I pay for Premium too and get your frustration (it's expensive), but the Premium membership is separate from in-video ads that content creators insert either to make a profit or to continue being able to make videos. (Hopefully both... I think a lot of people underestimate how long it takes to put together a quality UA-cam video.)
The mute feature on body cameras needs to be removed. There's absolutely no reason to mute them. If there's something captured by the audio that shouldn't be released to the public then it can be redacted, just like the video. The only reason for muting audio or turning off the camera in the middle of an incident is to prevent the documentation of exculpatory evidence.

The fact that a court would state a requirement such as "...would reasonably incite the average person to retaliate..." in their judgment is very interesting regarding this. I don't see how they would criminalize a verbal retaliation (because disagreements fall under the 1st amendment), and any violent retaliation should be illegal on its face

@@thatcomicdad1687 Exactly. Police officers should be entitled to some privacy while on the job, but by default that camera should be on and unmuted. If a police officer turns off the camera or mutes the sound while responding to a potential criminal action, then whatever charges were laid should be immediately dropped and the cop should be charged with tampering with evidence. The same should happen if the police officer simply "forgets" to turn it on during an interaction with the public. If a FOI request comes in for the bodycam footage, the police can still edit whatever video they give out, but the original must remain in an unedited state until the charges go before a judge and at least 6 months after that. If someone actually files a case against the cops, then the process should start again with the footage being held until that case is resolved, plus 6 months.
Funny how multiple cops can pull up and surround an individual, sometimes with guns drawn, and they expect the civilian to not get scared or confrontational, but the second one dude shows up to talk to an officer, these "professionals" immediately get scared and escalate the situation, using violence to arrest anyone they feel like. Obviously it's better to not get involved if you're a bystander, but it's bound to happen sometimes and the cops need to be better trained to de-escalate instead of barking orders and threatening people first.

Totally disrespecting everyone, he came pretty close to the supervisor, almost hitting him. His intention appeared to be confrontation from the moment he pulled up. There was no de-escalation or conversation, just pure adrenaline charged intimidation.

Basically because Officer Hernandez didn't like the way he was dressed (a spiked black leather wrist band the jerk said was a "deadly weapon"🙄). Got him for possession of a suspended license, though he wasn't driving. Said he would have arrested him for "attempting to incite a riot" if nothing else came back when he ran his name. In his report he always referred to my friend as "the A", obviously meaning "a**hole". I was in court when the judge read the report. The judge said nothing about that. I learned long ago about what kind of people we're dealing with.
There was no disorderly conduct. None of the employees heard him say suck my d*ck. I couldn't even hear it on the video. The cops just wanted to escalate the situation after a fruitless ticket for a tinted license cover. This should be thrown out. These cops should be fired. They should be charged with abuse of authority. It looks like the cops just hang out around that area waiting to hem somebody up. They do that in Stone Mountain, GA near the Amazon facility... just hang around and wait to catch someone doing something they can twist into a crime.

It was a lawful arrest. The fact he was getting belligerent with the officers when they asked what the guy’s deal was with threatening her was already probable cause to arrest for criminal threats. He doesn’t have to leave the scene. If you are free to go you are free to stay. As far as the threatening words you are correct. Subsequently I believe that threats and threatening words need to have a review of real threats vs. conditional threats. There is a difference. A real threat is “ I’m going to F you up.” A conditional threat is “If you don’t stop kicking me, I’m going to F you up.” But I have seen people get arrested with words equivalent to the latter. That should never happen. There is a difference between the two, but police and DAs don’t always see that.
If she really felt that he had threatened to “F her up,” she wouldnt have turned her back to him. She’d have pulled her gun or tazer while she was calling for backup.

@@NefosG Actually there is a Supreme Court case from the 1890's where the Court found that you can resist an unlawful arrest with force, including deadly force, if necessary. Over the past century the ruling has been chipped away by other rulings that allowed states to prohibit resisting an false arrest. The ruling itself has never been directly overturned.

It’s always amazing to me that cops expect citizens to be sympathetic over things that make cops nervous despite them having more power to protect themselves, meanwhile they neglect to sympathize over things that make citizens nervous.
That's what's crazy to me. I wish I could be sympathetic toward the police, I really truly do. It's a dangerous job (though, admittedly, they often make it more dangerous that it needs to be entirely on their own). But the reality is that they have significant power over me. No matter how heinous an officer's actions might be while on duty, if you do anything to protect yourself from them, you're automatically assumed guilty. But they can do just about anything they want to you, and in the majority of cases, the worst outcome for them is they get fired. *Citizens* are the ones who should be nervous, but they're treated as criminals for that completely reasonable reaction.

The mute feature on body cameras needs to be removed. There's absolutely no reason to mute them. If there's something captured by the audio that shouldn't be released to the public then it can be redacted, just like the video. The only reason for muting audio or turning off the camera in the middle of an incident is to prevent the documentation of exculpatory evidence.
While actively engaging the public yes but to completely remove a mute feature for reasons as simple as using the bathroom is unreasonable.

@@thatcomicdad1687 Exactly. Police officers should be entitled to some privacy while on the job, but by default that camera should be on and unmuted. If a police officer turns off the camera or mutes the sound while responding to a potential criminal action, then whatever charges were laid should be immediately dropped and the cop should be charged with tampering with evidence. The same should happen if the police officer simply "forgets" to turn it on during an interaction with the public.
If a FOI request comes in for the bodycam footage, the police can still edit whatever video they give out, but the original must remain in an unedited state until the charges go before a judge and at least 6 months after that. If someone actually files a case against the cops, then the process should start again with the footage being held until that case is resolved, plus 6 months.
Funny how multiple cops can pull up and surround an individual, sometimes with guns drawn, and they expect the civilian to not get scared or confrontational, but the second one dude shows up to talk to an officer, these "professionals" immediately get scared and escalate the situation, using violence to arrest anyone they feel like. Obviously it's better to not get involved if you're a bystander, but it's bound to happen sometimes and the cops need to be better trained to de-escalate instead of barking orders and threatening people first.

The least we got is videos like this that show cops like these pinning an unnecessary flurry of charges for merely speech, and someone explaining the jurisdiction of which a US citizen can't resist an unlawful arrest.

A friend of mine was arrested in Orlando back in 1990. Basically because Officer Hernandez didn't like the way he was dressed (a spiked black leather wrist band the jerk said was a "deadly weapon"🙄). Got him for possession of a suspended license, though he wasn't driving. Said he would have arrested him for "attempting to incite a riot" if nothing else came back when he ran his name.
In his report he always referred to my friend as "the A", obviously meaning "a**hole". I was in court when the judge read the report. The judge said nothing about that.
I learned long ago about what kind of people we're dealing with.
There was no disorderly conduct. None of the employees heard him say suck my d*ck. I couldn't even hear it on the video. The cops just wanted to escalate the situation after a fruitless ticket for a tinted license cover.

Subsequently I believe that threats and threatening words need to have a review of real threats vs. conditional threats. There is a difference. A real threat is “ I’m going to F you up.” A conditional threat is “If you don’t stop kicking me, I’m going to F you up.” But I have seen people get arrested with words equivalent to the latter. That should never happen. There is a difference between the two, but police and DAs don’t always see that.

All she had to do was stop the driver and give him a verbal warning about the obstructed plate. But she has to go full RoboCop in hopes of finding the driver is wanted or has warrants. The fact that a police captain conferred with these officers and STILL they wanted to bring a disorderly conduct charge in this instance is just awful. The captain needs a demotion and some remedial training.
These cops are clearly corrupt, and every one can see it. If our elected officials won't do anything, we at least need to keep a data base of their name so the people can identify them. The can look us up, and if nothing else, we can look them up.

I was told they are trained on an excuses. If someone resist arrest. Cops are allowed to body slam them. There excuse for the body slam was he was resisting arrest. They take advantage of escalating everything to have an excuse of what they want to do with someone.

Yeah any police officer can make any person into a criminal for any reason. You could place a person under arrest for absolutely no reason and bait them into some petty offense and essentially snowball someone walking down the street to several felonies if you really wanted
But that's how it's supposed to be. Lawful or unlawful, that's up to the courts, and people should reimburse themselves over abusive behavior like this one.
@@NefosG Actually there is a Supreme Court case from the 1890's where the Court found that you can resist an unlawful arrest with force, including deadly force, if necessary. Over the past century the ruling has been chipped away by other rulings that allowed states to prohibit resisting an false arrest. The ruling itself has never been directly overturned.

She lied over the radio call -- the other responding officers were basing everything on what the first officer (female officer) said.
I don't fault the other officers for responding how they did -- it was based on her lies.

It’s always amazing to me that cops expect citizens to be sympathetic over things that make cops nervous despite them having more power to protect themselves, meanwhile they neglect to sympathize over things that make citizens nervous.
That's what's crazy to me. I wish I could be sympathetic toward the police, I really truly do. It's a dangerous job (though, admittedly, they often make it more dangerous that it needs to be entirely on their own). But the reality is that they have significant power over me. No matter how heinous an officer's actions might be while on duty, if you do anything to protect yourself from them, you're automatically assumed guilty. But they can do just about anything they want to you, and in the majority of cases, the worst outcome for them is they get fired. *Citizens* are the ones who should be nervous, but they're treated as criminals for that completely reasonable reaction.

I'm no coward and I live in an area where many people have told me they carry pistols. Being in the same place as a police officer with a gun on their hip makes me feel less safe.

Free Speech is a constitutional right and the police had no probable cause for this arrest. This is an easy win for the defense and most probably will be settled out of court. Again using the tax payers money to buy out unethical practices within law enforcement. I for one think that qualified immunity should get abolished, there’s no reason the people should pay for institutional incompetence.

People are under the impression there has to be a good guy in these scenarios. There doesn't. A superior is allways responsible for the actions of his subordinates to the utmost extent, up to losing his rank or job in case he can't control his subordinates. I understand why you evoke kidnapping but, as with any criminal charge, intent should be established. It would be good if officers were explicitly required to be trained that unlawful detention is kidnapping.:"unlawfully and intentionally depriving a person of his or her freedom of movement". They should sign that they attended a course that made them cognisant of the possibility of kidnapping. With that mens rea can be established Think they'll volunteer?
