    The depths in which law enforcement agencies narrate stories and twists your statement aren’t pleasing, sometimes rendering helps gets you in trouble and it’s not something anyone will be proud of. I helped a drunk guy off the roadway and he fell off and had slight accidents, I was accused of pushing him to the roadway, I was charged and that affected my livelihood. Couldn’t get a better job or pay a proper rent due to background checks of crime I didn’t entirely commit. Few months passed and my cousin introduced me to a programmer whom helped me clear my crime records from the database, have been always grateful for the opportunity that presented itself to me.

      Marcellus Williams was an innocent man that was just recently executed, and it was actually the prosecution opposing his execution. The state unfortunately didn’t care for the redeeming evidence

      My brother and sister got off their charges and shockingly the prosecutor even stood up for them in court. I know it’s rare but this happened in Tacoma, Washington. Charges dropped.

    To say attorneys know the law is saying all people in any profession are good at it. Not true...there are good attorneys and bad attorneys. Seen it with doctors, engineers, and lawyers. Always go with your gut instinct...always ask questions if you feel you need to. Don't hesitate to make a change or get a second, third or fourth opinion.

      Agreed! People place WAY too much confidence in attorneys and judges with law degrees that imply "competency" I've seen a few very good attorneys, the rest I would go toe-to-toe with any day of the week.

    Do NOT underestimate the power of AA ... I saw a young guy get 4 felony drug possession charges dismissed for honestly turning his life around and the strength of the testimony of the fellowship on his behalf. He is free and living a good life today instead of rotting in prison.

      Joseph Meador: For me it seeems to be the opposite: I have struggled in AA and other 12-step programs for 25 years , sought treatment and helped myself as far as I could, but have more been punished for it: My home, money, honour and rights stolen and health destroyed, I was put in bad places instead of in 12-step treatment which they knew I wanted. They don't want my good, althpoiugh I haven't committed any crime but only applied for personal assistence for Aspergers and then for a Good Man. Instead the social officials have schemed to have me under a (false, criminal) guardian! Without even warning or informing me.
      My 12-step work has been severely hindered for many tears and I am breakin g down. They all lie and deceive. I am to alonely, sleep deprived, starved and frighetend to manage this, since they exchange officials now and then, and no one knows my case and what others before them has harmd me doing which would explain my severe stress reactions/behaviours. The fear prayer can't work well when there is real threat, danger and justified fear constantly, with health and social life breaking down quickly.And I have never had the kind of healed, strong sponsor that I need(ed). Could you respond to this, please? i'd be most grateful. I want up and out from under the ice.

      @@Medietos Right out of the gate, you are not sober. Clearly. There are other programs out there. Seek them. And stop doing it because of court shit. Seek it because you actually want it. They know when you are doing it genuinely or because you know they want to see it. Be genuine. Otherwise idk how tf anybody here can help you.

      What other programs are you thinking of, and what about me if you don't think I am sober? Anyway, AA is nit for getting just sober sober, but for transforming and getting a contact /relationship with God and one's higher power.

    I love this. "Do you have any friends who will be a witness to something opposite to the charges?" The real facts are: Does the Prosecutor have a quota? Did you give the police any damning statement? Are you going to a class for what you're accused of, which they later will say is your self admission of HAVING the issue they charged you with? Courts are all politics, self interest, loopholes, financial gains, back room deals, and a legal chess match where real justice isn't even part of the game. WHY would you have to be patient to try to get charges dismissed? Because "retainer" is a thing. If you're found guilty or not guilty...the lawyers still win.

      Lawyers don't always win lol most lawyers make under 100k with massive amounts of debt and 7 long years of hard schooling. This is the comment of someone who has no clue what they're talking about and says stuff to sound "intelligent" .

      @@Wakanda21D You'd be surprised. Plenty of innocent people get sent to prison or punished by the law, even if they didn't do it. Prosecutors and cops dont care if you're innocent, they just want to convict people. A good defense attorney can prove your innocence. If you didn't do it, you may think "I didn't do it, so how are they going to convict me. I can easily defend my case", but proving innocence is harder than you think. Cops and prosecutors have a lot of tricks to make you look guilty. It's why so many innocent people go to prison. A good defense attorney can defend you against these tricks
      Like you said, the state loves throwing people in prison, so they do it however they can

    I find that people don't know that if your case goes to trial, you will have to pay again. To retain either a new attorney or the same one to represent you in the trial phase.

    Because he was facing 45 years in jail from the prosecutor his public defender didn't get off his ass to do anything for him not even take his calls this is ridiculous this is not justice . In this country it's how much Justice can you afford

      He should get a retrial because he wasn't given adequate legal counseling, as his constitutional right. Also he should report that public defender to the bar, because abandoning or neglecting your client is grounds for disbarment

    No, you do not have to listen to everything your attorney says, you never have to sign a medical authorization form, and you do not have to plead guilty to anything when you are innocent and you can prove it.

    The prosecutor in my daughters rape and overdose is evil . Along with sheriff and coroner. Daughter at sheriff relatives house. But trying to pin on a black drug dealer. We the victims family . Is helping defendant to get out of murder charge. Never believed corruption until it hit home.

    All you have to do is fire your attorney, because he has an obligation to the court instead of his client. Appear as special appearance as the beneficiary of the trust on the paperwork. And tell the judge that you appoint him trustee of the trust, and now it's his fiduciary obligation to perform and benefit you as the trustee. And that he's not allowed to commit fraud in the trust. And you will not accept anything the prosecuting attorney says or the other creep up there because all they can do is speak second-hand information, which is not valid

      Apologies come in the form of a monetary settlement. If you are falsely arrested, and it can be proven, then the officer/deputy is not protected under qualified immunity- which leaves the door wide open to a civil rights suit against them.

    I worked for a criminal defense attorney in Albany. Once a cop claimed to see a gun 185 feet away in the back of a truck. "We'd like to call the weather lady..." (visibility was zero). Another time someone in a room of crack smokers tested positive and I found a study where that happened to newborns.

    Hello, I just came across your Utube video explaining a bit about how to get a criminal offense dismissed.
    I’m a female truck driver a minority in this industry. I recently received a citation for stopping the company I work for tractor-trailer on a thoroughfare/ hwy. Also the officer arrested me at that time and had the semi towed to the impound yard. He charged me with 1. Obstructing a thoroughfare/hwy and 2. Obedience to an officer.
    Both of these charges ended up being marked as criminal traffic and criminal.
    I sought the help of an attorney as pro bono.
    I could not find one!
    So I retained one by way of a payment plan.
    My point is and question . I am concerned that the attorney I retained does not know much or anything about a truck drivers rules and regulations regarding FMCSA and how a misdemeanor would effect my career/ CDL-A that I hold.
    Another fact in my case is when I was arrested the officer never actually booked me nor was it marked on the citation that I was even put into custody!
    Actually I was handcuffed put into the back of another female officer’s vehicle and taken to the jail by her then put into a jail cell, where I sat for approximately 3-4 hours detained basically. Then the arresting officer came in and gave me my cell phone so I could make a phone call to my dispatch/company to let them know what was going on! Upon my release I was given the ticket and then offered a ride in the same arresting officers vehicle and by the same officer who had placed me under arrest to the impound yard, only a block away. I had to pay out of my own pocket to get the tractor and trailer out of impound.
    All said and done, I was never treated so unfairly by an officer.
    I do not think he had the just cause to even arrest me in the first place!
    I should have been given possibly a traffic citation and been on my way!
    I certainly did not deserve to be detained and arrested!
    What can I do about this?
    My attorney has never mentioned trying to have the case dismissed!
    I know that some very bogus actions took place by this officer and as I said I certainly should have never been arrested and forced into having to pay for a company tractor and trailer to be released from impound!
    Concerned that even tho it is classified as a mere misdemeanor on my record, that it will effect my career/ employment potentially to such a degree that it shames my good name not to mention has caused me a severe amount of lost wages, has been a struggle to continue operating/driving OTR and basically has consumed a large part of my time because it’s always on my mind at this point as to what will happen to me!
    Any advise would be greatly appreciated!
    I know that you do not have the whole story just what I have told you. But I do not want to overload you with to much as I’m sure you know the laws!
    This occurred in a small town in AZ .
    Any help as I said would be greatly appreciated!

      This actually happened to me as a delivery driver.. Going through the exact same thing and my trial is tomorrow. I have stopped delivering at night, and barely deliver anymore. All the wind was knocked out of my sails with these charges.

      Qualified Immunity. SMH-Don’t waste any time challenging the actions of the police force-never gonna happen. Cops commit grossly unconstitutional acts ALL THE TIME. It is the Gold Standard of the Profession. I wouldn’t even advise you to take it to trial, because then you waste years of your life, spent exorbitant amounts of money, and face the very real promise of a trial penalty. And they can stack you in the meantime. I fought my case for five years, only to have local law enforcement stack on bogus charges, confiscate all of my animals, and allow my house to be repeatedly burglarized for nearly sixty days. They even found two women on my property robbing me, and let them go. I had to plead out--as an innocent person-I had to plead out, or face the threat of 40-60 years in prison, as a “first-time offender”. Small AZ town, too. Take the misdemeanors and walk away. Leave Arizona. It’s the scummiest legal landscape in the country.

      @M Instinct: Good question! In our experience the other side never thinks it is open and shut. We cannot give legal advice here, but in general you want to get the information to your attorney and let them use their experience with the relevant "decider" to get them to do what benefits you. You do not need to convince them you are right, just to let you go. Thanks for watching!

Person was arrested in all that. However, the court has been doing all these private pretrials. I am wondering, how many pretrials can someone have before the actual trial begins? i just wonder when the actual trial will begin.

    The public defender and prosecutor system needs to change. 😢 They are over worked over book and the out come is stacked against the defendant. They are more programs for the accused then for the accuser. Knowing this be carful be respectful, and listen and pray.

However, the court has been doing all these private pretrials. I am wondering, how many pretrials can someone have before the actual trial begins? i just wonder when the actual trial will begin.

      @Johnny Eric: In Washington State there is no technical limit on pretrial hearings. Many felonies go on for over a year before a resolution happens. Great questions and we hope it turns out how you want.

    I’ve been falsely accused of domestic battery Misdemeanor I was on the phone at the time and I have a witness that Seen nothing happened also and a recording that nothing happened. Not to Mention the 911 call will show nothing was going on either Still went to jail. Trying to get it dismissed What are my Options

      Start building up and gathering all the necessary evidence. List every witness you could think of, get a copy of the video surveillance, etc. Make sure that you have so much evidence that the DA will shit their bricks and forfeit.

    What happens if there is evidence against you? Could pretrial Diversion or any Inpatient programs be beneficial for even felony charges? I'm facing animal cruelty in texas. I'm a veteran and suffer PTSD and have some mental health problems. My district Attorney isn't making any deals my lawyer likes besides serving time or probation.

      That is a good question. We do not practice in Texas, so we can only speak to Washington State. Here, some counties have something similar to pretrial diversion for felonies. It varies county to county, however. The best suggestion may be to contact a few very local Texas criminal defense attorneys to see what your options might be. Thanks for watching!

    Mine didn't he said give me 3k and he would get 1 charge dismissed and wheel and deal for the other charge, I told him where he could shove it. I am not wheeling and dealing with my constitutional rights. No way I would ever lisen to someone who thinks constitutional rights are something that can be wheeled and dealed.

    So I’ve pled guilty to a lesser charge and got accused of the same a crime again but I’m completely innocent the prosecuter seen that I’ve been charge with this same crime again and thinks I’m guilty because of it but there is absolutely no evidence because I didn’t how can I have my lawyer get it dismissed?

    if there is 2 crimes, for different time and place, does the state need to prove the corpus delicti for each offence or does the state merge both crimes together for one corpus delicti or is the two corpus delicti for 2 crimes?. is there case law on that in washington?There is in California. Rayyis v. Superior Court, 133 Cal.App.4th 138 (for 2 corpus delicti for 2 crimes)
    long story i think my public defender had no such case law for that so he convinced me to take a plea deal.I was hoping he filed a motion to dismiss crime number 2 because all they had was a false confession and no evidence for crime number 2,,but there was evidence for crime number 1.

    What if the case is based on an illegal stop that was unsupported by probable cause or exigent circumstances, they jailed you for eleven months and the public defender wouldn't even remotely entertain seeking a dismissal based on that merit? What if there is deep-rooted corruption between the DA and public defenders office, and even the judge is on it? They held me in false captivity indefinitely and leveraged that to get me to take a plea deal...

    What about aggravated suspended license I’m going to trial how can they prove I knew they don’t notify u ur suspended u find out that bad news when the officer comes back to car was arrested and feel wronged? Can I get dismissed

      @Shaun W: In Washington State the prosecutor only needs to show the notice of suspension was SENT to the address on record, NOT that it was received. It sounds like your matter may be outside of Washington State. Please check with your attorney and good luck!

    My uncle has been locked up for almost 20yrs he never hurt anyone he was at the wrong place at the wrong time because he's sending notifications to the courts pertaining to how he's being treated there's a lot of retaliation being done to him. They switch him too far to see his family now

    Your work towards trying to help the public become better educated in the criminal court process is honorable. Thank you for that. I think you were helpful in the procedural areas and etiquette with your own counsel. However, i think you may have transversed your percentages of prosecutors who seek convictions over justice (5%)!!!! C’mon man, it’s probably beneficial for your future business relationships to infer such publicly, but it’s most likely making your potential clients that know better, (ie. Us) question your perspectives. But your efforts to spread knowledge is certainly appreciated. Ps. You may me misconstrued about all of those professionals in court’s motives as well. 🙂

    In court he stays quiet!!! Hasn’t said a word for his defense , lies to him about how he didn’t have to inform him of his arraignent or grand jury ??? He was denied medical attention while in custody!! Acts as if that was nothing ? Mind you he had open cut wounds in a cell bleeding ! Open cuts on both hands !! I had to find out he was detained in cell although they confirmed he was in hospital and I had to literally say I was going to talk to Judge!! Then they came and told me ! I was right he was in the cell bleeding !! So much more !!

    No i rather go to jury. There is either six or twelve people that have common sense something prosecutors dont have in wrongful charges. You ever hear of filing false reports. But as you said innocence doesnt matter!

    I am at a lost on what or how to get my daughter help please give me some advice or who can defender her or what happens if they find her guilty. she has been in jail since May 4,2022 sshe has had mental issues due to long time with drugs and every cop here knew that for she would call them every other week or month for help that someone had been at her house and she would be fighting with the voices in her head they kinda would harresses her sometimes when they would see her walking at night either coming from my house or store to get something to eat and they eould put her in jail and release her in morning. Anyhow on May 4 she called them that someone stole her wallet 2 cops came to her house she was inside her property and they were in her driveway and there was a fence between them so they told her they had a warrant for her arrest yet she had court on the Tuesday the coming week so as she turned to go close her door they grabbed her by the arms pulled her over the fence as she was i guess struggling for she was then slammed into the ground knee on her face at that time the fence door opened and the dog came out and just pulled on the cops pants where he fired 2 shots randomly which could have hit her while on ground the dig ran behind the house. So they are charging her with 2 assualt charges on police officer she hasnt heard from her court appointed lawyer since she been in jail MHMR goes and gives her pills to make her sleep and everytime I visit her she thinking suicidal and noone seems to care just give her another pill make her go to sleep. I desperately am seeking some help on how to go about this since I have limited resources I dont want to lose her to suicide I think they need to send her to some hospital to get help she is not capable of thinking what can I do or who would help please let me know anything Thank you .

    @the lance law I was fighting with a girl online for something that one of her friends did. I said some very bad things about her friends and they had gross pictures of them together I was threatening to tell her boyfriend etc I was going on anonymously I told an attorney and they laughed and said she was bluffing. Also she called me for 30 minutes

    First, that's a very misleading wording of the finders of facts duties in the deliberation room. Agree on guilt or innocence? Innocence? That's the reason I always represent myself (4-0) One criminal acquittal by 12 jurors, one civil judgement for the defendant, (me) and two criminal dismissals both at the pre trial stage. Because its apparent that long winded boring attorneys don't really have any true desire to protect innocent defendants. And if you told my jury they should agree on innocence or guilt I'd faint. Because that's like lighting a firecracker with a short fuse and not dropping it. No one is innocent. It's guilty or NOT guilty. Did the prosecutor PROVE beyond a reasonable doubt that the defendant committed the crime. The jury's job isn't to make sure a guilty man doesn't walk, but to make sure that an innocent man isn't hung. But please don't send my jury away thinking they have to agree on my innocence. Because I go to prison and you go to the bank with my moms house or my daughters college fund. And you sleep like a baby won't even remember my name in a few days. A good attorney listens to his client. Not the other way around. That's the problem with the Defense side of the law. Your ego's are huge but your brains are small. Just hot air, deviant sneers and open palms.

    The prosecutor for me should look at the report and dismiss them automatically. THe only "Evidence" the report has is "he used the f word several times" without that there is no resisting for saying no to get out of the car because it was not a traffic stop, there was no crime, and it was a consentual encounter until the officer lost his temper.
