  • What is going on everybody, this is TGA, and in this video. we visit another prison, this time it's an open prison, known as HMP Prescoed, it is a satelite prison for HMP Usk I believe, we catch some real tyrants here, threatened with arrest, a prison officer thinking he can detain me, the lot. Absolutely disgusting, prison service are never gonna learn it seems.

    This is the only prison that I've worked where you can drive in and don't have to lock up your mobile at the reception. It's also the first prison where I heard a prisoners mobile ringing from inside their cell. I panicked because I thought I'd forgotten to leave mine in the glovebox.

    they were distressed that a man with his face covered was at the prison gate so they sent one female officer at first to sort it out

    The real answer to "If you're not doing anything wrong, why not give your name?" is: "How do you know if you're not doing anything wrong?" There are more laws and than even lawyers know! That's a reason not to talk the police as well. You never know when you might confess to a crime.
    It should also be noted that even lawful activities can be escalated to crimes - for instance, Stalking laws; i.e. repetitive behaviours which can be construed as harassment. That's the heart of questions like "Do you go to a lot of prisons?"
    NB: Auditors follow a scripted set of answers which generally protects them from accidental confessions.

      if a citizen journalist is filming a prison has part of their job then they have every right to do it, not sure what you're talking about it being harassment for, i visit 7 sites all belonging to the same company per week, does this mean i'm harassing them if i'm doing my job and my job is at these sites ?, then how can a journalist or camera man be charged with harassment for doing their job at the places their job is at ?

      ​@@25242824 It's true that legalisation exists which can turn behaviour which is legal into a potential crime IF that behaviour becomes repetitive. I'm not saying it should be like that.
      Were I to be filming the same person all day, whenever they left their home, following them around, that could be called harassment - even if the person filming is a "citizen journalist"; and the subject a minor celebrity (or something).
      I agree that it shouldn't be happening in the case of filming public officials and buildings; but "shouldn't" never stops the police from trying.
      Take the case of Audit Ed in Bristol is (or was) given a Protection order and prevented from filming police and security - or even filming in the city centre - on the basis that his actions were "harassment".
      To answer your question "how can".... It can very easily be done and has been done. Therefore saying "I record all the prisons" can be used as justification for suspicion.
      The point I'm making is that "Give your name if you're not doing anything wrong" is terrible advice because you can never know whether something you say could be twisted into suspicion. Even if it's not "wrong", your name can easily end up on a terrorist watch list on those grounds.

    It's also against the law for prison guards to bring drugs in for the prisoners but they do it regularly all the time......

      Absolutely correct, buddy. If they don’t comply with the law or their own policies they need to be told to sod off and refuse to engage. I don’t understand why auditors give them so much engagement and allow stupid conversations to even take place.

    For the last two years we've been threatened if you don't cover your face you will be arrested blah blah blah all of a sudden you can't cover your face or it is suspicious if you do... What a wonderful world we live in

    Good video TGA. I enjoyed watching this one. The prison staff seemed misinformed. The officer was unnecessarily harsh. Otherwise it was a good experience. Looking forward to your next journey mate.

      Staff seemed well informed to me.
      It's TGA that's using the "publicly accessible", and "section 33" stuff , calling prison property "public grounds", saying they need signs, not knowing screws have the power of arrest, amongst other things.

      @@TheGwentAuditorTGA You were on prison property. You had been, for a long time, well before you reached the gates. You had no legitimate business at the prison. You were doing filming which you knew the prison staff would object to. "Public access" is meaningless, it doesn't give you a "right" of access. Public access is by "permission" not right, and that permission would be revoked as soon as the screws clocked you filming. That pretty much amounts to an intentional trespass.
      Then there's the matter of laws you might be breaking. According to the 1952 Prison Act you're not allowed to film "inside a prison".....but what is the meaning of "inside" ? Most auditors, and I'm sure yourself, would interpret it as meaning inside a secure area or inside a building.......because that suits the auditing agenda. But what if you're wrong? What if...it means "within the boundary" - of prison property..? It perfectly reasonable to see it that way. If fact a judge may very well do just that. He would look at what was intended when the legislation was written. But...not you, me, or the prison staff actually know for sure. It might be worth asking Marti what he thinks, because I believe him and a few chums are currently awaiting trial for it. So, the fact remains, you "may" have been committing an offence....or you may not, but until it's clarified in court we only have opinions, nobody knows for sure.

    Good watch TGA. Your quite right if anybody is going to bring up the law they should have the evidence and knowledge to back it up. Nicely handled by yourself and is a shame to see staff couldn’t be as professional

    When did they privatise the prison service then ? I never heard about that? It's civil trespass, the police cannot do anything about that. Imagine a PC using the term no worries. So unprofessional.

      A lot of the prison service is privatized. Has been for donkeys years. Even so, all prison property is classed as private whether its privately run or not.

    You are totally wrong when you start quoting the Public Order Act 1986. The bit about publicly accessible in that Act relates to public order offences, not the ability to video in public. What that means is that you can be convicted of a public order offence in a publicly accessible place even though you might not be on the highway.
    Likewise with it's actually Section 33 (I believe you said 32) of the Criminal Justice Act 1972. This is concerned with the definition of a public place when you are wearing a uniform and attending a political demonstration. That has nothing to do with the right to video.
    There is an implied permission for you to go up to their front door or entrance and enquire whether you may be admitted in order to undertake your lawful business. If they tell you to leave you are then a trespasser and they may use the necessary minimum force to make you leave.

      It doesn't matter one jot if the public have access or not. Its an auditing myth.
      Public access to private property is by permission, not by granted right. And that permission can be revoked.
      Auditors seem to think "public access" gives you a "right" to be there, and to film. They're wrong, it doesn't.

    28:06, she says that ; to identify is a reasonable thing, however she only gave her shoulder number and not her name. Therefore all auditor's should stick a shoulder number on them self as well.

    at 29.30 you can see there is a very short attention span. cops get bored listening.
    they want you to listen. so its all about criminalizing the public doing lawful activity and this cop demonstrates that clearly in how she interacts with you.
    It's very green there. Some beautiful trees.

    Love how they say it's illegal and against the law and you just ask what law, what section and they know nothing. I can detain you, for what ? Taking photos in the prison. I'm not in the prison ! Loved the sign please report to the gatehouse, so showing it's publically accessible ! Shot down in flames. They can't bark orders at you, your not a prisoner under their rule. I bet they don't bark orders at inmates either !

    13:30 Guy with the motorbike says that TGA has committed a criminal offence (and has said so three times). Nope. Not a criminal offence to be on prison property outside the prison, nor to be filming at that location. So he would be committing the crime of abusing his powers and also unlawful detention if they did arrest TGA.

    Prison officers have the powers of a constable to arrest, grant street bail and seize property for the purposes of criminal investigations under PACE. The powers of a constable apply to Prison Officers only and not to prison custody officers (employed by private prisons).

    15:15 Technically you can walk across any field. Now, you might have problems with the farmer if they spot you, but that depends on the field and the use it's being used for - if fallow then not much damage, but if it's got animals or crops then you are causing damage or harm. As for a garden, you won't walk across is because of the very strong social convention that it's something people don't do. But people to walk across fields because of campaigns like the right to roam, the desire to see the countryside, and public rights of way etc.

    Just remember all prison staff worked throughout Covid. Caught it many times, lost fellow Officers. Many have worked in higher category prisons and sustained injuries. Show a bit of respect. Also staff have a lot of laws and regulations to remember its understandable if they can’t quote powers off the top of their head. How about you get a real job, love to see how long you and the other critics would last as Officers in HMP Cardiff.

    You don't need to know the specific act or law to quote what the contents are. It's like saying you can't tell somebody not to break in to your car if you don't know under which bit of legislation it falls. It's not the prison staff's job to know this, it's for the police and lawyers. Do whatever you see is exercising your rights, but saying "go on tell me, if you're going to quote it" etc is quite childish and antagonistic. Being abrasive for views only proves you know how to be a prick within the law, not that they're pricks for not knowing.

    Hi G A, those soon at the side track on the way in make it entirely clear that the restrictions do not apply to where you were walking, stopping and reading all the signs is always a good idea, the first one to stop and ask you questions failed to observe the simplest civilised protocols, she should first have waited until you were ready to speak to her, then told you exactly who she is and what she wants, she could then ask you if you were willing to answer any questions, then and only then if you had consented could she have any reasonable expectation of good answers, exactly the same applies to the next ones who are just acting like tyrants, which is probably what they think is expected of them.
    It is still not within their official powers to make demands of any member of the public and such behaviour deserves contempt.
    The most difficult thing they have to deal with is proper understanding to what is Public Access regardless of ownership, exactly the same applies to all property unless otherwise clearly stated and sign-posted with effective barriers.
    When he tells you he is asking you forcefully that suggests that he knows he is being a tyrant.
    They also do not understand the difference between a public servant and a member of the public.
    Altogether they are just getting everything completely wrong, there are no circumstances where you have to believe anything he says, especially when his attitude is so aggressive.
    You did a very good job of standing your ground, I would have had difficulty keeping my temper!.
    In the end they have to give up!, well done. I do hope that the people responsible for their training take some notice of this and act accordingly.

    11:50 A prison officer does have the power of arrest. But for a crime, not because of a civil tort. And they are limited to only arresting escaping prisoners or those helping prisoners to escape. And only around a prison. Outside of that their power is limited to a citizen's arrest, so only for indictable offences.

    13:05 You don't need permission to film someone. In a public place or even on private land. If you needed permission, then if you were in a tourist place (which is obviously a private property) you wouldn't be able to take any pictures. Obviously not true, so you can take pictures anywhere and of anyone at anytime.

    I done a runner from there in 1989 lol 7 miles across the fields into newport jumped a train home to bristol.lasted 2 months happy days

    my son, now been made into a girl , but still held in male prisons like parc , then moved away so family couldnt visit , no rehab , he/ she been abused and made to live prison rules

    To be honest, if someone randomly walked into my office wearing a mask, filming everything on his phone, and refusing to give his name, I'd probably call the police too. Some of our clients are vulnerable and we have to protect them. Giving this a downvote.

    You obviously know very little about where you were filming. It’s called an open prison for a reason, it’s open, no fences or barriers. That doesn’t mean you can wander around at will. Why didn’t you tell the guy on the bike to do one then get yourself arrested, you could of filmed from inside then. That would of been quite entertaining. Better than the rest of the video, we learned nothing of interest about the prison or its inhabitants. What do you think you achieved.

    As long as that female officer doesn’t shoot anyone or throw anyone in the river. I’m just saying! As long as she doesn’t deliberately run anymore over. Just to remind her that she can’t break the law. I’m just saying. Would she give her private details? Why not if she’s got nothing to hide? I’m just saying!

    "It is illegal to film into prison property". So any car that drives past with a dashcam and happens to record inside a prison when driving past is breaking the law? I reckon that motorcycle helmet is on too tight and starved his brain of oxygen.

      The law states its illegal to film "inside a prison".
      Everybody has made assumptions that it means inside a building or inside a secure area. But the fact is, nobody really knows because it hasn't been tested in court. A judge might easily see it as "within the boundary" in which case, TGA would be committing an offence.
      Auditors interpret the law one way, prison staff interpret it a different way. Either could be right.....or wrong.
      Considering there are three UK auditors awaiting trial for said offence, it's possible some clarification may be forthcoming.

    14:40 you do need it written down from people that have already been caught lying just 3 minute prior - maybe don't LIE as a guard and your life will get better
