The cop should not be charging her for DUI because she under the legal limit on the breathalyzer. She never should have accused the officer of any misconduct because she can prove in court she passed the sobriety test.
The cop made the first false accusation against her after passing the breathalyzer by saying she would have failed the test if she took it two hours earlier, which is impossible for anyone to prove unless she was given the test right after the traffic stop.
DA can't charge her because she didn't make an official claim with the police. The Officer can file personal lawsuit against her, but after the fact, he just wanted it to be over.
