    After over a decade with a previous employer who fired me because I wouldn't quit after a few years of making my life a living hell (workplace wise). My Pit Bull/Shark of an attorney went after them with a vengeance. Not only did he go after break and overtime violations on my behalf, but found nearly everyone on hourly pay was being violated. They had to pay CA and federal penalties, a class action lawsuit and closed down an entire branch.
    If they treated me with respect I would have walked away with no issues. No, it was demeaning, cruel and awful. It also cost them almost a million dollars in fines, fees, payments, my attorney fees.
    Don't treat your employees like shit. The End

      Boss move!!! Good for you! Who's your attorney if you don't mind me asking? I need a badass attorney to do that with Abso Lutely Productions and Adult Swim. The things they have been doing to actor David Liebe Hart are horrific and abusive. He needs a shark born swimming attorney like this.

    I have worked in multiple hostile work environments. The worst was at a particular social services organization. I can't believe I worked there for 4 years. Our boss treated everyone terribly. She treated someone so terrible that the fired/quit employee won her Unemployment claim and our office was declared a hostile work environment. She badmouthed everyone even making fun of my car and home because I was poor. When someone would put their 2 weeks notice she would see to it those 2 weeks were hell. When she quit she never put in a notice. I took a pay cut when I left that job just to get away from her. I started developing autoimmune issues while working there. She literally made me sick.

      Those older female managers are very moody. Even women tell me about these types of managers. And many of them are in HR. Miserable people.

      Absolutely I’m so sorry you had to go through that treatment. I’m dealing with a difficult employee & a jealous co-manager who’s upset with me because I don’t meet her for a briefing; instead I read her notes before shift.

    Thank you sir, you gave me the courage to find a lawyer to take my case after being fired. I reported sexual harassment to both my manager and HR and nothing was done for months, I was then abruptly fired. I was signed up on contingency immediately and they filed a charge with the EEOC on my behalf. I have a sex/hostile/retaliation case. I am currently seeing a mental health provider for the trauma, I hope I have a strong case and am able to seek justice!

      @@heartbeat2961 Unfortunately, they will do whatever it takes to protect the agency, company, managers and themselves. Sometimes they are the puppet masters pulling the strings. With that being said, be careful what you tell them because they don't have your best interest at heart.

    Thank you, I have dealt with management harassment on a daily basis, due to a work injury for nearly a year. I dread work. I've been documenting everything and have a handful of witnesses. This video has helped me a lot. I filed a complaint tonight, fingers crossed.

    I cannot believe I found a lawyer that give a good advice to everyone like me just now after a terrible accident at work with my foot and toes lacerations besides a harassment and hostile work environment, shortened me of my hours and overtime, force me to change contract I could not take anymore and in a mist of workers comp I had to quit after got light duty in the papers they list that if I will not comply with duties be possible terminated. Now is hard to find a law firm that stick with the little guy. I sincerely appreciate from heart your great explanation and guidance that give many of us some hope thru information.

    What about a work environment where multiple coworkers are excluding you, ignoring you, being rude, criticizing belittling and then acting like they aren’t doing anything. This includes management so going to them isn’t an option. It definitely feels hostile. But this isn’t included in your definition so how would I explain this.

      I'm dealing with this too rn, since I'm not black my coworkers gave me a shifty training experience and shoo me away to my supervisor for help . 🙃 went to my manager above the supervisor, he yells at me and tells me "you- -can't -expect -for -them- to- talk- to- you!..." but he mentioned that the reason why 5 other girls got hired and quit was because of their little clique behavior. 😂 when I walked out of his office, he asked if I was quitting.. 😮

    I have been harassed at my job by a much older lady for about a year. I am 23 she is late 50s. She has been making passive-aggressive comments towards me for about a year. She also at one point yelled at me infront of the whole kitchen staff which I had to bite my tongue a few months ago. I Immediately went to management and was told they would have a sit down with her (which never happened). This Monday, things completely blew way out of line & she threaten to “knock the shit out of me” and then got her clique to start harassing me. The one friend started clapping in my face saying that no one likes me and that I am a useless worker. The women also was telling other co workers that she loves to mess with me after the situation. I immediately contacted corporate/HR in the bathroom while still at my shift and they told me at this point it is just a “he say she say” and that they are making my manager write up a official documentation saying that if they do it again they will be terminated. I really hope this resolves this situation and the seriousness of it. I have been having suicidal ideation and going to sleep crying, waking up crying, feeling hopeless over it. I know these women want me to quit and I do not want them to get the satisfaction that “they won” especially since this lady told me working here comes with the “survival of the fittest”

      I'd keep my phone in my pocket and record this stuff as it happens. You can't use it in court, but you can use it to show HR what happens.

    I work in a hostile environment and there is no cure for it. If you are unlucky enough to be targeted, you have to options: take it and shut up or quit and move on.

      Same here being bullied, mobbed, gaslighting, harassed at the hospital for over 12 years. I've happened to be the top worker for 38 years and have never been suspended. These bullies are jealous and miserable people. Union, manager, HR and the police are all totally useless. Bullies are lazy bums and stupid managers are scared of the bullies. They say about me I'm crazy, I drink, I'm a stalker all bs defamation of character. The biggest mistake since they removed disciplinary measures. They should arrest the bullies and fire the manager. Action speaks louder than nasty words. It destroyed my reputation. I will never quit to make these lazy bums ever win. If I decide to transfer to another hospital and may start mobbing once again, I don't know all the managers ect like in every department like now. So best to not change hospitals. I will never let bullies try to control me from quitting. Never let these low life lazy bums win ever win.

    Thank you Branigan! I shared this with friends who are in very Histile environments where neither Supervisors Union Reps or HR are being helpful in resolving the Hostility. Consequently this affects the daily workflow of patient care. Very sad wgen this Co. prides itself in up-holding a high standard "Code of Conduct".

    What if I am in HR, and the supervisor who handles grievances will not document or address the situation because the coworker causing the hostility is her friend?

      My boss only hires his close friends and family to supervise with him. They all cover each other asses!
      HR is also in bed with them. The amount of grievances my department has should call for a class action lawsuit. But everyone is intimidated by the size of our organization.

      @@Angela-cd9bj Oh yes.....this is great. My company I work for has presented me with a termination letter because they say I went over my attendance points. I am also on FMLA and have used this for these " points " they are saying I got. I know they got them because they were approved by bot the company and FMLA. Yet they emailed me saying were going to have a meeting. I emailed them back asking what the meeting was going to be about and do I need my film representative. They never responded . I went in. I didn't sign the letter. Went home and have not been to work in a month and have been building my own case having to back track emails, texts, phone calls, etc.
      Then I get a message saying , " oh you know what " We would like to reinstate your employment. Yet they won't tell me why. I know its cause I fought it and they messed up and won't tell me why. My manager also told me to stop emailing HR and he would be dealing with it from here on out. I need to stop emailing ev

      everyone else, meaning HR and the big big plant manager. The one that tried to get me fired. My HR is also on guy in Chicago. Not even where we are in Kansas City. I have emailed to HR guy and called him so many times in this past month and he has not responded all.
      I am just so annoyed and wonder if I should look into legal assistance.
      Thats so shady for the guy to tell me to not email HR anymore or the big wig. They are shady as hell.

    i just received a call back from your office, i am hoping you can help, i started following you in nov 2023 once i felt my job was at risk, after i complained to HR, filed for FMLA, workmans comp, all leadig to being let go, your videos have helped me build a case. recommend everyone watches and learns their rights even if there is no current issue at the job/office, as ppl can turn on a dime, co-workers are not your freinds nor is HR as attorney mentions in all his videos. good luck all, appreicate this channel.

    just experienced weirdo manager harrassed me last year, I confronted him cause I wasnt having it and they denied and lied. Now I know better and next time I run into these high level weirdos again, I'm getting it on camera and exposing them. Never again will I make this mistake.

    What if I have an employer that calls my husband a “sugar daddy.” I have this on IM. He has now laid me off and is forcing me to train someone senior of me, a manager before my lay off date. He has exclaimed that I must attend each day for a 1.5 hours of “mandatory training” for the next two weeks to train this individual. I was never given a proper training. I don’t even have 12 hours of info to give her. He screams at me. Tells me to quit. He doesn’t want me to get my severance.

    This is helpful as I am being harassed at work as a new employee now at 6 weeks. This guy told me he had a Glock 40 in his truck for me. I need my job and the pay. I’m just trying to stay away from him. Why are people so crazy at work now.

      @@Lukronius I stayed 8 months. Then resigned. I really liked the job and helping clients but the Negative Vortex of Personalities that existed and was tolerated by My Boss was crazy. He had held that position with NO OVERSIGHT from upper level mgmt for years, in fact 30 years. He is the GateKeeper and controls ALL internal communication with the parent company so employees that are being harassed by him cannot reach out for help from the parent company. The Parent Company has a No Harassment Policy between employees and we had to have computer training on it and sign a document attesting to it, yet our Boss broke it everyday by harassing the employees. The turn over rate for employees there is huge and most people don’t last 5 months. Being that the Boss was a Bully, The Assistant Manager copies the Boss’s Bullying behavior and actively bullies other employees in front of the boss to Earn his praise and admiration. When the boss has a day off the Assistant Manager is just himself and he is great to work with. But with the boss at the store they would hover over my work station and intimidate me by telling each other out loud how stupid I was. When this would happen I would leave my work station and go do other work like process shipping orders.
      My boss when he was bored would come over to my workstation and say: “I’m just going to stand here because you just LOOK GUILTY”.
      I would just ignore him and process calls. Then he would stand over me and nitpick everything I was doing.
      After I resigned I was going to write to the parent company with my complaints but never did because it was a low paying job and really not worth my time. The sales department there was a joke. The commission rate for sales people was 0.03% which made each sales associate completely undermine other sales people in the same department. One Salesman named Stan, would call MY Customers and tell them that I was trying to rip them off, and he would try to steal my clients.
      I informed my Boss of this and he just laughed in my face. He was a weak Boss and never disciplined people for harassment so people there knew there were no rules.
      What really angered me was a guy that was a decorated Vietnam Veteran and he pays him $10/ hour and chews him out in front of the other employees. He treats him like shit. I made it my goal to help that Veteran by helping him re-write his resume and get out of that situation. I even gave him my spare MAC computer because he didn’t have anything to look for work in his off time. I hate seeing people get crapped on. Last I heard he was working with the VA to find something better. Makes me sick to my stomach seeing a guy that took a mortar round and lived with injuries working his ass off and then treated so unfairly by this loser boss.
      If I had stayed there another month, you might have heard about it on the news. I left because I was contemplating physically harming those individuals. Which is Wrong, but it was getting worse everyday. I was losing sleep. Had a pit in my stomach everyday. It’s not worth dying for. I don’t even want to look for another job because every Job out there is like this internally. It’s so depressing. I’m afraid to move forward and end up in this same environment at a different place. Huff.
      My Dream Job going forward would be to work undercover as a new employee in different companies to root out this internal illegal practices of harassment and to hold companies legally responsible for disrupting people’s lives with bullying and harassment.. Nobody should have to put up with this in their lives. People should have a RIGHT to work hard for their companies and not be driven to suicide from bad bosses.

      @@Lukronius Thanks Luke ! After I left that Negative Vortex, the pressure relief was immediate. As bad as it was it opened my mind to recognize bad work situations that much quicker. I am better informed now. The only other aspect that could really decrease the probability of this happening elsewhere..is for Human Resources to really become more than JUST an advocate for Companies. Too many HR firms work to only fire Good People so that the Toxicity continues. Management Teams/Human Resources should really root out these negative power structures within their organizations, by encouraging Positive Employee participation. Workplace violence could be eliminated. People could flourish at work, and Happy People work harder for the company. It's a Win-Win, but somehow the ridiculousness continues.

    My company uses a drive cam in my co. car. They set up a point system that was so strict that it is not a question of if you will be fired but a matter of when. Creating a hostile environment, incredibly stressful situation. That I actually could not see straight trying not to set off this camera. Could I have a case?

    If I’ve been asked to continue to meet in a meeting with a harasser despite my objections to these meetings (as I’ve been harassed belittled in these meetings) does that qualify? Thanks

    One thing I disagree with strongly: You said that to only call a lawyer once you've been fired. However, if the hostile work environment is going on, how you HANDLE the ongoing situation UNTIL you leave or are fired is critical to getting the best outcome. Therefore, once it starts to be become hostile, getting some advice on how to proceed can be critical. For example, in England and Wales, if you leave because of constructive dismissal, (ie, you choose to leave because continuing to work there is untenable), you need to say you are leaving because of constructive dismissal in your resignation letter.

    Thank you for this video. We had employees complained on inappropriate racial comments made by a medical provider. After written complaints received for almost two years, the provider who those complaints were made about, the provider turns around and files a complaint of working in a hostile environment against the employees!! Now the staff are targeted with the exception to one of the employees that has a personal relationship with that provider. This has created an uncomfortable, and walking on eggshells environment. :(

    My manager came to my car yesterday harrassing me trying to get in my car. I told her through the window i didnt want to talk. She kept antagonizing me, followed me into the store yelling at me embarrassing me in front of customers and other co workers. She then came charging toward me and other co-workers and customers were holding her back. The whole time i was telling her i didnt want to argue with her. Is this grounds for cantacting a lawyer?

      I took it to our other manager and the head boss for the whole company... i was cut off everytime I tried to explain the situation or how I felt. I was accused of stealing over $200 out of a register. When i asked her to watch the cameras she told me she doesnt have time to watch hours worth of cameras. I told her i refuse to be accused of stealing because a paper said so when theres cameras right above the register. After telling me she didnt want to hear it I told them i dont feel comfortable working around her and i believe she should be fired. They said if they fire her they would have to fire me. For what? I didnt do anything. Thats wrongful termination. She said she can only schedule me one day a week and if I want anymore hours than that i will have to get them at another store. Why is the other person not being transferred instead of me? After that conversation she called management at the other store I work at and told them that I said a bunch of things i didnt say. So now its conflict at my other job - WITH THE SAME COMPANY - how should i go about this?

    one of my co workers was using the toilet and he was sprayed with water and he started flinging his own human excrement around. which is a felony. i would have been furious if that was anywhere near me. it’s a hostile work environment and he proceeded to cut a clients hair after touching his own excrement. i am disgusted and suffering from anxiety in the workplace and i can obtain medical records . im in los angeles

    So I work in a place that has adults with disabilities but it’s not actually harassing me per se, but it’s harassing a group of people, and there’s 2 supervisors especially one who was screaming on the top of her lungs and was threatening us to tell on us on the higher ups about it… would that be considered workplace harassment?

      @Ena Thank you so much for validating my position. Everything you outlined makes perfect sense. Things have gotten better, but I still feel like I”m working under a microscope and I’m starting to feel bad about myself which I don’t think is fair. Expectations are constantly changing, even after mastering the issues you got written up for.

    I am a woman working 8months in this place. My supervisor took the position after a month that I was employed. I don't know if I can have a case for the short time that I been there. But he doesn't like me and treats me unfair, allways settings me for failure

    I watched you prior to my situation in which I have age & medical disability, hostile work environment, harassment, retaliation and Wrongful termination and failure to make accommodation s and changing job titles without additional compensation, and you really put into perspective what actions I needed to take so I did It and launched it with all supporting documents and emails and it's in the works 4 weeks already what do you think about this?
    Also thank you for your wisdom and your videos they really help get people's lives in order after such a tramatic events and gets justice for the blue collar workers.

    I’m a vendor dealing with a hostile work environment from a GM on a power trip. She takes before pictures and says work is incomplete when we haven’t done it or started for the day, makes up OSHA violations with our equipment, puffs out her chest and tries to assert her dominance on everyone on a daily basis. Corporate will do nothing about her

    What about smaller employers? My ex employer has less than 15 employees and the owner seems to feel that she can do whatever she wants without repercussion. It's crazy the things that she's done as if she's invisible. I have a mountain of documentation to prove all allegations but cannot locate an attorney in my state. Guess I'll be in the law library working this case myself..

      If an employer doesn't respond to a lawsuit, administrative charge, or something similar, a default judgment will probably be entered against them.

      To get greater protection than the basic anti-discrimination & harassment laws in place at the federal level, your state legislature must pass a law or laws creating additional protected classes. For example, CA protects "sexual orientation" as a protected characteristic but Federal law does not.

Two years ago I learned a coworker of mine was protected and I wasn't. Here in Virginia we have DARS. Department of Aging and Rebilitation that protected his ADHD. I can never get a return phone call from DARS on how to get job protection from a disability. So I just tough it out and keep going forward.

    The law sometimes creates tortured logic. In California and for title vii there's an enumeration of many 'protected' classes so instead of being parsimonious and making harassment in the workplace illegal we create all these distinctions. It's actually outrageous yet we are asked as employees to accept this nonsense. The European Union does better on laws against workplace harassment and stress that causes illness. The other maddening thing is as attorneys do this work over time they lose any sense of the irony in participating in a system designed to confuse and confound employees...

      It depends on why the coworker acted in a threatening manner towards you. If it was because of a protected characteristic, then maybe. If it was because of something unprotected, then no. When I say a "hostile work environment" I'm always referring to the legal definition. Yes, people act "hostile" at work all the time, but that doesn't necessarily meant it meets the legal definition or that you/the victim should take legal action.

I've happened to be the top worker for 38 years and have never been suspended. These bullies are jealous and miserable people. Union, manager, HR and the police are all totally useless. Bullies are lazy bums and stupid managers are scared of the bullies. They say about me I'm crazy, I drink, I'm a stalker all bs defamation of character. The biggest mistake since they removed disciplinary measures. They should arrest the bullies and fire the manager. Action speaks louder than nasty words. It destroyed my reputation. I will never quit to make these lazy bums ever win. If I decide to transfer to another hospital and may start mobbing me once again, I don't know all the new managers etc. like in every department like now. So best to not change hospitals. I will never let bullies try to control me from quitting. Never let these low life lazy bums win ever win.

    I resigned from hostile environment. I have every bit of my documentation showing proof, as well as my attempts to stop the behavior. I also fall under a protective class. No performance issues.
    Left a message for the EEOC. I having issues with any lawyer wanting to even schedule a consultation. I’m in Massachusetts.

    These videos are very helpful. Just one question, I had a supervisor hit me with his clipboard out of anger and I reported it to HR and about a week later, I was fired. Is there a case?

      Contact an attorney immediately! Unless you have had performances issues addressed and documented, a reasonable person would consider it retaliation for reporting the incident to HR. I would go so for as to file a police report for battery, as well. You can request charges be filed against the supervisor. The company is liable for the supervisor's deplorable actions.

    What is the burden of proof of harassment if it is not legal to document voice recordings that often occur on the job

      The burden of proof in most civil trials regarding sexual harassment is Preponderance of the Evidence. Think of it as you win if you convince the jury that there is a greater than 50% chance that the claim is true. This is obviously much easier to meet than the Beyond a Reasonable Doubt standard in criminal trials.

    Yup! Cafeteria supposedly needs an accommodation form to eat some vegan food, from the cafe menu. Being vegan is not just an accommodation, but it's my belief/ & an allergy against meat. If I only ask, for a salad this becomes a great issue between supervisor's at times. Other times they let me eat my salad without an accommodation form. Now I make sure I eat before I go to work. -And one time this hr person harassed me, due to my water bottle not being clear enough. That I was advertising a vegan lifestyle, I told her that those were my favorite vegan stickers on my green clear water jug. I reported her, and soon enough she backed off.

    There is not one item you said in here that doesn’t accurately describe the importance of what I’m currently experiencing. I’ve always been afraid, and these employers know this about me and continue to ignore it when I ask for basic reasonable accommodations due to my several illnesses, including some rare ones you mentioned I see and experience regularly I didn’t know about - punitive with fraud, etc. This was the first time someone was able to articulate my situation, and now I see the severity of it. It’s hard when you are constantly being gaslit by your employer and lose your sense of self and trust. Nonetheless, I realized how bad my circumstances are, and even now after everything that has been done to me, I am afraid to even broach the issue. Although your videos clearly showed me how dire and accurate my work circumstances are, I am still afraid. But thank you for at least letting me know I am not “crazy.”
    Ugh, this is bad. Now I really don’t know what to do. They are essentially sending me out to “sea to die”. Crap. I legitimately realize now that I need guidance and help.

My case is already in the court since last 17 months and now at the final arguments the defense wants dismissal because they say an ex employee can't sue. My case documents mention I resigned because of hostile environment but it doesn't mention a plea in specific. I have to save myself from dismissal.

    I have to share my story! I was being sexually harassed by the owner of the small company I worked for many years ago, in my late 30's. The creepy boss would always come by my desk area while I was on the phone or doing paperwork. I had a high wall with cabinets above my desk, so it looked somewhat private where I sat. I was one of 2 inside sales women. His 25 yr old son was the Vice President. About 7 employees total. This wealthy boss of mine, would come creeping up behind me while I was sitting at my desk, minding my own business, and he would come behind me and roll me out on my chair on wheels and comment on my legs.. smh.. or he would take off his glasses and try to tuk them into my clevage (which was never ever exposed and my legs were mostly covered, from the knee down), I dressed professional, never provocative. That's just not me! The VP of sales who had an office near my desk used to tell me how he always noticed how stable my personality was. He seemed to be ashamed of the boss, so he must have noticed. And one more thing I'll share.. I had a box of those bugel chips at the end of my desk.. and one day he paused and looked at the box and said "hmmmm, bagels, except you don't EAT them... you BLOW them" and he smirked at me. So.. what he didn't know was that I used to work for lawyers and I knew the importance of evidence to prove a case.. so I kept notes and tucked them in my eyeglass case, every time he said something and walked back to his huge private office. Finally the day came when I had to quit cuz he got subpoenaed to court and I knew I couldn't stay any longer. When we had a meeting with his and my lawyer.. and they saw all my notes, with details from each day.. they were speechless and decided to settle the case. I was awarded a $35,000 settlement! I noticed he was finally the one who was humiliated when his son found out what he was doing! Justice was served! I could have asked for much more money.. but I didn't! I pray this testimony helps someone! God bless.

    The main problem I see is that if you aren't a protected class, then the harassment is ok? Working with women is generally a nightmare, especially in office settings where there are 3 women. It seems like inevitably two will team up against the third one and start bullying and harassing her.

    I had acid poured on my car at work.i never feel valued and I never complain to hr on anyone due to I'm the only one in my sector.i work alone.however men constantly are lying deflecting and trying to get me fired by saying untrue things.ive tried hr.they don't take anything serious. A man tried to fight me over a parking spot.yes,I am good at my job.am I valued NOT TO ANYONE but the owner who is never there and is probably told lies.im fedup and don't know how to deal with the abuse.

    Age shouldn't be confined only to people that are 40+. Young people experience age discrimination too! I was fired for being too young when I was legally allowed to work. I was over 18. This happened in Canada.

    Imagine working for a company that lowers attendance on review score for serving in the miltary. The company also had a policy not to give perfect attendance awards or bonus for this as well.
    Still working for them but is it military discrimination?
    From our HR said theyre following federal guidelines

      I did try to stop ✋️ the Harrassments. I even went to EEOC Daniel Nance because Blyth and Monica had threatened and bullied to resign. The used scare tactics, verbal outrageous beatdowns, Defamation of Character Libel, false accusations, Fraud, and oppression to intimidate me to resign. Blyth, Monica, and John interrogated me, as the pointed their fingers and angerly stated, "We are going to make an example [ wipping boy out of you to help keep the others [implied "N Word"] in line. "ADMIT THAT YOU TOLD SHERWIN THAT BLYTH CALLED YOU A NXXXER!"
