to replace the drain than to repair it. The plaintiff didn’t realize that until after putting all that work into it.
Plumbers go by getting paid by time, regardless of whether the problem is solved or not; but lost in this case because the judge ruled he did not complete the repair.
Lesson learned for the future; consider replacing instead of repairing.
Seems like the plaintiff had some issues so he couldn't explain what he did or didn't do.

Wow the judge sure screwed that one up. You could tell she had her mind made up before she entered the court room. Sure another guy comes along after this guy has done all the hard work to find the problems...and no small feat to chip all that ice from inside, and outside, the pipe....and this new guy can come, see all the problems uncovered by the plaintiff, so naturally he comes up with the solution of just putting in a whole new pipe...so easy to do after all the problems are uncovered for you. Judge Milian is often way off in her judgements. And she's often sexist. Based on Judge Milian and Judge Judy, it looks like women judges are unable to keep personal viewsn prejudices separate from their rulings. Men are usually pretty good at being fair and keeping personal views/prejudices out of their judgements.
