- What is going on everybody, this is TGA, and this is the long waited, my perspective of events of my assault at HMP Swansea, couldn't get much of the big lummocks with him gripping me as tight as he could and pushing me in to a fence, honestly going to take this further guys, prison officers really don't learn and it's shocking, simple brutes mostly, that we pay for.
All I see is auditors that don't understand trespass law.
This is exactly why this "its publicly accessible" myth needs bursting.
I love auditing and have been following it since before it ever came to the UK. But these people who are in denial of proper law, preferring instead the made up audit rules are only going to hit "real life" law, just like in this vid.
No assault, any complaint will get nowhere.
Its about time auditors questioned themselves over this "its public because we pay for it" and "its publicly accessible so I can...", nonsense.
Most auditors don't understand trespass law, but you seem confused too. The guard assaulted, battered and falsely imprisoned TGA. You have to tell a trespasser to leave. If they refuse, you may use only the reasonable force necessary to *remove* them. You can't grab and detain someone for trespassing. Complaints probably won't get anywhere though unfortunately.

Auditors, in general live in a dream world of their own made up "law".
The prison act 1952 states that filming "inside a prison" is a criminal offence. And yeah, we all know auditors take their preferred option of choosing to interpret that to suit themselves:- inside a building/secure area. And the ignorant denial that they may be wrong is a risk. Just ask Marti Blagborough, Arthur Taylor, and Chris Gallone who are currently facing charges for doing what they "thought" was their right.
If this prison officer interprets "inside" as meaning - within the boundary, ie - anywhere on prison property, then he would be reasonable in his judgment that a criminal offence has been committed. And another little titbit of legal knowledge - 'prison officers have the power of a constable'..so they have the right to detain and arrest the same as a pc.
So it could, be seen that the screw acted reasonably and lawfully. But if the auditor wasn't told to leave....possibly not.
@@aireboat7988 The courts interpret the statute and decide what 'inside a prison' means: not some prison guard. The 1952 Act distinguishes between 'inside' and 'outside' a prison. You think a judge would consider an open entryway, directly off a public pavement, to be 'inside' the prison? If not, it may be found that the reasonable belief of an offence was absent and the guard had no powers.

But here's the 'thing'.....it hasn't been tested yet. So for all our differing opinions none of us really knows for sure.
There is an ongoing case with auditors that "may" clarify it.......But its been adjourned.....again..!
Agreed that most auditors fail to understand basic principles of trespass, but guard equally failed to apply 'reasonable force.'
You turn up to a prison, causing problems, going where you know you shouldn't be, then asked to move on and cry 'Assault' when a prison officer touches you. Just so pathetic. Grow up lad and leave them to the job they do. They are under staffed, under pressure and you'd shite yourself if you had to do their job. Well done the Prison service I say.

7:50 That is assault by prison officer SW 130 against RR. He doesn't have excuse that he is effectively acting as a bouncer stopping RR from going on to the prison property since there are loads of other prison officers able to do that and who are actually blocking the entry on to prison property. His actions are unnecessary and just an attempt to control the situation and therefore unlawful.
I'm guessing you are not actually going to DO anything about this?

Prison property is private. No right even to "be there" so no right to film.
If you refuse to leave they have the right to use force.
We could also go into the incorrect quoting of the prison act. There is NO mention of "inside a building" it says "inside a prison". That "could" include the prison grounds. If you close to interpret it as "inside a secure area" then at least be man enough to face up to the fact that you could be wrong.

Excellent work TGA. Shocking footage and you did well to remain calm. You definitely retained the moral high-ground here and it is a good job you were with Rightful Recordings to provide back up support / extra footage. Good luck in whatever action you decide to take as 'pressing charges' or whatever is not as easy or fast as many people may think. Fantastic work - many thanks for standing up for our rights.
