      Employers know most employees don’t know their rights. They messed up with me when they retaliated because I knew they would retaliate and I formed my complaint in a manner to show retaliation.

    I was unlawfully terminated from a university professor job because of title XII retaliation. My attorney screwed up by missing the deadline for discovery and after that lost interest in my case. Yet, because i did not have the resources to hire another lawyer, i had to continue with the same. But this lawyer ineffectively represented my case and the summary judgement was granted in favor of the defendant (employer). My lawyer also prepared the summary judgement brief extremely ineffectively not disputing the incorrect claims of the opposition, despite my request. The rationale for summary judgement is "insufficient evidence to prove material fact" is incorrect because abundant evidence was provided and the summary judgement has not refuted or referenced to any of those evidence, but only vaguely stated "insufficient evidence".
    I would like to know how can i appeal to move the case for a trial. As stated, i am not able to retain another attorney unless on contingency. Can attorney's ineffective representation be a ground for appeal? Can i self-represent?

      Can you go after the Attorney’s malpractice insurance? Is the attorney is still representing you?

      Oh, wow, this is interesting. I was under the belief that "summary Judgement is Final! I also thought that clients can sue their attorneys, if you objected to how they were handling your case and not taking what you want in consideration even if you think its not in your best interest. and the attorney make decision against your better judgment. But unless you record that conversation how do you prove that? I hope that you can use ineffective counsel as a defense in a complaint to sue your attorney.

    So if I addressed a concern about a coworker's behavior toward me and then was taken off the schedule that week. No conversations or mediation took place about the event with coworker. Would this count as retaliation?

    I have to say, I mean no one is making me say etc..but you have an excellent presentation of someone who is honest and by your expressions as you speak it comes from an honest attempt to help another..
    There are so many adds now as the economy has slowed down..and more and more rip-offs are coming in as commercials!
    The big business or those with a little money want more then they use to sap up from people!
    We all have to work a little harder..
    Life though, may seem like a bowl of cherries..it is not for some..who work hard and are exploited by their employer…
    People need to have hope, and your expression and and clarity in your presentation has a solid warm feeling!
    I have had a few unjust situations..but all I could do at the time is work through it..and it actually was in the 2 years I lived in Seattle..
    We’ll time passes and things change..
    I work on having a clean and clear consciousness, and it takes work for me to be happy each day as I step out the door..sometimes I step out the door to find clarity calmness and happiness in a good walk..
    Thank you for your clear and uplifting presentation..
    It will help many people..sometimes it just takes patience for those that are unfairly treated at work to come forward..

    How would a retaliation charge from EEOC help a case

      If the EEOC finds evidence of retaliation, that will help your case.

      I received a right to sue from EEOC in Texas. My attorney wanted aggressively to find my signed arbitration form bc my employer (who wrongfully terminated me) failed to keep a copy. So my right to sue prevented my attorney from throwing away my case. However it did nothing more than that. We got as far as a mediation. My attorney then requested $10,000 for discovery. I had been charged most of $5000 - $6000 for my 10 years of Financials and previous work history - submitted to my employer who fired me- including more questions I had to answer and letters of recommendations from previous employers friends and family also provide names and numbers of witnesses (who were never called). I couldn't pay so I had to drop my case. Basically in my situation it did nothing for me. The EEOC is not an easy process and I was informed only 5% of all complainants win their cases. However I had witnesses and documentation to refute wrongful termination. The EEOC couldn't take into account my abusers previous court martial case and statements written by those witnesses which I obtained by a submitting a FOIA request. I still won my case with the EEOC despite that evidence not being able to be submitted.

    Is this considered retaliation a person with a medical condition who worked at a company for many years the new manager kicked someone out of management program which they had one week to complete this person went to complain they weren’t getting any help from their co workers then pulled them in office to tell them your not in program no more

      Basically they moved my friend from the easy side to a harder position she needed help with the other side she couldn’t do alone then kicked her out of the manager program
