  • In this video, Leah explains details related to Compensation and Pension (C&P) exams for depression. As a US Army veteran and physician assistant, she discusses how veterans often demonstrate a service connection for depression, which can, at times, be straightforward if diagnosed during active duty and directly related to service. For others, depression might be considered secondary to a service-connected physical condition depending on the circumstances. Leah details elements of the C&P exam process, emphasizing the importance of the Disability Benefit Questionnaire (DBQ), which helps determine the veteran's service connection and compensation level. She discusses how veterans often prepare for the exam with the assistance of their accredited legal representative, suggesting the may consider reviewing the DBQ beforehand and thinking of specific examples of how their depression affects their occupational and social functioning.

Take your time reviewing your mental health DBQ...an addition, I would advise seeking mental health treatment before starting a claim.😊

@@OldSOULinsightgood luck. Just have the main talking points on what you would like to address. Check off what has been said and address what hasn’t been said before it is completed. Make sure you take a look at the CFR and see what different percentages equate to what conditions

Great video, Leah! In February I got service connected for depression secondary to SC knee injury from 1994. I had a C&P exam with a VA doctor in January (not a contractor). He made up his mind before the exam that I would get 50% level even though I had documented SI and examples of problems that coincide with the 70% rating. I filed for a HLR and the DRO sent it back to the regional office and they doubled down on their decision even though it was wrong. Not sure if you guys can help or not. I've seen examples similar to mine that went to veteran court of appeals, even the Secretary Donough thought the VBA judge was wrong. Took couple years to get the veteran from 50 to 70. It's so messed up.

@@combatdouglas1306 The medical opinion is for getting service connected. The DBQ is for the rating level. I have asked my VA MH provider and they won't do DBQ.

@@jahh8088 I understood your question. Your question is specifically about how the VA combines or rates claims of similar type. This is a legal question and is within the scope of a legal professionals job.
