I get what you're saying. Resigning does look better but if youre fired by a police department you can immediately be hired by another department. At least in the state of Georgia. When I was a kid I got a ticket from a cop for not wearing a bike helmet and days later he came by my house in a residential cul de sac and gave me another ticket for just sitting on a bike. Some cops have too much time on their hands and make an us vs them mentality. And as a teenager I got in trouble smoking pot and so they made excuses to pull over my car once a week until I got a different car. I only ride a bike now because cops can't harass me as long as I have bike lights on at night.
If it makes you feel better I had 3 police agencies get rid of their bike police. The were training and riding them on a pathway after sunset with no lights, did not have noise making devices, and were riding 4 abreast and blocking the pathway. I requested that they get off the bicycles and walk them to the police station. Some started to, but the group decided they were above the law. I went to the station gave my complaint. He tried to give BS. I persisted and we went through the lawbook. He agreed that I was correct on everyone of the charges. All three departments closed the bicycle police rather than equip the bicycles properly. I think it had to do with the officers attitudes.
Just because it's public property doesn't mean it's open to the public. Try walking into an army base witihout authorization, for example. But in this case it's public property that was open to the public at the time of the "trespass". And when you deny someone entry to an area that is normally accessible to the public, you need a good reason to do so. Performing a perfectly legal 1st Amendment activity is not a good reason.

Judge didn't have the full story. Cop made it seem like there was an actual disturbance, so that's why the judge said to arrest him. I'm sure if the judge had been there, he'd be looking at the chief sideways 🤔
As always getting the story straight matters: the chief resigned due to an ongoing SLED investigation about domestic accusations against him. While this aidtor was correct in the law; he was actually only arrested once and before any civil suit he must beat that criminal case. Finally assuming he beats the disroderly charge any 1983! civil case could take years and that's it he can find an attorney to take the case. Lastly and most importantly, to what end was his behavior necessary? It's already well established law cops can be recorded and recording is allowed in public buildings subject to place , time and manner constraints. So in the end , he was arrested , with a pending charge and even if he pursues a civil suit his damages are minimal and definitely not "humongous". Other than an interesting video to watch nothing was gained by the city or citizens since the chief resigned already.
That Chief was _way_ out of his depth. 😂 The auditor was top tier. Some may think that auditing such relatively minor issues is pointless, but I believe that if LEOs can't behave lawfully in low-stress, comfortable surroundings it indicates that they will likely behave egregiously and unlawfully out on the street in more serious situations.

Be careful though. Not every state has the same laws as the South Carolina law book highlighted in the video. We see the videos where it all went well. When it doesn't, those videos don't get uploaded. These details state to state matter, a LOT.
@@ThatOpalGuy Well, those parts do apply in every state. But the specifics highlighted in the video, were about South Carolina law, and the video even notes some other states the laws vary slightly. Your right to not have to ID, is universal, as you say, because of the Constitution. But some of the details live on a lower level of the law, and those details can get you jailed if you are wrong about them, and take certain actions. Furthermore, sometimes the court that made a prominent decision highlighted in these videos, was a higher court, but not the SCOTUS, which means those decisions only apply to that district. If the 9th circuit makes a decision, it does you no good if you live in the 7th. At least, not by default precedent. You will have to win your own higher court case, to expand that decision, to where you live. That kind of lawyering literally costs tens, if not hundreds of thousands of dollars.

For your professor: The biggest enemy of that cause, is the plea bargain system, that permits prosecutors to threaten maximum sentences for all who are convicted, that refuse the accept the plea deal. They also threaten additional charges for the same acts, as a threat to accept their "deals". My own sister was guilty of a crime, but their case was incredibly weak. She had to choose between missing her children in prison for 2 years, or trying her luck with a threat to give her 15. She would have won her case; but who in their right mind would take that risk?

I recently saw a video of an off duty cop was driving a marked vehicle while dressed in jeans and a tee heading to the pharmacy in a neighboring town (out of the marked vehicles town) that was stopped by a sergeant Lieutenant and a captain after someone called in reporting that the out of justification vehicle was driving erratic and took out a mail box. *they referred to this as an ADMINISTRATIVE issue* The off duty officer REFUSED to immediately leave with them and take a mandatory drug test! He called for a ride to pick him up. He admitted to not sleeping after a night shift and taking ambien and adderall. There's nothing wrong with the use of a possessive pronoun by itself. It frequently means affiliation, not ownership (e.g., this is my high school, this is hometown, this is my block). When the tone/context strongly imply ownership and control, that's another matter.

When I was a kid I got a ticket from a cop for not wearing a bike helmet and days later he came by my house in a residential cul de sac and gave me another ticket for just sitting on a bike. Some cops have too much time on their hands and make an us vs them mentality. And as a teenager I got in trouble smoking pot and so they made excuses to pull over my car once a week until I got a different car. I only ride a bike now because cops can't harass me as long as I have bike lights on at night.

If it makes you feel better I had 3 police agencies get rid of their bike police. The were training and riding them on a pathway after sunset with no lights, did not have noise making devices, and were riding 4 abreast and blocking the pathway. I requested that they get off the bicycles and walk them to the police station. Some started to, but the group decided they were above the law. I went to the station gave my complaint. He tried to give BS. I persisted and we went through the lawbook. He agreed that I was correct on everyone of the charges. All three departments closed the bicycle police rather than equip the bicycles properly. I think it had to do with the officers attitudes.

Just because it's public property doesn't mean it's open to the public. Try walking into an army base witihout authorization, for example. But in this case it's public property that was open to the public at the time of the "trespass". And when you deny someone entry to an area that is normally accessible to the public, you need a good reason to do so. Performing a perfectly legal 1st Amendment activity is not a good reason.

As always getting the story straight matters: the chief resigned due to an ongoing SLED investigation about domestic accusations against him.
While this aidtor was correct in the law; he was actually only arrested once and before any civil suit he must beat that criminal case. Finally assuming he beats the disroderly charge any 1983! civil case could take years and that's it he can find an attorney to take the case.
Lastly and most importantly, to what end was his behavior necessary? It's already well established law cops can be recorded and recording is allowed in public buildings subject to place , time and manner constraints.
So in the end , he was arrested , with a pending charge and even if he pursues a civil suit his damages are minimal and definitely not "humongous".
Other than an interesting video to watch nothing was gained by the city or citizens since the chief resigned already.

Some may think that auditing such relatively minor issues is pointless, but I believe that if LEOs can't behave lawfully in low-stress, comfortable surroundings it indicates that they will likely behave egregiously and unlawfully out on the street in more serious situations.

Be careful though. Not every state has the same laws as the South Carolina law book highlighted in the video. We see the videos where it all went well. When it doesn't, those videos don't get uploaded. These details state to state matter, a LOT.

Your right to not have to ID, is universal, as you say, because of the Constitution. But some of the details live on a lower level of the law, and those details can get you jailed if you are wrong about them, and take certain actions. Furthermore, sometimes the court that made a prominent decision highlighted in these videos, was a higher court, but not the SCOTUS, which means those decisions only apply to that district. If the 9th circuit makes a decision, it does you no good if you live in the 7th. At least, not by default precedent. You will have to win your own higher court case, to expand that decision, to where you live. That kind of lawyering literally costs tens, if not hundreds of thousands of dollars.

For your professor: The biggest enemy of that cause, is the plea bargain system, that permits prosecutors to threaten maximum sentences for all who are convicted, that refuse the accept the plea deal. They also threaten additional charges for the same acts, as a threat to accept their "deals". My own sister was guilty of a crime, but their case was incredibly weak. She had to choose between missing her children in prison for 2 years, or trying her luck with a threat to give her 15. She would have won her case; but who in their right mind would take that risk?

@@Tijuanabill You were way too polite in your reply. Apparently, he is unaware that in most plea bargains, the prosecutor actually decides the sentence by making the plea deal with the defendant. Judges rubberstamp the plea deal and rarely deviate from the sentence agreed upon in the deal.
When committing a crime of any kind whether it’s considered a major or minor crime NO officer should be allowed to resign rather they should be sacked and delt with accordingly through the justice system like any one of use would be for committing a criminal act

I love how the Chief keeps repeating “That’s fine.” when the auditor tells him how he’s violated the auditor’s rights and the consequences he’ll face for doing so. The Chief having his qualified immunity upheld is very much in doubt and losing in a civil suit is likely. However I’d be willing to bet he’s got little in the way of assets to pay up when the time comes, particularly having resigned from a paying position and being in further legal jeopardy with his domestic behavior.

If filing a false police report is a crime, it is unacceptable that they allow officers to resign instead of being fired. Charging those officers with filing a false police report would perhaps give them incentive to abstain from frivolous overreach.

I recently saw a video of an off duty cop was driving a marked vehicle while dressed in jeans and a tee heading to the pharmacy in a neighboring town (out of the marked vehicles town) that was stopped by a sergeant Lieutenant and a captain after someone called in reporting that the out of justification vehicle was driving erratic and took out a mail box.

The off duty officer REFUSED to immediately leave with them and take a mandatory drug test!
He called for a ride to pick him up.
He admitted to not sleeping after a night shift and taking ambien and adderall.

The public often can't fight unlawful arrests in the courts because of the costs involved.
They put people in those positions who “play the game” the judge in that building or someone above the chief was probably told get that nuisance out of this building so ignoring the laws and rights of said person he went and did it to make his “boss” happy and as usual that “boss” sees no consequences. Its how the world works and needs to change

You would think a prerequisite of enforcing the law would be to actually know the law.
How many times have the public been told that ignorance of the law is not an excuse? How much more should Law Enforcement be held PERSONALLY accountable when they violate the law?!?! Chief Middleton, who is clearly either ignorant as hell or corrupt as hell, should be arrested and tried for his multiple instances of battery, false arrest, false imprisonment, and deprivation of rights under color of law.
You're totally correct! As a law enforcement officer, not only are they presumed to know the law, but they certainly should be held, AT LEAST, to the same standard as every other citizen for obeying the laws, and ignorance of the law is absolutely not an excuse for an officer of the law, even more so than for an ordinary citizen!

The judge evidently told him he can’t arrest him because the cop “undetained” him until the swearing became “breach of peace” or whatever…supposedly.

He was not on the phone with the judge. He was talking to the body camera for when the judge views the video at a later date. Any good judge would tell the cop that they were in the wrong and that the guy was not breaking any laws filming there.
