Cambodians Who Fled War, U.S. Bombs and Genocide Now Face ICE Raids and Deportations Under Trump

On Monday, an Omni Air flight departed from El Paso, Texas, with 36 Cambodians on board. They were deported to the Cambodian capital Phnom Penh. Attorneys believe it to be one of the largest deportation flights to Cambodia yet under the Trump administration. We speak with Kevin Lo, staff attorney in the Immigrant Rights Program at Asian Americans Advancing Justice-Asian Law Caucus. He has been working with Cambodians living in the U.S. who are facing deportation.

    If I'm understanding the situation correctly, some of these deportations may be unconstitutional under Article I, Section 10, Clause 1 of the US Constitution which prohibits ex post facto laws which retroactively makes criminal conducts that were not criminal when performed, increases the punishment for crimes already committed, or changes the rules of procedure in force at the time an alleged crime was committed in a way substantially disadvantageous to the accused.
    Back in 1996, there was a law change which expanded the types of crimes that someone can be deported from the US for. The problem is that this same law allowed for the application of the law *retroactively* and in doing so increases the punishment for people who may have already served their time as was required by law before the 1996 law change happened. It may also make it more difficult for the people who had already served their time to get US citizenship, which no one can argue doesn't make things substantially disadvantageous to the accused.
    I can't recall where I saw the statistics of it, but I think it was around 78% of the Cambodians being deported were only eligible for deportation due to the law change in 1996 and just as many may have committed those crimes prior to 1996. In other words, they're being punished ex post facto.
    Unfortunately, these Cambodian refugees fled from a situation where anyone with any education was being murdered or worked to death, they were murdered if they even looked like they were educated such as wearing glasses, they're poorly educated, are poor, and often have psychological problems that they never got any help for or were raised by people whose psychological problems make it so they had no business raising children. This means even if they were being deported unconstitutionally, many of them wouldn't even begin to know what to do about it, who to ask for help, or anything else that might help them with the situation.
    I'll say it again, it is possible that up to 78% of those being deported are being deported using an ex post facto law, something that is unconstitutional, and for things they may have already done time for. Even if you're pro deporting criminals, are you ok in allowing the US to punish people retroactively?

    Per wikipedia ICE data the average of 41 Cambodian refugees from USA were deported back to Cambodia per year between 2001 to 2010. In 2011 it increased to 96. In 2012 there were 90. Apparently, that is the latest data on wikipedia

      Basically when a non citizen commits most crimes they become ineligible for permanent resident status and are subject to deportation. Upon completion of your Prison or Parole time, the DOC hands you over to Ice. Most of these Cambodian were documented, but lost their immigration status due to their crime. In the Eyes of immigration it doesn't matter if you served time for shoplifting or serial raping, unless you could prove that deportation will put your spouses/child life in danger you'll be sent back to your country of origin.

      Oh no one of my childhood friends mom is here illegally, I hope they leave to Canada or somewhere safe. I hope soon we can all go to Latin America now that Russia has send Bomber to Venezuela so now they can't invade and steal their Oil. So they can protect us from Terrorist State USA.

      @@plataztar5913 is it reasonable to deport someone who just committed a small crime like fighting in a bar and breaking a window or having marijuana?some people got a new life new job and family, some have even business after their jail time, is it reasonable to deport them even if they didn't kill anyone or committed a serious crime?

    34 of these people are convicted criminals. According to the US gov, "Criminal convictions included two counts of murder, two counts of attempted murder, manslaughter, voluntary manslaughter, accessory after the fact of a homicide, sexual assault, three counts of sexual offenses, child abuse, domestic violence, aggravated assault, aggravated assault with a weapon, aggravated robbery, two counts of assault, arson, auto theft, two counts of robbery, robbery with a gun, two weapons offenses, theft, larceny, stolen property, fraud, and five drug convictions."
    It is disgusting and truly shameful that this channel fails to place this deportation into the correct context. I am having a difficult time not raising my middle fingers to you here Ms Goodman.

Some simple honest and objective fact checking clearly shows that Ms Goodman is dumping a huge load of propaganda on you and her listeners.
