What is going on everybody, this is TGA, and in today's video, we visit BAE Systems in Glascoed, for the first time in nearly 3 years now I believe, but hope you enjoy this video, the Security Manager here tries going down the National Security Act 2023 route. We do get the drone up from multiple angles, and get some film of the site.
"I'm an ex-cop, I know how the law works", bollocks, he proved on camera that he didn't know the law under his own interpretation.
You've got to watch out for that National Security Act.
It should have a no fly zone over it then if they want it that secure the 🔔 ends!!

The BAE facility was Royal Ordnance Factory Glascoed No 54 opening in 1940 and transferred to BAE in late 80s with privatization. Several websites including BAE detail the site history. Paul Bartlett page hosts great assortment of ROF Glascoed railway wagon photos.

The act has very specific intent requirements for an offence, yet no one remembers that when they quote it.
If this is covered by the act then signs have to be in place clearly stating the law. If they are so concerned then to stop any ambiguity a FRZ should be asked of the CAA. The law restriction is already there so why bring in another law to confuse? I thought the act only applied to MOD sites anyway as it involves the official secrets act which is not related to private business. I may be wrong so anyone with more knowledge please answer✍️😎
It applies to MOD contract sites, such as this one.

The Official Secrets Acts applied here, but they have been trumped by the new National Security Act.
It applies to sites in relation to defence purposes, which this comes under, and sites which fall under MI5, MI6 and GCHQ, however it only applies to those who have genuine hostile intent, however you could fall foul if you capture and publish something which would not otherwise be in the public domain, such as a new weapon being moved etc

Yeah, could get somewhere where they won’t listen to my understanding at all. I won’t let the National Security Act deter me. I plan on still doing some defence sites

There's no no-fly zone in place which there would be if it was a protected site. Therefore get them drones over.
Its great that they are admitting on film though that there's something sensitive going on at the site so that any unfriendly government know where to target.
@@yorkshirewanderer6176 The law says no drone flying, you don't need an app to tell you that, its down to the drone operator to check there are no restrictions in place to start with (apps, websites and laws prohibiting drone flying), which they failed to do.
@tonyb1223 You need to learn the law then. Just because a police officer says something it doesn't become law.
@@yorkshirewanderer6176 You need to read the law, it's in the national security act 2023, quite clearly states that it's illegal to fly a drone that can inspect a prohibited place under said act (section 7 defines a prohibited place, such as a defence works like this BAE site).

@@mikeel6074 He's a bit of a muppet tbh, has no real understanding of the law when it even tells you the person commits the offence if they do any of the following, including inspecting and taking photographs of the site, I mean it isn't hard to understand this but some people don't understand that the internet also has bad people looking for idiots who upload stuff like this and the fact is, this isn't upholding the right to photography, it even states that in article 10, yet people believe it and you then get people like sbml who fall for it without any understanding of what it means.

The security manager was spot on, anyone who thinks otherwise has no idea about the law, what you can or cannot do whilst out doing photography, the intention has nothing to do with it because if you were the one recording and then put it on the internet for 9 billion people to see, guess what, you are either completely stupid or you had an intention in the first place.
Lets see what the law actually says, rather than listening to a couple of muppets who have no idea.
First up, the only law that gives you a right to express a freedom such as photography or filming.
Freedom of expression
1Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This Article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises.
2The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary.
Note the part where it says in the interests of national security.
Next up, the 2023 NSA.
Unauthorised entry etc to a prohibited place
(1)A person commits an offence if-
(a)the person-
(i)accesses, enters, inspects or passes over or under a prohibited place, or
(ii)causes an unmanned vehicle or device to access, enter, inspect or pass over or under a prohibited place,
(b)that conduct is unauthorised, and
(c)the person knows, or having regard to other matters known to them ought reasonably to know, that their conduct is unauthorised.
(2)A person’s conduct is unauthorised if the person-
(a)is not entitled to determine whether they may engage in the conduct, and
(b)does not have consent to engage in the conduct from a person so entitled.
(3)In subsection (1)(a) a reference to inspecting a prohibited place includes taking, or procuring the taking of, photographs, videos or other recordings of the prohibited place.
(4)For the purposes of this section, a person engages in conduct mentioned in subsection (1)(a) if the person does so in person or by electronic or remote means.
Now lets see section 7 where it defines a prohibited place.
Meaning of “prohibited place”
(1)In this Part “prohibited place” means-
(a)Crown land in the United Kingdom or the Sovereign Base Areas of Akrotiri and Dhekelia which is used-
(i)for UK defence purposes;
(ii)for extracting any metals, oil or minerals for use for UK defence purposes;
(iii)for the purposes of the defence of a foreign country or territory;
(2)In subsection (1) use for UK defence purposes means use for the purposes of-
(a)the activities of the armed forces of the Crown,
(b)the invention, development, production, operation, storage or disposal of weapons or other equipment or capabilities of those forces and research relating to it,
(c)United Kingdom defence policy and strategy and military planning and intelligence, or
(d)plans and measures for the maintenance of essential supplies and services that are or would be needed by the United Kingdom in time of war.
And finally, what does the CAA say about flying drones (drone code section 8)
Follow any flying restrictions
and check for hazards
Always check for restrictions and hazards before you fly.
Byelaws
Byelaws may restrict when you can fly and where you can fly from.
Look out for local signs for information and contact details where you can find out more. Byelaws are unlikely to be shown on apps or drone websites.
Restrictions also includes laws such as the 2023 NSA.
This is the difference between a real photographer and someone out to cause issues and get photography restricted (auditors).

If you have ever read the drone code (by the sounds of it you haven't), it tells you that there may be laws in place which restrict flying (and that they won't be in apps or on websites), such as this, but hey, you have a drone and that means you understand everything that goes with it
